Netflix, Paramount ask Canadian courts to ditch local news funding rule The new 5% tax —called the Online Streaming Act— which is to go into effect on September 1 is targeted at streaming services who pull in more than C$25m and aren't affiliated with domestic broadcasters. The expected $200m in funds will go towards creating local content, including supporting Black and Indigenous creators. The Motion Picture Association of Canada, who represent studios including Netflix, Paramount & Disney, say they support the law, but there's also a component to fund local news content which they have asked the courts to strike out. They say this news content mandate is "unreasonable" and "is neither appropriate in consideration of the nature of the services they provide, nor equitable.” Amazon has got into the luxury department store game The parent of Saks Fifth Avenue, in a partnership with Amazon, will buy its rival department store chain Neiman Marcus in a US$2.65 billion deal. Amazon will take a minority stake in the new company, called Saks Global, and will provide technology and logistical expertise, according to the Wall Street Journal said. Salesforce is also part of the deal - which is a departure from their usual investments in software startups. Commentators say the luxury market is an area Amazon has been struggling to break into. The CRTC has delayed implementation of its Online Streaming Act – the law that allows the government to control what you see on platforms such as YouTube, Netflix, and podcast databases – until “late 2025,” a postponement that more than likely kicks it to after the next federal election. True North's Andrew Lawton says this might be a bit of a reprieve for Canadians who want the governments hands off their content. Also, while healthcare is in the provincial domain, it's federal gatekeepers who are preventing Canadians (except those living in Quebec) from accessing healthcare choice. The declaration is part of the Trudeau government's Online Streaming Act, or Bill C-11, which was called a "dangerous first step towards government control of the internet" by Justice Centre for Constitution Freedoms President John Carpay, who wrote that "In the long run, the CRTC could end up regulating much of the content posted on major social media, even where the content is generated or uploaded by religious, political, and charitable non-profits." However, reading further down in the news release, the CRTC uses ambiguous language and apparently contradicts its own guidelines by stating, "online services that offer podcasts must register; however, individuals who use social media to share podcasts do not." The CRTC has previously stated that: "individuals that host podcasts on their own websites or make them available on a subscription service platform other than a social media service are not explicitly excluded from the Broadcasting Act under subsection 2(2.1)" University of Ottawa law professor Michael Geist was quick to comprehensively comment on the CRTC announcement in an essay. Geist suggested the government's plans are "not as bad as critics would suggest, but not nearly as benign as the CRTC would have you believe." But Geist says the real danger of the CRTC's announcement is that it is "the thin edge of the wedge with the registration requirement being the first step toward a far broader regulatory framework." "In fact, the rationale for the CRTC to include many of the services is that without such information it is not well positioned to regulate. Bill C-11, commonly known as the Online Streaming Act, has been riddled with controversy since its introduction in June of last year, through to its adoption as law in April 2023. Canada's first major reform of the Broadcasting Act since 1991, the Act aims to promote Canadian content on online streaming services, in part by extending the regulatory powers of the Canadian Radio-television and Telecommunications Commission (CRTC). In this episode, we hear from Michael Geist, Canada Research Chair in Internet and E-commerce Law, on why the Act falls flat, and how it misunderstands the nature of on-demand streaming services. This conversation was recorded in January 2023, while Bill C-11 was in its third reading before the Senate.

(Adam@TheWorldview.com) By Kevin Swanson 6-year-old boy only one in family to survive Texas mall massacre Only one member of the Cho Family — a 6-year-old boy -- survived the Texas mall massacre last week in Allen Texas, reports ABC News. William Cho lost his parents and 3-year-old brother that day. The Cho family was part of the Prestonwood Christian School and community in Plano, Texas. Pastor Jack Graham commented on the Christian community helping out. GRAHAM: “This wonderful, sweet family, three of the four now in Heaven, one child left behind needs the ministry and the care of Christian people. Our entire community needs this as well. The church is made for a time like this. Christians are made for moments like these so that we can show the love of Christ and to be there for people.” Thus far, the Go Fund Me campaign for little William Cho has raised almost $1.9 million. Psalm 68:5-6 tells us, “A father of the fatherless, a defender of widows, is God in His holy habitation. God sets the solitary in families; He brings out those who are bound into prosperity.” Non-mortgage debt on the rise Consumer non-mortgage debt is on the rise in the U.S. It's now at $4.64 trillion, up from $2.7 trillion ten years ago. That's an appreciable increase in debt per Gross Domestic Product as well. Overall household debt now exceeds $25.5 trillion, according to numbers just released by the New York Fed. Debt in America is 360% of Gross Domestic Product The overall debt in America has grown from 160% of the Gross Domestic Product – the sum total value of all goods and services -- in 1980 to 360% of the GDP