Bryan Daniels, the President and CEO of the Blount Partnership – Incoming IEDC Board chair, joins Dennis, and they discuss what is ahead for the economic development profession and IEDC in 2025. Bryan Daniels was born and raised in Greeneville, Tennessee, which is adjacent to Cherokee National Forest. He has a Bachelor of Science Degree in Communications & Computer Science and a Master of Science degree in Manufacturing Engineering Technology from East Tennessee State University. Bryan began his career with the Tennessee Department of Economic and Community Development based in Nashville, Tennessee. Mr. Daniels left the State of Tennessee in 1997 and begun work as an Economic Development Planner for the firm of Barge Waggoner, Sumner and Cannon based in Nashville, Tennessee. During this time Bryan worked with several communities within East Tennessee and Southwest Virginia. His clients were municipalities trying to develop their local economies and seeking state and federal support for their goals. From 2001 thru 2010, Bryan accepted the role of Executive Vice President under the Blount Partnership. He was directly responsible for the Economic Development offices and staff located in Maryville, Tennessee; Munich, Germany; and Yokohama, Japan. Bryan managed the operations of the community's four industrial parks, two science/technology parks, and the Economic Development Programs for Blount County, City of Maryville, and City of Alcoa, Tennessee. The Economic Development Board is one of the four partner agencies of the Blount Partnership. In 2010, Bryan was named President and CEO of the Blount Partnership. The Partnership is comprised of The Blount County Chamber of Commerce, Blount County Economic Development Board, the Smoky Mountain Tourism Development Authority, and the Blount Chamber Foundation. The 24-person staff is responsible for all economic development activities within the jurisdictional boarders of Blount County and the cities of Alcoa, Maryville, Townsend, Rockford, Friendsville, and Louisville. During Bryan's tenure, Blount County has recruited over 75 new and expanding companies in the areas of research & development, corporate headquarters, manufacturing, and back-office support centers. The total capital investment of these companies has exceeded $4 billion dollars and created more than 12,000 direct new jobs with average wages above Tennessee's average. The Blount County local governments adopted the new tourism authority structure which was written by Bryan and former Senator Doug Overbey. The authority was unanimously adopted by the 107th Tennessee general assembly. Bryan has continued his professional education by graduating from the Economic Development Institute located at the University of Oklahoma and is a Certified Economic Developer (CEcD) from the International Economic Development Council. Bryan is also a graduate from the US Chamber's Institute of Non-Profit Management and attained the designation of IOM. He has also attained the status of Certified Chamber Executive (CCE) from the American Chamber of Commerce Executives. The Blount Partnership is a five-star accredited Chamber of Commerce by the U.S. Chamber of Commerce and is the only Accredited Economic Development Organization (AEDO) by the International Economic Development Council in the state of Tennessee. Lonely employees are less productive and more expensive, while socially connected people contribute to the economy and are better brand ambassadors. IT TAKES A LOT TO GET JEWS TO SHUN DEMOCRATIC CANDIDATES, so says writer for the New York Post, Adam Brodsky.It does take a lot, for traditionally, most Jews vote democratic, so say the polls. But that is changing, changing more so every day and finally for the right reasons. Far too many democrats, and democratic candidates for office are anti-Israel and consequently, more or less, antisemitic. No matter what they say, their actions speak louder than words.So many today are pro-Palestinian, and consequently, anti-Israel, and as a result of that, anti-Jewish, antisemitic. The protestors demand that the United States not support Israel, not provide it with foreign aid, weapons, or justification, or defense of any kind. These protestors have no problem with present day Israel becoming the homeland of the Palestinians, even if Israelis are located or even extinguished. Jihadist radicals have no problem with that, and in fact, that may be their goal, for the motto is:EVERY JEW IN ISRAEL BURRIED AT THE BOTTOM OF THE MEDITERRANEAN!Israel has a population of approximately 7,250,000 people, which is less than the population of New York City, and a good many of them are not Jewish, but Arab or otherwise. The land of Israel is 8,000 sq. miles. It is 263 miles from north to south, and 71 miles at the very widest part, and only 6.2 miles at the most narrow. Israel, all of it, is approximately the size of the state of New Jersey. By contrast, surrounding nations, mostly Arab and Muslim, are huge in size geographically and in terms of population, and include Syria, Lebanon, Jordan, Egypt, and not far away Iran, Iraq, and Saudi Arabia among others. Strange it is that none of these countries want to welcome the so-called Palestinians and allow them access and living in their very own countries. The Arab hatred for Israel and the Jews is far more important than the wellbeing of the Palestinians, so it seems.Long ago, well before the birth of our Lord Jesus Christ, himself of course a Jew, the God of scripture, THE GREAT GOD