Alan Donovan introduces his guest, Maggie Roshan, who is having serious issues with the service, and how it is alienating her from her daughter. Maggie explains that there have been issues with her daughter, such as runaways and skipping school, which has resulted in CPS being mandatory reporters and her having to work with them. She then explains that her daughter stole her vehicle in the middle of the night and blew the engine, and was then picked up in Columbia Falls. Maggie is a single parent who is struggling to raise her daughter. Her daughter is exhibiting signs of juvenile crime, which she attributes to the lack of two parents in the household. She had her first child at 15 and got pregnant with her daughter while on the IUD or the shot. The speaker's daughter had taken the family car and was eventually apprehended by youth court services. The speaker wanted a more formal agreement than the informal one offered by the court, as it did not provide the help she was seeking. Diversity, Equity, and Inclusion: Is It a Zero-Sum Proposition?

Numerous organizations, including courts, are embracing Diversity, Equity, and Inclusion.  With that increasing acceptance, we are also seeing increasing resistance, and it is important to address that resistance directly.  On the December episode we discussed the question “can hiring criteria, particularly for managers and supervisors, be objective?”  This month we are going to explore the growing question “Is Diversity, Equity, and Inclusion a Zero-Sum Proposition for White employees?” Michael Norton from Harvard University, and Samuel Summers from Tufts University, surveyed 417 citizens on their conception of racism in America.[1]  Several of their conclusions are worth noting:   · Overall anti-Black bias has been declining over the years. · White responses perceived that anti-Black bias has been declining at a rate even faster than that shown in responses from the group overall. · Black respondents perceived anti-White bias is almost non-existent. · White respondents perceive that anti-White bias has been growing since the year 2000. · Whites now see anti-White racism is a bigger problem than anti-Black bias, and · Anti-White racism is seen as a zero-sum condition.   This is encapsulated in a quote by ex-U.S. Senator and ex-U.S. Attorney General Jeff Sessions who said: “Empathy for one party is always prejudice against another.”   Today's Panelists   Stacy Fields who is the Court Administrator for the Municipal Court in Crestwood, Missouri. Stacey has worked in the judiciary for 12 years. She has been a member of NACM for 5 years and serves on the Conference Development Committee. She also serves as Vice President of the Metropolitan St. Louis Association for Court Administration (MSLACA) and on the board of the Missouri Association for Court Administration as Professional Development Director. Zenell Brown who is Executive Court Administrator for the 3rd Circuit Court in Detroit, Michigan. As a Court Administrator, Zenell has garnered respect for her ethical leadership and innovation. She has built her approach on three pillars: communication, leadership responsibility and accountability, and diversity and inclusion. She has shared her “Justice for All” leadership and organizational wisdom at local, state, and national level conferences for court managers and teams. Zenell continues to add to her current credentials of Juris Doctor (Wayne State University Law School), Public Service Administration Graduate Certificate (Central Michigan University), Court Administration Certificate (Michigan State University), and Certified Diversity Professional (National Diversity Council-Diversity First).      Kristie Collier -Tucker who is Court Administrator and Clerk of Court for the Municipal Court in Union City, Georgia. Kristie is responsible for all court operations, including the implementation of policies and procedures of the Court Services department. Union City Municipal Court is a high-volume court, holding more than 20 sessions per month including specialty dockets such as a Under 21 Court, a docket that focuses on defendants who are under 21 at the time of the violation. This docket is an effort to reduce recidivism and improve driver awareness. The court utilizes alternative sentencing principles in all court activities by establishing partnerships with other programs. Kristie received a Bachelor of Arts in Early Childhood Education from South Carolina State University, an ABA approved Paralegal Certificate and Bachelor of Science in Administrative Management from Clayton State University and a MBA with a Human Resources Concentration from Ashford University. During her tenure, she was promoted through the ranks to become the first Assistant Executive Director for Court Services. She led a department of approximately 1,100 sworn officers and 200 civilian employees with around-the-clock operations, including the service of orders of protections, evictions, and the security of the courthouses throughout Cook County. Recently, Carmen lost a series of court battles that will prevent her from being a candidate on the ballot for Sheriff of Cook County.

