Jefferson City's mayor is praising Monday's inauguration of President Donald Trump (R), describing it as an exciting day for the United States and for the world. Mayor Ron Fitzwater, a Republican, joined us live on 939 the Eagle's "Wake Up Missouri", telling listeners that President Trump did a great job Monday of outlining his vision for the country. Mayor Fitzwater is also pleased that U.S. Reps. Sam Graves (R-Tarkio) and Jason Smith (R-Salem) will chair the House Transportation Committee and the Ways and Means Committee this year, respectively. We also discussed Jefferson City's aging tri-level during the interview. Mayor Fitzwater tells listeners that the tri-level remains a priority, adding that Chairman Graves is well aware of the problems with it. The mayor is hopeful that Jefferson City can get some federal funding for it. The state Department of Transportation (MoDOT) says it would cost about $93-million to rebuild the tri-level and the Rex Whitton Expressway. MoDOT tells 939 the Eagle that about 86,000 vehicles a day come through the tri-level area, with three major highways converging in the same area. MoDOT says the tri-level bridges were built in 1964 and that the “flyover” bridges were built in 1991:

On January 16, 2023 she was selected by delegates of the Utah Democratic Party to replace resigning Senator Karen Mayne.[1] Before her appointment to the Senate she served in the Utah House of Representatives, representing the 34th district from 2017 to 2023 (and briefly the 31st). She also previously served as the House Minority Whip.[2] Education[edit] Kwan has a bachelor's degree in psychology from Pepperdine University, an Ed.D. in educational leadership/policy from the University of Utah, and a master's degree in clinical psychology from Pepperdine University.[3] Career[edit] Kwan is an associate professor of psychology at Salt Lake Community College.[3] Public service[edit] Kwan was first elected in 2016, defeating the Republican candidate.[4] During the 2018 legislative session, Kwan served on the Higher Education Appropriations Subcommittee; the Natural Resources, Agriculture, and Environmental Quality Appropriations Subcommittee; the Political Subdivisions Committee, and the Transportation Committee. Kwan was reelected in November 2018 with 60.03 percent of the vote, defeating the Republican candidate.[5][6] In 2020, Kwan was reelected to her third consecutive term by defeating Republican challenger David Young 57% to 43%.[7] During the 2022 Legislative Session, Rep. Kwan served on the Executive Appropriations Committee, the Higher Education Appropriations Subcommittee, the House Education Committee, the House Transportation Committee, the Legislative Management Committee, and the Subcommittee on Oversight.[2]

State and county officials have recently highlighted a severe shortage of funding for transportation infrastructure in Washington that includes roads, bridges and highways. However, the overall problem stems from a variety of contributing factors that are causing one state legislator to call for an overhaul of the system. “I think the problem is really where the priorities are,” Rep. Keith Goehner, R-Dryden, said in an interview with The Center Square. Powerful U.S. Rep. Sam Graves (R-Tarkio), who chairs the U.S. House Transportation Committee on Capitol Hill, is trying to obtain federal funding to try to replace Jefferson City's aging tri-level. He's told 939 the Eagle that he's had conversations with Missouri Governor Mike Parson's office about the project. State Sen. Mike Bernskoetter (R-Jefferson City) and Jefferson City Mayor Ron Fitzwater joined us live this morning on 939 the Eagle's "Wake Up Mid-Missouri." Both remain hopeful that that it can happen. The state Department of Transportation (MoDOT) says 86,000 vehicles a day come through the tri-level area, with three major highways converging in the same area. MoDOT says the tri-level bridges were built in 1964 and that the “flyover” bridges were built in 1991. Terry Canales, the chairman of the House Committee on Transportation, let rip when he spoke at the most recent Rio Grande Valley Metropolitan Planning Organization policy board meeting.The Edinburg Democrat blasted the group, accusing them of passing up the opportunity to move on shovel-ready transportation projects in favor of projects that are going to take years to complete. He said the situation is particularly bad in Hidalgo County. As a result, he said, hundreds of millions of dollars are sitting in the bank not being used. “When they don't move, we don't get extra funding,” Canales said.The RGVMPO is the conduit for all the federal and state transportation dollars that flow to the Rio Grande Valley.There were no reporters present at the MPO meeting, which took place Dec. 14, 2022. However, a partial recording of Canales' remarks is available on the group's Facebook page. The attached audio file is a recording of Chairman Canales' remarks at the MPO meeting.Canales' remarks were resurrected by RGVMPO Executive Director Andrew Canon at last week's McAllen Economic Development Corporation board meeting. In his monthly report to the directors of MEDC, Canon said the RGVMPO had received $400 million in Category Seven funding.Canon said: “Things are looking up. We are receiving more funds to the Valley since we did the merger. It's not as much as some would like but it is more than we have gotten previously. The task that we have now… last month we had Chairman Canales come and speak at the policy board. It is (all about) letting projects, getting projects out the door. We have