GDV fordert Einsatz privaten Kapitals zur Modernisierung der Infrastruktur Das neue Sondervermögen des Bundes ist laut Gesamtverband der Deutschen Versicherungswirtschaft (GDV) ein wichtiger Schritt – jetzt müsse die Politik auch für mehr Öffentlich-Private Partnerschaften sorgen. Versicherer sehen Potenzial: Schon heute stecken 100 Mrd. Euro in Infrastrukturprojekten. BVK: Lob für Riester-Reform und Elementarpflicht, Kritik am Kostendeckel Der BVK sieht in den Ergebnissen der Koalitionsarbeitsgruppen Licht und Schatten: Gelobt werden Pläne zur Riester-Reform ohne Garantiezwang und mit weniger Bürokratie – kritisiert wird jedoch ein möglicher gesetzlicher Kostendeckel. Damit baut der Industrieversicherer seine Präsenz in Kontinentaleuropa weiter aus. Bereits heute ist Sompo in Deutschland, Frankreich, Italien, Spanien und der Schweiz aktiv. About Anne Reinke Anne Reinke was named President & CEO of the TIA in October 2020, coming from the USDOT where she served as the Deputy Assistant Secretary – Congressional Affairs. Reinke started her service at USDOT in April 2019, initially as the Deputy Assistant Secretary for Intergovernmental Affairs, and transitioned to Congressional Affairs in November 2019. About Lynn: Dr. Reinke is the Claire Dumke Ryberg, RN, Presidential Endowed Chair for Palliative and End of Life Care at the University of Utah, College of Nursing. In this role, she works to increase the palliative care workforce in rural and underserved populations by educating professionals and laypersons to deliver primary palliative care. Dr. Reinke's clinical practice and program of research focuses on improving the delivery of palliative and end-of-life care for patients with serious illnesses. She is internationally recognized as an expert in dyspnea management for patients diagnosed with advanced lung diseases. Her studies, funded by NIH, VA, and Foundations, are designed to test nurse-led palliative care interventions in sub-specialty and primary care services and to improve the quality of clinicians' end-of-life communication skills. About Masako: Dr. Mayahara is a clinical expert in pain management in hospice and palliative care. Her research focuses on reducing pain and suffering in patients and families facing serious illness. She utilizes innovative technology and evidence-based interventions to support family caregivers in delivering patient pain management at home. Her federally funded research includes the development and testing of a digital application (e-PainSupport) designed to reduce pain intensity in home hospice patients. Additionally, she serves as a co-investigator on multiple NIH R01 grants, including a study funded by the National Institutes of Aging to provide chronic grief intervention to dementia caregivers using video conference technology. She is a member of the editorial board of the Journal of Hospice and Palliative Nursing and serves as the president-elect of the Hospice and Palliative Nurses Association and the Hospice and Palliative Nurses Foundation. About Michelle: Dr. Webb is an Assistant Professor in the Duke University School of Nursing. She earned a Bachelor of Science in Nursing from Indiana University, a Master of Science in Nursing from The George Washington University and a Doctor of Nursing Practice degree from the University of Minnesota. She has diverse nursing practice and leadership experience and has held executive leadership positions in behavioral/psychiatric-mental health, home health, acute care, and hospice care. In this role, she works to increase the palliative care workforce in rural and underserved populations by educating professionals and laypersons to deliver primary palliative care. Dr. Reinke's clinical practice and program of research focuses on improving the delivery of palliative and end-of-life care for patients with serious illnesses. She is internationally recognized as an expert in dyspnea management for patients diagnosed with advanced lung diseases. Her studies, funded by NIH, VA, and Foundations, are designed to test nurse-led palliative care interventions in sub-specialty and primary care services and to improve the quality of clinicians' end-of-life communication skills.

