In his role as President, Col Christensen appeared regularly in broadcast and print media to advocate for the rights of crime victims, including appearances on CNN, CBS, NBC, ABC, MSNBC, Fox News, and the BBC, in addition to the New York Times, the Washington Post, the Los Angeles Times, USA Today, Time, and Newsweek. During his time with POD, he testified numerous times before Congress on the need to reform the military justice system. His advocacy was critical to the passage of the most significant military justice reform in at least 70 years in 2021. He also served as pro bono attorney for victims of military sexual assault in EEO complaints, and lawsuits under the Federal Torts Claims Act and as a special victims counsel. He served as chief prosecutor for the United States Air Force between 2010 and 2014. He served as a trial counsel, defense counsel, or military judge for every year of his 23-year career in the United States Air Force.Christensen has served as an Assistant Staff Judge Advocate, Area Defense Counsel, Circuit Defense Counsel, Deputy Chief Circuit Defense Counsel, and Deputy Staff Judge Advocate, as a deployed Staff Judge Advocate, Chief Circuit Trial Counsel, and Staff Judge Advocate, and as a Military Judge. The architect of the Marquette University Law School polls, Dr. Charles Franklin joined, to talk about his creation, how its evolved and some of its latest findings, including the 2024 presidential election and the Wisconsin Supreme Court. Franklin is a Professor of Law and Public Policy, as well as the Director of Marquette Law School Poll. We were also joined by UW-La Crosse political science professor, Dr. Anthony Chergosky. Chergosky began the show talking a bit about the latest Marquette Law poll and how polls have changed. That conversation, of course, continued with Franklin throughout the show — how the questions are created and how the information is gathered from the public — phone and online. Franklin told an interesting story on how the poll began in 2012, and how it may not have become as popular as it has, if the politics at that time had not been the way they were. We then got into a conversation about the 2024 presidential election — and what the poll numbers show a year away from the election. Went down multiple rabbit holes Friday with UW-La Crosse political science professor, Dr. Anthony Chergosky in regards to Joe Biden being on the 2024 ballot, the Marquette U poll being trusted and how to stay nonpartisan. The first rabbit hole was about Green Party candidate Jill Stein announcing a 2024 presidential run, where she's been for the past seven years and where a candidate needs to start to run for office. It stems from Eric Wilson, on La Crosse Talk PM the day before, running for US House in the 3rd District with no prior experience. After that we talked about the Wisconsin state Legislature's, what I like to call cram session, where a hundred bills get passed and the public can't keep up. But we contrasted that with the very public way the $517 million Milwaukee Brewers stadium deal is being handled in the public's eye. After that, we discussed how Chergosky has to walk the line of non-partisanship. That conversation began with polls, including the Marquette University Law School poll — how it's one of the most trusted — and how else we could get the public's take on issues — like polling the Joe Rogan podcast audience. Also, we discussed polling on the 2024 presidential race and — at the end of the show — whether we should be voting for judges. In this episode, Amy interviews Andrea Kupfer Schneider, Professor of Law and Director of the Kukin Program for Conflict Resolution at Cardozo Law. Professor Schneider was the previous director of the nationally ranked ADR program at Marquette University Law School in Wisconsin, where she taught ADR, Negotiation, Ethics and International Conflict Resolution for over two decades. In addition to overseeing the ADR program, Professor Schneider was the inaugural director of the university's Institute for Women's Leadership. In 2009, Professor Schneider was awarded the Woman of the Year Award by the Wisconsin Law Journal and the Association for Women Lawyers. She was named the 2017 recipient of the ABA Section of Dispute Resolution Award for Outstanding Scholarly Work, the highest scholarly award given by the ABA in the field of dispute resolution. Professor Schneider has published numerous articles on negotiation, plea bargaining, negotiation pedagogy, ethics, gender and international conflict. She serves as the co-editor of the ABA Dispute Resolution Magazine and on the Board of Advisors for the Saltman Center for Conflict Resolution at UNLV School of Law. She is a founding editor of Indisputably, the blog for ADR law faculty, and started the Dispute Resolution Works-in-Progress annual conferences in 2007. In 2016, she gave her first TEDx talk titled Women Don't Negotiate and Other Similar Nonsense.