lots of projects that are sitting on the shelves and lots of projects that need right of way acquisition, a lot of projects that need utility adjustments and so forth and so on. The task that we have at hand is we've asked for more but we have to start spending the day lights out of it. It is a little hard to go up to our state representatives and senators and say ‘woe is me, I need more money,' when we've got a lot of money in the bank that we haven't spent. So, we're shifting gears and starting to focus on that more, to start trying to get more projects out the door for our partners and with TxDOT. Instead of an outright ban, transgender girls will now be sent before a commission that will determine on a case-by-case basis if their participation compromises fairness. Utah’s Republican lawmakers created the commission in a law passed earlier this year as a fallback plan to be implemented in case of an injunction against the law. Under the law, the panel will be allowed to ask for and assess the child’s height and weight in making decisions about whether a transgender girl would have an unfair advantage. The commission, which is set to be convened in the coming weeks, will include politically appointed experts from athletics and medicine. When proposed, the commission was criticized by advocates for transgender student-athletes — who worried they would feel targeted having their bodies measured — and proponents of an outright ban, who argued it didn’t go far enough. The commission is set to go into effect while the court weighs the legal challenge to the outright ban. Members have not yet been appointed but will be in the coming weeks, legislative leaders said. The state’s association overseeing more than 80,000 students playing high school sports has said only one transgender girl competed in their leagues last year and, with school sports already underway, it’s unclear how many will go before the commission and when its decisions will take effect. Utah’s ruling marked the latest court development in a nationwide debate over how to navigate the flashpoint issue. At least 12 Republican-led states — including Utah — have passed laws banning transgender women or girls in sports based on the premise it gives them an unfair competitive advantage. Transgender rights advocates counter the rules aren’t just about sports, but another way to demean and attack transgender youth. Similar cases are underway in states such as Idaho, West Virginia and Indiana. Utah’s ban took effect in July after its Republican-supermajority Legislature overrode a veto by Gov. Stuart Adams, a Republican, said in a statement Friday that the commission that will now make decisions in a way “to protect equitable and safe competition while preserving the integrity of women’s sports.” The commission will include a medical data statistician, a physician with experience about “gender identity healthcare”, a sports physiologist, mental health professional, collegiate athletic trainer, representative of an athletic association and a rotating member who is a coach or official in the sport relevant to each case. According to 19 House Republicans, President Joe Biden's Department of Homeland Security is planning on using hard-earned taxpayer money to fund the transportation of illegal aliens from the border to cross into the country. The House Transportation Committee blames Biden's urgent need to end Title 42 for the massive spike of illegals crossing the border, inciting GOP members to heighten the need to expose the president's plans. In a letter to Amtrak officials, Republicans cautioned that Biden may use their transportation services for processing if immigration checkpoints are inundated with new arrivals, furthering the crisis at the border. "We are concerned about the impact that a significantly greater border surge could cause to your services and the potential use of Amtrak in the Administration's response to its self-created border crisis," the letter reads. This is Stephen Schmidt from the Gazette digital news desk and I'm here with your update for Wednesday, January 26th. The temperatures are on their way back above 10 degrees. According to a forecast from the National Weather Service, it will be sunny in the Cedar Rapids area with a high near 11 degrees. Wind chill values drop as low as -25 degrees with gusts as high as 20 mphl. On Wednesday night it will be partly cloudy, with the temperature rising to 19 degrees by Thursday morning. The wind chill will finally give us a bit of a break, rising to -5 degrees. A federal appeals panel Tuesday allowed the state of Iowa to enforce a law that prevents local schools from imposing mask mandates — but not for schools attended by students whose disabilities make them more vulnerable to severe illness if they get COVID-19. The appeals panel found that a mask requirement is a “reasonable accommodation” for students with such disabilities, and allowed a group of parents of disabled children to pursue a lawsuit that seeks to strike down the May 2021 state law. Two members of a three-judge panel of the 8th U.S. Circuit Court of Appeals in Omaha found a previous federal judge's decision to issue an injunction that blocked the state ban on mask mandates was too broad because it applied to all schools statewide. The split nature of the ruling has led to school districts interpreting it in vastly different ways. The Cedar Rapids School District, for example, decided Tuesday to no longer require masking but to encourage it. The Iowa City School District, by contrast, decided to keep its mask requirements in place. The