About Anne Reinke Anne Reinke was named President & CEO of the TIA in October 2020, coming from the USDOT where she served as the Deputy Assistant Secretary – Congressional Affairs. Reinke started her service at USDOT in April 2019, initially as the Deputy Assistant Secretary for Intergovernmental Affairs, and transitioned to Congressional Affairs in November 2019. Prior to her time at USDOT, Reinke spent 16 years at CSX Corporation in their Federal Affairs office, ultimately serving as the Vice President – Government Affairs, overseeing the Federal, State Government and Community Affairs Departments. Before joining CSX, she worked at the Association of American Railroads and High-Speed Ground Transportation Association. Cargo theft and transportation fraud are on the rise.  Criminal groups and bad actors often pose as legitimate freight brokers and carriers with the aim of taking payments for services they will never fulfill. What can carriers and shippers do to be sure they are staying away from fraudsters and selecting legitimate transportation providers? Nick Reinke, is not only the CEO of HabiTerre but also grew up on a farm, worked in soil health with an agricultural coop, and has a background in ag finance. He is uniquely qualified to help us explore how all of this “carbon talk” fits into soil health practice adoption, company involvement and sustainability goals. HabiTerre uses deep science and technology to quantify environmental outcomes for agriculture. But where many other companies focus on trying to measure soil carbon, Nick says HabiTerre looks at things in a really comprehensive systems context. Their goal is to try to determine how productivity and environmental sustainability relate to farming outcomes like productivity, nutrient management, and soil health. Nick says he was most excited to join HabiTerre because he saw too many people focused on soil carbon measurement missing the picture of what that means for real farm outcomes. “I saw something just fundamentally groundbreaking about the technology that he had developed. So a lot less dependency on manually gathered data and still generating really accurate outcomes. But again, getting back to that systems perspective. Not just looking at soil carbon, but let's think about this through the lens of the farmer… Like how does this relate to inputs? How does it impact productivity? Things like that. So that's where I've been really excited to kind of join this scaling team here.” - Nick Reinke Reinke shares that HabiTerre is collaborating with the National Association of Conservation Districts in creating field specific scenario modeling for what future soil health practices could produce. This “feedback loop” to farmers will serve as another “value added tool” for agronomists and advisors to use in order to support on-farm changes and practices. Furthermore Reinke breaks down the role agriculture plays in big corporations reducing their scope 3 emissions and why practices on the farm are of a great interest to them.  “Well, if you're gonna track progress, you're gonna need a lot better data, that's just logistically and cost prohibitive. It's very difficult for them to get. So we're trying to streamline that process. And the big thing that I don't wanna lose there is streamlining that process means more of these resources go to farmers…So if we make that quantification piece more efficient, that's more resources to farmers.” - Nick Reinke

ZOO LAWSUIT Howie put this together for me to recap the lawsuit we've had against Joe Exotic Schreibvogel.     2014-04-15 cv-14-377   Suit filed Defendants:   • Zoo 1, Zoo 2, Directors of Zoo 1 Reinke, Finlay, Corona, McAnallys • Shirley was later added as a defendant because tax return said assets transferred to her, she gave deposition saying they were not, she only owned land, and was dismissed. • Individual directors later dismissed to increase chances for Motion for Summary Judgment. Claims: • Fraudulent Transfers/Oklahoma Uniform Fraudulent Transfer Act • Successor Liability/Corporate Alter Ego • Individual Liability for Dissolved Entity's Debts (the five directors) Layman's Argument: Zoo 2 is really Zoo 1 and liable for the judgment. 2015-10 Mediation reaches settlement agreement, Lowe scuttles it following week. 2016-02-02 RULING: • Just before trial Zoo 2 consented to judgment leaving damages for court to decide. 2/2/16 J. Cauthron granted MSJ, set damages, entered an Agreed Judgment and Permanent Injunction against Zoo 2 in favor of BCR forbidding further transfer of assets. Basically rules Zoo 2 is Zoo 1 and liable for judgment. 2016-02-05+ Joe announces Zoo 3 will take over managing the zoo. Zoo 2 dissolved. 2016-02-13 Lowe forms (1) Zoo 3 LLC, (2) Big Cat Institute OK nonprofit, (3) GW Development LLC. 2016-03-04 Our Motion for Receiver 2016-03-10 Our Motion for contempt for violating injunction against transfer of assets 2016-03-10 Our Motion for Receiver Supplement: At court's request we submit supplement recommending Klingenberg be Receiver and advising court of Zoo 3. 2016-03-14 RULING: • Order for Receiver over Zoo 2 and Zoo 3 • Hearing to show cause re contempt for transfer   Lowe hires Ryan Leonard of Meyer, Leonard & Edinger where J. Cauthron's husband works so she recuses and case goes to J. Miles-LaGrange. 2016-03-21 Zoo 3 files to intervene and vacate Receiver 2016-09-07 Atty Leonard moves to withdraw. Denied two days later. Then replaced by Justin Meek and Melanie Christians. 