The Paychex Business Series Podcast with Gene Marks - Coronavirus
The number of federal Executive Orders issued by the president since Jan. 20 has created confusion for some business owners. Host Gene Marks moderated a webinar that produced additional questions from attendees, so he's using this episode of the podcast to offer clarification as well as his own take around the EOs on DEI. He talks about job postings, preferred gender pronouns on websites and in other company communications, “gender vs. sex”, the exclusion of impact on veterans, how these might affect EEO-1 reporting, and more. DISCLAIMER: The information presented in this podcast, and that is further provided by the presenter, should not be considered legal or accounting advice, and should not substitute for legal, accounting, or other professional advice in which the facts and circumstances may warrant. We encourage you to consult legal counsel as it pertains to your own unique situation(s) and/or with any specific legal questions you may have.
In this episode, Jen discusses why employers should update their EEO compliance training.
President Trump's two anti-DEI executive orders are temporarily blocked, but some employers are adjusting policies and shifting the way they collect workforce data. While critical obligations, such as EEO-1 reporting, remain in place, the EEOC's acting chair has indicated the agency will prioritize addressing race and gender discrimination and bias. In this week's episode, Epstein Becker Green attorneys Jill K. Bigler and Briar L. McNutt discuss how employers can balance compliance with federal, state, and international regulations while effectively mitigating risks. Fastest 5 Minutes, The Podcast Government Contractors Can't Do Without
This week's episode covers initial thoughts on what contractors can expect from the Trump administration, an interim rule to clarify that an offeror's failure to maintain SAM registration during the period between proposal submission and contract award does not render the offeror ineligible for award, an OFCCP notice giving contractors the opportunity to object to release of Type 2 EEO-1 reports, and a proposed rule that would expand the application of the “Rule of Two” to require federal agencies to give preference to small businesses on multiple‑award contract task and delivery orders, and is hosted by Peter Eyre and Yuan Zhou. Crowell & Moring's "Fastest 5 Minutes" is a biweekly podcast that provides a brief summary of significant government contracts legal and regulatory developments that no government contracts lawyer or executive should be without.

Mike Ferguson in the Morning 10-01-24 Wilson Freeman, an attorney with the Pacific Legal Foundation, talks about the FCC's proposal to require broadcasters to submit racial/gender staffing numbers for publication. Wilson calls it "DEI shaming. "In February 2024, the FCC resurrected a rule that's been dormant for nearly 30 years. The rule requires broadcasters with five or more employees to annually collect and publicly report information about their employees' race and sex. The FCC claims the rule aims to satisfy its own equal employment opportunity (EEO) reporting requirements. But the Equal Employment Opportunity Commission already maintains those records and is required to keep the information confidential. In reality, the FCC rule is a thinly veiled attempt to do indirectly what it may not do directly: pressure stations into race- and sex-conscious hiring practices." In this episode, Jen reminds us why EEO compliance training is not just something to cross off our “to do” list.
Today's guest is a widely respected government attorney, and my friend, Arlean Leland. She recently retired from an impressive Federal career, including more than two decades as Associate General Counsel for Civil Rights, Labor and Employment, at the powerful Department of Agriculture. Over the years her accomplishments brought many accolades, including multiple honor awards from both the USDA Secretary and the President of the United States. Arlean tells us about her life and career, starting with her modest beginning as the child of a teen mom. She describes how hard work, strong values and connecting with other people helped build her career. She says she knows what it's like to be the only person of color in the room, and that experience has strengthened her belief in never treating people as invisible. We discuss the crisis surrounding some DEI and EEO programs, and Arlean shares tips for creating inclusion and diversity policies that will make your team stronger. On this day in history, in 1991, Boris Yelstin was elected Russia's first popularly elected president. Boris Yeltsin, a Soviet and Russian politician, served as the first president of Russia from 1991 to 1999. Initially a member of the Communist Party, he later distanced himself from the party and aligned himself with liberalism and Russian nationalism. Yeltsin was born in Butka, Ural Oblast, and after studying at the Ural State Technical University, he worked in the construction industry. Rising through the ranks of the Communist Party, he became known as an anti-establishment figure when he resigned from the Politburo in 1987. In 1990, he was elected chair of the Russian Supreme Soviet and then as president of the Russian Soviet Federative Socialist Republic (RSFSR) in 1991.Yeltsin played a crucial role in the dissolution of the Soviet Union, leading to the establishment of the independent Russian Federation. During his presidency, Yeltsin pursued economic reforms that shifted Russia from a command economy to a market economy. This included implementing shock therapy, introducing a market exchange rate for the ruble, privatizing state-owned enterprises, and lifting price controls. Yeltsin was reelected in the controversial 1996 election, which was criticized for widespread corruption. While his presidency was marked by significant political and economic changes, it also faced challenges and criticism for its handling of reforms and corruption allegations.A white postal employee who sued the US Postal Service for race bias has lost the case. James Halbauer claimed that he was treated unfairly for wearing a MAGA hat while his fellow co-worker faced no consequences for wearing a Black Lives Matter hat. The court ruled that the Hatch Act, which restricts political activity for civil-service employees, played a role in the decision. The judge stated that the other employee's hat was not campaign-related but associated with a social movement, whereas Halbauer's MAGA hat violated the Hatch Act. Other claims of unequal treatment