On this episode of The Callover, we are joined the Honourable Justice Elizabeth Wilson and Dr Jane Phillips to discuss the value of expert psychiatric evidence in legal proceedings. Justice Wilson graduated with a Bachelor of Laws (with Honours) at the Queensland University of Technology in 1995, was admitted to the Bar the following year and, in 2011, was appointed as senior counsel. While at the bar, her Honour practiced in criminal, administrative and constitutional matters. Before being appointed as a Judge of the Supreme Court in 2018 and the President of the Mental Health Court in 2022, Justice Wilson had served as a sessional member of the Anti-Discrimination Tribunal and the Queensland Civil and Administrative Tribunal and acted as counsel in a number of Commission of Inquiries including the Youth Detention Review in 2016. Dr Jane Phillips is a consultant forensic psychiatrist who specialises in medico-legal psychiatric assessments and reports. Dr Phillips completed her internship and basic psychiatry training at the Alfred Hospital in Melbourne before completing advanced training in forensic psychiatry at the Victorian Institute of Forensic Mental Health. In additional to her work as a forensic psychiatrist, she has worked as a consultant psychiatrist in prisons and Victoria's High Security Forensic Hospital. Dr Phillips has been providing expert evidence to the Mental Health Court since 2011, and has otherwise prepared reports for Legal Aid Queensland, the Director of Public Prosecutions, the Parole Board and the Mental Health Review Tribunal.See omnystudio.com/listener for privacy information.

I speak with Leora Joseph, mother of three, wife and career prosecutor who oversees the Colorado Office of Civil and Forensic Mental Health.  Leora has been the Chief of Staff in the Colorado Attorney General's office, managing attorney and law enforcement teams, special victim's, and human trafficking units and she has worked with over 1,000 victims of sexual abuse, and sex trafficking.  Her experiences helped her identify gaps within the legal and criminal justice systems where limited access to mental healthcare and stigma often trap those needing care within a loop of prosecution and incarceration.  Leora is subsequently running for office as Denver's District Attorney with a vision of balancing treatment for chronic mental illness with victim's advocacy, restorative justice and public awareness to help improve a complex legal system. In 2018, Dr. Zapf brought CONCEPT Professional Training to Palo Alto University to further its mission of continuing and professional studies in partnership with Palo Alto University. Dr. Zapf is a past President of the American Psychology-Law Society (AP-LS; Division 41 of the American Psychological Association). In 2006, in recognition of her outstanding contributions to the science and profession of forensic psychology, she was named a Fellow of the American Psychological Association (APA) and a Distinguished Member of the American Psychology-Law Society (AP-LS). She has served on the board of directors for the International Association of Forensic Mental Health Services, as an associate editor for Law and Human Behavior and as editor of the American Psychology-Law Society book series, as well as the International Perspectives on Forensic Mental Health book series. She has published 9 books and manuals and over 100 articles and chapters, mainly on the assessment of criminal competencies and forensic evaluation. Checkout our Guests:  LT Grant currently serves as the Group Psychologist for Commander, Naval Surface Group Middle Pacific where he oversees the psychological care for the Sailors assigned to all surface ships homeported in Joint Base Pearl Harbor-Hickam, Hawaii. His leadership roles include Department Head of the Embedded Mental Health Department and Mental Health Advisor to the Commander. Additionally, he serves as faculty in the Tripler Army Medical Center Clinical Psychology Postdoctoral Residency Program, supervising an interservice clinical rotation serving surface warfighters. In 2022, LT Grant was selected by the Office of the Chief of Naval Operations' 21st Century Sailor Office as a Fellow in the International Career Advancement Program.  LT Grant completed his first tour at Naval Medical Readiness and Training Command (NMRTC) San Diego from 2019 to 2021 where he served as the Division Officer of the Mental Health Unit of the Marine Corps Recruit Depot, San Diego. In addition to this role, he co-led the base's Psychological Health Committee. He additionally served as the chair of the Grand Rounds Committee for NMRTC San Diego's Directorate of Mental Health and co-chair of the Naval Medical Forces Pacific Transgender Care Team. In the fall of 2019, LT Grant deployed to the USS ABRAHAM LINCOLN during its time in the Fifth Fleet. He served as the lead for a Mental Health Augmentation Team, which spent the final three months of the ship's record-breaking deployment supporting the crew. In the spring of 2020, he deployed again, this time serving as lead mental health clinician aboard the USNS MERCY during its defense support of civilian authorities mission to provide hospital relief to Los Angeles in response to COVID-19.  