Episode transcript Note: The following transcript was created by Slack and may contain misspellings and other inaccuracies as it was generated automatically: Welcome to Late Edition Crime Beat Chronicles, a Lee Enterprises Podcast. I'm Ambre Moton, the producer and editor of the show, filling in for Nat Cardona who's taking some well-deserved time off.  If you haven't listened to the first two episodes of our series about the Osage reign of terror, please go back and listen to those before starting this one. So far, we've talked about the history of the Osage tribe and how they ended up in what became the state of Oklahoma. Their oil rich land. And how those rights were divided. And the horrible series of murders or suspicious deaths. Kidnappings and the environment of fear that made up what historians and journalists call the reign of terror. This week we're talking about the investigations into the crimes, what they found and more. Randy Krehbiel of The Tulsa World reminds us about how difficult it was to get proper investigations into the deaths of the Osage community. Who hired a private detectives to find the cause for the suspicious deaths? The Osage Tribal Council finally petitioned the federal government to send investigators, and in April of 1923, the Bureau of Investigation, the precursor to the FBI, assigned agents to the case. Here's what Randy had to say about the investigation. Well, it was called the reign of terror, because people just lived in terror. They were afraid to to talk. And when the FBI came in there in 1923 to try and sort things out in their in their letters and reports and so forth from that time, you know, they talk about how people are just terrified to talk and and they would not talk to outsiders at all. And, in fact, this is just been talked about a lot with with this book and movie. They wound up putting some some men undercover to try and insinuate themselves into the community so they could get information because people were afraid if they if they told what they knew or what they thought and they were honest about it, they they'd be killed. And and this and this was true of a lot of a lot of people. And, you know, I think Mollie Burkhart, at one time, she told her priest that she was afraid. People just, you know, people people who were not part of the and even some of them who were part of the these these organizations that were that were doing these things were afraid to talk about it. And sometimes they were afraid to talk about it because they were involved, too. You know, but but they often they were afraid to talk about it because of repercussions against themselves. Tulsa World's Jimmy Trammel commented about the investigation's primary target. Who were the the FBI, you know, kind of focusing on or suspecting of all these crimes? Well, Jesse Plemons plays the FBI character, I think, in the in the film. And as far as the actual suspects, you had some other people had kind of amateurish early tried to be the detective or figured this out or, you know, paid to find things out. What ended up happening was the gentleman who was ultimately the suspect and the primary culprit and was put on trial, many people was like, oh, my, he couldn't it couldn't be that guy. He couldn't do it because he's friendly. He was probably the most soldiers. But I mean, you just never know. I mean, it was some kind of wolf in sheep's clothing kind of deal. I asked Tulsa World's Tim Stanley about how well the boy investigated and who they held responsible for the 24 murders that they determined were on an official record. Federal investigators did a good job in so far as it went. I mean, they did they did investigate it. They did bring charges. And they did get convictions. I think the problem is, is that they were more or less content to kind of tie a bow on the whole thing at that point and then move on, which I mean, that's we see that even today in cases of mass killings or where you have serial killers or who are suspected of being connected to any number of deaths, once they get the conviction on on one or two deaths and they get that person off the street, often that's the end of it. You know, for them that, you know, the value in the case to them has, you know, they've they've achieved. But that's yeah. I mean, I think that's kind of what you had here is it was investigated and the federal agency which you know, as we may have discussed previously, the one that it would become the FBI, they did they did a solid job and bringing at least some justice in this case. But they were they didn't really want to dig any further than than just the initial investigation. I mean, J. Edgar Hoover, you know, who was the boss at the time? You know, he got he was well-known for enjoying publicity. And he saw that as valuable to the agency. And he's right. I mean, public relations matter. So, you know, coming in and getting this getting some convictions here, getting a lot of good press out of it, I think satisfied him. And he had no reason to to investigate it or direct that it be investigated further. So, yeah, unfortunate. But you know what that leads us here. You know, 100 years later and tribal members over the decades leaves us all asking a lot of questions that unfortunately can never be