The massive layoffs at Jeff Bezos's Washington Post involve more than just the financial situation at the paper. The Amazon founder's real priority is keeping Donald Trump happy so the money keeps flowing from his lucrative government contracts. Observers are concerned that the search is the beginning of a broader effort to relitigate the 2020 election—especially as Trump calls for Republicans in Congress to “nationalize elections” in advance of the November mid-terms. What do we know about the legal basis for this search? And what does it tell us about what the Trump administration has planned for November?“I Hear the Jury's Still Out on the Fourth Amendment.” Over the past week, whistleblowers have revealed that ICE has issued a series of internal memos to agents advising that they do not need judicial warrants to detain or search the homes of people suspected of being undocumented immigrants. Instead, ICE has attempted to side-step the regular judicial process by suggesting that agents only need an administrative warrant, a controversial move that will almost certainly be challenged in court. What do we think of ICE's decision to shift to such a legally dubious policy, and where do we expect it to go from here?“Ex Post Justification.” Last month, the FBI conducted a search on the home of Washington Post reporter Hannah Natanson as part of an investigation into alleged leaks by a Defense Department contractor. During the search, agents seized Natanson's personal and professional devices, which drew concern from media outlets and civil liberty groups over potential First Amendment and privacy violations. A magistrate judge has now ordered that the FBI cannot access Natanson's materials at least for now, while some of these issues are litigated. How should federal law enforcement balance the need to conduct leak investigations with press freedoms? The goal of the US government is to send aliens home immediately (they get cash and a free plane ticket) with the fewest days in custody as logistically possible. Any delay is caused by the fake asylum claim. 6. When the fake asylum claim is heard on the “non-detained” docket the illegal aliens rarely show for their hearings. Those few who do show stay in the country regardless after losing (unless placed into detention). Removal orders are ignored as a matter of course. If and when absconders are eventually found (at great time and expense) they still have to be detained to actually effectuate the removal. At this point in time their lawyers will file a motion to reopen their asylum claim or otherwise appeal the finding and seek release again. Regardless, no removal of any alien anywhere can occur unless in a detained setting. If the alien has children they are, by law, supposed to stay in a family residential center (that costs more per night than a high-end hotel, and includes full medical, dental, scholastic and other services) 7. This week, Scott sat down with his Lawfare colleagues Molly Roberts, Michael Feinberg, and Troy Edwards to talk through the week's big warrant-related national security news, including:“Tulsi Went Down to Georgia, She Was Looking for a Vote to Steal.” This past week, the FBI executed a warrant to search Fulton County's election center for ballots and equipment related to the 2020 election, with the help of an unlikely senior administration official: Director of National Intelligence Tulsi Gabbard, who was reportedly there in-person at the order of President Trump. Observers are concerned that the search is the beginning of a broader effort to relitigate the 2020 election—especially as Trump calls for Republicans in Congress to “nationalize elections” in advance of the November mid-terms. What do we know about the legal basis for this search? And what does it tell us about what the Trump administration has planned for November?“I Hear the Jury's Still Out on the Fourth Amendment.” Over the past week, whistleblowers have revealed that ICE has issued a series of internal memos to agents advising that they do not need judicial warrants to detain or search the homes of people suspected of being undocumented immigrants. Instead, ICE has attempted to side-step the regular judicial process by suggesting that agents only need an administrative warrant, a controversial move that will almost certainly be challenged in court. What do we think of ICE's decision to shift to such a legally dubious policy, and where do we expect it to go from here?“Ex Post Justification.” Last month, the FBI conducted a search on the home of Washington Post reporter Hannah Natanson as part of an investigation into alleged leaks by a Defense Department contractor. During the search, agents seized Natanson's personal and professional devices, which drew concern from media outlets and civil liberty groups over potential First Amendment and privacy violations. A magistrate judge has now ordered that the FBI cannot access Natanson's materials at least for now, while some of these issues are litigated. How should federal law enforcement balance the need to conduct leak investigations with press freedoms? Today's Headlines: While U.S. officials continue to shrug at the Epstein files, Europe is once again doing the most. Lithuanian prosecutors announced a human trafficking investigation after reviewing information tied to the Epstein documents, citing connections to Lithuanian models and artists and urging potential victims to come forward. Back stateside, DHS said it will pull 700 federal immigration agents out of Minnesota following weeks of aggressive enforcement, though roughly 2,000 agents will remain after about 3,000 arrests during “Operation Metro Surge.” The Supreme Court also issued an emergency ruling allowing California to use its newly redrawn congressional map, after Democrats responded to Trump's push for GOP-led states to aggressively gerrymander ahead of the 2026 midterms. Meanwhile, new reporting revealed that days before Trump's inauguration, his family quietly sold nearly half of their crypto company to an Emirati royal with deep intelligence ties, a deal now under scrutiny by House Democrats over national security concerns tied to advanced U.S. AI chips. Elsewhere, the EEOC announced it is investigating Nike for allegedly discriminating against white employees as part of its DEI programs, marking a first-of-its-kind case.