today. The federal deficit for this fiscal year has already topped $1.1 trillion, and estimates for the 2023 and 2024 deficits hover around $1.8 trillion. The average deficits between 2013 and 2018 were about $600 billion. The average deficit under the Clinton administration was 1.6% of the GDP. The average deficit under the George W. Bush administration was 3.3% of the GDP. The average deficit under the Barack Obama administration was 4.9%. The average deficit under the Trump administration was 7.4%. And now, the average deficit under the Biden administration is estimated at 7.9%. American optimism declining Pew Research finds that American optimism has taken a dive in the last two years. Now, a full 58% of Americans believe that life was better 50 years ago in 1973. Just two years ago, only 43% of Americans claimed that. Democrats tend to be more optimistic. Deuteronomy 28:43-45 reminds us that “the alien who is among you shall rise higher and higher above you, and you shall come down lower and lower. He shall lend to you, but you shall not lend to him; he shall be the head, and you shall be the tail. Moreover, all these curses shall come upon you and pursue and overtake you, until you are destroyed, because you did not obey the voice of the Lord your God, to keep His commandments.” Trump makes exceptions on abortion An eye-opening interview with Donald Trump conducted by the Messenger over the weekend pressed in on the former president's views on abortion. THE MESSENGER: "Abortion is a big issue you talked about in 2022 when you said that Republicans didn't really have the right message. They didn't know how to talk about the issue properly. So what's the right way for a Republican to talk about abortion in the 2024 elections?" TRUMP: “Well, pretty much what I said in the CNN town hall. ... First of all, I'm a believer in the exceptions, right? And just as Ronald Reagan was a believer in the exceptions, but I'm a believer in the exceptions … the life of the mother, raping and incest. … The other thing I really believe is that the radicals are people that would have a baby destroyed, killed at the end of the ninth month or even after birth.” Later in the conversation, this was said. THE MESSENGER: "DeSantis signed a six-week abortion restriction in Florida. Do you think he was right to do that?" TRUMP: “Well, he has to do what he has to do. If you look at what DeSantis did, a lot of people don't even know if he knew what he was doing. But he signed six weeks, and many people within the pro-life movement feel that that was too harsh.” THE MESSENGER: "What do you think? Is it too harsh for you?" TRUMP: “I'm looking at all alternatives. I'm looking at many alternatives. But I was able to get us to the table by terminating Roe v. Wade. That's the most important thing that's ever happened for the pro-life movement.” The U.S. church gender gap The church gender gap in America is bigger than you may have thought. A recently released Study of Faith and relationships looked at 19,000 Sunday church attendees and found that there are 42% more never-married single women than never-married men in the pews today. The gender gap between single, divorced churchgoers is 77 percent women to 23 percent men. Overall, women make up 62 percent of all Sunday church attendees. Here's another important takeaway from the study. Faithful marriages matter. While less than half of young adults in the U.S. grew up in continuously married homes, a full 87% of young men still attending church grew up in continuously married homes. Canadian government looking to punish Christian on-line content The Canadian Radio-Television and Telecommunications Commission will now be regulating online content, according to the newly adopted Online Streaming Act, reports the CBC. It will have the power to impose financial penalties on anybody who violates parts of the act, which includes respecting diversity in sexual orientation and gender identity. The Canadian Radio-Television Commission already regulates Christian broadcasters, requiring them to dedicate broadcast time to promoting other religions. No more COVID passports for incoming vistors to America Beginning last Friday, Canadians and other multinationals may enter the U.S. without proof of COVID-19 vaccination. The Biden administration dropped the requirement, following a vote of the US House of Representative to that order in February. Japan dropped their requirements for COVID vaccines or testing on April 29th. And China and Brazil still require testing before entering their respective nations. SpaceX launched another 56 satellites And finally, Elon Musk's SpaceX launched another 56 satellites over the weekend taking the total to over 4,400. His Starlink internet system now has an estimated 1.5 million subscribers. The Royal Caribbean cruise line has implemented the system. The dish will run you $599, and the monthly cost will be $90-$120. If you're an RV'er, and on the move, the month's rate jacks up to $150. That gets you 30 gigs a day. 2022 was the year of the trucker, wasn't it? They were the heroes who broke the official establishment narrative and proved that we didn't all love the lockdowns and the forced vaccines. We didn't all love our civil liberties being violated and our democracy being truncated. And, no, even though government workers all got paid to stay home, real people still had to pay the bills. The truckers saved us. They captured the imagination of the world; they embarrassed Trudeau; he panicked and overplayed his hand, invoking martial law. The mask slipped; we saw the tyrant underneath the sociopathic smile. The convoy was the greatest civil liberties campaign in a generation — and it was led, as George Orwell said it would be, by the working class. But it almost wasn't so. Because, you'll recall, every part of the establishment, the entire