[3:24] It is October; it's cybersecurity awareness month in the U.S. and several other areas of the world and that's why I'm so excited to introduce our guest, Pamela Hans, managing shareholder of the Philadelphia office of the law firm Anderson Kill. She focuses on insurance coverage, which includes cyber. [3:45] We're going to talk about cyber trends. I met Pamela at the RIMS Canada Conference in Ottawa last month where she was delivering a session on “Getting the Deal Done.” We're also going to hear her tips on how to handle the curveballs that might be thrown at you ahead of a live presentation and how to turn them into opportunities. [4:16] Justin met Pamela Hans of Anderson Kill on the last day of the RIMS Canada Conference 2023 when she was hosting a session. Pamela knows cybersecurity and October is National Cybersecurity Awareness Month in the U.S. [5:57] The trend of the phone calls Pamela gets is all about ransomware. A threat actor freezes up the system, completely takes control, and demands a ransom in return for a description key. But the trend in cybersecurity is data breaches to steal personal data. Recently Topgolf, Freecycle, Forever21, Duolingo, and Discord.io suffered breaches. [6:41] Those are just a few examples of cybersecurity incidents where personal sensitive data has been grabbed by the threat actor, with threats to use the data to do more damage to the individuals whose data was taken. [7:03] Pamela has also seen distributed denial of service attacks. The army of bots seems to be increasing in number while the cost is decreasing to rent a bot to execute a distributed denial of service attack. [7:50] When there is an exfiltration of personal data, that data can be used by the threat actor to do more damage to the individuals by impersonating the user and fraud. [8:29] Pamela addresses the SEC rules on the disclosure of cybersecurity events and the annual obligation imposed on publicly traded and registered companies to disclose their cybersecurity governance. That has an impact on the company and its stock price. The public may then decide which companies to trust by their cybersecurity protocols. [9:30] Justin refers to the RIMScast episode with Hilary Tuttle on the SEC cybersecurity reporting rules. They discussed the four-day reporting rule. Four days after the company finds out they were attacked in a material fashion they have to report the breach. [10:09] Pamela notes that a material breach is one that investors would want to know about before investing in the company, as the breach may affect the value of the stock and the company. This is an important SEC rule on cybersecurity governance. [11:41] Risk professionals should be asking questions about this rule now. Prepare to make these required reports. Run tabletop exercises with your response team. Ascertain now what “material,” in the cyber context, looks like to your company. Getting ready now is important, for when you experience a cybersecurity event. [13:23] Pamela speaks about the need for cybersecurity awareness. Any individual can be the gateway to a cybersecurity event. Everyone who has a device needs to be aware of cybersecurity risks to help prevent infiltration by cybercriminals of our phones, laptops, and businesses. [14:54] Cybersecurity is as simple as multi-factor authentication. Don't give away your passwords. Be thinking about cybersecurity, Don't click on the puppy dog. [18:36] Pamela reviews her career path, with degrees in civil engineering and then law school. She knew she wanted to solve technical problems for companies. Cybersecurity is a natural fit for her background. Cybersecurity is everywhere. [21:07] Pamela foresees two things from these new reporting rules. One will be SEC subpoenas to companies for information about their cybersecurity reporting and governance. Another will be shareholder scrutiny and lawsuits around failure to disclose or poor evaluation of materiality. The rule is self-enforcing through shareholder suits. [22:35] Pamela predicts we'll see more D&O coverage activity because of this rule. Risk professionals need to be looking at that when renewing or placing new D&O coverage, asking their brokers about the impact of the new SEC requirement around disclosure and materiality. Risk managers will need to explain this if there is a subpoena or claim. [23:52] Risk managers also need to be thinking of looking across the entire insurance program, to see which insurance policies may respond in the event of an SEC subpoena or a claim related to disclosure. Now is the time to prepare for what may be coming. [24:40] Pamela says risk professionals need to ask their insurance broker what is new in their policy since last year. Are there new endorsements or policy language? New policy language or endorsements for 2024 will be enormously important. Risk managers should also run tabletop exercises with the insurance pre-approved response team. [26:53] Risk professionals should look at your policies now to see what policies will respond if you have an SEC