2016-10-05 Court approves Receiver invoice for $50k and orders Zoo 3 to pay. 2016-10-20 Zoo 3 Motion to Intervene broadly 2016-12-08 Receiver Motion for Contempt for not paying $50k invoice and Motion for acceptance of 2nd invoice for $35k. 2016-12-16 Claims by Zoo 3: Zoo 3 Intervenes, asks for declaratory judgment that Zoo 3 not Zoo 2 and not liable for judgment, makes following claims: (I don't have this filing, info from ruling on our Motion to dismiss)   • wrongful receivership • abuse of process • tortious interference (based on contact with Travis Horn) 2017-01-17 Our Motion to dismiss Zoo 3 claims 2017-07-21 RULING: (On Zoo 3's Motion to vacate order for receiver and stay receivership) • Vacates order appointing Receiver • Grants stay of Receivership pending ruling on Zoo 3 motion • Requires Receiver & BCR return any property • Set hearing schedule on motion to appoint Receiver 2017-09-11 RULING: (On our Motion to dismiss their claims) • Granted re declaratory judgment but could amend, denied re other claims. 2017-09-22 Zoo 3 amends claim for declaratory judgment and adds LaWanna post to Travis Horn as evidence of tortious interference and adds claim for Defamation/Libel based on LaWanna post. 2017-10-06 Our answer to Zoo 3 claims and our Counterclaims: • Fraudulent Transfers/OK Uniform Fraudulent Transfer Act • Successor Liability/Corporate Alter Ego Layman's Argument: Zoo 3 is Zoo 2 2017-10-06 Receiver Motion for 3rd invoice $24k 2017-10-26 Zoo 3 Motion to dismiss our counterclaims 2017-10-26 J. Palk appointed and in November case transferred to him. 2017-12-01 Zoo 3 reply to dismiss our counterclaims 2018-07-11 RULINGS: • Zoo 3 in contempt for not paying first Receiver bill $50k. Hearing set Aug 28 but Lowe firing counsel 8/24 delayed.  29 days to obtain counsel and counsel will likely ask for time to learn case. • Receiver reinstated • Our Motion to add BCI and GW Dev granted • BCR owes 60% of Receiver 2nd & 3rd invoices minus few thousand related to contempt filings to be decided later. (Our part $33k) • Zoo 3 Motion to dismiss counterclaims denied 2018-08-17 Receiver Motion for amended Receiver order due to possible Fair Labor Standards Act payroll violations for minimum wage, record keeping, withholding, sales tax. 2018-08-17 Receiver 2nd Motion to find Zoo 3 in contempt, this time for Lowe/Lauren refusing to let them enter zoo without signing waiver the day before. 2018-08-17 Receiver 3rd Motion to find Zoo 3 in contempt, this time for failing to give access to bank accounts or turn over requested documents.   SHIRLEY LAWSUIT   2015-01-15 Bankruptcy Trustee lets Shirley buy land for $63k appraisal which limited the land value to this based on lease encumbrance. She uses $30k donation check to Zoo 2 signed over to her as part of payment. 2015-09 Shirley makes Lowe joint tenant on land. Deed. 2016-02-12 Shirley/Francis/Jeff quitclaim land to GW Dev LLC 50-50 ownership, Jeff Pres. Execute lease from Dev to Zoo 3 for $5500/mo. 2016-02-18 cv-16-155 Suit filed Defendants: Shirley & GW Dev (we may have amended complain to include GW Dev?) Cause of Action:   • Fraudulent Transfers/Conveyances – Actual Fraud • Fraudulent Transfers/Conveyances – Constructive Fraud • Constructive Trust • Equitable Lien Layman's Argument: Transfer of land from Joe to Shirley, transfer of Zoo checks, cash and physical assets to her name, use of Zoo 2 funds ($30k ck and more) to purchase land from Trustee all were improper acts to hide assets from us and we should have rights to all. Date? Our Motion for Summary Judgment Date? GW Dev Motion for Summary Judgment It was all champaign and brie tonight  to celebrate Shirley throwing Joe under the bus!  We submitted her admission that everything she and Joe and Jeff Lowe did was to defraud us from collecting on our million dollar judgment.  We presented her consent order to the judge but as of Dec 13, he hasn't ruled on any of the motions before him in any of the cases.

As a salesperson, you (hopefully) enjoy interacting with your prospects. However, a typical sales mistake is forcing the prospect to fit our communication style rather than the other way around. In today's episode of The Sales Evangelist, Donald is joined by the author of The Savage Leader and founder of Group Sixty, Darren Reinke, to discuss building rapport the way the prospect wants.  Sellers assume prospects like to communicate in the same style as the seller. Selling should start with the understanding that we're all different. Establishing that early on will impact your ability to build rapport. Some people might like starting with a conversation; others prefer to focus on the tasks at hand. We're all different. Get a sense of the customer's style by learning what motivates and drives them. Listen to the prospect and pay attention to their tone and how they conduct themselves to understand how to communicate. Three steps to learn a prospect's communication style: Intention: Have a willingness to change and do something different. Question if there are better ways to build rapport as a seller and think about the potential achievements. Reflection: Know what kind of seller you are and use that understanding to change your communication (when necessary.) Action: Analyze someone's body language, tone of speaking, and how they interact and put that change into play. A focus on the commission can ruin the relationship.  If you see someone as a dollar sign, you probably won't build rapport anytime soon. Ask prompts to directly understand the audience - How do you like to receive information? How do you want to communicate? Asking questions (and listening to the answers) will indicate how you can best communicate. Be more intentional with your questions. People will come back to the conversation repeatedly because they like talking to you. Less talking and more listening is the best way to build relationships. Darren's biggest takeaway?