answered. How many people were eventually held responsible or convicted, at least of some of these crimes? There were three principal convictions. And the one that's, you know, most significant is the trial and conviction of William Hale and two of the others who were convicted along with him were associates of his. He he has always been considered the mastermind behind many in the slayings, although, again, I think, as we just discussed, the investigators were pretty happy to hang the whole thing on him that made it, you know, a cleaner case and then they could move on in all likelihood. You know, there were many other perpetrators acting independently of Mr. Hale, just opportunists, again, close family members who saw an opportunity to inherit. He was the primary conviction. He was. And he was important, very significant. Even if even if the feds didn't, you know, go any further than this. I mean, it's just, you know, without a doubt, he was behind several of them. And, you know, he ended up I think everyone, the three Hale and his associates were given life sentences, but they were all eventually paroled after just a handful of years, which, you know, is kind of a sad, you know, footnote to this is that while they did face justice, well, they were convicted. You know, they they did end up not serving all of that long. And so while the people obviously it's often this way with justice, but obviously the people that they killed, you know, that that was it for them that these guys did eventually get to get out. But yeah, so three primary, there may have been some others and some tangentially related cases, but three primary convictions. And with William Hale being the chief one. We have to take a quick break. So don't go too far. And Randy added more details about those held responsible and a little about those who weren't. How many people were held responsible for the reign of terror? Almost no one. Almost no one. So in the case of the murders that are highlighted in killers of the flower moon, the two main defendants, as it turned out, were Bill Hale, who was accused of being that kind of the mastermind, and a guy named John Ramsey, who was kind of a ne'er do well cowboy, who basically just, you know, did whatever Hale told him to do. And so each of them was tried three times in federal court for the same murder. And and they were of the first time was a hung jury. They were convicted. This is they were convicted in the next two. And and after the first conviction, there was an appeal. And so they had to be tried again. So those two guys went to prison. Molly Burkhart has been also went to prison. A guy named Kelsey Mawson who killed Anna Brown, who was who was Molly Burkhart sister, he went to prison. Byron Burkhart, who was a Molly Burkhart brother in law, even though he had confessed to killing Hannah Brown, never went to prison. He he testified against Kelsey Morse and in his trial ended in a hung jury. He was never retried. And I'm getting a little bit off your your question here, but I think you'll find this interesting. In the sixties, there was an Osage woman die and she left behind a letter that said, if something happens to me, look at Byron. Well, she was living with Byron Burkhart, who had been involved in these things 40 years before and in and again, he nothing ever happened to him. So I think there were some others that were prosecuted, but but they were very few. And one of the things you realize, especially in going through these FBI papers and reading the trial stories, is how hard it was to get convictions in these things. And and emails case. He had a lot of money and he just pretty blatantly went out and bought tried to buy alibis. I mean the the federal officials and some of the state officials that they were working with were just furious at what they considered to be dishonest and unethical behavior, behavior by his lawyers and some of these lawyers were pretty well known. One of them was a former attorney general in the state of Oklahoma, the the his defense lawyers. So the answer to your question is not many and not only not many, you know, go to prison over this. They really didn't stay very long. They'll have all got out in 16 years. But Burkhart got out before that but then got in trouble again. He violated parole. And so they put him back in in prison. Kelsey Morrison got out in a few years and was killed in a shootout in Texas. So, you know, most of these guys, they didn't serve very long in it. I remember, you know, I was reading some of this stuff and at the same time, we had the the Jones case going on here. And and, you know, whether you think he's guilty or whatever. But I just I couldn't help thinking about the difference in the way, you know, we think about that, at least in Oklahoma. It's pretty routine for people to get life without parole, if not the death penalty. And these guys were out in 16 years. So, you know, I'm sure somebody who is a lot smarter than I am to try and figure out what all of the different racial biases and so forth were in the criminal justice system or in the criminal justice system. I will say just in general, at that time, they didn't they tended not to keep people in prison any longer than they had to. They were you know, they were. It