claim and what the policy limits are. Your policies need to be on paper, not on your computer network, and not named “Cyber Policy 1,” or “Cyber Policy 2,” where threat actors can find and read them on the network. [33:58] You have tools as a risk professional to deal with risk transfer provisions you might not want. The session talked about how to make insurance work for you in this context and how to indemnify a counterparty that is 10,000 times larger than you. How can your insurance respond to make these provisions opportunities, not deal-breakers? [35:03] People left the session with ideas about what to ask their insurance broker and the business side, to know what they should be ready for. [36:09] Pamela was scheduled to present with two co-presenters but neither of them could attend. For Pamela, it was an opportunity to have fun with the people who were in the room. Presentations are better when they are conversations with the people in the room. It was terrific! This week we talked to the seasoned Quantity Surveyor Millie Lucas about the role of a QS in a renovation or extension project and what lessons we can learn from her years in the construction industry. We start by learning that we are all capable of making minor omissions in the project but they can have expensive consequences! The devil is in the detail and never take something just on word alone. Millie describes how the Quantity Surveyor is the ‘purse strings’ of a project and they are obligated to work to get the best value for their client during the ‘Buy It’ Stage. We go through the reasonable level of information to receive from your contractors Quantity Surveyor and Millie reminds us if there is no programme then it is likely that the costs have not been calculated accurately. We discuss the use of Gumtree (https://www.gumtree.com) , Freecycle (https://www.freecycle.org) and NextDoor (https://nextdoor.co.uk) to sell ‘left over’ materials, but we also talk about how to avoid this in the first place! Millie spills her secrets on getting the best price through shopping around, going straight to the manufacturer and if possible getting your contractor to purchase it, as they might well have much stronger buying power than you. And watch out for those fancy showrooms as that fancy thick brochure and free drinks are being added onto the cost of your product! We cover What Value Engineering is, which is an elegant way of saying cost saving. Millie tells us there are 3 fundamental ways to Value Engineer: assess if there is a better cost method of installing the item, a different and lower priced product or a reduction in the finish to a cheaper specification. BUT Millie reminds us that we need to have conversations with the people we are doing the project, your partner or other home users. The value engineer options are easy to come up with but, unless you know what each uses ‘need to and nice to’s’ are for the home design, you might cut something which you later lead to regret. We are trying to design happiness, not anger and animosity! And remember, if you find that the project value is simply more than you can afford, even after value engineering, it isn’t that your dream won’t happen, it is just postponed until you can save the funds. We’re moving into the home renovation season. The National Association of Realtors and National Association of the Remodeling Industry | NARI conduct value studies and have found that a homeowner will get back 50 cents on the dollar for a kitchen remodel. So a 10k kitchen redo will increase the value of your home $5900 at best. The return on adding a master bedroom suite also yields around half. What does pay? Hardwood flooring, HVAC updates and insulating come close to recovering costs. Clark’s simple rule: The reason you renovate or add on to a home is enjoyment. Don’t con yourself into thinking you’re investing for a positive return in cash. People are stretching their dollars by taking advantage of how much things depreciate from new to used, particularly in the area of high end women’s clothing. Nordstrom is now actively selling used clothes, joining Macy’s and others. Independents include ThredUp, and TheRealReal. How You Can Make Money With A Podcast That Is Free – Episode 167 One of the most popular and controversial questions in our industry is, “How do I make money with a podcast?” The question is popular, because many podcasters hope to monetize their content. That desire ranges from simply covering the costs associated with producing the show to making more than an average annual salary each month. Earning money with an online business is a desire of many budding entrepreneurs. Podcasting is a great way to begin sharing your message. The controversy arises between those who want to make money and those who see it as a hobby where profit is unnecessary. The fans of the hobbiest approach often wonder why people think it is so important to make money with your show. Making money isn't necessary. It also isn't evil. Both sides of the debate can be correct. It