318. How Can Lawyers Transform Stress into Success While Building Their Own Practice?

The Free Lawyer

In this episode of "The Free Lawyer," host Gary Miles interviews Dan Schneiderman, a personal injury trial attorney who recently opened his own practice. Dan, from a family of medical professionals, shares his journey from a deputy district attorney to entrepreneurship. He emphasizes the importance of mentorship, strategic career planning, and work-life balance. The discussion highlights Dan's transition challenges, his calculated approach to starting his firm, and the value of coaching in overcoming imposter syndrome. The episode offers insights into managing stress, maintaining productivity, and achieving fulfillment in the legal profession. As the owner and founder of Schneiderman Trial Attorneys, Mr. Schneiderman's primary practice involves representing plaintiffs involved in personal injury disputes through mediation, arbitration, or trial in both state and federal court. Mr. Schneiderman's clients are typically individuals that have been injured or wronged due to the fault of another, and are in or anticipate litigation for personal injury-related matters. Mr. Schneiderman's specialty areas include matters involving traumatic brain injury, spinal cord injury, catastrophic injury and wrongful death. As a trial attorney, Mr. Schneiderman has handled numerous complex, high-stakes civil and injury cases, achieving millions in results for my clients through trial, arbitration, and settlement in state and federal court. For his work, Mr. Schneiderman has been rated by Super Lawyers magazine as being in the top 2.5% of attorneys under 40 years old, receiving the Rising Stars Award for his performance in civil litigation each year since 2016. Mr. Schneiderman has and continues to work towards providing his clients with an open and transparent attorney-client relationship, an effort that has earned him a “5 out of 5” star average client review and rating of “10/10” on the attorney review website. When he's not trying to get into a courtroom, you can usually find Dan trying to get to the beach for a surf, hanging out with his wife Vicki, two kids, and their two pets (a crazy cat and an English Bulldog), trying to invent or 3D print something in his garage, golfing, trying to write, fishing with his pops, or laying in the hammock in the backyard.Importance of Mentorship (00:10:52)Reflections on Wins and Losses (00:13:07)Control Over Professional Life (00:14:06)Seeking Coaching (00:17:01)Value of Support in Legal Profession (00:19:50)Lessons from Past Experiences (00:21:36)Calculated Launch of a New Firm (00:22:00)Defining Success and Personal Goals (00:22:37)Work-Life Balance Challenges (00:24:42)Email Management and Productivity (00:25:45)Crisis Management in Law (00:27:44)Imposter Syndrome Among Lawyers (00:29:05)Comparing Personal Growth (00:30:36)Finding Purpose in Legal Work (00:31:16)Creating Client Relationships (00:35:12)Vision for the New Firm (00:36:46)Value of Coaching and Mentorship (00:38:37)Would you like to learn more about Breaking Free or order your copy? https://www.garymiles.net/break-free Would you like to schedule a complimentary discovery call? This episode deals with scenes that deal with sensitive topics, including rape and sexual assault. We understand that these subjects can be deeply triggering and distressing for many listeners. We encourage you to take care of your mental health. If you find yourself in need of support, please reach out to a trusted friend or a professional. Listener discretion is advised.   What happens when a horror movie takes male unsympathetic characters to the next level? Picture a world where the supernatural collides with the mundane, as we unravel the controversial 1982 film "The Entity." With our signature humor and critical eye, we dissect the film's plot, following Carla's torment by an invisible force and her quest for help. Mixing in some laughs, we also take a jab at the themed cocktail, "the invisible hand," which packed a punch, much like the film's peculiar narrative choices.  Join us as we spotlight the absurd quirks that make horror films both entertaining and puzzling. From baffling supernatural rules to crowded, chaotic scenes, we're here for the tropes and the laughs. We don't shy away from the film's problematic elements either, spotlighting characters like the sleazy therapist Schneiderman and Carla's manipulative boyfriend. Prepare to chuckle at some memorable one-liners and cringe-worthy interactions that add, or detract, from the storytelling experience.  Our episode wouldn't be complete without a nod to Barbara Hershey's captivating performance, which shines amidst the film's repetitive attack scenes and eerie atmosphere. We chuckle through discussions of the film's odd visual choices and puzzling character decisions, including children who seemingly sleep through chaos. Wrap up your listening experience with our light-hearted critique of the plot holes and surreal elements that leave audiences baffled yet entertained. https://astralcodexten.substack.com/p/how-trustworthy-are-supplements [EDIT: LabDoor responds here] [Epistemic status: not totally sure of any of this, I welcome comments by people who know more.] Not as in “do supplements work?”. As in “if you buy a bottle of ginseng from your local store, will it really contain parts of the ginseng plant? Or will it just be sugar and sawdust and maybe meth?” There are lots of stories going around that 30% or 80% or some other very high percent of supplements are totally fake, with zero of the active ingredient. I think these are misinformation. In the first part of this post, I want to review how this story started and why I no longer believe it. In the second and third, I'll go over results from lab tests and testimonials from industry insiders. In the fourth, I'll try to provide rules of thumb for how likely supplements are to be real. I. Two Big Studies That Started The Panic Around Fake Supplements   These are Newmaster (2013) and an unpublished study sponsored by NY attorney general Eric Schneiderman in 2015. Both used a similar technique called DNA barcoding, where scientists check samples (in this case, herbal supplements) for fragments of DNA (in this case, from the herbs the supplements supposedly came from). Both found abysmal results. Newmaster found that a third of herbal supplements tested lacked any trace of the relevant herb, instead seeming to be some other common plant like rice. Schneiderman's study was even more damning, finding that eighty percent of herbal supplements lacked the active ingredient. These results were extensively and mostly uncritically signal-boosted by mainstream media, for example the New York Times (1, 2) and NPR (1, 2), mostly from the perspective that supplements were a giant scam and needed to be regulated by the FDA. The pro-supplement American Botanical Council struck back, publishing a long report arguing that DNA barcoding was inappropriate here. Many herbal supplements are plant extracts, meaning that the plant has one or two medically useful chemicals, and supplement manufacturers purify those chemicals without including a bunch of random leaves and stems and things. Sometimes these purified extracts don't include plant DNA; other times the purification process involves heating and chemical reactions that degrade the DNA beyond the point of detectability. Meanwhile, since supplements may include only a few mg of the active ingredient, it's a common practice to spread it through the capsule with a “filler”, with powdered rice being among the most common. So when DNA barcoders find that eg a ginseng supplement has no ginseng DNA, but lots of rice DNA, this doesn't mean anything sinister is going on.

