Six years after its introduction, India's indirect tax system has undergone substantial changes because of the Goods and Services Tax (GST). In this podcast, businessline's Shishir Sinha talks to Darshan Bora, Partner, Economic Laws Practice and M S Mani, Senior Partner, Deloitte about various aspects of GST in India. Initially, businesses faced challenges, but the landscape of indirect taxes has significantly improved. The GST has eliminated multiple taxes and brought uniformity in tax rates across states, making it easier for businesses and consumers. A survey conducted by Deloitte also showed that 75% of industry professionals were satisfied with GST compared to the past. While GST has been successful, there are still areas that can be improved. One area is the complexity of the legal structure, which includes multiple laws and subordinate legislations. Simplifying the legal framework would contribute to making GST a simpler taxation system. The conversation also focuses on GST collections. The collection numbers have been increasing, and various factors have influenced these numbers. The economy's performance and actions by GST authorities to curb tax evasion are significant variables affecting collections. Regarding the functioning of the Authority for Advance Rulings (AAR), the guests suggest incorporating judicial members to provide a balance in rulings. Lastly, the conversation touches upon rate rationalization and the possibility of reducing the number of tax rates. Die Umsatzsteuer zählt zu den aufkommensstärksten Steuern. Gleichzeitig ist sie bereits systembedingt in besonderem Maße anfällig für Missbrauchsgestaltungen, wie Umsatzsteuerkarusselle. Hintergrund ist, dass der Vorsteuerabzug beim Leistungsempfänger gegebenenfalls zu gewähren ist, obwohl beim Leistenden die Umsatzsteuer nicht entrichtet wurde. Regelmäßig bieten Steuerbefreiungen im innergemeinschaftlichen Warenverkehr ein Einfallstor für derartige Missbrauchsgestaltungen. Gerichte auf nationaler Ebene als auch auf Unionsebene versuchen, dem Missbrauch in der Umsatzsteuer entgegenzuwirken. Insbesondere der Europäische Gerichtshof hat in den vergangenen Jahren eine umfassende Missbrauchsrechtsprechung im Zusammenhang mit der Mehrwertsteuer entwickelt, die mit Einführung des § 25f UStG am 1. Januar 2020 auf nationaler Ebene gesetzlich verankert wurde. Dr. Carsten Höink gibt im Interview mit Dr. Christian Rosinus einen Überblick, wie sich die Rechtsprechung des EuGH zur Missbrauchsbekämpfung in der Umsatzsteuer entwickelt hat und welche Maßstäbe sich daraus für die Tax Compliance Praxis ableiten lassen. In its Annual Financial Statement -- also called Union Budget -- the Central government provides details of how much money it expects to garner from various sources and how it intends to spend the funds India earns about 80% of its total revenue through taxes. While taxation is the primary source of income for the government, it also earns a recurring income, which is called non-tax revenue. This comes from dividends and profits of public sector enterprises, interest, fines, regulatory charges and user charges for publicly provided goods and services. Tax revenue comes from two categories -- Direct taxes and indirect taxes. Let us first understand direct taxes.  As the name suggests, it is levied directly on taxpayers. Direct taxes include income tax and corporation tax. Income tax is imposed on individuals and businesses other than companies. It is paid on the income earned during a particular financial year.  Corporation tax is the money paid by companies on the profits made by them in a given financial year. Direct tax also included inheritance tax and wealth tax, which were abolished in India in 1985 and 2015 respectively.  On the other hand, indirect taxes are levied by the government on goods and services, and not on the income, profit or revenue of an individual. India introduced Goods and Services Tax on July 1, 2017. It replaced several indirect taxes such as the excise duty, VAT, services tax, etc. It is not paid directly by a person to the government but collected by an intermediary such as manufacturer, trader or service provider and passed on to the government. The consumer bears the final economic burden of the tax. Indirect tax includes GST, central excise duty and customs. Central excise duty is an indirect tax levied on goods made in the country. In Financial Year 2021, India's direct tax collection stood at Rs 9.45 lakh crore while the indirect tax collection was at Rs 10.71 lakh crore. Direct taxes in India are overseen by the Central Board of Direct Taxes (CBDT) and indirect taxes by the Central Board of Indirect Tax and Customs. Direct taxes are considered more equitable. In most developed countries, the share of direct taxes in the total taxes collection is far more than the indirect taxes. According to the latest data, the OECD average for direct tax collection in 2018 was 67.3% of the total tax collection. While for India, it was 38.3% for Financial Year 2019. Direct taxes are imposed on those individuals who can afford it. It is linked to the tax payer's income level. Higher the income, the higher is the income tax liability. While high indirect taxes are considered regressive. They are paid by everyone at the same rate, irrespective of their income or financial status. A poor man pays the same amount of tax on soap as the rich man.  The shares of direct taxes and indirect taxes also indicate how the government has managed its public finance. In 1991, for instance, the share of direct taxes in GDP was about 2% and that of indirect taxes in GDP was over 8%. In 2007-08, just before the global financial crisis, the shares had changed to 6% of GDP each for direct and indirect taxes. In 2020-21, direct taxes had a share of 4.7% of GDP, while indirect taxes' share in GDP was about 5.4%. Low direct tax and low corporate tax suggest that the tax burden is shifting towards the poor. #Authentication of #Aadhaar #number under the #GST Act The #Central #Board of #Indirect #Tax and #Customs (CBIC) had issued a #notification on 23rd March 2020, about #Aadhaar #authentication for #GST #registration from 1st April 2020. The same has been #amended vide notification 62/2020 dated 20th August 2020 to be made optional. The #aadhaar #authentication for #GST #registration is not required for non-residents, #persons other than citizens of India, and persons who have already been registered under GST. As per the latest #notification, every applicant for GST registration can opt for the Aadhaar authentication. The #exceptions are person #exempted by the #Central #government under the CGST Act or those who must mandatorily undergo the Aadhaar authentication under section 25(6C) of the CGST Act. The #revised rule will be effective for applications made on or after 21st August 2020. #Mandatory Cases of Aadhaar Authentication As per Section 25(6C) of the CGST Act, the Aadhaar #authentication is mandatory for the following class of individuals as per Rule 8 of the CGST Act in order to become eligible for the GST registration: 1. Authorised signatory of all types 2. Managing/authorized partners of a partnership firm 3. Karta of a #Hindu #Undivided #Family

We kicked off the podcast by asking both Anitha and Bart about their experiences with Digital Services Tax – the new kid on the block in their industry. It’s something that both eBay and Expedia, as online marketplaces, must deal with. However, they both explain how their departments deal with the legislation differently. Anitha is positive about changes in the Tax sector, as it keeps her role interesting. Bart agrees that professionals must remain savvy to the new platforms in the Tax ecosystem. Due to the changing demands of the function, Bart discusses why Tax newbies should go down that route in the first place and the roles available. Anitha runs through the characteristics that she believes good Tax professionals need, especially those interested in Indirect Tax. We also found out Bart’s golden nugget of recruitment – it’s a top tip that any professional in any discipline can apply to the interview process!