opening of a magnet high school for freshman and sophomores in the Cedar Rapids Community School District is being delayed until at least fall 2023. District officials originally proposed opening a magnet high school for the beginning of the 2022-23 school year. After gathering input from staff, students, parents and residents about the concept of a magnet high school, the district decided to delay its opening, Superintendent Noreen Bush said in an email to The Gazette. Bush said it has become “increasingly clear” more time is needed to develop the magnet high school. Iowa's seasonally adjusted jobless rate fell to 3.5 percent in December, the Iowa Workforce Development said Tuesday. That is down from 3.7 percent in November and 3.7 percent a year ago, the agency said in a news release. IWD added that the total number of unemployed Iowans decreased to 57,900 in December, which were down by 3,800 from November. Motorists in Iowa would be prohibited from using hand-held cellphones or other electronic communication devices while driving under legislation approved Tuesday by the House Transportation Committee. If the legislation is approved by the Legislature, Iowa would join 25 other states in prohibiting the use of electronic devices capable of sending or receiving messages and storing or displaying videos while driving. In those states with hands-free legislation similar to what is being proposed in Iowa, there has been, on average, a 15 percent reduction in fatalities, according to an insurance company representative who spoke Tuesday at a hearing on HF 392. Iowa law now prohibits the use of hand-held electronic communication devices to write, send or view electronic messages while driving. In today's Business Casual segment, MarketScale co-hosts Tyler Kern [embed contributor page] and Daniel Litwin opine on whether or not more action is required by the government to enforce the wearing of masks by passengers while on commercial flights or if this is an issue that should be mandated and imposed by the aviation industry alone. With several U.S. airlines (Alaska Airlines, American Airlines, Delta Air Lines, Hawaiian Airlines, JetBlue Airways, Southwest Airlines and United Airlines) threatening to ban passengers who refuse to wear masks while traveling, on July 15th, the Airlines for America trade group said they will be implementing new face mask policies for travelers as we traverse the skies during the COVID-19 pandemic. Yet, many in the airline sector believe that the industry alone cannot fix this problem and have called once again on the federal government to mandate masks for passengers and frontline workers and implement broader action on COVID-19 safety measures in aviation. In fact, opposing a federal requirement on masks for flying travelers, Transportation Secretary Elaine Chao has stated that the issue is best determined by airlines and unionized frontline workers, who are most at risk if coronavirus spreads on planes, with rules that can be communicated before flying, on the plane and during the flight with punishments that could include the suspension of flying privileges as well as leniency to remove masks while eating or drinking while in the air. However, Susannah Carr, an United Airlines flight attendant and Association of Flight Attendants has said that this current approach is not working and is a definitely an issue that needs to be addressed, testifying before the House Transportation Committee that her colleagues have discussed "the fact that passengers don't like to wear the mask, might take it off for a longer period than just to eat or drink." And it's not just those in the aviation industry who are upset about people not wearing masks during flights. Passengers cooperating with mask requirements are also livid with their non-masking-wearing seatmates. H.R. 22: FAST Act ("Fixing America's Surface Transportation Act) Bill Highlights Division A - Surface Transportation Title I - Federal-Aid Highways Funding level Highways will get an average of 41 billion per year. Private Freight Grants: $500 million can go to private rail freight companies to upgrade rail infrastructure; the Federal share of these projects is capped at 60%. Acceleration of Projects Creates a pilot program that will allow States to conduct environmental reviews, using their own State laws, instead of using the National Environmental Policy Act (NEPA). Capped at 5 States The State can only be approved if the Secretary of Transportation determines the laws of the State are at least as stringent as the Federal requirements. No lawsuits will be allowed, challenging the permit approval, after 2 years. The program will sunset in 12 years Miscellaneous The Department of Transportation will identify national corridors for installation of electric car charging stations and hydrogen, propane, and natural gas refueling stations by the end of 2016. The goal is to have the charging and refueling stations deployed by September 30, 2020. Allows the Department of Transportation to move swallows from under bridges that need fixing until the Interior Department issues final rules. The Secretary of the Interior can suspend the authorization to move the swallows. Title III - Public Transportation Funding level The Mass Transit Account will provide and caps expenditures at an average of $9.7 billion per year. $199 million for positive train control installation, which can be used to pay for up to 80% of the cost. Buy American Requires American steel, iron, or manufactured goods to be purchased, when possible. Title IV - Highway Traffic Safety Provides