LT Grant was commissioned into the US Navy via the Navy Psychology Licensed Direct Accession program in 2019. He is a native of Southern California, and prior to joining the Navy, he worked as a Clinical Psychology Subject Matter Expert at the Defense Health Agency's Psychological Health Center of Excellence and as a clinical researcher in the Department of Medical and Clinical Psychology at the Uniformed Services University of Health Sciences supporting research on military suicide prevention.  Capt Deonte Williams is a Clinical Psychologist at Aviano Air Base Italy. In 2021, he received his doctorate in Clinical Psychology from Palo Alto University in Palo Alto, CA. He completed his pre-doctoral clinical residency at Wilford Hall Ambulatory Surgical Center (WHASC), Joint Base San Antonio-Lackland, Texas, and is a previous recipient of the United States Air Force Health Professions Scholarship Program in 2018.   Capt Williams specializes in trauma treatment, and has an added focus on treatment focused on couples/intimate relationships. His clinical experiences similarly include working with adults with a wide range of clinical presentations, including neuropsychological assessment, mood disorders, and behavioral-health-related conditions. His graduate-level clinical experiences included advanced practicums within the Palo Alto VA Healthcare System, where he focused on outpatient mental health, neuropsychological evaluation, inpatient care, and clinical research on opioid use within the veteran population. His primary research interests include personality factors and habits related to romantic relationship outcomes in young adults as well as the impact of stress/anxiety on human performance in stressful environments. Additionally, he hosts a weekly radio podcast titled the DNA of Love with Dr. Williams, where he uses humor and anecdotal personal experience to highlight research-informed aspects of healthy dating behaviors in hopes of helping listeners find the one they're meant to be with. She has received numerous honors including the Sigma Theta Tau International Audrey Hepburn Award, the American Nurses' Association Hildegard Peplau Award, and the Sigma Theta Tau International Episteme Laureate Award. Her courtroom testimony has been described as “groundbreaking,” and she has been called a “nursing pathfinder.” Her research with victims began when she co-founded, with Boston College sociologist Lynda Lytle Holmstrom, one of the first hospital-based crisis counseling programs at Boston City Hospital. She then worked with FBI Academy special agents to study serial offenders, and the links between child abuse, juvenile delinquency, and subsequent perpetration. Her work with Boston College nursing colleague Carol Hartman led to the study of very young victims and the impact of trauma on their growth and development, their families and communities. In this podcast, Chris and John share the ideas presented in their recent book, which examines how trauma and marginalization are produced and perpetuated by in-group and out-group dynamics. They turn questions upside down, making us think differently about social problems. When asked how to help the homeless, they return the question in a different way, asking how the ‘we' of ‘housed' in groups cause people to be psycho-socially 'unhoused', revealing how we are all implicated in the trauma of others. The hundreds of migrants who die at sea are not poor neutral victims, but those we have unhoused and displaced through wars, colonialism and neo-liberal capitalist economics.   They invite us to make use of their "Diogenes Paradigm", drawing on the story of the ancient street philosopher to highlight questions of power and authority; they re-tell the story of how Alexander the Great asked Diogenes, who lived in a barrel with his dogs, whether he could do anything for him. Diogenes replied: “Yes, you can move as you are blocking the sunlight”. BP - My name is Bryony and I am currently studying Mental Health Nursing through the degree apprenticeship with Canterbury Christ Church University. I started working in Forensic Mental Health in 2016. I have experience in an inpatient setting where I worked as a Lead Healthcare Worker, and I currently work for Forensic Community Services as a Senior Support Time and Recovery Worker; this is my base job role whilst I am on the nursing apprenticeship. TRW - I am a third-year mental health nursing student. I came into my course straight from completing my A-levels. I am the youngest student on my course. I wanted to work in mental health from a young age, but I never knew it would be nursing. It wasn't until my grandad was ill and I saw how nurses treated him that I decided to investigate nursing and saw mental health nursing, it was the perfect combination really. My future ambitions are to firstly finish up my mental health nursing course, and then I'd love to work as a forensic mental health nurse or in children's mental health service (CAHMS). I would also love to do a masters, but I will see where life takes me! On today's episode, I interviewed Mr. Robert Ochs on the role of probation in the criminal justice system.  