Where were you on April 20th, 1999? Many of us watched in horror that day as the news unfolded about of the Columbine School shootings. At the time I was working for a police psychology private practice about two miles from Columbine. What many don't know about me is that before my brother died, my area of expertise was violence prevention because of this tragedy and our group's response. In the wake of the Covid-19 pandemic, five U.S. jurisdictions opted to suspend their July 2020 bar exams. Instead, these jurisdictions granted licensure to new attorneys through "diploma privilege.” That's the practice of admitting new attorneys to the state bar, and allowing them to practice law, contingent on their graduation from an ABA-accredited law school only. It does not require taking and passing a bar exam. Wisconsin is currently the only state to permanently offer diploma privilege, and it is only available to graduates of its two in-state law schools, Marquette University Law School and University of Wisconsin Law School. Critics of the bar exam have long argued that a timed test, based on short-term memorization of how to apply a vast amount legal rules, is not a true measure of legal competency. And now, with a string of remote testing snafus during the pandemic, many in the legal community are asking whether diploma privilege is a better option. Standing in the way of these fundamental changes are many state supreme courts and bar associations who have authority over who can practice law in their jurisdictions. Additionally, those opposed to diploma privilege argue that, whether it's accounting, medicine, or law, licensure exams are there for a good reason—to protect the public from incompetent practitioners. Remember to rate and review GTP in iTunes: Click Here To Rate and Review Episode Details: Two-time Wisconsin Association for Justice Trial Lawyer of the Year Award winner Timothy Trecek of Habush, Habush & Rottier S.C. shares how he successfully represented Edward Vanderventer, Jr. and his wife Susan after Edward was rendered a paraplegic following a traffic accident due to a seatback defect in the 2013 Hyundai Elantra. In July 2015, Edward was driving a Hyundai Elantra when he slowed down to make a left turn and was hit from behind by a 17-year-old driver. Upon impact, Edward's headrest flew backwards into the back seat and the headrest guide poles within the seatback deformed toward his spine. The headrest guide poles separated his spinal column, rendering him a paraplegic. Despite Hyundai's attempts to blame Edward's spinal injuries on the rear-end crash and a degenerative spinal condition, the Racine County, Wisconsin jury found Hyundai negligent in the design and testing of the driver's seat. In February 2020, the jury awarded $38,164,263 in damages to Edward and Susan Vanderventer, resulting in the largest single plaintiff compensatory award in Wisconsin history and a landmark victory for Timothy Trecek in the same courtroom where he experienced his first trial victory as a high school mock trial attorney 36 years earlier. Click Here to Read/Download the Complete Trial Documents Guest Bio: Timothy Trecek In 2020, as lead trial counsel, Tim Trecek obtained a $38.1 million verdict against Hyundai Motor Company, for a defectively designed seat back and head restraint system in his client's 2013 Hyundai Elantra (see news story). The verdict is the largest single plaintiff compensatory award in Wisconsin history. The verdict included $7.77 million for the plaintiff's spouse, another record for Wisconsin verdicts. Based on the significance of his 2020 verdict, Tim was honored to receive the Robert L. Habush, Trial Lawyer of the Year Award, the second time being recognized with said award (read acceptance speech). He was also awarded The Litigation Counsel of America's Tommy Malone Outstanding Verdict Award, an honor bestowed upon one attorney in the US whose verdict is extraordinary in amount or significance. Tim is the Vice President, Chief Operating Officer (COO) and Secretary of Habush Habush & Rottier and has been a member of the law firm since 1995. He is a managing partner of both the Milwaukee and West Bend offices. Tim specializes in all types of personal injury litigation. He has successfully litigated cases involving automobile defects (airbags, seatbelts, seats and structural integrity), construction accidents, mis-filled prescriptions, car/motorcycle accidents, truck/semi accidents, slip/trip and falls, dog bites, injuries involving horses, brain injuries, RSD (reflex sympathetic