regime, was told to fight the truckers. It's hard to believe this now, but the CBC actually ran a bunch of stories about a trucker convoy — but claimed they were mad about driving conditions on British Columbia's Coquihalla highway. From the very beginning, they were under marching orders: ignore the truckers; do not give them any coverage at all. And when that became impossible, their mission changed to smearing the truckers. Tamars Lich was the newsmaker of the year at the heart of the event of the year, the freedom convoy. Yesterday she told me she was never approached by the CBC, not once — other than, towards the end, when a muckraker from the Fifth Estate asked her some bad faith questions for a “gotcha” story. But not a single reporter, not a single panel discussion, no one even bothered to talk to her. How is that even possible? https://youtu.be/epLS3TZvcpc Well, because it was a strategy; not an accident or an oversight. As you know the government literally put the mainstream media on the payroll. I mean, they did that years ago — the CBC has always been a creature of the government; the newspapers have been on the take for half a decade now; but even the TV and radio stations were getting huge subsidies, especially over the past two years. I mean, just a plain old $104 million dollar gift, in one single instance. How can you take $104 million from Trudeau and then report a “news” story about Trudeau, without disclosing that? That's a form of corruption. And that's just government money — not even Pfizer ad money. Frankly, that's what Tucker Carlson talked about in his monologue on the last day he worked for Fox, before getting fired. But I think the under-story of 2022 was the conspiracy to smear the truckers and keep the false unanimity about the lockdowns, it all failed because — of citizen journalism. The truckers were the greatest embarrassment Trudeau has ever faced in his career. And for some reason, they didn't respond to his drama teacher's soliloquies. He can't stand that blue-collar truckers embarrassed him, and citizen journalists told their story. He had all the big shots in the palm of his hand — CBC, CTV, Global, all the newspapers. But there was that pesky internet, those pesky citizen journalists on social media. Don't think he didn't notice. You don't spend billions of dollars a year buying and renting and corrupting the media to support your agenda without seeing the holdouts. And that's why the big story of 2023 is actually linked to the big story of 2022. 2023 is the year of Trudeau's revenge. Social media videos were the poor man's broadcasters. But Trudeau doesn't control them. Well, enter Bill C-11 — the Online Streaming Act, as it's known. It does one simple thing and sets the table for many complex things. It gives Trudeau's hand-picked CRTC regulator jurisdiction over the Internet in the same way that they have jurisdiction over old-fashioned TV and radio. It's Trudeau's revenge. https://youtu.be/eTfhwkgGAH0 Well, this week Bill C-11 passed in the Senate, by a vote of 52 to 16. It won't surprise you that China's two favourite Senators — Peter Harder, of the Canada China Business Council, and the disgraceful Yuen Pau Woo, the pro-Communist propagandist, love C-11. It reminds them of China's censorship regime. 52-16. How embarrassing for Canada. Even more embarrassing, Patrick Brazeau abstained. How can you abstain? I mean, either have the courage to stand for freedom, or have the courage to admit you're a censor. How embarrassing to abstain. It received Royal Assent last night, too — so it now only awaits being “proclaimed” before it is active law. So this has passed Parliament. And it will be turned into law very soon. This is Trudeau's top priority — not the economy, not solving the national strike, not the cost of living or the cost of housing or immigration or taxes. This is. Censoring us. And by us, I mean you and me. Not the CBC or other government propagandists. So what can I do? I'll tell you more on Monday. But as you know, once in a while Rebel News stops just talking about the news, talking about the crisis. And from time to time we stop and we actually do something about it. On Monday I'll take you through our plans in detail. Our battle plan. Because it's not enough just to report and give our opinions. That's important — to spread the word. But as we showed during the pandemic, we have to do things, too. During the pandemic, we crowdfunded the legal defence of more than 2,500 ordinary Canadians. Because we just had to do something about it — we couldn't just watch, we had to help fix the world. I believe we're in the same position now. Guest: Jon Festinger, adjunct professor at the Allard School of Law The federal government is changing how the internet is regulated in Canada. Bill C-11, also known as the Online Streaming Act, is new legislation that will give the Canadian Radio-television and Telecommunications Commission (CRTC) the task of regulating companies like Netflix, YouTube and TikTok, similar to what it does with radio and television broadcasting. Many critics point out that internet streaming is very different and question if a similar approach is the right idea. There are also concerns about where user-generated content fits in. Jon Festinger, an adjunct professor at the University of British Columbia's Peter A. Allard School of Law and a faculty member in the Centre for Digital Media, joins “This Matters” to discuss. Prior to joining Music Canada in 2016, Patrick worked in Stephen Harper's Prime Minister's Office from 2010-2013, and then was the Director of Policy for the Minister of Canadian Heritage and Official Languages from 2013-2015. Based on that experience, Patrick offers some insight as to why Bill C-11 is constructed like it is, for better or worse, and shares some anecdotes from his appearance in the Senate.