We talked about:What are the roles and duties at CYA, Gateways, and treatment centers?What is it like to manage mentally ill offenders in the probation population?Does treatment actually work for this population of offenders? About Mr. Robert Ochs:Mr. Robert Ochs started his career as a licensed clinician (MSW) and began working at the California Youth Authority (CYA).  During his time there, he conducted adolescent forensic evaluations.  Seeking more experience with treatment, he left the CYA and began working at Gateways where he worked in an adolescent residential treatment program with disturbed youth - many of which were on probation.  Mr. Ochs then transitioned to evaluating adult mentally ill offenders.  In that position, he would track and treat the population of NGRI's, MDO's, and MDSO's (Mentally Disordered Sex Offenders).  Mr. Ochs was later promoted to run the Community Corrections Center (CCC) - a federal program.  Later, Mr. Ochs transitioned to the Sonoma County Probation Department where he ultimately retired as Chief Probation Officer.  During retirement, Mr. Ochs enjoys spending his free-time painting and playing golf. Contact Mr. Robert Ochs Email: bobbyo95@comcast.net Thanks for listening! He earned his doctorate from Midwestern University – Glendale, an APA accredited program. Dr. Delatorre completed his doctoral internship at a crisis stabilization unit and completed advanced training in forensic psychology. Dr. Delatorre provides therapy and assessment for a variety of concerns, including providing interventions to the severely mentally ill, individuals with significant trauma histories, and crisis interventions/de-escalation. He has training and experience in various assessments including general psychological, risk/threat assessments (member of Association of Threat Assessment Professionals, ATAP), competency to stand trial and criminal responsibility, psychosexual evaluations (member of Association for Treatment of Sexual Abusers, ATSA), police and public safety, and immigration evaluations. The execution of individuals with mental disorder is prohibited by international law, such that the presence of mental disorder, and how it is dealt with during the investigatory or trial and sentencing process, may render a conviction legally unsafe.  Although legal principles designed to protect those with mental disorder from the death penalty are not in dispute, for them to operate mental health professionals must be both equipped with relevant clinico-ethico-legal expertise and be prepared to engage in the process. Engaging in such cases represents the most extreme focus of the usual clinical, legal and ethical issues involved in all evaluations for criminal courts. Crucial to not avoiding engagement in such cases must be the recognition that they do not raise ‘different' issues for forensic practitioners but merely offer extreme representations of those issues.  Dr Jay Sarkar is a Consultant with Victorian Institute of Forensic Mental Health, Forensicare and Spectrum Personality Disorder Service, Melbourne. He was previously an Adjunct Assistant Professor in Singapore. He has a particular interest in capital cases and provided expert testimony in over 100 cases and counting. His testimony has helped prevent deaths of many. Dr Danny Sullivan is a UK and Australian-trained forensic psychiatrist, currently Executive Director of Clinical Services of Forensicare, the statewide Victorian forensic mental health service. He has provided expert evidence in criminal matters in may jurisdictions for 20 years. In 2018 the Australian Human Rights Commission stated that the trend towards incarceration saw a 77% increase of women in prison, with Aboriginal and Torres Strait Islander women making up the majority of this increase. Indigenous women and girls are the fastest growing group of people being incarcerated in 'Australia'. Approximately 90% of women in prison are mothers, and the majority of these mothers are single parents. Statistics also stated that almost 1 in 50 women reported being pregnant while in prison.In this episode of Pregnancy Birth and Beyond, presenter Kirilly Dawn speaks with Debbie Kilroy OAM, founder of Sisters Inside, about the targeted impact of the Prison Industrial Complex on mothers, women and girls. Debbie is one of Australia’s leading advocates for protecting the human rights of women and children through decarceration - the process of moving away from using prisons and other systems of social control in response to crime and social issues. In this conversation, Debbie discusses why she is a prison abolitionist, why she started Sisters Inside after her own experience of prison, and the justice a world without prisons would provide. She unravels the racial capitalist system which is responsible for the alarmingly yet strategically high incarceration rates of women, particularly Aboriginal and Torres Strait Islander