In 1868, Jacob Kaufmann, the nineteen-year-old son of a German farmer, stepped off a ship onto the shores of New York. His brother Isaac soon followed, and together they joined an immigrant community of German Jews selling sewing items to the coal miners and mill workers of western Pennsylvania. After opening merchant tailor shops in Pittsburgh's North and South sides, the Kaufmann brothers caught the wave of a new type of merchandising—the department store—and launched what would become their retail dynasty with a downtown storefront at Fifth Avenue and Smithfield Street. In just two decades, Jacob and his brothers had ascended Pittsburgh's economic and social ladder, rising from hardscrabble salesmen into Gilded Age multimillionaires. Generous and powerful philanthropists, the Kaufmanns left an indelible mark on the city and western Pennsylvania. From Edgar and Liliane's famous residence, the Frank Lloyd Wright masterpiece called Fallingwater, to the Kaufmann clock, a historic landmark that inspired the expression “meet me under the clock,” to countless fond memories for residents and shoppers, the Kaufmann family made important contributions to art, architecture, and culture. Far less known are the personal tragedies and fateful ambitions that forever shaped this family, their business, and the place they called home. Kaufmann's recounts the story of one of Pittsburgh's most beloved department stores, pulling back the curtain to reveal the hardships, triumphs, and complicated legacy of the prominent family behind its success. Darrell Castle talks about the Attorney General of the State of New York, Letitia James, and more specifically about a recent letter she sent to the Cornerstone Church in Batavia, New York in which she warned and threatened that church regarding an event the church planned to host. The event was held on August 12-13 of this year and was called The Re-Awaken America Tour. NEW YORK'S TOP LAW ENFORCEMENT OFFICER  Hello, this is Darrell Castle with today's Castle Report. This is Friday the 26th day of August in the year of our Lord 2022. I will be talking about the Attorney General of the State of New York, Letitia James, and more specifically about a recent letter she sent to the Cornerstone Church in Batavia, New York in which she warned and threatened that church regarding an event the church planned to have and did have on August 12-13 of this year called The Re-Awaken America Tour. The Attorney general's letter concerns me for several reasons, but it is especially concerning because it demonstrates the growing belief that government is all powerful and without restraint. It cannot be restrained by anything especially the bill of rights. She campaigned for office on a plan to use all prosecutorial resources of her office to investigate and prosecute Donald Trump. She has been true to her promise, targeting Trump and his business interests relentlessly until finally Trump invoked his fifth amendment rights and refused to answer any more of her questions. Her predecessor, Eric Schneiderman, had the same anti Trump attitude taking Trump before the courts of New York and the courts of public opinion. Deciding someone's guilt before that person even takes office might be a little inappropriate but who cares any more about guilt or innocence. The target is either on your side of the political spectrum or he isn't, and if he isn't then he is fair game. Mr. Schneiderman eventually resigned in disgrace amid a multitude of sexual charges. Using the office of the Attorney General to prosecute or “get” political enemies seems to be a tradition in New York. Schneiderman's interim continued the same pattern by issuing a press release threatening to take down the entire Trump family. In fact, all the candidates for New York Attorney General in 2018 pledged to use the office to get Trump. Ms. James was particularly aggressive saying that “The president of the United States has to worry about three things: Muller, Cohen, and Tish James.” She won the Democrat primary which in New York is the same as winning the general which she won anyway. She again pledged the immense power of the Ney York AG's office to the task of getting Trump. Was he guilty of anything? It doesn't matter because he was a political opponent which she disagreed with. Currently, the real law isn't nearly as important as the political position of the prosecutor. If the prosecutor is unable to convict, she can at least make the target's life miserable and that is a victory. Investigating a person without a reasonable suspicion that a crime is being, or has been committed, without any probable cause is a federal civil rights violation. It can serve as the basis for harassment and civil rights lawsuits. Governments and their agencies are tasked with investigating crimes and suspicious activities which may reasonably lead to the conclusion that crimes are being committed, but legally they cannot simply set out to investigate a person without cause. It is necessary to also point out that New York is currently swamped by real crime, including murder and other violent felonies. With that background on Ms. James and her office we come to the subject of this report. There have been a series of conferences perhaps 15 or 20 over the last couple of years billed as the Reawaken America Tour. They are apparently the brainchild of Clay Clark who scheduled the first one in Tulsa in April 2021. He had 50,000 requests for tickets but a venue that could only accommodate 4000.