dystrophy), machine defects (saws, chippers, cement mixer defects, deer stands, snow blowers), child car seats, personal watercraft, and specialized experience with serious burn injuries from events such as explosions and utility/electrical accidents. It also makes Tim the only attorney in Wisconsin to have four multi-million-dollar recoveries against the State's largest utility. In 2011, the Wisconsin Association for Justice selected Tim as the annual recipient of the prestigious Robert L. Habush Wisconsin Trial Lawyer of the Year Award for the first time (read acceptance speech). Additionally, he was named as one of Wisconsin's Leaders in the Law in 2008 by the Wisconsin Law Journal. In 2013 Tim was accepted as a Fellow in the prestigious American College of Trial Attorneys, one of the youngest recipients of this venerable honor. To me, it’s like they’re beating their heads against the wall,” said Harry Rose, a 78-year-old retired factory worker and Trump supporter in Racine County, a swing county in the swing state of Wisconsin.Nicole Morrison, a 36-year-old nurse who can’t see herself voting for Trump in 2020, had a similar review.“There’s so much information that sometimes it’s hard to decide which is the truth and which is just rumors,” she said. “So I just don’t pay attention to it.”After 30 hours of televised hearings, a dozen witnesses, at least a couple of major revelations and scores of tweeted rebuttals, voters in Wisconsin and nationwide aren’t changing their minds about removing the Republican president. If they came into the inquiry defensive of Trump, they likely still are. And if they were inclined to think the president abused his power, they didn’t need televised hearings to prove it.“For the most part, most Americans already have pretty solidified views of the president,” said Josh Schwerin, senior strategist for the Democratic super PAC Priorities USA. “There’s a small segment of the population that can be moved, and they’re not paying as close attention to the day-to-day ins and outs of the impeachment hearings.”It’s a disappointing — if not unexpected — response for Democrats, who had hoped to use the hearings to sway public opinion. Without that backing, it’s virtually impossible to imagine Republican senators voting to convict Trump.It’s also a reaction that leaves the political impact of this dramatic chapter in American history remarkably uncertain. If the division on the question holds, and independents remain disengaged, it is possible that impeachment and Senate trial may ultimately play little role in Trump’s reelection bid next year.Two polls released this week showed the public remains roughly evenly divided over whether Trump should be impeached and removed from office. Although there was a one-time increase in support after the inquiry launched, polls have since remained stable.A CNN survey conducted over the weekend showed that 50% of Americans believe Trump should be impeached and removed from office, roughly the same as in late October and in late September. Meanwhile, Trump’s job approval has remained steady. A Quinnipiac University survey of registered voters nationwide also conducted this past weekend found a similar split on whether Trump should be impeached and removed, and just 13% of those who have an opinion say they might change their mind.In Wisconsin, views on impeachment appear to be slightly more negative. A Marquette University Law School poll of Wisconsin registered voters that was conducted during the first week of the impeachment hearings showed 47% of registered voters approve of the job Trump is doing, and more expressed opposition than support for impeachment and removal, 53% to 40%, figures largely unchanged from October.The poll was conducted before U.S. Ambassador to the European Union Gordon Sondland and former top aide Fiona Hill offered testimony that largely corroborated allegations that Trump tried to pressure a foreign government into investigating his political rival Joe Biden.The entrenched divisions are clear even in Racine County, a place with a history of shifting political winds. The county voted for Democrat Barack Obama in 2008 and 2012 and then swung to support Trump in 2016.The county, just south of Milwaukee, is divided between the Democratic-leaning electorate in and surrounding Racine, and the more conservative electorate in the rural and suburban areas. Most of the county’s residents worked white-collar jobs in 2019, like administrative services and sales, and the median household income was just under $65...