Last Tuesday, Quebec's legislature passed Bill 96, a new bill that forces small businesses to operate exclusively in French; caps enrollment at English-language CEGEPs; and allows language inspectors to raid businesses, without a warrant, to make sure employees are following the rules. It also compels new immigrants to learn French within six months and introduces other language-enforcement rules. Two days after the bill passed, about 500 people in Montreal protested against the bill at Place du Canada. Montreal's English-language school board has vowed to challenge Bill 96 in court—as have a group of lawyers, including Julius Grey, who belives this case could make it all the way to the United Nations. To explain why the million English-speaking Quebeckers are so anxious, and how this bill will affect minority and Jewish residents, The CJN Daily spoke with several Jewish community leaders in Quebec, including Marvin Rotrand, a former city councillor who now heads the League for Human Rights of B'nai Brith, and Liberal MP Anthony Housefather. Dr. Shawna Coxon is the Deputy Commissioner of An Garda Siochana, Ireland's National Police.  Shawna served with the Toronto Police Service, where she served for 26 years and rose to the rank of Deputy Chief where she led three commands at different times. Most recently, she was in charge of the Human Resources Command, which is comprised of three functions: People and Culture, Corporate Risk Management and the Hearings Office. This Command is responsible for driving the progressive hiring, training, discipline and development of Service members. Prior to that, she led the Priority Response Command followed by the Communities and Neighbourhoods Command. There she oversaw the reactive and proactive policing response of all 16 police divisions in the City of Toronto. These two commands include all front-line policing, community and neighbourhood policing, as well as the investigation functions at Toronto's police divisions. They also include the Service's Operations Centre, 911 Communications, Traffic Services, the Parking Enforcement Unit and Court Services. Deputy Coxon has had a diverse career working in many areas of policing including child abuse, sex crimes, human rights, professional standards, community response, vice, intelligence and national security. She was a proud member of the Transformational Task Force and is also well known for having implemented Service's inaugural Computer Cyber Crime (C3) Section. She was chosen for both of these initiatives because she has led numerous enterprise-wide innovation projects. Shawna Coxon has a B.A.(Hons) in Psychology,  an M.A. in Criminology, and a Ph.D. in Law. from the University of Leicester in the UK.  She has published and lectured extensively around the world.  She has been an adjunct professor at the University of Guelph-Humber for fourteen years. As Depuy Commissioner for the Garda, Shawna is responsible for Governance, Transformation, and Strategic Planning.