women and girls. We also speak about reproductive justice, maternity care inside, and the realities many women face when being pregnant and birthing in prison. Since then, she has qualified as a Gestalt Therapist and Legal Practitioner, and has completed a Graduate Diploma of Forensic Mental Health.After her release in 1992, Debbie established Sisters Inside, which advocates for the human rights of women in the criminal justice system and responds to gaps in the services available to them. Sisters Inside has won international recognition for its work and its unique structure which ensures it is driven by women with lived prison experience.In 2003, Debbie was awarded the Order of Australia Medal for services to the community for working with women in prison. She was also awarded the Australian Human Rights Medal in 2004 and a Churchill Fellowship to explore decarceration strategies and programs internationally in 2014. In 2017, Debbie was appointed to the Queensland Government Sentencing Advisory Council. Debbie was admitted to the legal profession by the Supreme Court of Queensland in 2007 – a rare achievement for someone with serious convictions. How easy is it to fake mental illness when you are facing the death penalty? How about when you are applying for disability or suing someone for emotional distress? Psychologists call this malingering and it’s something every forensic psychologist has to consider when money or freedom is on the line. In this episode of Thread of Evidence, Dr. Joni Johnston interviews Dr. Barry Rosenfeld, a board certified forensic psychologist who talks about how often mental illnesses are faked and how forensic psychologists tell the difference between genuine symptoms and faked ones. Dr. Barry Rosenfeld is a Professor and Chair in the Department of Psychology and an Adjunct Professor of Law at Fordham University. He worked for several years as Senior Psychologist for the New York and is Past President of the International Association of Forensic Mental Health Services as well as the former Editor-in-Chief of the International Journal of Forensic Mental Health. Dr. Rosenfeld is board certified in forensic psychology and maintains an active practice in forensic consultation. He has evaluated multiple individuals detained in the infamous Abu Ghraib and Guantanamo Bay military prisons, consulted to a U.N. War Tribunal regarding the prosecution of Serbian individuals accused of war crimes, and evaluated litigants in a class action lawsuit against the government of India. He has testified in many high-profile domestic cases, including U.S. v. Osama Bin Laden (involving alleged Al Qaeda members convicted of blowing up the U.S. Embassies in Tanzania and Kenya).

This is the audio of the section in Hepatitis Victoria’s Annual General Meeting on 15th October, where the winners of the annual awards were announced. Community Participation Coordinator, Steph Houghton read the nominations and Hepatitis Victoria president Frank Carlus announced the winners. There were three nominations for the Organisation Collaboration Award, the Chinese Cancer and Chronic Illness Society of Victoria, IIbijerri Theatre Company and Forensicare, (the Victorian Institute of Forensic Mental Health). Forensicare, received the award for its tireless work across the health sector making progress against the unacceptably high levels of hepatitis C inside. There were three nominations for the Individual Contribution Award, Cr Lucinda Congreve, Mayor of Brimbank, Marion Lau and Sambath My, all of whom are already HEP Heroes, with Marion Lau receiving the award. There were two nominees for the prestigious Mark Farmer Memorial Award for advocacy; Aboriginal elder, actor, musician, potter and activist Uncle Jack Charles and Councillor Youhorn Chea, the former Mayor of Dandenong. Uncle Jack was this year’s winner in recognition of his advocacy for people living with hepatitis C, his passion and encouragement of people to be tested and seek treatment.

Ann Wolbert Burgess, D.N.Sc., APRN, FAAN, is an internationally recognized pioneer in the assessment and treatment of victims of trauma and abuse. She has received numerous honors including the Sigma Theta Tau International Audrey Hepburn Award, the American Nurses’ Association Hildegard Peplau Award, and the Sigma Theta Tau International Episteme Laureate Award. Her courtroom testimony has been described as “groundbreaking,” and she has been called a “nursing pathfinder.”Her research with victims began when she co-founded, with Boston College sociologist Lynda Lytle Holmstrom, one of the first hospital-based crisis counseling programs at Boston City Hospital. She then worked with FBI Academy special agents to study serial offenders, and the links between child abuse, juvenile delinquency, and subsequent perpetration. Her work with Boston College nursing colleague Carol Hartman led to the study of very young victims and the impact of trauma on their growth and development, their families and communities. Her work continues in the study of elder abuse in nursing homes, cyberstalking, and Internet sex crimes.