wasn't for profit back then? It wasn't. Well, no, it was it was a cost. And a lot of the states didn't have a lot of money to to they'd rather turn the guys loose and than keep housing and feeding them. Right. Yeah, exactly. How did the government kind of impact this? The FBI came in to investigate. Was the federal government making sure allocations and money were going to the right places and right people? Was it state or was it tribal responsibility? So in theory and this is one of the things that we're still fighting about in Oklahoma, but in theory, the the Osage reservation was dissolved, that statehood. And that's pretty much held up even with some recent Supreme Court decisions that have decided that some of the other reservations weren't dissolved, that statehood. So it was dissolved, that statehood. However, you still had the Osage is owned a lot of the land there because it had been allotted to them. So again, this gets a little complicated, but the state officials did not think they could get a conviction in this case, in state court and in Pawhuska. They wanted the federal government to come in. They wanted. And so the federal government has jurisdiction over Indian land. And and so and there was a lot of discussion at the time to our guys even have any kind of authority here. The the FBI was not even the FBI at that time. It was just the Bureau of Investigation in the Department of Justice. And it had very, very limited authority. And so the key sort of the key thing in bringing this case down, or one of the key things was that one of the men who who was killed, Henry Roan, was killed on an allotment that was still owned by the original L.A. The federal judge in Oklahoma originally ruled that the federal government didn't have authority over that allotment, and it went up to the U.S. Supreme Court. The US Supreme Court said no and allotment is Indian land. And that means the federal the federal government has the authority to to to do this. And so almost all of the real police work, if you will, on this was done by the by the Bureau of Investigation. And they were helped by somewhat by state and local officials. But in their letters, they talk about they just didn't feel like there were many of those people they could trust because of their interest in, first of all, what was going on in Osage County. But then more broadly, you know, they did not want anybody looking too closely into the what was going on with these Indian allotments and in the mineral rights. So. So the involvement of the federal government was key. It's really unlikely that that anything could have been done in the Osage Nation, had actually gone to Congress and asked them to intervene. The Osage is pay a big part and maybe all of the federal government's expenses in prosecuting this case. They paid the federal government to investigate these, or at least they paid the expenses of the federal government to do that. I think another important person in this does not get a lot of attention was Charles Curtis. Charles Curtis was a U.S. senator from Kansas, his whose mother was a college Indian, who was born in in that in what is now Oklahoma. And he was later the vice president of the United States. And he got involved in it and and pushed the Department of Justice to do something. And that, folks, is where we're leaving it for this episode. This episode should feel like an old, familiar tune. Kristin starts us off with an old timey love triangle and Brandi covers a family annihilator…?  Robert Miller was a celebrated criminal defense attorney in Washington DC. He was buddies with Herbert Hoover and Franklin Roosevelt. He'd been the law partner of vice president Charles Curtis. He even had a nickname! It was: Judge, not guilty. He was pretty content. But his much younger wife, Marguerite, was not. Soon, she and her psychiatrist, Dr. John Lind began having an affair. It didn't take Robert long to decide that he needed to get even.  Then Brandi tells us about David Hendricks, who was out of town on a business trip when his wife, Susan, and their three children, Rebekah, Grace and Benjamin were found dead in their home. David quickly emerged as the prime suspect. (Isn't it always the father?) But there wasn't much evidence tying him to the crime. The DA's office moved forward, undeterred. The Friday Newsletter |  Daily Gardener Community   Historical Events 1722 Birth of Christopher Smart, English poet. He was known for his pen name as the midwife "Mrs. Mary Midnight."  The back half of Christopher's life was spent in madhouses or prisons. He wrote his long religious poem, Jubilate Agno (Rejoice in the Lamb), in a debtor's prison. It includes the words, For the flowers are great blessings. For there is a language of flowers. For the flowers are peculiarly the poetry of Christ. In this same poem, Christopher praises his beloved cat Jeoffry. The Jeoffry verses inspired Oliver Soden's whimsical biography of Jeoffry, which debuted in April 2021 to the delight of cat lovers everywhere.  In 1752, Christopher published The Hop-Garden, a long poem of 733 lines about a hop garden that tells the reader how to cultivate hops. The poem is part personal history and part instruction.  