SCOTUS Blocks Biden VAX Mandate & Upholds Healthcare Worker Mandate https://www.cnbc.com/2022/01/13/supreme-court-ruling-biden-covid-vaccine-mandates.html The Supreme Court on Thursday blocked the Biden administration from enforcing its sweeping vaccine-or-test requirements for large private companies, but allowed a vaccine mandate to stand for medical facilities that take Medicare or Medicaid payments. The rulings came three days after the Occupational Safety and Health Administration's emergency measure for businesses started to take effect. The mandate required that workers at businesses with 100 or more employees get vaccinated or submit a negative Covid test weekly to enter the workplace. It also required unvaccinated workers to wear masks indoors at work. “Although Congress has indisputably given OSHA the power to regulate occupational dangers, it has not given that agency the power to regulate public health more broadly,” the court wrote in an unsigned opinion. “Requiring the vaccination of 84 million Americans, selected simply because they work for employers with more than 100 employees, certainly falls in the latter category,” the court wrote. President Joe Biden, in a statement, said the Supreme Court chose to block requirements that are life-saving for workers. Biden called on states and businesses to step up and voluntarily institute vaccination requirements to protect workers, customers and the broader community. “The Court has ruled that my administration cannot use the authority granted to it by Congress to require this measure, but that does not stop me from using my voice as President to advocate for employers to do the right thing to protect Americans' health and economy,” Biden said. In a separate, simultaneously released ruling on the administration's vaccination rules for health-care workers, a 5-4 majority sided with the Biden administration. “We agree with the Government that the [Health and Human Services] Secretary's rule falls within the authorities that Congress has conferred upon him,” said the majority, writing that the rule “fits neatly within the language of the statute.” “After all, ensuring that providers take steps to avoid transmitting a dangerous virus to their patients is consistent with the fundamental principle of the medical profession: first, do no harm,” the majority opinion read. Justices Clarence Thomas, Samuel Alito, Neil Gorsuch and Amy Coney Barrett, four of the six conservatives on the nine-seat bench, dissented. Kavanaugh and Roberts joined the three liberals to enforce this ruling. “I do not think that the Federal Government is likely to be able to show that Congress has authorized the unprecedented step of compelling over 10,000,000 healthcare workers to be vaccinated on pain of being fired,” Alito wrote in his dissent. FDA Issues Racist Triage Rationing for COVID Treatments https://freebeacon.com/coronavirus/food-and-drug-administration-drives-racial-rationing-of-covid-drugs/ Fron the Washington Free Beacon: In New York, racial minorities are automatically eligible for scarce COVID-19 therapeutics, regardless of age or underlying conditions. In Utah, "Latinx ethnicity" counts for more points than "congestive heart failure" in a patient's "COVID-19 risk score"—the state's framework for allocating monoclonal antibodies. And in Minnesota, health officials have devised their own "ethical framework" that prioritizes black 18-year-olds over white 64-year-olds—even though the latter are at much higher risk of severe disease. These schemes have sparked widespread condemnation of the state governments implementing them. But the idea to use race to determine drug eligibility wasn't hatched in local health departments; it came directly from the federal Food and Drug Administration. When the FDA issued its emergency use authorizations for monoclonal antibodies and oral antivirals, it authorized them only for "high risk" patients—and issued guidance on what factors put patients at risk. One of those factors was race. The FDA "fact sheet" for Sotrovimab, the only monoclonal antibody effective against the Omicron variant, states that "race or ethnicity" can "place individual patients at high risk for progression to severe COVID-19." The fact sheet for Paxlovid, Pfizer's new antiviral pill, uses the Centers for Disease Control and Prevention's definition of "high risk," which states that "systemic health and social inequities" have put minorities "at increased risk of getting sick and dying from COVID-19." The guidance sheets are nonbinding and do not require clinicians to racially allocate the drugs. But states have nonetheless relied on them to justify race-based triage. "The FDA has acknowledged that in addition to certain underlying health conditions, race and ethnicity ‘may also place individual patients at high risk for progression to severe COVID-19,'" Minnesota's plan reads. "FDA's acknowledgment means that race and ethnicity alone, apart from other underlying health conditions, may be considered in determining eligibility for [monoclonal