regarding dress code violations were also dismissed, as Halbauer failed to provide statistical proof or demonstrate suspicious background circumstances required for a reverse discrimination case. The court concluded that Halbauer didn't exhaust pre-suit remedies and didn't raise race discrimination in his internal EEO complaint.MAGA-Hat-Wearing White Postal Employee Loses Race Bias LawsuitLaw firm Greenberg Traurig and other major firms are shifting their focus to the growing private credit market as traditional M&A opportunities dwindle. Private debt has increased from around $300 billion in 2010 to approximately $1.5 trillion globally as of September 2022, with projections estimating it to reach $2.2 trillion by 2027. Private credit deals are gaining popularity as an alternative to traditional lending, given bank failures and stricter standards. Greenberg Traurig has been hiring lawyers specializing in private credit across multiple locations, recognizing the potential in this area. The firm attributes its long-term success to its early focus on private equity work, and it aims to follow the trajectory of the market by investing in private credit expertise. For the uninitiated private credit is a type of investment that involves lending money to private companies – that is, those that are not listed on stock exchanges. This asset class has been gaining popularity in recent years, as fewer companies have gone public and the number of private firms looking for capital has grown. Private credit can offer investors higher returns than traditional investments, but there are also some risks involved. In brief, these include transparency (you may not know what you are investing in) and illiquidity (you may have difficulty finding someone to buy shares you want to unload). Greenberg Traurig Eyes $2.2 Trillion Private Credit MarketThe IRS is changing its approach to target potentially abusive transactions by issuing proposed rules to identify them as listed transactions. This shift comes after court opinions ruled that the agency must follow the formal regulatory process with notice and a comment period. The proposed rules aim to address syndicated conservation easements, micro-captive insurance transactions, and transactions involving Maltese retirement plans. The Biden administration's unified agenda also includes proposed rules on charitable remainder annuity trusts and monetized installment sales. Listing transactions as suspect subjects them to additional reporting requirements, with penalties for non-compliance. The change in approach provides more transparency and ensures that court rulings do not hinder the agency's efforts to combat abusive transactions. The IRS is expected to continue targeting transactions involving promoters and heavy marketing in its enforcement efforts.IRS Shifts Tactics on ‘Dirty Dozen' Suspected Tax DodgesSVB Financial Group has filed a lawsuit against the U.S. Federal Deposit Insurance Corp (FDIC) in an attempt to recover $1.93 billion that was seized during the FDIC's takeover of failed Silicon Valley Bank in March. SVB Financial argues that the lack of access to these funds is hindering its reorganization efforts, and the money should be generating over $100 million in annual interest. The FDIC has stated that it can legally hold the seized funds while determining SVB Financial's share of the rescue costs, which the FDIC estimates to be around $16 billion. SVB Financial claims that the FDIC has not provided any specific claims to justify its refusal to pay despite having multiple opportunities to do so. In a separate ruling in May, a bankruptcy judge ordered the FDIC to return $10 million in seized tax refund checks to SVB Financial.SVB Financial sues US FDIC to recover $1.93 bln seized in SVB rescue | ReutersCalifornia Governor Gavin Newsom has announced that he will no longer fight against granting parole to Leslie Van Houten, one of Charles Manson's followers. The governor could have appealed the decision to the California Supreme Court but has decided not to pursue further action as it is unlikely to succeed. She hosts a podcast on Fire Engineering called "5 after Midnight" Stephanie and I talk about EEO in the fire service and how it falls short in the fire service. Although we follow the laws there are gray areas that EEO does not account for. As firefighters and officers we must navigate the gray areas. Strive to be good human beings and trust that each person on your shift has you back during an emergency. We discuss moving forward in the fire service and how to attract new firefighters of all sex, race and religions without having politicians change physical entrance requirements to achieve their vision of a diverse fire service. We close with being a mentor and leader for the next generation.

Lisa Fain grew up in a family of lawyers and while there was no obvious pressure, she ended up going to law school. She had envisioned a career in public interest law, but upon graduation, she had significant student loan debt which she wanted to clear before moving forward. Fortunately, Lisa was able to work in an area that interested her, labor and employment law, while squaring away her loan, working for a large law firm. She enjoyed counseling clients, using her negotiation and mediation skills while focusing on matters pertaining to EEO, diversity, and compliance. Yet, still, Lisa knew this was not the way she wanted to work. The turning point came after she had pulled an all-nighter preparing for a litigation case. She saw a blinking light on her phone indicating she had a voicemail. It was a message from her four-year-old daughter. She said “Mommy come home. We need a mommy, not a lawyer.” Lisa shared, “It was the worst best gift I ever got because I recognized that I wasn't living my values. Although I was doing great work, I wasn't able to be the kind of mother that I wanted to be.” Lisa left the large firm and transitioned to an in-house role at a company where she developed workplace policies, eventually focusing on diversity, equity, and inclusion. She loved the work and demand across the company grew. Lisa was asked to create a mentoring program so she reached out to Lois Zachary of the Center for Mentoring Excellence to provide consultation on how to set it up. Full disclosure: Lois is Lisa's mother! Fast forward to today: Lisa is the CEO of the Center for Mentoring Excellence. She is a global speaker with expertise in cultural competency and mentoring. Her passion for diversity and inclusion fuels her conviction that leveraging differences creates a better workplace and drives better business results.
