January 6th Derrick Evans was a newly elected member to the West Virginia House of Delegates and a Trump supporter. He went to the Capitol for the rally and then entered the US Capitol as a peaceful protestor. Derrick became one of the faces of the "Insurrection" since he was an elected politician and since that day our government has put him and his family through hell. But you can't keep a good man down and Derrick has now served his prison sentence and he talked to us about his prison bout at length. Three months he sat in prison and during that time he made the best of it. He learned about the customs and culture of prison life and he explained to us how many US citizens are currently spending time in the clink for victimless crimes and petty drug charges that are absolutely ridiculous. Derrick refused the COVID vaccination so upon reporting to prison he had to spend his first 8 days in solitary confinement which he explains how he passed the time. The segregation of races in prison is a serious thing but in his case he said that he didn't encounter any racism it was just how they did things to make it safer and as free inside as possible. The hierarchy of the inmates and television and food are the things that are cherished the most. You don't want to miss this almost expose on our prison system, just a warning this episode isn't one to listen to with children. --- Support this podcast: https://anchor.fm/grunts-in-appalachia/support

Shelley Moore Capito was elected by the people of West Virginia to the United States Senate in 2014, and re-elected in 2020. She is the first female U.S. senator in West Virginia’s history and was elected with the largest margin of victory for a Republican in state history—winning more than 70 percent of the vote and all 55 counties, surpassing the previous mark she set in 2014 when she won more than 62 percent of the vote and all 55 counties. After serving West Virginia’s Second Congressional District in the U.S. House of Representatives for 14 years, and as a member of the West Virginia House of Delegates for four years prior, Senator Capito decided to run for Senate to be an even stronger voice for the Mountain State. She also saw an opportunity to restore order to a Senate stuck in gridlock for far too long. She believes that today's challenges demand bipartisan solutions and cooperation across the aisle to advance legislation that benefits West Virginia and the country as a whole. Senator Capito serves on the Appropriations Committee; the Commerce, Science, andTransportation Committee; the Environment and Public Works (EPW) Committee; and the Rules and Administration Committee. A lifelong West Virginian herself, Senator Capito was born in Glen Dale in the NorthernPanhandle. She holds a B.S. in Zoology from Duke University and a M.Ed. from the University of Virginia. She and her husband Charles L. Capito Jr. reside in Charleston. They have three adult children: two sons, Charles (wife Laura) and Moore, and one daughter, Shelley (husband Colin Macleod). You may think you know the answer, but there's a lot more to the story - like the Italian IT Department head who just testified to stealing the election on behalf of the American Embassy and others! So, before rushing to a hasty decision about the people who stormed the Capitol: who they were and why they did it, let's look back at that day. Though many want to jump to the conclusion that we should blame it all on President Trump, a more careful look at all the psychological and political elements show that there are many factors that need to be considered and questions that still need to be answered. We look at the backstory of some of the most colorful characters who stormed the Capitol - like Doug Jensen, a QAnon booster who led the protesters up the stairs, Jake Angeli, the man in the horns and a painted face, Richard Barnett, who sat at Nancy Pelosi’s desk, Ashli Babbitt, the veteran shot by police who believed Trump was “worth dying for,” Roseanne Boyland who was trampled to death, Derrick Evans who resigned from the West Virginia House of Delegates, Jenna Ryan who flew in by private jet because “they want to steal the election,"Jenny Cudd, who said she decided to storm the Capitol when Mike Pence “betrayed us.” Whether you’re a Republican or Democrat, whether you voted for Trump or Biden, if you love America, you’ll want to get to the bottom of this!

He says there will be five hubs where the vaccine will be brought into the state and roughly 525 providers who have already signed up to assist with distributing the vaccine. The first phase of distribution is to stabilize the healthcare system to allow workers to continue providing healthcare and to protect the most vulnerable in nursing homes and assisted living facilities.Hoyer also shares his thoughts on the passing of West Virginia legend Brig. Gen. Chuck Yeager (Ret.), saying he hopes people will remember him not only as the man to break the sound bearer, but also an American Hero who bravely fought for our country, flying combat missions in both World War II and Vietnam and trained 26 of the nation’s first astronauts. In Segment 2, West Virginia’s Public Health Officer Dr. Ayne Amjad says the state is starting to see an increase in COVID-19 cases, partially from Thanksgiving holiday travel, but not all of that data is in yet, and numbers could continue to increase. She also says a significant number of people with COVID-19 aren’t answering their phones for contact tracing, urging people to pick up the phone because identifying those contacts is important to prevent further spread of the virus. She says the number will usually be from your local health department. In Segment 3, Delegate Daniel Linville (R – Cabell County), vice-chair of the House Committee on Technology and Infrastructure, talks about an issue with a bipartisan agreement – the lack of broadband in rural West Virginia needs to be fixed. He says the state has put together a more accurate map to tailor resources to fund ways to expand and enhance broadband in the state. In this week's Inside West Virginia Politics, we talk about what should be included in the COVID-aid package currently before Congress, why one state House employee is being hailed as a hero and how a Legislative Scorecard helps make government more transparent to voters. In segment one, Sen. Shelley Moore Capito (R-WV) explains how the Senate Republican's COVID-aid package will differ from what was offered in the House, how the Senate package offers "targeted relief" to help the country reopen and how the current pandemic impacts her current campaign. In segment two, Paula Jean Swearengin, the Democratic candidate for Senate explains why the current $600 employment benefit should continue, why the government should help small businesses to be able to pay their employees a living wage and how the nation needs more "people servants" instead of "corporate servants" in Congress. In segment three, Anne Landgrebe, a West Virginia House employee who tested positive for COVID-19 explains how she helped to protect 49 others in a Health Committee hearing room by wearing a mask before she learned she had the virus and why others should wear a mask to help protect others. In segment four, Jason Huffman, the state director of the West Virginia Chapter of Americans for Prosperity, explains how the organization's "Legislative Scorecard" helps create transparency with the state government, how the information helps voters and how the organization hopes to change the political culture to encourage West Virginians to get more involved in politics.