antibodies]." Utah's plan contains similar language. In a section on the "Ethical Justification for Using Race/Ethnicity in Patient Selection," it notes that the FDA "specifically states that race and ethnicity may be considered when identifying patients most likely to benefit from this lifesaving treatment." The FDA declined to comment on either state's plan, saying only that "there are no limitations on the authorizations that would restrict their use in individuals based on race." The triage plans are part of a broader push to rectify racial health disparities through race-conscious means. In March of last year, for example, two doctors at Brigham and Women's Hospital in Boston outlined an "antiracist agenda for medicine" that involved "offering preferential care based on race." But that wasn't enough for the tech giant. They (probably) thought, "spelling and grammar checks are great and all but what we really want to do is influence and control the masses." Control is the biggest rave these days. Word will now highlight no-no words with a purple line beneath any problematic words or phrases that focus on gender, age, sexual orientation, ethnicity or even "socioeconomic status." Red lines are for spelling errors. Green lines for grammar mistakes. And now, purple lines are politically correct language police alerts. If you type a bigoted word like, let's say... "postman," Word will offer less offensive, gender-neutral alternatives like "mail carrier" or "postal worker." The software also suggests altering astronaut Neil Armstrong's famous quote from "one giant leap for mankind," to "humankind" or "humanity" instead. Who knew Neil Armstrong was such a sexist bigot... Microsoft Word knew. In the lyrics to Barry Manilow's party favourite Copacabana, Microsoft suggests Lola be referred to as a "dancer," "performer" or "performing artist" rather than a "showgirl." Word is not just policing your language (and by default, your thoughts) but it seems as though Microsoft wants us to re-write and re-imagine history by suggesting we change famous quotes. It also proposes changing "maid" to "house cleaner." Other changes include "headmaster" (Word suggests "principal"), "mistress" ("lover"), "master" ("expert"), "manpower" ("workforce") and "heroine" ("hero"). At least seven other federal agencies, including five Cabinet departments, are apparently setting up similar “personal religious information” databases, according to an analyst at the Heritage Foundation, a conservative think tank in the District. The federal Court Services and Offender Supervision Agency for the District of Columbia, or CSOSA, published a “notice of a new system of records” in the Federal Register on Tuesday. The agency, which supervises defendants awaiting trial as well as parolees, aims to “reduce recidivism” and “integrate offenders into the community by connecting them with resources and interventions.” The federal departments of Treasury, the Interior, Housing and Urban Development, Health and Human Services, and Transportation, as well as the General Services Administration and the Securities and Exchange Commission, have each published proposed rule-makings to implement “systems of records” tracking their workers' religious accommodation requests. Today is Friday, January 14, 2022.  SCOTUS Blocks Biden VAX Mandate & Upholds Healthcare Worker Mandate https://www.cnbc.com/2022/01/13/supreme-court-ruling-biden-covid-vaccine-mandates.html The Supreme Court on Thursday blocked the Biden administration from enforcing its sweeping vaccine-or-test requirements for large private companies, but allowed a vaccine mandate to stand for medical facilities that take Medicare or Medicaid payments. The rulings came three days after the Occupational Safety and Health Administration's emergency measure for businesses started to take effect. The mandate required that workers at businesses with 100 or more employees get vaccinated or submit a negative Covid test weekly to enter the workplace. It also required unvaccinated workers to wear masks indoors at work. “Although Congress has indisputably given OSHA the power to regulate occupational dangers, it has not given that agency the power to regulate public health more broadly,” the court wrote in an unsigned opinion. “Requiring the vaccination of 84 million Americans, selected simply because they work for employers with more than 100 employees, certainly falls in the latter category,” the court wrote. President Joe Biden, in a statement, said the Supreme Court chose to block requirements that are life-saving for workers. Biden called on states and businesses to step up and voluntarily institute vaccination requirements to protect workers, customers and the broader community. “The Court has ruled that my administration cannot use the authority granted to it by Congress to require this measure, but that does not stop me from using my voice as President to advocate for employers to do the right thing to protect Americans' health and economy,” Biden said. In a separate, simultaneously released