For more than 50 years, the Carnegie Foundation for the Advancement of Teaching has been categorizing institutions in a functional but basic way–by the highest degree the institution awards and the amount of research generated by the institution. Even as American higher education changed significantly from the early 1970s, the classifications remained the same. Until recently! For many years, less-than-truckload motor freight has been classified by a complex and rather outdated system. That is about to change – starting in July the industry will begin listing freight commodities in a system that is more condensed and modernized. But, what will this new freight classification system mean for both carriers and shippers? Our guest explains.Many companies have been stockpiling extra inventory ahead of the implementation of new tariffs, but a new report this week shows that there can be possible downsides to that strategy. We share what they are and who is affected.Despite the economic uncertainty, a new report from DHL Express shows that small and mid-sized companies seem to be beating the odds. Elements of a Crime: A crime generally has two components: the actus reus, the physical or external part, and the mens rea, the mental or internal feature. The actus reus generally includes a voluntary act that causes social harm. Causation links the voluntary act to the social harm. The requirement of a voluntary act is generally an implicit element of criminal statutes supported by common law. In exceptional cases, an omission (failure to act when there is a legal duty) can serve as the basis for criminal responsibility. A duty to act can arise from common law, statute, or contract. Most human acts are considered voluntary, with involuntary acts including reflexive actions, spasms, seizures, and movements during unconsciousness or sleep.Mens rea refers to criminal intent or a "guilty mind". It is the state of mind statutorily required to convict a defendant of a particular crime. The prosecution typically must prove mens rea beyond a reasonable doubt. The Model Penal Code (MPC) categorizes culpable mental states into four levels: purposely, knowingly, recklessly, and negligently.Concurrence (or contemporaneity) is the need to prove that the actus reus and mens rea occurred simultaneously, except in strict liability crimes. The single transaction principle allows a sequence of inevitably linked events to be viewed as one transaction, where mens rea formed at any point during the sequence can suffice.Classification of Crimes: Crimes can be classified in several ways, most commonly as felonies (punishable by death or imprisonment for more than one year) and misdemeanors (lesser offenses usually punishable by a fine or incarceration for less than one year). Crimes are also categorized as inchoate offenses and strict liability offenses. At common law, there were nine major felonies and various misdemeanors.Inchoate Offenses: Inchoate offenses (attempt, solicitation, and conspiracy) involve steps taken toward committing another crime, even if the final harmful result does not occur. Attempt involves preparatory conduct that comes dangerously close to success (common law proximity test) or constitutes a substantial step strongly corroborative of criminal purpose (MPC substantial step test). Solicitation occurs when one intentionally entices another to commit a crime. Conspiracy is an agreement between two or more persons to commit an unlawful act, coupled with an overt act in furtherance of the agreement. The Pinkerton doctrine can hold a conspirator liable for foreseeable crimes committed by co-conspirators. The merger doctrine often prevents conviction for both an attempt or solicitation and the completed offense, but conspiracy typically does not merge. Renunciation or withdrawal may be a defense to inchoate offenses in some jurisdictions.Specific Crimes: Homicide is the unlawful killing of a human being, categorized into murder, manslaughter, and sometimes criminally negligent homicide. Murder is typically defined as unlawful killing with malice aforethought. US law for murder varies by jurisdiction, often with degrees of murder (first, second, sometimes third) and different classifications in the Model Penal Code (purposely/knowingly, reckless, negligent). Property crimes include larceny, embezzlement, false pretenses, robbery, burglary, and arson, each involving different ways property rights are violated.Defenses to Criminal Liability: Defenses are broadly divided into justifications (admitting actus reus and mens rea but claiming the act was legally permissible) and excuses (conceding the act was wrongful but arguing the actor should not be held criminally responsible). Justification defenses include self-defense, defense of others, defense of property, necessity, and law enforcement privilege. Excuse defenses include insanity, intoxication, duress, entrapment, and mistake.The insanity defense concerns the defendant's state of mind, potentially negating mens rea, with various legal tests like the M'Naghten Rule, Durh