In late June, the Canada's Parliament passed Bill C-11, commonly known as the Online Streaming Act. This legislation is something music industry groups like SOCAN, CIMA, and Music Canada have long lobbied for, and it could have a major impact on the country's music, TV, and film industries. In broad terms, it updates the federal Broadcasting Act in order to apply a new version of CanCon regulations to streaming companies like Spotify, YouTube, and Netflix, and bring them within the CRTC's regulatory regime. Current CanCon regulations have been in places since the early 1970s and force Canadian content quotas and an arts funding system on traditional Canadian broadcasters. Though the broad goals of Bill C-11 are made clear (which include significant monetary contributions from DSPs into Canadian arts funding bodies like FACTOR and greater promotion of Canadian artists on the platforms), significant parts of how this will be implemented is still widely unknown. And so, this week Mike brings back beloved broadcaster and music industry expert Alan Cross to chat about all this and what it could mean for both streaming companies and the music industry in Canada.
How do you regulate the Internet? It's a question that the federal government in Canada is in the process of trying to answer. But its approach is generating controversy, with several bills raising concerns around freedom of expression.Bill C-11, the Online Streaming Act, was recently rushed through the House of Commons in a remarkable manner that led one Conservative MP to call it an “affront to democracy.” And Tara's guest on the podcast today says a subsequent ruling from the CRTC — the Canadian Radio-television and Telecommunications Commission — on a CBC/Radio-Canada segment is a “freedom of expression wake up call.”Michael Geist is a law professor at the University of Ottawa, the Canada Research Chair in Internet and e-Commerce Law, and a member of the Centre for Law, Technology and Society. PIAC discusses Bill C-11 - the "Online Streaming Act" with Scott Benzie of Digital First Canada, a group representing Canadians making user-generated content on social media and related platforms. We discuss PIAC's proposal of "statIc" versus "dynamic" discoverability as a method to reach a compromise between promotion of Canadian content and user-generated content. We also discuss algorithmic platforms and the present environment for digital creators in Canada as well as several scenarios and their effect on viewers and creators if C-11 passes as is. PIAC argued for a fix to the “discoverability” sticking point to solve the “user-generated content” question. Too bad we got no questions on our proposal from MPs. We are not sure ignoring consumers helps. PIAC will seek to appear before the Senate of Canada during its consideration of Bill C-11.
PIAC discusses, once again, Bill C-11 - the "Online Streaming Act" which is an Act to Amend the Broadcasting Act, to, among other things, require "Internet broadcasters" to be registered under Canadian law and contribute to the creation of "Canadian content" or more simply, "CanCon". We recap PIAC's appearance before the Standing Committee on Canadian Heritage at the House of Commons (CHPC) and in particular, detail our idea to "fix" C-11, in particular, the user-generated content issue.We argue that the "discoverability" issue and the "exemption" of "YouTubers" and other online content creators that has roiled the House and the (Canadian) Internet can be managed by reducing its scope. Our idea is to define discoverability as not not one concept but two: static discoverability and dynamic discoverability. "Static discoverability" is a banner on YouTube or another platform that simply links, upon a consumer click, to selected CanCon. It is “static”, unobtrusive and, likely, unobjectionable to consumers but still clearly “promotes and recommends” CanCon. "Dynamic discoverability" requires AI prediction tools to insert a CanCon video or song into a user's autoplay feature, or to ‘dynamically' suggest links. It is intrusive and disruptive to the user's expectations and experience. It is overkill to achieve the goal to “promote and recommend” CanCon.Our recommendation is to amend the Bill by removing language requiring dynamic discoverability but leaving language requiring static discoverability. This will also take pressure off the question of what CanCon should be defined as. Discuss.This is Part 1 of 2 part special. The debate over Bill C-11 – the Online Streaming Act – seems likely to come to an end this week, at least in the House of Commons. Last week, the government introduced a motion to put an end to committee debate and set tight timelines for any further review or discussion. Freedom of conscience or religion and freedom of speech are both fundamental freedoms that are protected in the Canadian Constitution. Over this past season, the battle has intensified on where exactly the line is between these individual rights and the power of government to force professionals to do certain things in order to keep their employment. The battle is also intensifying around what Canadians can see and say online. Two pieces of legislation have recently been tabled in Parliament that touch on these freedom issues. C-11, the Online Streaming Act, aims to update the current Broadcast Act to regulate what Canadians see online. C-230, the Protection of Freedom of Conscience Act, would make it a criminal offence to coerce a medical professional to take part in assisting a patient's death.