ruling on the administration's vaccination rules for health-care workers, a 5-4 majority sided with the Biden administration. “We agree with the Government that the [Health and Human Services] Secretary's rule falls within the authorities that Congress has conferred upon him,” said the majority, writing that the rule “fits neatly within the language of the statute.” “After all, ensuring that providers take steps to avoid transmitting a dangerous virus to their patients is consistent with the fundamental principle of the medical profession: first, do no harm,” the majority opinion read. Justices Clarence Thomas, Samuel Alito, Neil Gorsuch and Amy Coney Barrett, four of the six conservatives on the nine-seat bench, dissented. Kavanaugh and Roberts joined the three liberals to enforce this ruling. “I do not think that the Federal Government is likely to be able to show that Congress has authorized the unprecedented step of compelling over 10,000,000 healthcare workers to be vaccinated on pain of being fired,” Alito wrote in his dissent. FDA Issues Racist Triage Rationing for COVID Treatments https://freebeacon.com/coronavirus/food-and-drug-administration-drives-racial-rationing-of-covid-drugs/ Fron the Washington Free Beacon: In New York, racial minorities are automatically eligible for scarce COVID-19 therapeutics, regardless of age or underlying conditions. In Utah, "Latinx ethnicity" counts for more points than "congestive heart failure" in a patient's "COVID-19 risk score"—the state's framework for allocating monoclonal antibodies. And in Minnesota, health officials have devised their own "ethical framework" that prioritizes black 18-year-olds over white 64-year-olds—even though the latter are at much higher risk of severe disease. These schemes have sparked widespread condemnation of the state governments implementing them. But the idea to use race to determine drug eligibility wasn't hatched in local health departments; it came directly from the federal Food and Drug Administration. When the FDA issued its emergency use authorizations for monoclonal antibodies and oral antivirals, it authorized them only for "high risk" patients—and issued guidance on what factors put patients at risk. One of those factors was race. The FDA "fact sheet" for Sotrovimab, the only monoclonal antibody effective against the Omicron variant, states that "race or ethnicity" can "place individual patients at high risk for progression to severe COVID-19." The fact sheet for Paxlovid, Pfizer's new antiviral pill, uses the Centers for Disease Control and Prevention's definition of "high risk," which states that "systemic health and social inequities" have put minorities "at increased risk of getting sick and dying from COVID-19." The guidance sheets are nonbinding and do not require clinicians to racially allocate the drugs. But states have nonetheless relied on them to justify race-based triage. "The FDA has acknowledged that in addition to certain underlying health conditions, race and ethnicity ‘may also place individual patients at high risk for progression to severe COVID-19,'" Minnesota's plan reads. "FDA's acknowledgment means that race and ethnicity alone, apart from other underlying health conditions, may be considered in determining eligibility for [monoclonal antibodies]." Utah's plan contains similar language. In a section on the "Ethical Justification for Using Race/Ethnicity in Patient Selection," it notes that the FDA  "specifically states that race and ethnicity may be considered when identifying patients most likely to benefit from this lifesaving treatment." The FDA declined to comment on either state's plan, saying only that "there are no limitations on the authorizations that would restrict their use in individuals based on race." Natasha then went on to earn her Master's of Social Work Degree from the University of Southern California with a concentration in Children and Families. Experience Natasha is a Licensed Clinical Social Worker who has several years experience working with individuals seeking to overcome Depressive and Anxiety Disorders, Bi-polar Disorder, PTSD, grief and loss, as well as difficulty managing stress. While there is no cookie-cutter approach to working with different mental disorders, Natasha has a strong foundation in Cognitive Behavioral Therapy (CBT). CBT is based on the idea that changing the way one thinks will then change associated feelings and behaviors. Natasha devotes her time to working with adults to improve their overall mental health and quality of life. Natasha seeks to help those who have had difficulty reaching their “best” mental and physical self. Natasha works with clients to decrease their mental health symptoms that may serve as a barrier to achieving an overall sense of well-being. Natasha has worked with victims of domestic violence, children and families within foster care, adolescents and adults with co-occurring substance abuse and mental health disorders, relationships complications that affect heterosexual and homosexual couples. Organizationally, Natasha