is all about your point of view. THE POWER OF “FREE” Today, we are taking the monetization route. Much of the information I want to share with you on this episode is derived from a great book called “Free: The Future of a Radical Price” by Chris Anderson. The show is beginning to attract an audience. How can we turn this great podcast into a business? First, let's make one thing clear. As you develop your podcast, understand that it is difficult to have the show itself be your sole source of revenue. Sponsorships and donations can only take you so far. Your inventory and sources will be limited. Making your podcast your lone revenue source is possible. However, it is limited to the biggest of the big podcasts. Most podcasters needs another revenue stream. How do we create other streams of income using our podcast? STREAMS OF INCOME We need to be creative. Once we start creating some unique ideas, you will see many others begin to open for you. In this episode, we are going to devise various opportunities to generate revenue using your free podcast. Each of these ideas uses a different approach. You can tailor each approach to your niche and passion. The foundation of the book “Free: The Future of a Radical Price” centers on using a free product or service to create demand for a paid product or service. The concept is similar to the lead magnets you see quite often in online business. You are producing a podcast that is free for your listeners. How can we use that free product to create demand for a paid product or service? We are not going to cover all of the ideas in Anderson's book. There are 50 different business models. We will only review part of one section. You can find all of the ideas in the book using the link. Bad habits Same old routines- If they're not working for you it's time to let them go Work situation: If you're ready for a change than check out Dan Miller's 48 Days Podcast Stop Letting Others Dictate How You Use Your Time: DVR your shows or "cut the cord" and watch online on sites like iTunes, Hulu, Netflix, in the US. Outside the US, just Google TV Steaming sites to find those available in your area, such as the BBC's iPlayer. Don't forget to check your local network sites to see what streams they offer, too. Another way to control your own time is to: Choose Podcasts over radio. Podcasts allow for time shifting your favorite content. You can listen to podcasts as your walk, run, work, commute, travel, do chores…whenever you want? Break free of the 10 to 20 minutes per hour devoted to advertising on commercial broadcasting stations. iTunes University has free college-level classes, tying into the education suggestion mention earlier.
We all know that clutter is a part of life for many of us. Further, some clutter is natural and manageable. But, at some point the clutter is apparent and stymies your productivity. So, let's kick-start your decluttering process with learning where clutter lives and a few tips on your way to what I'm calling, Hardcore Decluttering, a regular series of podcasts here on ProdPod. The idea is to take two minutes to reduce your clutter for dramatically beneficial outcomes![image: Venn diagram of physical/psychic/digital-->center area: Hardcore Decluttering]PHYSICALLet's start with the easiest clutter to identify, the physical stuff hanging around your home, office, carrying bags (such as a briefcases, shoulder bags or purses), and the car. One way to help you make headway on physical clutter is by calculating its worth (or, rather, its cost to your bank account annually). So, what's the monetary value of your stuff? Create a spreadsheet or just make a paper list and start tabulating the cost of storing it in your home, storage or elsewhere? Every cubic square foot has a cost per year that's being eaten up by clutter; measure it and add the space to your spreadsheet. Next, how much did you pay for all that stuff? What's its market value today? Find those out and add them to your data. Add this information to the reality that this clutter is depleting your emotional reservoir of good feelings. Ready to start selling and donating and trashing that stuff now? Great! So, head to Craigslist.org for your nearest locality, sign up to give stuff away on Freecycle.org and Google your nearest Salvation Army or Goodwill store to see what you have that they might be accepting. This led to some discussion later in the show about electricity and coal. Our Sleeping Naked is Green segment was all about community sharing, borrowing and bartering. Lots of discussion about ecovillages and other ways we can share books and everything! Our feature interview was with Philip Campbell, who is visiting Austin, TX from the UK to be at the SXSW Eco event. He gave a great report (even though the audio was pretty rough from the phone he had to borrow to be on the show with us). It's worth listening to because he talks about his new Living Ark Project, where he will be going into the forest and living in an eco-pod with his 4-year old daughter for a year!