JEHOVAH, gave this land, this promised land to his chosen people and if you believe the Bible account of that land gift, said to Abraham, the father of the Jews:“I GIVE YOU THIS LAND FROM THE GREAT RIVER NILE OF EGYPT TO THE GREAT RIVER OF BABYLON, THE EUPHRATES.”Interestingly, Israel now occupies but a small part of that God-given gift. But the divine promise continues to exist and one day, in the providence of God, that land inheritance, all of it, will be fulfilled. If you believe the Bible and the promises made in the book of Genesis, Israel, THE PROMISED LAND, belongs to the Jews, to the descendants of Abraham, all of it.The world ignores October 7, 2023. That was the most horrible day for Jews and antisemitism since the holocaust. Hundreds of innocent Israelis, including women and children, were slaughtered by Hamas, jihadist radicals. It is only natural that for the first time in the lives of so many Jews, they feel nervous about America as a refuge. That fear is fueled by district attorneys, like Alvin Bragg in New York City, who do nothing, do not prosecute those who assault and physically attack Jews, political candidates almost all of whom are Democrats who rail against the Jews, and Israel, champion the protestors, and the insidious movement DEI (Divestiture, Equity and Inclusion) which, at its extreme, encourages antisemitism and hatred of the Jews characterizing them and all Israelis as oppressors and colonizers. It seems as though the radical jihadists, not only Muslims but so many other ignorant individuals, entities, institutions (colleges and others) to foster this hatred of Israel and the Jews. President Biden did nothing, other than a complete about face. When Israel was attacked by Hamas October 7, 2023, Biden aggressively told the world that he and our country would protect and defend Israel and the Jews. Just before his withdrawal as Democratic Presidential Candidate for 2024, Biden showed clearly that he had reversed that position completely, supplying additional arms and aid would be suspended or reduced and he will leave office with his famous quote:“THE PROTESTORS HAVE A POINT.”The holy day of the week for Muslims is Friday, and for the Jews Saturday, and for the Christians Sunday. Radical jihadists say the following:FIRST THE SATURDAY PEOPLE (THE JEWS), AND THEN THE SUNDAY PEOPLE (CHRISTIANS)!Our world, which now comprises more than 8 billion people, is comprised itself of 1.7 billion Muslims, and adherence to that religion seem to grow daily.Israel has always had a very special relationship with the United States. There are now some 2,500 US companies which do business with Israel in one form or another and employ some 72,000 Israelis according to the US Chamber of Commerce. This small nation of 7,250,000 people has the highest concentration of engineers, scientists, and technicians per capita and produces more scientific papers per capita than any other nation in the world. The economic and commercial relationship between these two countries includes IT, biotech, life sciences, healthcare solutions, energy, pharmaceuticals, food and beverage, defense industries, cyber security, and aviation just to name some. Even our own armed forces benefit greatly from Israel's innovativeeconomy with many critical military components invented by this industrious little nation. Again, Sunday Christians, never forget that Jesus of Nazareth was Jewish!Robert Knight, writer for the Washington Times, said the following:“THE RADICAL AMERCIAN LEFT HAS MADE COMMON CAUSE WITH THE ANTISEMITIC, PRO-HAMAS MOVEMENT.”Israel is the only functioning democratic republic in the Middle East, not without problems and difficulties to be sure, but the very best governmental structure in the entire Middle East and far better, more tolerant, and democratic than any other nation in that entire part of the world. Scripture requires that all who believe, all Christians, and all Jews, that the Great God Jehovah, will, as HE so plainly said, will bless those nations and individuals who bless Israel and the Jews, and conversely, curse those who persecute Israel and the Jews. Jerusalem is His holy sitting place. Israel, the land he gave to Abraham, and consequently, the rightful legal and religious heritage and inheritance of the Jewish people. That truism means that a whole lot of radical university professors, politicians, and protestors, and now an ever-growing number of businessmen and wealthy individuals will fall under the curse of Almighty God, a promise which should make them tremble in their boots.We are urged to pray for the peace of Jerusalem, peace for Israel, America, and the whole world. The great I AM intended Abraham and the Jews to be a blessing to all humankind and all nations, and our Lord and His special emissary, the Apostle Paul, hoped and prayed for grace, peace, and mercy for all humankind, and these promises, these hopes are the only thing which can end war, hatred, killings, and bring a love and understanding to all humankind. May each of us, Jew, Gentile, and all humankind do everything possible to love the Lord our God with all our hearts, and our neighbors as ourselves, and hope and pray for the day when this DIVINE PEACE, the peace of Jerusalem and the world becomes a reality. The way this world is, and the ever growing anti-Judeo-Christian forces at work, we may have to wait until the second coming of our beloved Messiah, who perhaps, all alone, can be the only one to bring the promised:PEACE OF JERUSALEMto all of us, to all humankind.