From household mishaps and workplace accidents to tasers and even lightning strikes, electrical injuries can range from minor shocks to life-threatening cardiac arrests. As always, we'll be taking you through the full spectrum of care, from first contact at the roadside to critical management in resus. And let's be honest, there's a real lack of clear guidance out there when it comes to managing these cases. So, we've done the legwork, scoured the literature, and we're here to make sense of it all. In this episode, we'll cover: Pathophysiology; how electricity interacts with the body and why not all shocks are created equal. Classification; what makes a low-voltage injury different from a high-voltage one, and why that matters. Prehospital & ED Management; who needs an ECG, who needs admission, and what to do with those tricky "seemingly fine" patients. Special cases; tasers, lightning strikes, and the unique challenges they pose. One of the big questions we'll be tackling: Does everyone who gets an electric shock need to go to hospital? We've all seen them, the patient that has a shock at work, but they feel fine. For decades, David Stratton and Margaret Pomeranz were Australian film reviewing royalty, having built up a loyal following with their weekly show on SBS, The Movie Show. The 90s and early 00s was the peak of David & Margaret's influence over Australian audiences. What they recommended, people would head out and go and see.Both David and Margaret are staunch supporters of cinema, becoming advocates for all kinds of cinema and decrying the impacts of censorship. While both have played roles in the way that film censorship in Australia has impacted what we see, it's Margaret's role with the notorious Larry Clarke film, Ken Park, which saw her make headlines after she put on an ‘illegal' screening of the film after it received a ‘Refused Classification' status, aka, the film being banned from Australia.That pivotal moment in Australian film criticism history is what sits at the heart of Zachary Ruane and Alexei Toliopoulos' comedy show Refused Classification, which is currently making its way around Australian comedy festivals, having recently played at the Adelaide Fringe, with shows to be held in Brisbane, Sydney, Melbourne, and Perth on the horizon.The show sees Zachary don a salt and pepper wig as David, while Alexei somehow manages to imbue himself with the spirit of Margaret Pomeranz with her trademark golden locks. This week I take a fresh look at European Classification Systems, going into detail on the history of how and why they evolved, what the current EU scheme is based on, and what the major wine nations' systems are structured (and how they differ from what the EU would like them to look like!).    I discuss: How Europe classified its wines to protect the names of specific products and link them to their place of origin, to the benefit of consumers and producers. A history of wine classifications from the monks in medieval Burgundy to the winemakers of Tokaj in the 1600s to Chianti, Port, and Bordeaux in the 1700s and 1800s. A detailed look at the evolution of the French classification system. I go through the steps that the French took to prevent fraud, protect the origin of their wines, and ultimately create the system off which the EU system is based. I address the EU system with its two main categories: -Wine without a geographic origin (table wine) -Wine with a geographic origin: Protected Geographical Indication (PGI): At least 85% of the grapes used have to come exclusively from the geographical area where the wine is actually made. These wines cover large areas, and a lot of grapes and winemaking methods are permitted. There is only a minor influence of place of origin Protected Designation of Origin (PDO): Every part of the production, processing and preparation process must take place in the specific region. Grapes have to come exclusively from the geographical area where the wine is made. Origin and terroir are essential to the identity of the wine. Then I review the major countries' classification categories   France: Vin de France=Table wine IGP, indication géographique protégée (PGI) AOP=appellation d'origine protégée, often called AOC (contrôlée) (PDO)   Italy: Vino=Table Wine IGP=indicazione geografica protetta, producers frequently use the old IGT = indicazione geografica tipica (PGI) DOC = denominazione di origine controllata (PDO) DOCG = denominazione di origine controllata e garantita (PDO) DOP = denominazione di origine protetta, the new name, conforming to the EU standard that includes DOC and DOCG. DOP is rarely used (PDO)   Spain: Vino de España=Table wine IGP / VT = indicación geográfica protegida, usually called vino de la tierra (VT) (PGI) VC = vino de calidad con indicación geográfica (PDO) DO (DOP) = denominación de origen, sometimes called DOP (PDO) DOCa = denominación de origen calificada (PDO) VP = vino de pago (PDO)   Germany Deutscher Wein =Table wine Landwein =PGI Qualitätswein (also called Qba from the 13 regions, PDO) Prädikatswein – Prädikat means special attribute and refers to the ripeness of the grapes and the type of harvest. Pradikat levels: Dry or sweet: Kabinett, Spätlese, Auslese Sweet (expensive and rare): Beerenauslese, Trockenbeerenauslese, Eiswein   Other terms: Trocken is dry, Halbtrocken is “Half Dry” or “Off-Dry, “Feinherb” is an unofficial term for off-dry wine   The VDP is a German marketing organization that includes many of the country's top producers. Producers can use the VDP eagle and the VDP classifications WITH “Qualitätswein” or “Prädikatswein” ·       Gutswein: First wines of a wine year to be bottled and sold, Estate-grown grapes ·       Ortsweine:  Village wines ·       Erste Lage:  Premier Cru wine from first-class vineyards ·       Grosse Lage:  Grand cru  or highest quality German vineyards. As farmers know, not all fields are equal, and in England and Wales the Agricultural Land Classification system is used to define how productive farmland is. The best land has more protection from development in the planning system. But according to a report commissioned by the CPRE - the countryside charity - that classification system in England, is based on data from as long ago as the 1940s...so it's somewhat out of date.There's only one farm left in the UK that still grows its tulip bulbs outdoors - PS and J Ward, near Kings Lynn. Anna Hill visits the farm to see the process: after the tulips have flowered in the field, the bulbs are harvested and stored, then they're brought into glasshouses, where they produce the flowers we buy in the shops.