has also worked as a Clinical Supervisor, training staff on evidence based interventions to help low income individuals and families overcome mental and substance abuse challenges. Natasha has also worked as a program supervisor for a non profit community mental health agency in which she developed mental health and substance abuse programs to the underserved within the community. As the Director of Court Services for a local community health agency, Natasha built programs to support individuals presenting with co-occurring disorders with drug related offenses. Within this role, Natasha received the "Game Changer" Award for organizational commitment, dedication and innovation with a client centered approach for 2019. Sheriff Charmaine McGuffey is a 33-year veteran of the Hamilton County Sheriff's Office and has held the rank of Sergeant, Lieutenant, Captain, and Major prior to being elected Sheriff in November 2020. Sheriff McGuffey is the highest-ranking woman in the history of the Sheriff's Office. Sheriff McGuffey was born and raised in Cincinnati, growing up in Price Hill. By the time she was 14, she knew she wanted to be a Police Officer. She graduated from Western Hills High School and entered the Criminal Justice program at the University of Cincinnati, even though at the time, women were not allowed to be uniformed patrol officers. Fortunately, that changed by the time Sheriff McGuffey graduated with a Bachelor of Science degree in Criminal Justice. She then joined the Hamilton County Sheriff's Office in 1983. Sheriff McGuffey began her career as a Corrections Officer at the former Workhouse and has worked in nearly all facets of the Sheriff's Office including as the Academy Commander for the Ohio Peace Officer Corrections Academy, serving as lead hostage negotiator for the Sheriff's Special Response Team, and as Commander of the Sheriff's Honor Guard. Sheriff McGuffey provided training for law enforcement officers throughout the State of Ohio and is an accomplished self-defense instructor. During her tenure as Major of Jail and Court Services, Sheriff McGuffey was credited with leading reforms in the jail to reduce the likelihood of people returning to jail. She was also credited with bringing the jail from the worst ranking in the State of Ohio to the top ranking. Sheriff McGuffey is committed to public safety and to ensuring accountability, transparency, and engagement with the community as the foundation of the work in the Sheriff's Office. Artificial Intelligence (A.I.) has already brought us general business tools that courts can use to assist in automating work, analyzing documents, and conducting legal analysis. As a start, courts will need to put their information into an electronic format that can be used by A.I. tools. They will also need to re-engineer their business practices. Small courts will have to be assertive in making their needs known. But, exactly how will A.I. tools help courts and what will we, as citizens, give up in privacy in order to maximize A.I.’s potential? Alan Carlson along with co-host Rick Pierce discuss how A.I. will be used in the courts and how soon it will be here. About the Presenter Alan Carlson retired at the end of 2016 after working 40 years in state trial courts. He was the CEO (court administrator, clerk of court, and jury commissioner) of the Orange County (CA) Superior Court, the CEO in San Francisco Superior Court, the Executive Officer of the Monterey Superior Court, and the Assistant Executive officer of the Alameda County Superior Court. Mr. Carlson also was president of JMI, Director of Court Services at the CA AOC, and a Staff Attorney at NCSC. Mr. Carlson received a Distinguished Service Award from the California Judicial Council in 2016, the NACM Award of Merit in 2012, and the ABA Robert B. Yegge Award in 2010. He was inducted as a member of the NCSC’s Warren Burger Society in 2012. He received a law degree from Hastings College of Law and a BS in engineering from University of California at Berkeley. About the Co-Host Rick Pierce, Judicial Programs Administrator, has served in the field of court administration for the past thirty years. Prior to his appointment at the Administrative Office of Pennsylvania Courts, Pierce was the district court administrator for the 9th Judicial District of Pennsylvania, Cumberland County. As judicial programs administrator, he is responsible for implementation of programs and education in court administration at the general and limited jurisdiction court levels. Pierce was elected to the National Association for Court Management Board of Directors in July of 2017 and currently serves as a director and vice chair of the Governance Committee of NACM. Pierce served as the President of the Mid-Atlantic Association for Court Management from 2005-2006.He also served as President of the Pennsylvania Association of Court Management in 2000-2001. A graduate of Washington and Lee University, Pierce received his Master’s in Public Administration from Shippensburg University in 1995.
