On 6th June 2023, the Nova Kakhovka dam was breached while under Russian occupation, releasing a wave of toxic pollution into Ukraine's rivers. The number of casualties – both human and animal – may never be fully known. Ukraine is one of a small number of countries to include ecocide in its domestic criminal code, and the destruction of Kakhovka Dam is one of hundreds of incidents that prosecutors are studying while building environmental damages cases against Russia. Stop Ecocide International‘s goal is to create a new international Crime of Ecocide (long-standing, wide-sclae, severe damage to the environment) within the jurisdiction of the International Criminal Court where it would sit alongside the crimes of genocide, crimes against humanity, war crimes and crimes of aggression as one of the “crimes against peace”, which are those crimes which are considered to be most serious by humankind. Sue Miller is Head of global networks where her distinctive role is to help seed and socialize the concept of “Ecocide” in as many communities as possible. Sue explains that when people are introduced to the term “Ecocide” and its meaning they can't believe that this doesn't exist anyway – that there is no law that protects earth from large scale damage already. So why do crimes against earth, which at the end affect every single one of us, take much more hard work and push to be acknowledged as the crimes they are? Perhaps the lack of political will and the assumption that environmental protection will somehow detract from people's lives?   You will also find out what happens once countries decide to include Ecocide into their legislature and rules of law. Earlier this fall, three Pacific Island States – Vanuatu, Fiji, and Samoa – formally proposed adding ecocide as a crime that can be heard and punished by the International Criminal Court, which can currently try individuals for war crimes, crimes against humanity, genocide, and the crime of aggression.Any change to the ICC's Rome Statute, particularly adding a new international crime, would require a massive level of diplomatic coordination and negotiation. But the future crime might hold individuals criminally accountable for severe environmental damage, such as massive oil or chemical spills or the destruction of rainforests. In the meantime, what does the ecocide proposal mean in practice? How might it potentially impact our understanding of ongoing destruction of the environment and the role of international criminal law? Joining the show to unpack the ecocide proposal are Naima Fifita, Rebecca Hamilton, and Kate Mackintosh.  Naima is a lawyer from Tuvalu. She is the Executive Director of the Institute for Climate and Peace. Bec is an Executive Editor at Just Security and a Professor of Law at American University. The heat within Earth's crust could become a major source of always-on, carbon-free, renewable geothermal electricity thanks to a technology developed for fracking that allows for much deeper drilling into hot zones. How a partnership between the oil and gas and geothermal industries could bring transformational change to the electric power sector worldwide.  Also, an explosion that spilled chemical waste into a river near the Russia-Ukraine border this August led to an ecological disaster with mass fish die-offs. Kyiv blames the Kremlin for a deliberate act of ‘ecocide' amid the war that started with Russia's 2022 invasion. And in addition to the retreat and collapse of huge ice shelves, climate change is associated with rapid greening in Antarctica as plants thrive in warmer temperatures. This month we are honored to be joined by Jojo Mehta from Stop Ecocide International, which is an international advocacy organization with the goal of making ecocide a crime. Jojo gives us insight into the continuous thread throughout her life that led her to this work. Her “outrage” moment was when she learned about fracking. Her work in the anti-fracking community introduced her to the late Polly Higgins, with whom she co-founded Stop Ecocide International. Jojo gives us insight into what kind of gross environmental harms which fall under the umbrella of ecocide. The Independent Expert Panel for the Legal Definition of Ecocide describes it as "unlawful or wanton acts committed with knowledge that there is a substantial likelihood of severe and either widespread or long-term damage to the environment being caused by those acts". This definition focuses on the potential results of the activity in question which creates a kind of reality check. It is not exactly what you do but how you do it, how much you do it, and where you do. It is any instance where the net results of what ones does results in gross damage to the environment. This would force this companies to look at their activities on the ground to assess their activities and whether they are at risk of committing ecocide through their activities. It won't come as a surprise to anyone who's paying attention, that Russia is suspected of deliberately leaking chemical waste into rivers. This has had deadly consequences already for wildlife within the waters and surrounding ecosystems. Can our national and international legal systems be harnessed in service of life, to put the brakes on the worst excesses of capitalism and slow the annihilation of our eco-sphere?  Stop Ecocide International exists explicitly to make this happen and this week, we talk to Jojo Mehta, co-founder and Executive Director of the movement. If we're going to stop capitalism's harms to the planet, we have to build road blocks into the current system that will be recognised by those who make the harms happen and one of the key ways to do this is to criminalise activities that are wiping out the future in real time - if we're using Joanna Macy's concept of the Three Pillars of the Great Turning, this is one of the most effective Holding Actions imaginable (the other two pillars are 'Systems Change' and 'Shifting in Consciousness', which we explore in many other episodes. Today, though, we're exploring this ultimate Holding Action and our guest is right at the forefront of this. Jojo Mehta is co-founder and Executive Director of Stop Ecocide International (SEI)  which she and the late pioneering barrister Polly Higgins (1968-2019) set up in 2017.  SEI is the driving force at the heart of the growing global movement to make ecocide an international crime. Their core work is supporting diplomatic progress and fostering global cross-sector support for this. To this end, they collaborate with diplomats, politicians, lawyers, corporate leaders, NGOs, indigenous and faith groups, influencers, academic experts, grassroots campaigns and individuals, positioning themselves with great clarity at the meeting point of legal evolution, political traction and public narrative. As a result, they are uniquely placed to track, support and amplify the global conversation. This conversation took us in many directions, exploring the legal implications of the law, but beyond it to the potential it has to counter the iniquities of the States Investor Dispute Settlements and how it could bolster Indigenous groups seeking protections for their ancestral lands.  We looked at the ways the law is being framed and where it and laws like it have already been enacted, how it's progressing in the International Criminal Court and what the ultimate aims are in using it as a deterrent, but also as a cover for those in the extractive, destructive industries - which, let's face it, is pretty much every industry - who want to act, but are constrained by their requirement to push always for profit regardless of the impact on people and planet.  Those who drive them may not care about the little people - you and me - but they care about themselves and if they face actual gaol terms, then their incentive structures become quite different. Strikes on Russian oil refineries have a significant impact on Russia's ability to conduct warfare. Lieutenant General Ben Hodges, Commander of U.S. Forces Europe in 2014-17, stated this during the 16th annual Kyiv Security Forum. “Of course, attacks on oil refineries have a significant impact. Russia is less able to pay for this war, and it also deprives it of the necessary fuel to continue hostilities. I would recommend ignoring the calls for an end to such attacks.” The Lieutenant General emphasized that sanctions against Russia need to be strengthened. He also added that 2024 will be the year of industrial competition. “Ukraine and the West should win this competition. I am talking about of course building up ammunition supplies, but also moving forward maintenance capabilities so that the Ukrainian soldiers can fix forward equipment that is broken or damaged on site, as well as increasing their ammunition stocks.” According to Hodges, Ukraine should put pressure on Russian logistics, particularly in Crimea, to make the peninsula unusable for Russian troops. “I would not expect a dramatic drop in Ukraine's ability to defend itself. The job of (new Commander-in-Chief of the Armed Forces of Ukraine) Syrskyi will be to stabilize the situation on the front line, but industrial competition will play a role here, while the Ukrainian army needs new units to ensure rotation”. ---------- Ben Hodges is a retired United States Army officer, who became commander of United States Army Europe in November 2014, and held that position for three years until retiring from the United States Army in January 2018.