Pat McGeehan recounts his experience in the most recent West Virginia state legislative session trying to pass his “Defend the Guard” legistlation. He describes the many battles involved in introducing a bill like this, waged both behind the scenes in the form of threats and bullying, and publicly in the form of media coverage. McGeehan’s opponents claim that the bill could cause West Virginia to lose federal funding, which he says is untrue, or at least greatly exaggerated. More brazenly, they argue that it’s unconstitutional, citing a supreme court case from the 1990s (that doesn’t actually bear directly on McGeehan’s argument)—but of course the Defend the Guard act itself is based on a constitutional argument about Congress’ failure to declare war the way it should. McGeehan and his allies came close to passing the legislation this time around, but ultimately failed. He assures Scott that he will be back at it again next year. Mal·ad·min·is·tra·tion — n. (formal) : inefficient or dishonest administration; mismanagement. In 2006, while serving as a law clerk for the Supreme Court of Appeals of West Virginia, Allen H. Loughry authored a book titled, Don't Buy Another Vote, I Won't Pay for a Landslide: The Sordid And Continuing History of Political Corruption in West Virginia.Six years later, he was elected by the people of West Virginia as a justice on the same court, and on January 1, 2017, he became Chief Justice. On June 20, 2018, Loughry was impeached by the West Virginia House for mind-boggling corruption of his own. Today, he is “living history” — facing impeachment and up to 390 years in prison. However, this was only the beginning of the truly continuing history of political corruption in West Virginia's Supreme Court. What began with a revelation of Loughry's excessive spending on an office remodel — including the purchase of a $32,000 couch — implicated all five of the standing members of the Mountain State's highest court. Now, three of them face impeachment trials, while the other two resigned to avoid the ugly proceedings into their potentially criminal “maladministration.”The majority of the charges revolve around lavish spending on their offices — partly a product of the lack of oversight on judicial budgets in West Virginia. Laurie Lin (@WVPundette), a columnist for West Virginia's Charleston Gazette-Mail and former attorney, has been following the story carefully. Earlier this month, she recapped the depressing yet almost comical saga in a teleforum hosted by The Federalist Society, and fielded questions on the political implications of such a blatant abuse of power. It's easy to blame judicial elections for such widespread corruption. We know that voters are largely ignorant. Furthermore, elections could create incentives for judges to favor those who give to their campaigns. But in this case, the maladministration seems to have simply come from a unique culture of corruption within the courthouse — specifically around office expenditures. In addition to the infamous $32,000 sofa, one justice had renovated her office with a tacky Egyptian theme, meaning that her successor had to spend significant sums just to restore it to something normal. This quickly snowballed into a culture of personalizing offices to an absurd degree. Now, Governor Jim Justice is replacing the justices who resigned with temporary appointees — both from his own party (Republican) — and Democrats in the House are calling foul play. While this story may seem beyond odd to outsiders of West Virginia politics, it comes as little surprise to the state's residents. Wikipedia provides some helpful pretext for West Virginia's political bizarro world:“In 2015, Justice switched from the Republican Party to the Democratic Party and announced his candidacy for Governor in the 2016 election. He ran as a Democrat and defeated the Republican nominee, Bill Cole. Less than seven months after taking office, Justice switched back to the Republican Party the day after announcing his plans at a President Trump rally in the state.”— Wikipedia page for Jim JusticeSoon enough, the voters of West Virginia will have a chance to elect new judges to the two to five vacant seats that will be left in the wake of the judicial crisis. They've already repealed the part of the constitution that enables the judiciary to get away with unaccountable spending on couches, Egyptian-themed offices, and the like. But a broader debate remains over the merits of electing judges versus appointing them, under a system sometimes known as merit selection.

The finance council includes companies, trade groups, labor unions and public interest organizations, who pay anywhere from $12,000 to more than $100,000 to the DLCC. Shawn has an awesome vision for growth in the Wheeling area AND bought us a beer (which Craig spilled). 34:01 Kelly Clutter, Brian Stefan and Andrew Grimm (our gracious hosts and connections to nachos and beer) have stocking stuffer stories. You can hear Andrew’s tie sing! Big thanks to the Wheeling Nailers organization and Sports Monger (Did You See That Now) for having us and actually allowing us in the building! Definitely make a point to go see some Wheeling Nailers games! See Andrew’s write-up about the game here.
