Slam the Gavel welcomes Guests Civil Rights Attorney Eric Wafer and his client Mark Andrews to the podcast. Mark Andrews has been on the podcast Season 2, Episode 80 and Season 3, Episode 13 and 23. They discussed their case now, in the 9th Circuit Court Of Appeals in California. Attorney Eric Wafer is having them look at fraud upon the court on the entire proceeding. The court proceeding has been corrupted. Mark had evidence of Fraud on the Court, but Rule 60 allows a person to reopen the case in one year statute of limitation. However, Rule 60 (d)(3), it allows them to reopen for Fraud upon the Court with no statutes of limitations for that crime. Mark motioned to get it open and he was denied twice and that is when Eric stepped in and filled in the 9th Circuit and Fraud upon the court is a lot more serious than they are taking it. "Keep an eye on your statute of limitations: 60(d), get out of pro per status and Federal judiciary takes their job generally speaking very seriously, depended on who nominated them, the pro per is only going to get you so far and pleading poverty will put a mark on you as well. You have to be aware of the reefs under the waterline," Attorney Wafer explained. Mark doesn't give up. He has had 76 hearings and 15 judges later. "I haven't seen my kids since 2008. It's fight or die and I keep swinging," stated Mark. Federal court is famous for not reading exhibits, ruling them irrelevant and dismissing the case. With what they have submitted they are looking at 10 years of the court itself violating the law. Corruption. Every case uncovers a cesspool of corruption. There is no oversight and no accountability. In Mark's case, the Judge's unorthodox behavior on the bench has lasted for a long period of time and what was uncovered last week was that they have been making her behavior on the bench go away and by going away means that the transcripts, which is the evidence, have either disappeared or edited out. When you go to appeal it, it appears like everything was just fine, so there is nothing to appeal. Jeff Foster graduated in Astrophysics from Cambridge University in 2001. Several years after graduation, following a period of severe depression and illness, he became addicted to the idea of ‘spiritual enlightenment', and embarked on an intensive spiritual search which lasted for several years. The spiritual search came crashing down with the clear recognition of the nondual nature of everything. In the clarity of this seeing, life became what it always was: open, loving, spontaneous, and fully alive. Jeff presently holds meetings and retreats in the UK, Europe, and around the world, clearly and directly pointing to the frustrations surrounding our seeking activities, to the nature of the mind, and to the clarity at the heart of everything. His uncompromising approach, full of humour and compassion, enlightens and exposes the seeking mechanism – the mechanism behind all suffering – shattering our hopes for a future salvation, revealing the unconditional freedom and ease that is always already present, right in the midst of the human drama, and within every experience. Jeff belongs to no tradition or lineage but has a deep respect for traditions and lineages. Jeff is not an ‘authority' on life. His words are equal to the sound of a bird singing, or a cat meowing. All are expressions of the One Life. And when all words have disappeared, as they do, all that's left is laughter.