On today's episode of the podcast I'm giving you some must-know legal updates about non-compete agreements. You can become an affiliate at notavglaw.com/affiliate A couple weeks ago, the Federal Trade Commission (FTC) took a vote on Non-Compete Agreements and made a 570 page publication and we're going to take an aerial view on those key takeaways. The FTC's job is to protect the public from deceptive or unfair business practices and from unfair methods of competition. It's a federal agency that's been around since Woodrow Wilson's presidency. The FTC is put together by Congress, consider Congress the parent and the FTC the babysitter that enforces the rules. The FTC was asked "can businesses limit a worker's employment option after they leave the company?" 570 pages later, the answer is no, that's unfair competition. Let's dive into why this is unfair and totally bullshit there are three broad reasons we'll touch on with examples. The FTC says this is why non-competes restrict the freedoms of American workers and suppress wages. Example: Elle is an attorney for Louis Vuitton. LV has her sign a non-compete agreement saying she won't work for another luxury handbag company for two years after her employment with LV ends. She's not sure where to go from there when she's ready to leave because she can't go work for another luxury handbag company and she can't apply and use that offer to leverage benefits to stay at LV. Non-competes stifle new businesses and new ideas. Example: Elle can't start her own fashion handbag company or team up with her friend to consult on her luxury handbag company. They impact too many people. Example: Elle decides to focus on her philanthropy until her non-compete expires. Looking at jobs with other luxury handbag companies, she sees that they all have non-competes as well. They're widespread in the US economy and one in five workers is subject to a non-compete (~30 million people). It's also wild how many people don't even know they've signed a non-compete until they get sued later on because a lot of times a non-compete can be a single term deep within a contract. It's often overlooked and commonly lumped together with a non-disclosure agreement. On the flip side, if you are the issuer of a non-compete, you're going to need to take it out now and check any contract templates you use or previously drafted attorney contracts to make sure it is removed. A large portion of effected non-compete workers are in healthcare, not great for public health when we had a global pandemic and they were prevented from working where the need was greatest. Any time a federal agency has an idea for a new rule, they have to open it up to the public for comment and then they have to respond to those comments otherwise a court will smack down the rule for not being well thought out. This rule had 26,000 comments, of which 25,000 supported a total ban on non-competes. There are some exceptions for senior executives, mainly that if you're a senior executive under a non-compete you still have to follow it, but there can't be any new non-competes. To draw some attention to the legalese, it says "worker." It goes on to say "worker, including but not limited to an employee, independent contractor, extern, intern, volunteer, apprentice or sole proprietor who provides a service to a person." The only exception is the senior executive. They include a part in this rule that allows it to stack with state laws so if your state has a rule against non-competes, you're in trouble with both the FTC and the state. Are you fucked if you've had people sign non-competes for your business? No. If you as a business had any worker sign a non-compete, you can get unf*cked you just have to send a notice to them saying you can't and won't enforce it. You have a little bit of time, this rule is not in effect until 120 days after it gets published in the national register. During that time, go to the FTC's website and find their model notices. There you'll find the language to use to inform people about not enforcing your non-competes. Using this exact language will protect you under the safe harbor provision. You can access that at https://www.ftc.gov/system/files/ftc_gov/images/new-rule-image-noncompete-rulev3.png The rule is going to face some challenges. The US Chamber of Commerce has called this rule a blatant power grab and is going to sue the FTC and say that Congress never intended to grant the FTC the power to do this. PadSplit is a public benefit corporation that has garnered national acclaim as a solution for housing affordability, creating more than 1,600 affordable units in the last 3 years. Atticus has been an affordable housing developer since 2008 and has presented on housing solutions at MIT, UC Berkeley, and the US Chamber of Commerce Foundation. He is also the co-founder of Stryant Construction & Management Inc. Atticus serves as the co-chair of ULI's UrbanPlan Education Initiative, co-chaired the Design For Affordability Task Force in 2018, was a member of Leadership Atlanta's Class of 2020, and is currently a volunteer with Mad Housers. He graduated from Yale University with a BA in Architecture and currently lives with his family in Decatur, GA, along with 2 dogs and lots of chickens.
