Klaus-Michael Kühne – HSV-Aktionär und Geldgeber – dürfte insgesamt einen neunstelligen Betrag in den HSV investiert haben.In Hamburg auch bekannt durch die Kühne-Stiftung, investiert Kühne in die in der Hafencity ansässige Kühne Logistics University oder in die Elbphilharmonie. Jüngstes Prestigeprojekt ist der Bau einer neuen Oper, für das die Stiftung bis zu 340 Millionen Euro bereitstellt.Kühnes Vermögen wird auf ca. 38,9 Milliarden Dollar geschätzt. Damit ist er der zweitreichste Deutsche. Doch wo kommt all das Geld her?Kühne ist Mehrheitsgesellschafter der Kühne + Nagel Gruppe, einem der größten Transport- und Logistikunternehmen der Welt. 1890 gegründet, stieg das Speditionsunternehmen im 20. Jh. rasant auf. Strukturell wichtig für die heutige Stellung ist ausgerechnet: die Zeit des Nationalsozialismus.Als NS-Musterbetrieb ausgezeichnet, stellte sich Kühne + Nagel unter der Leitung von Kühnes Vater Alfred und seinem Onkel Werner in den Dienst des NS-Regimes. Die Brüder Kühne traten bereits am 1. Mai 1933 in die NSDAP ein und drängten im selben Jahr den jüdischen Hauptanteilseigner Adolf Maass aus der Firma. Adolf Maass wurde in Auschwitz ermordet.Kühne + Nagel profitierte von der Verwertung Eigentums jüdischer Deportierter aus den besetzten Gebieten – der sogenannten M-Aktion. Mit logistischer Unterstützung der Firma wurden ab 1942 die Besitztümer zehntausender deportierter Jüdinnen und Juden nach Deutschland transportiert. Die Möbel wurden unter Wert auktioniert oder an Ausgebombte verteilt, um die Kriegsmoral der Bevölkerung aufrechtzuerhalten.Alfred und Werner Kühne wurden auch deshalb nach dem 2. Weltkrieg im Prozess der “Entnazifizierung” Westdeutschlands in der zweithöchsten Belastungskategorie als “Aktivist und Nutznießer” geführt, ehe sie auf Initiative der US-Militärregierung als “Mitläufer” entlastet wurden. Schon 1948 durften sie wieder ihre Firma führen und die Internationalisierung des Unternehmens auf Grundlage der zur NS-Zeit geschaffenen Infrastruktur vorantreiben.Die Firma Kühne + Nagel war damit einer der Hauptprofiteure der sog. „Arisierungs“-Politik der Nazis, hat an der massenhaften Verfolgung, dem Raub und der letztendlichen Ermordung von Jüdinnen und Juden in der NS-Zeit verdient und war somit Mittäter.Und was sagt Klaus-Michael Kühne dazu? Bis heute gibt es nur zaghafte Bekundungen zur Rolle des Unternehmens in der NS-Zeit. Eine angemessene Aufarbeitung fand bislang nicht statt.Was folgt daraus? Es stellt sich explizit nicht die Frage, welche Schuld Klaus-Michael Kühne an den Verbrechen der Nazis trägt. Hierfür trägt er selbstverständlich keine Schuld, er war zur NS-Zeit noch ein Kind. Es geht um seine Verantwortung in der heutigen Zeit, mit der Schuld seines Vaters, Onkels und Unternehmens und seinem maßgeblich auch hieraus folgenden Wohlstand umzugehen. Gerade weil Politik und Recht eng zusammenhängen, weist die Theorie sozialer Systeme auf ihre unterschiedlichen Systemreferenzen hin. Ein Beobachter kann zwar erkennen, dass sich politische und rechtliche Operationen (Kommunikationen) gegenseitig bedingen und aufeinander auswirken. Daraus lässt sich jedoch nicht ableiten, dass die Systeme eine Einheit bilden würden. Die Theorie sozialer Systeme geht von getrennten Systemen aus und macht das u.a. an folgenden Begriffen fest. Beide Funktionssysteme vollziehen ihre Autopoiesis (Selbstreproduktion) in jeweils operativer Geschlossenheit. D.h., die Kommunikation unterscheidet laufend, ob sie dem eigenen Netzwerk zuzuordnen ist oder nicht. Ausschlaggebend ist, ob die Kommunikation den eigenen Code berührt. Codes sind binäre (zweiwertige) Leitunterscheidungen. Beide Systeme verwenden unterschiedliche Codes. In der Politik dreht sich alles um die Unterscheidung