In this episode, Bruce Boyden, Associate Professor of Law at Marquette University Law School, discusses his article "Daly v. Palmer, or the Melodramatic Origins of the Ordinary Observer," which was published in the Syracuse Law Review. Boyden's article was part of the "Forgotten Intellectual Property" symposium sponsored by Syracuse Law School. He observes that the Daly v. Palmer case provided the standard for copyright law's "ordinary observer" test for infringement for quite some time, until it was supplanted by Arnstein v. Porter. Justice Brennan’s 1977 article “State Constitutions and the Protection of Individual Rights,” provoked many litigators to look to the state courts to enhance individual liberties beyond the scope of the federal constitution. This came at a time when the conservative legal movement developed out of a perception that the Warren Court and its successors had gone too far, with courts holding an influence far too powerful in American life. They called for a more restrained view of the judicial role, while those on the left looked to state courts to assert their role in protecting individual rights. This sparked a New Federalism that embraced more active and robust efforts to achieve litigation-oriented outcomes through state constitutional litigation. In recent years, many in the conservative legal movement have also come to embrace state constitutions as separate documents that best protect both individual and economic liberty. Update: Brendan Dassey, nephew to Steven Avery, the primary defendant from the "Making a Murderer" series on Netflix had his conviction for murder, rape, and mutilation of a corpse overturned by U.S. Magistrate Judge William E. Duffin of the US District Court for the Eastern District of Wisconsin last Friday. This episode was recorded shortly before the development. Back on October 31st of 2005, a young photographer named Teresa Halbach went missing. Teresa’s last meeting had been with Steven Avery, on the grounds of Avery's Auto Salvage in Manitowoc County, Wisconsin. Teresa’s remains were later found on the grounds of Avery’s home and family business. Avery was well known to law enforcement and had previously served a lengthy prison sentence for rape and attempted murder from which he was later exonerated on DNA evidence. What transpired inspired the extremely popular Netflix series “Making a Murderer,” directed by Laura Ricciardi and Moira Demos. The series spotlights Steven Avery and his quest for justice after claims that he was wrongfully accused in the murder of Teresa Halbach. In 2005, Steven Avery was arrested for the murder of Teresa Halbach, and was ultimately represented by Wisconsin attorneys, Dean Strang and Jerry Buting. Strang and Buting presented their case and their defense strategy, bringing to light alleged tampering and planting of evidence by police. After a whirlwind of a trial, the verdict came back guilty, sending Steven Avery to jail for life without the possibility of parole. As Steven Avery sits in jail, a new attorney has taken over his case and Steven hopes for a new trial and maybe one day his freedom. On this special episode of Lawyer 2 Lawyer, host Bob Ambrogi joins Dean Strang, former defense attorney for Steven Avery, and Peter Linton-Smith, a former television news reporter who covered the Avery trials, as they discuss the popular Netflix series, “Making a Murderer.” Dean and Peter offer inside perspectives and get the latest on Steven Avery and his quest for a new trial and justice under a new attorney. Dean Strang is a lawyer in Madison, Wisconsin, at the firm Strang Bradley, LLC. Mr. Strang is a member of the American Law Institute and serves on several charity boards, including the Wisconsin Innocence Project. His second book will be published in early 2018. Peter Linton-Smith was a television news reporter for 24 years covering primarily courts (1988-2012). Peter has covered cases ranging from first degree murder, wrongful death, products liability, copyright dispute, employment and labor disputes. Peter has covered Steven Avery, both his civil and criminal case from 2003-2007. Peter is currently employed at Leventhal & Puga in Denver, Colorado. Today we travel to a future without lies. What would it be like if we all wore accurate lie detectors around all the time? In this episode we talk about when children learn to lie, the different social functions of lying, and what might happen if we couldn’t ever fib. How would negotiations be different? How would we make small talk? Could we create art or music? All that and more in this week’s future. This week’s show features four experts in the different facets of deception. Patti Wood is an expert in detecting non-verbal cues. She told me about her work, and the ways she uses body language to try and tell if someone is lying. Maria Konnikova is a journalist and the author of a book called The Confidence Game, all about con artists and people who are really good at lying. She says that while many of the people her book is about would have been thwarted, there would be serious downsides to not being able to lie to one another. Michael Lewis has studied lying and childhood development for over fifty years, and he says that children learn really early on that lying is something they should be doing. And Andrea Kupfer Schneider is a professor of ethics and dispute resolution at Marquette University Law School. She says that without the ability to lie, negotiations would actually be way better. Right now there are tons of different technologies and methods that try to detect lying, which range from imperfect to totally bogus. According to the American Psychological Association polygraph tests, the lie detector setup you see in movies and TV all the time, don’t accurately tell if someone is lying. There’s also a device called a voice stress analyzer — what it does is listen to your voice and try to detect signs of stress, which suggests that you might not be telling the truth. But according to a study done by the National Institute of Justice, voice stress analyzers are often no better than chance at detecting lies. Of course, that hasn’t stopped some places from using them surreptitiously during phone interviews. There are also all kinds of drugs that attempt to make people tell the truth. These are staples of movies and television shows, but like most things they don't work as well as they do on TV.