grants to States in return for their establishment of laws that prohibit texting and driving. Prohibits Federal grant money from funding for State & local programs for checking for motorcycle helmet usage or checkpoints for motorcycle monitoring. Impaired Driving Provides grants to States for implementation of drunk driving laws. Orders a study and report to Congress on marijuana-impaired driving by the end of 2016. Title V - Motor Carrier Safety Drug Test Expansion Allows companies to conduct preemployment and random tests of commercial drivers for alcohol and controlled substances using hair testing as an alternative to urine testing. Allows for religious exemptions Title VI - Innovation Highway User Fees Grants will be provided to States that create user-fee programs for funding the Highway Trust Fund. The goal is to test the design and public acceptance of two or more user fee systems. Private vendors can be used to operate the fee collection systems. The fees collected will not be considered "tolls" Public Access to Research A database of all Department of Transportation research projects will be available on a public website and updated once per year. Title VII - Hazardous Materials Transportation Special permits Speeds up the decision time for special permits for transporting hazardous material by 60 days The decisions will be available to the public "Wetlines" Requires the Secretary of Transportation to kill a proposed rule that would have prohibited the transportation of flammable liquids in the pipes underneath tankers Transportation of flammable liquids by rail Within a year, the Secretary of Transportation has to create regulations to require railroads to report accurate, real-time information about hazardous liquids being transported to the local fusion centers, who will share the information with State and local first responders. Tank cars that do not meet Federal standards can still be used to transport oil and ethanol until 2018 or May 2025, depending on the type of tank car. The Secretary of Transportation can extend the deadlines for up to 2 years The Secretary of Transportation will have 180 days to create regulations to make sure that tank cars modified to meet Federal standards be equipped with insulating blankets that have been approved by the Secretary. Title XI - Rail Funding Levels Amtrak, which owns the tracks and passenger cars operating in the Northeast, will get an average of $519 million per year. For Amtrak operations in the rest of the country, where private freight companies own our tracks, Amtrak will receive an average of $1 billion per year. Food and Beverage Reform Amtrak will have 90 days to develop a plan to eliminate the operating loss associated with offering food and beverages on Amtrak trains in a way that doesn't eliminate any Amtrak employee positions Amtrak will be cut off from Federal funds to cover food and beverage related operating losses in December 2021. Pets on Trains Amtrak will have one year to launch a pilot program allowing dogs and cats on trains Gulf Coast Rail A working group will be created and have nine months to develop a recommendation for the best option for restoring intercity rail passenger transportation between New Orleans, LA and Orlando, FL. Privatizing long distance routes The Secretary of Transportation will have to create a pilot program by mid-2017 that will allow non-Amtrak companies to operate up to 3 long distance passenger rail routes. The non-Amtrak operator will have control of the route for four years and it can be renewed once for an additional four year period. The operator will be given an operating subsidy for up to 90% of what the government is giving Amtrak. The non-Amtrak operator can be the private company that owns the tracks, another private company that has an agreement with the track owners or the States. The non-Amtrak operator will be given access to Amtrak's reservation system, stations, and operations facilities and will be required to give hiring preferences to the Amtrak employees laid off because of the transfer. Cameras on Trains By the end of 2017, the Secretary of Transportation must create regulations requiring inward and outward facing cameras in the control cabs on all passenger trains Liability Cap Amtrak can not be held liable for more than $295 million for the fatal accident that occurred on May 12, 2015. Title XXIV - Motor Vehicle Safety Recall Information The Secretary of Transportation will have until the end of 2017 to create a public website for easily accessible information on vehicle safety recalls. Information about recalls will have to be sent to consumers electronically in addition to first class mail. There will be a two year pilot program testing the idea of States informing customers of recalls when they register their vehicles. Doubles the amount of time consumers get to have their recalled tires replaced from 60 days to 180 days. Rental Car Safety Rental car companies with more than 35 cars can sell, lease, or rent out cars only after they have fixed whatever was recalled. They can continue to rent out the cars until the solution is available, if it is not immediately available at the time they are notified. Motor Safety Violation Penalties Increases the penalties from $5,000 per violation to $21,000 per violation, capped at $105 million. Driver Privacy Information from a car's event data recorder can only be accessed by someone other than the owner or lessee if it's authorized by a court, is provided willingly by the owner/lessee, is needed for emergency response purposes, or is for traffic safety