von machtüberlegener/machtunterlegener Kommunikation. (Milder ausgedrückt: Die Kommunikation unterscheidet Regierende/Regierte, Regierung/Opposition, Amtsmacht/keine Amtsmacht.) Die leitende Unterscheidung des Rechtssystems ist dagegen: Recht/Unrecht. Zusätzlich wird differenziert, ob ein Fall gleich/ungleich ist. Auf diese Weise überprüfen beide Systeme laufend im Prozess der Kommunikation, wo die Grenze des jeweils eigenen Systems zur Umwelt verläuft. Sie konstruieren sich selbst als System in Differenz zur Umwelt (System-Umwelt-Differenz). Beide pflegen rekursive (rückbezügliche) Netzwerke. Die Kommunikation bezieht sich auf Begriffe mit unterschiedlicher politischer/rechtlicher »Vorgeschichte« zurück. Bereits in der Vergangenheit haben politische/rechtliche Kommunikationen auf unterschiedliche Weise Bezug auf Begriffe genommen – zu verschiedenen Zeitpunkten und in verschiedenen Kontexten. Jede dieser früheren Kommunikationen hat ihren eigenen Zeithorizont, ihre eigene Begriffs-Vernetzungsgeschichte. Z.B.: Bundestagsdebatten und rechtswissenschaftliche Studien zum Begriff der Souveränität. Durch Verweisen auf Begriffe werden Kommunikationen (die bereits in der Vergangenheit vernetzt waren) in der Gegenwart neu miteinander vernetzt. Es wird ein jeweils spezifisch rechtlicher/politischer Sinn erzeugt. (Sinn bedeutet: Verweisen auf anderes.) Kurz, ein Beobachter kann zwar erkennen, dass ein Akt wie das Erlassen eines Gesetzes beide Systeme gleichzeitig »betrifft«. Der Sinn, der sich daraus für Politik und Recht ergibt, war und ist jedoch nicht derselbe. Beide Systeme verfolgen unterschiedliche Programme. Die Politik operiert mit Zweckprogrammen (Um-zu-Konstruktionen dienen der Zweckverfolgung, dem Erreichen eines Ziels). Das Recht nutzt Konditionalprogramme (Wenn-dann-Konstruktionen: Jeder Sachverhalt wird an Bedingungen geknüpft. Mehrere Bedingungen können durch und/oder-Konstruktionen verknüpft werden.) Die Operationsweisen beider Systeme sind nicht aneinander anschlussfähig. Simpelstes Beispiel: Das Gericht kann kein Gesetz erlassen, die Politik kein Rechtsurteil sprechen. Dass Recht und Politik keine Einheit bilden, zeigt sich auch darin, dass sie in der Übergangsphase (16. bis 19. Jh.), in der sie sich voneinander und von der Kirche abgegrenzt haben und autonom wurden, kein einheitliches Symbol finden konnten, um die behauptete Einheit einheitlich zu erklären. Das Recht verweist auf die Geltung des Rechts. Der Geltungsbegriff umfasst sowohl die Rechtsgültigkeit des Gerichtsurteils als auch die Geltung der von der Politik erlassenen Gesetze. Also: beide Systeme. Die Politik verweist dagegen auf den Staat und damit auf die Gewaltenteilung zwischen Judikative (Rechtsprechung) und Legislative (Rechtsetzung; wobei auch die Exekutive der Politik unterstellt ist). (Dies schließt nicht aus, dass auch das Recht den Staatsbegriff benutzt.) Man sucht also Einheit und entdeckt Differenz. Die behauptete Einheit blieb zwangsläufig rätselhaft. Śrīla Rūpa Gosvāmī finally reached Prayāga and met with Śrī Caitanya Mahāprabhu for ten successive days. During this time, Vallabha Bhaṭṭa extended an invitation to the Lord with great respect. Śrī Caitanya Mahāprabhu introduced Śrīla Rūpa Gosvāmī to Vallabha Bhaṭṭa. After this, a brāhmaṇa scholar named Raghupati Upādhyāya arrived and discussed Kṛṣṇa consciousness with the Lord. Kavirāja Gosvāmī then extensively describes the living condition of Śrī Rūpa and Sanātana at Vṛndāvana. During the ten days at Prayāga, Śrīla Rūpa Gosvāmī was instructed by the Lord, who gave him the basic principles of the Bhakti-rasāmṛta-sindhu. The Lord then sent Śrīla Rūpa Gosvāmī to Vṛndāvana. The Lord Himself returned to Vārāṇasī and stayed at the home of Candraśekhara.