In The Hop-Garden, Christopher mentioned the river that ran past his childhood garden, and he dedicated the second half of the poem to his dear friend Theophilus Wheeler. Christopher was in the middle of writing The Hop-Garden when Theophilus died during his sophomore year at Christ College.  After The Hop-Garden was published, Christopher's friend, Samuel Johnson, said the poem was proof that, one could say a great deal about cabbage. In the poem, when a storm threatens the harvest, Christopher writes, Haste then, ye peasants; pull the poles, the hops; Where are the bins? Run, run, ye nimble maids, Move ev'ry muscle, ev'ry nerve extend, To save our crop from ruin, and ourselves. Christopher Smart died in debtor's prison in London in 1771, at 49.   1897 Death of David Burke, English plant collect and gardener. The Veitch nurseries became obsessed with the painting of a Pitcher-plant (Nepenthes Northiana) by Marianne North. After Marianne's death, Veitch sent David on his first collecting trip with Charles Curtis to bring back specimens of the North Pitcher plant. During the trip, David discovered the beautiful Leea amabilis, which is now a popular tropical houseplant that features dark, jagged-shaped leaves with have white color along the midrib. David continued to travel extensively for James Veitch & Sons, and he collected plants in British Guiana, Burma, and Colombia. David was honored with the naming of a pitcher plant he discovered called Nepenthes Burkei.  In the Philippines, David also collected Phalaenipsis stuartiana. He found the orchid growing abundantly along the coastline, where it thrived being sprayed by the ocean. The Veitch firm praised Burke's writing. This traveller (Burke) crossed a greater area of the earth's surface and covered more miles in search of plants than any other Veitchian collector, with the possible exception of the two brothers William and Thomas Lobb. The writer Sue Shephard wrote a biography of the Veitch family, and in it, she described David as Veitch's strangest, longest–serving and most adventurous orchid collector. James Veitch once remarked,  Burke was one of those curious natures who live more or less with natives as a native, and apparently, prefer[ed] this mode of existance. In 1896, David left on what was to be his final voyage. He died of cholera on Ambon island.   1912 Birth of Elsie Elizabeth Esterhuysen, South African botanist. Elsie's been described as the most outstanding collector of South African Flora. She collected over 36,000 herbarium species. A botanist at the Bolus Herbariumin Cape Town, Elsie was humble, and she would never publish the results of her work under her own name. After Elsie died, over 200 people gathered at her memorial, which featured three tributes from her botanist family. The botanist John Rourke recalled, It's an astonishing fact that for the first 18 years of her employment she received no proper salary and was paid out of petty cash at a rate not much better than a laborer. She did not collect randomly; Elsie was above all an intelligent collector, seeking range extensions, local variants, or even new species, filling voids in the Bolus Herbarium's records, often returning months later to collect seeds or fruits that were of diagnostic importance. […] Always self-deprecating, one of her favorite comments was ‘I'm only filling in gaps'.   The botanist Peter Linder said, She was what I thought a botanist was supposed to be. She was in the mountains every weekend, and came back with big black plastic bags full of plants, that she sorted and passed to Gert Syster to press.  Elsie taught me that each species has an essence, a character—that it liked some habitats but not others and that it flowered at a particular time.  ...She was interested in the plants themselves—she cared about them.   The botanist Ted Oliver remembered, Her mode of transport was the bicycle (we have her latest model here today). She rode to the University of Cape Town up that dreadful steep road every day for a lifetime, come sunshine or rain, heat or cold. Now one knows why she was so fit and could outstrip any poor unsuspecting younger botanist in the mountains! Every day she would come up and park her bicycle behind the Bolus Herbarium building and then often jump through the window in the preparation section rather than walk all the way around to the front door.   Today there are 56 plant species and two genera named for Elsie Esterhuysen.   Grow That Garden Library™ Book Recommendation The Ladies' Village Improvement Society Cookbook by Florence Fabricant This book came out in 2020, and the subtitle is Eating and Entertaining in East Hampton. Well, this is another book that I wish had debuted before the pandemic because I think it would have been so much more popular had it come out, say, in 2018. Nonetheless, it's not too late to discover this fabulous cookbook. This is a cookbook for all seasons, but I think the cover just screams summer and eating outside in your garden. So if you're going to get this book, now is the time. Martha Stewart wrote the forward to this cookbook, and I wanted to share just a bit of what she talks about here because she's introducing us to the LVIS, or the Ladies Village Improvement Society. This group of women has done so much to make sure that the natural beauty of the Hamptons