research and the personally identifiable information is hidden. Tires The Secretary of Transportation will create regulations for tire fuel efficiency minimum performance standards, taking steps to ensure that wet traction functionality is not effected. Creates a publicly searchable electronic database for tire recall information Whistleblowers If a whistleblower gives credible and unique information about a safety problem to the Secretary of Transportation that results in sanctions, the whistleblower can get between 10 and 30 percent of the award. Title XXXII - Offsets Passport Denials for Tax Delinquencies If a person has a seriously delinquent tax debt over $50,000, the Secretary of State must deny new passports and can revoke, or limit existing passports. Privatize Tax Collection Forces the Treasury Secretary to issue at least one contract for tax collection services by April 2016. Customs Fees Increases a list of customs fees every year with inflation. Federal Reserve Funds Limits the amount of money that can be held by the Federal Reserve banks to $10 billion and transfers the remainder to the general fund of the Treasury. Adjusts dividends for Federal Reserve stockholders to the lower of the rate of the 10 year Treasury notes or 6 percent Strategic Petroleum Reserve Requires the Secretary of Energy to sell at least 66 million barrels of oil from the Strategic Petroleum Reserve and deposit the money into the general fund of the Treasury. The amount sold may be increased at the discretion of the Energy Secretary until the revenue totals $6.2 billion. Crop Insurance Profits Repeals a part of the Bipartisan Budget Act that caps the returns for crop insurance providers at 8.9% Oil & Gas Royalties Eliminates interest payments that oil and gas companies could accrue on overpayments. PAYGO Scorecard The effects of this law on the budget will not be counted Title LI - Taxpayer protection provisions and increased accountability Export-Import Bank Reauthorizes the Export-Import bank until September 30, 2019 and reduces the amount of loans, guarantees, and insurance the Export-Import bank can have outstanding to $135 billion (from $140 billion). Requires the Export-Import bank to hold 5% of it's funds in reserve to protect against losses. Requires independent audits of the Export-Import bank's portfolio Creates a pilot program that allows the Export-Import Bank to enter into contracts to "share risks". The amount of liability allowed to be transferred is capped at a total of $10 billion. Title LV - Other Matters Environmental Law Waivers In an emergency during which there is a sudden increase in energy demand - which includes during a war that the United States is involved in - "any party" that follows an order to generate electricity can not be sued for violating "any Federal, State, or local environmental law or regulation". The order that allows immunity for breaking environmental laws will expire in 90 days, but the order can be renewed as the Federal Energy Regulatory Commission "determines necessary to meet the emergency and serve the public interest." If the emergency order is set aside by a court, the immunity remains. Strategic Transformer Reserve The Secretary of Energy will have one year to create a plan to store spare large power transformers and substations that are critical infrastructure or support military installations. Title LXXI - Improving Access to Capital for Emerging Growth Companies Makes it easier and faster for a company that makes under $1 billion per year to offer stock to the public. Title LXXII - Disclosure Modernization and Simplification Reduces paperwork for companies that make under $1 billion per year and want to offer stock to the public. Title LXXIII - Bullion and Collectible Coin Production Efficiency and Cost Savings Removes the requirement that collectable coins be 10% copper Title LXXIV - SBIC Advisors Relief Investment advisors who solely advise small business investment companies will be able to be excluded from registration requirements even if they are managing assets over $150 million (current limit for exemption from registration requirements). Title LXXV - Eliminate Privacy Notice Confusion Banks will not have to mail privacy notices to their customers if they haven't changed their policies since the last disclosure was sent. Title LXXVI - Reforming Access for Investments in Startup Enterprises Allows privately held shares to be sold to "accredited investors" without registering the securities with the Securities and Exchange Commission. Title LXXXII - Capital Access for Small Community Financial Institutions Allows privately insured credit unions to become members of Federal Home Loan Banks if they are FDIC eligible or are certified by the State If the State doesn't get to it in under 6 months, the application is deemed approved. Title LXXXIII - Small Bank Exam Cycle Reform Doubles the size of a bank that counts as a "small bank" from banks that have less than $500 million to banks that have less than $1 billion for the purpose of allowing those banks to have on-site examinations by regulators every 18 months instead of every year. As a firefighter and paramedic, Armando Martinez has seen first-hand how a "Safe-Passage" or "Move-Over" law affects the security of law enforcement and emergency-response personnel called to work on the highway. As a state legislator and vice chairman of the House Transportation Committee, Rep. Martinez is looking to not only expand the Safe Passage law to include TxDOT personnel, but to address a variety of other transportation issues across the state.
