As tax competition for lower rates continues around the world, America may well become an economic laggard with businesses leaving its shores for low tax jurisdictions. The Wall Street Journal's editorial board (https://www.wsj.com/opinion/kamala-harris-corporate-tax-increase-business-wages-2024-election-746ee509) opined by stating: "The Democratic team that brought you declining real wages is now threatening to lower your pay again. That's the practical effect of Kamala Harris's idea to raise the U.S. corporate tax rate to 28%, and it's instructive that an anti-growth tax increase is one of the Vice President's few distinctive policy priorities so far. Ms. Harris's endorsement Monday of a 28% rate, up from the current 21%, signs onto what President Biden has been proposing." Over the decades, there have been certain forces decrying the ills of capitalism and making unsubstantiated claims. The think tank The Institute of Economic Affairs, which offered reformer Margaret Thatcher strategic ideas on turning Great Britain away from socialism in the 1970s and 1980s states: "...but when we see such unsubstantiated claims, we should remember; the data simply doesn't support the anti-capitalists." The discussion also raises the concerns of skyrocketing government spending. Milton Friedman, Nobel prize winner in economics and founding partner of International Leaders Summit (the think tank which launched America's Roundtable) said: “Keep your eye on one thing and one thing only: how much government is spending, because that's the true tax … If you're not paying for it in the form of explicit taxes, you're paying for it indirectly in the form of inflation or in the form of borrowing." On April 14, 2015, The Acton Institute and the Mackinac Center for Public Policy jointly hosted Timothy Carney for a lecture on the topic "Is Big Business a Danger to Economic Liberty?" Timothy P. Carney is the senior political columnist at the Washington Examiner, a visiting fellow at the American Enterprise Institute, and the author of three books. Tim was a 2012 Pulliam Distinguished Visiting Fellow at Hillsdale College and he sits on the board of visitors for the Institute for Political Journalism. A protégé of the late columnist Robert Novak, Tim was senior reporter at the Evans-Novak Political Report and became editor when Novak retired in 2008. His work has appeared in the Wall Street Journal, New York Post, and many other publications. He is author of Obamanomics (2009) and The Big Ripoff (2006), which won the Templeton Enterprise Award from the Intercollegiate Studies Institute and the 2006 Lysander Spooner Award for the "best book on liberty." Tim is a native of Greenwich Village and an alumnus of St. John's College in Annapolis. The Constitution protects economic liberty,  but only against regulations that lack a rational foundation in a legitimate governmental interest. Two recent cases from the U.S. Court of Appeals for the Fifth Circuit show how slippery this principle can be in practice. The underlying principle is alive and well, but "rationality" is a fairly easy burden for a regulator to satisfy. In one, a Louisiana ban on the making of funeral caskets by Catholic monks was struck down (in no small part, because the ban served to benefit the funeral home directors who controlled the relevant agency). In the other, a Texas ban on telemedicine by veterinarians was affirmed, by a 2-1 vote, on the rational basis that pets cannot talk while humans can. (The dissent was swayed by the argument that babies cannot talk either, but we allow pediatricians to treat them by telemedicine).

The roundtable discussion covered "Federalism's Contribution to Economic Liberty: Catalyzing Technological Advancement and Economic Growth".Does the Fourteenth Amendment guarantee economic liberty? If not, what role might states play in advancing economic liberty? Frustrated with the federal government’s inability or unwillingness to solve regulatory or competition-based problems, some states have taken matters into their own hands. This panel will address how states have been, and still can be, laboratories of democracy when it comes to regulation and catalyzing economic growth. The government requires a license to work about 500 different jobs. How arbitrary and unreasonable can those licensing requirements be before they violate your constitutional (state or US) rights to earn an honest living? Can the government pass laws just to protect established businesses with good lobbyists? If the regulations violate your rights, what can you do?  My guest today is Arif Panju (@arifpanju) of the Institute for Justice (@IJ). Arif and IJ have sued the government in state and local courts to protect the rights of regular folks to earn a living without unreasonable government interference. On Thursday, June 21, 2018, NACDL hosted a discussion about the model legislation and a review of states that have enacted occupational licenses. Speakers included Lee McGrath, Managing Attorney of the Institute for Justice Minnesota office and IJ’s Senior Legislative Counsel; and Joshua House, an attorney with the Institute for Justice. The Institute for Justice has developed a campaign including model legislation that serves as a resource for state legislatures to institute laws designed to alleviate the barriers those with a conviction are faced with in applying for licenses. NACDL is supporting the occupational licensing model legislation (“Occupational Licensing Review Act”) and the “Model Collateral Consequences Reduction Act.” Background One of the primary barriers for those formerly incarcerated who are reentering the workforce is the ability to obtain an occupational license. While incarcerated, many individuals are trained and employed in industries that require a license. However, even upon reentry they are unable to apply for these licenses that would enable them to work in those very fields that could essentially help end the ever-revolving recidivism door. The Federalist Society hosted a lunch and discussion on the role of Economic Liberty in the United States on Tuesday, March 28, 2017. -- Today, many job-seeking Americans and companies face significant government barriers that restrict their full participation in the economy. These barriers, often in the form of restrictive regulatory regimes, prevent consumers from using their skills, entering new professions, and starting new businesses. They also prevent low and middle-class Americans from moving up the ladder. Competition and free markets have the power to spur innovation, create new business models, and drive economic opportunity and growth. -- Policymakers, like Acting Chair of the Federal Trade Commission Maureen Ohlhausen, have begun to take actions to address these barriers. For example, Ms. Ohlhausen recently announced the creation of an Economic Liberty Task Force to advance economic liberty issues, with a particular focus on occupational licensing regulations.