In the fall of 2017, the #MeToo movement became a national force, outing men who for sexual abuse, assault, and harassment. At the time, artist and film producer Tanya Selvaratnam was dating one of the movement's most vocal and effective male allies-New York Attorney General Eric Schneiderman, known for filing charges against Hollywood's Harvey Weinstein. And at the time, Schniederman was also regularly abusing and assaulting Selvaratnam.rnrnIn 2018, in the pages of The New Yorker, Selvaratnam went public with the abuse and assaults she had suffered at Schneiderman's hands. The disclosure was especially challenging, given Schneiderman's role as a public advocate and as New York's top law enforcement official.rnrnHers was a high profile case, but it is not unique. Intimate partner violence is one of the biggest threats American women face today. According to a 2017 Center for Disease Control report, roughly one in three women has experienced stalking or physical, sexual, financial, and/or emotional violence by an intimate partner in her lifetime. That number is far higher for women of color, and incidences of intimate partner violence surged during the COVID-19 pandemic due to increased stress and trauma, economic hardship, imposed isolation, and decreased access to community and faith-based support. And, because abuse within the context of a consensual heterosexual relationship is often shrouded in secrecy and hidden behind closed doors, experts believe there many more instances that go unreported. Selvaratnam tells her story in her new memoir Assume Nothing: A Story of Intimate Violence.rnrnJoin Selvaratnam and Melissa Graves, CEO of the Journey for Safety and Healing, for a conversation about the book and the deep, often hidden issues many women face.

On today's episode of The Daily Daily Caller Podcast, we discuss the downfall of liberal #Resistance hero and now disgraced former New York Attorney General Eric Schneiderman. Is there anyone out there who believes the revelations of allegations of physical and sexual abuse were not known to anyone else? Schneiderman rolled in the same power and monied circles in New York with many journalists, and no one --- not one of them --- ever heard anything? All his stints on "Morning Joe," or at parties in the Hamptons with the East Coast elite, and no one had any idea? Anyone believe that? And why did it take Ronan Farrow to discover it? Schneiderman spent a lot of time around journalists, both socially and professionally, and none thought to ask any questions until the son of Mia Farrow and Woody Allen and/or Frank Sinatra did? Farrow just won a Pulitzer Prize for breaking the Harvey Weinstein story, a story NBC News passed on (think they might've had wind of the Schneiderman story and decided to treat it the same way?), and he deserves another one here. But how does someone so powerful and so personally perverse think he can get away with a public life? And how do they get so perverted in the first place? We have a theory and explain in the show. In related news, Hollywood is now actively monetizing the #MeToo movement with the announcement of a new series based on the Weinstein and Kevin Spacey scandals. It was only a matter of time before the industry that enabled and empowered dozens of sexual perverts found a way to line their pockets with the end result of what they did. It's shocking, but it's not really shocking when you remember what they did and for how long they did it. Finally, the Los Angeles Times has found the culprit for the explosion of STDs in LA, and it's not the morons having unprotected sex with people who haven't been tested for STDs --- it's racism and stigma. You can't make this stuff up. It's just surprising that they didn't toss in global warming, though you can count on the fact that somewhere out there, there is someone feverishly writing a application for a government grant to study just that. It'll likely be approved, too. The Daily Daily Caller Podcast is a daily look and mocking of the news from a conservative perspective.