stays intact, and Martha alludes to adhere in this forward. She writes, I bought my home on Lily Pond Lane almost thirty years ago. Much has changed in Easthampton since then. Many new houses have been built, and countless new stores have opened on Main Street and Newton Lane. The summer populations have swelled, and the beaches have become more crowded. But some things have remained the same. The giant Elm trees that tower over the highway leading into town are still green and stately. The roadsides are still planted with lovely Maples and Lindens, offering shady avenues and streets on which to walk or bicycle. The scenic Village Green and its iconic pond populated by pairs of plump swans are still the backdrop for many thousands of photographs throughout the year. And the Ladies Village Improvement Society can claim bragging rights for the glory of this scenery. There is no better time to be in East Hampton than in mid-summer when the trees are leafed out, the roses are blooming, and the ocean is beautiful. And then there are the farmer's markets and the farm stands displaying their freshly harvested vegetables. It's a beautiful sight to see. And as Martha indicated, this volunteer organization, the Ladies Village Improvement Society, has done a lot to ensure that the Hamptons retain their natural charm. Now a lot of these women are gardeners and cooks. So you can imagine the beautiful recipes -the over 100 recipes - in this fabulous cookbook, and many of them are garden to table. The other thing that's really fun about this book is that the Hamptons is all about entertaining. And so, these women are sharing their go-to recipes for all kinds of gatherings - whether you're talking about dinner after a movie or lunch by the pool - whatever the occasion, there are delightful suggestions here. There's a Fettuccine recipe that's got Asparagus and Blue Cheese. There's a fabulous Bittersweet Chocolate Pound Cake. Bonnie Reiff-Smith shared her recipe for Perfection Pork Chops. There's an excellent Zucchini Sausage Quiche - another great recipe for using your zucchini. There's Moroccan Carrot Salad and a fabulous Sunflower Seed Salad along with Whole Roasted Cauliflower - that's fantastic as well. Anyway, I could go on and on. This beautiful cookbook is so fun. This book is 256 pages of more than 100 recipes for food and drink, and it's all put together in 20 different menus with directions on how to make any of your gatherings extra special. And it really is a beautiful cookbook for summer - and the price is right, too. You can get a copy of The Ladies' Village Improvement Society Cookbook by Florence Fabricant and support the show using the Amazon link in today's show notes for around $9.   Botanic Spark 2014 On this day, a dedication ceremony was held at the University of South Carolina in honor of the new Desegregation Commemorative Garden on the side of the Osborne building. The garden was established to commemorate the fiftieth anniversary of desegregation at the college. Student Government President Lindsay Richardson read a poem by USC Poet Nikky Finney called The Irresistible Ones, which is inscribed on a granite plaque in the garden and reads, THE IRRESISTIBLE ONES ROBERT ANDERSON, HENRIE MONTEITH, JAMES SOLOMON They arrive knocking at Osborne's great garnet door.  They want to study mathematics, join the debate team, and sing in the choir.  They are three in a sea of six thousand.  With each step they pole vault shards of doubt, sticks of dynamite, and stubborn hate mail.  With them arrives the bright peppermint of change.  The new laws of the new day can no longer resist these three irresistible ones, in a sea of six thousand, stepping through a door now garnet and black.   Thanks for listening to The Daily Gardener And remember: For a happy, healthy life, garden every day.

But I won't be the last.” Kamala Harris First female vice president of the US   Artwork: Harris' portrait in the Fearless Portrait project consists of an ink drawing of her giving her victory speech, on a map of the United States.    The story: Following days of election drama, on Saturday, November 7, all the major news outlets called the 2020 presidential election for Joe Biden. That evening, in front of a socially distant crowd in Wilmington, DE, and the millions more watching at home around the country, Biden and Harris gave their victory speeches as president- and vice president-elect.   Wearing an all-white pantsuit—a tribute to the suffragists who fought for women's right to vote—Harris confidently strode onto the outdoor stage. She celebrated Biden's “audacity” for selecting a woman as his vice president. “While I may be the first woman in this office, I won't be the last,” she vowed. “Because every little girl watching tonight sees that this is a country of possibilities.  “And to the children of our country, regardless of your gender, our country has sent you a clear message, dream with ambition. Lead with conviction,” she continued.  As the first female, black person, and Asian-American to be elected VP, Harris closed her speech with a brief vision of the next four years, saying,  “No matter who you voted for, I will strive to be a vice president like Joe was to President Obama—loyal, honest, and prepared. Waking up every day thinking of you and your family. Because now is when the real work begins...  “The essential work to save lives and beat this epidemic. To rebuild our economy so it works for working people. To root out systemic racism in our social justice system and society. To combat the climate crisis. To unite our country and heal the soul of our nation.”   Background on Kamala Harris Harris was born on October 20, 1964 in Oakland, CA. A child of immigrants—her mother from India and her father from Jamaica—Harris is well familiar with the struggles of minorities in the US. While campaigning for president, Harris often spoke of her childhood attending civil rights marches with her parents.  As a child, she was bused across town to public school in a more prosperous neighborhood as part of Berkeley, CA's desegregation program. She told of how children in her father's Palo Alto neighborhood were not allowed to play with her because she was black.  She spent most of her career as a prosecutor, working up to District Attorney of San Francisco in 2004 and then California Attorney General in 2011. She entered the US Senate as California's junior senator in 2017. She ran for president, but withdrew before the 2020 primaries and endorsing Biden. In August, Biden announced Harris would be his running mate.  Aside from the first black person, and first Indian American, she was only the third woman to be picked as the VP candidate for a major party ticket. She's the second ever person of color to hold the office, after Charles Curtis, a Native American, served under Herbert Hoover in 1929. During the presidential campaign, she acknowledged the historic nature of her candidacy, saying in one interview:  “It really does help to have examples of what can be done and role models, things you can point to, to make it clear that it's not impossible—and that, in fact, it's quite probable that you can do these things and will do those things.”    Music: Music comes from Geovane Bruno, Philip Phile's “Hail Columbia” performed by the US Coast Guard Band, and John Philip Sousa's “Starts and Stripes Forever,” performed by the US Navy Band.   Sources: Gambino, L. Curtis – a member of the Kaw Nation – has just become the first person of color elected to the Senate and will go on to rise even further as Vice President of the United States. This week, Kamala Harris follows Curtis as the second person of color to fill that seat. However, his legacy is a complicated one. How did Charles Curtis rise so high during an era that was arguably the height of American white supremacy? And what does his flawed political legacy tell us about the complexities of representation? So the data show that the vast majority of Native Americans vote for Democrats. And most run for office as Democrats. Of the active candidates on my #NativeVote16 boards there are 75 Democrats, 14 Republicans, and 4 independents. If you look at history, there are a lot more American Indians and Alaska Natives who have won office under the Republican banner. That list includes: Sen. Ben Nighthorse Campbell, Northern Cheyenne, who joined the Republican Party after his election; Vice President Charles Curtis; as well as the only current members of Congress, Tom Cole and Markwayne Mullin. The Republican Party platform says: “Based on both treaty and other law, the federal government has a unique government-to-government relationship with and trust responsibility for Indian Tribal Governments …These obligations have not been sufficiently honored.” Oklahoma's U.S. Rep. Cole is perhaps the most senior and respected Republican who's also a member of a tribe. “As an enrolled member of the Chickasaw Nation, I am very proud of my heritage … I am committed to advocating on behalf of Native Americans in Congress.” Cole's advocacy is routine and powerful. He was instrumental in the 2013 enactment of the Violence Against Women Act because he gave cover to Republicans who voted for the measure Cole has called for the repeal of the Affordable Care Act, and, at the same time, has consistently said the United States government has “fallen behind” in its funding of the Indian health system. He often advocates for spending more on Indian health throughout the budget and appropriations process. Perhaps the strongest case that Republican candidates for office make to Native American voters is that they will be inside the room when the party makes decisions on American Indian issues. Rep. Bruce Meyer of the Montana Legislature said he was able to convince Republicans to support tribal water compacts with the state. “We need friends on both sides,” he said. “It's good that I am on the other side of the aisle. I tell people that I am out to get the best deal for American Indians no matter which party because that's my constituency.” There is one question that every Republican has to answer this election: What do you think about your party's nominee for president? Rep. Cole, who is an important voice for party leadership, says that's really not an issue. He said on NBC: “This is a choice. It's a choice between Hillary Clinton and Donald Trump …  and, frankly, if you're a Republican that's a pretty easy choice.” Then again not every Native American candidate is quite so eager to embrace Donald Trump.
