Když se rodiče promění ve dvě válčící strany, stát si s tím často neví rady. Právníci a psychologové po zveřejnění podcastové série Bertík mluví v diskuzi pořadu Ve stínu o velkém selhání ze strany soudů, OSPODu i policie.„Máme zakořeněnou pohádkovou představu, že když označíme jednoho z rodičů za někoho, kdo brání styku dítěte s druhým rodičem, tak máme padoucha a tím je všechno vyřešeno. Ale co když mají pravdu všichni? Co když je tu ‚bránící‘ matka a zároveň zneužívající otec?“ hodnotí kauzu Bertík Michaela Dobrovičová, advokátka zabývající se právy dětí.Právnička se tím dotkla podstaty případu, který jsme v posledním týdnu popisovali ve speciální podcastové sérii Bertík a v němž jsme postupně odkrývali systém rozhodování policie, soudů a orgánů sociálně právní ochrany dítěte neboli OSPODu.Matka Barbora (celá jména rodičů kvůli ochraně identity dítěte nezveřejňujeme, pozn. red.) po rozpadu vztahu vyslovila podezření, že otec Marek syna Bertíka zneužívá a začala soudům i policii postupně předkládat různé indicie. Místo klidného dětství zažívá vleklý boj dospělých. A stát si s jeho ochranou neví rady. Nová epizoda podcastové série odkrývá, jak do života Bertíka zasáhla soudkyně Magdalena Kerlová a jak naložila s podezřením na zneužívání.Na jedné straně je otec Marek, na druhé matka Barbora. A mezi nimi dnes čtyřletý syn Bertík, o kterého už tři roky vedou spor. Marek Bennett, New Hampshire cartoonist, musician and educator drops in to talk about his graphic novel series “The Civil War Diary of Freeman Colby”. Marek is the recipient of the New Hampshire Governor's Arts Award for Art Education “...His work is brilliant, playful, relevant and infused with compassion and deep understanding of the world as it is, was and might be.” This interview was absolutely fascinating to me! It was intriguing, at times riveting and absolutely rich with information. I fell in love with his artistic style and his love for bringing subjects to light that I had never considered.

Čtyřleté dítě jako oběť vleklého sporu mámy a táty. Už několik let se řeší podezření ze sexuálního zneužívání syna. Podcastová série Bertík postupně odkrývá neschopnost soudů, policie a dalších institucí ochránit malé dítě.„Malý se vrátil od otce s krví na plence a opuchlými genitáliemi. Tahal se za ně a říkal ‚táta‘.“Jedna z nejotřesnějších výpovědí, jaké kdy naše mikrofony zaznamenaly. Patří Barboře, matce dnes čtyřletého chlapce, která už přes tři roky svádí soudní bitvu s bývalým manželem. Při osobním setkání předložil několik dokumentů, které dle něj podporují verzi, že matka je manipulátorka, která chtěla po rozchodu rodičů bránit otci ve styku s otcem, a proto přišla s vymyšleným obviněním.Jedná se o kauzu, která v prostředí sociálních sítí koluje už dlouho – a to s přiznanou identitou obou rodičů. Přesto se tým pořadu Ve stínu rozhodl v zájmu dětské oběti příjmení rodičů nezveřejňovat. Od letošního jara jsme intenzivně zkoumali případ, který zaměstnává OSPOD, policii i soudy. Případ, do kterého je zapojena řada vlivných lidí (včetně Jana Klause, syna bývalého prezidenta), politiků současných i bývalých (například psychiatra a bývalého primátora Pavla Béma či bývalé eurposlankyně KDU-ČSL Michaely Šojdrové), známých osobností (moderátorky Ester Janečkové) a právníků.Ode dneška začínáme v rámci investigativního podcastu Ve stínu zveřejňovat speciální sérii s názvem Bertík. Hledáme v ní odpověď na otázku, kdo měl a mohl ochránit malého chlapce, zmítajícího se uprostřed sporu jeho rodičů. Kdo a jak řešil situaci, když matka předložila policii a soudu videonahrávky pořízené mobilem, na nichž v tu dobu tříletý syn mimo jiné říká, že si se „zlým tátou cucali pindíky“.
