AI Is Not Your Lawyer: Protecting Client Privilege with Kent Berk | Ep 189

Great Practice. Great Life. by Atticus

Steve Riley sits down with attorney Kent Berk this week, on Great Practice, Great Life, to unpack a case every lawyer needs to understand: United States v. Heppner. A former CEO who used a free Claude account to draft thirty-one documents before he was indicted, and prosecutors seized every one of them. The judge ruled none of it was privileged because no attorney directed the work. The bigger lesson extends far beyond one criminal case. Clients are already using ChatGPT, Claude, Gemini, and other AI tools to research legal issues, draft timelines, summarize facts, and develop strategies, often without telling their attorneys. Kent and Steve explain why that creates new risks for attorney-client privilege, confidentiality, discoverability, and even the quality of evidence in a case. Whether you run a solo practice or a growing firm, this episode offers a roadmap for addressing AI with clients before a preventable mistake becomes a costly problem. The message is clear: AI is here to stay, but legal judgment, privilege, and client trust still require a lawyer. ___________ In this episode, you will hear: How the United States v. Heppner decision stripped privilege from documents created in a free AI account Why attorney-client privilege does not automatically extend AI tools The hidden risk of clients using AI before, during, and after they hire counsel What attorneys should add to intake processes, engagement letters, and firm AI policies Why AI can assist legal work but can never replace attorney judgment ___________ Subscribe & Review Never miss an episode. Send us your feedback In this episode, Technology Partner Tom Maasland and Litigation Senior Associate Oliver Sutton revisit the evolving intersection of artificial intelligence and legal privilege, highlighting some recent court decisions and the impact they may have in this area of law.[00:58] Tom and Oliver open the episode with a brief recap of their earlier Tech Suite episode on AI and legal privilege, noting that emerging case law is now offering clearer judicial guidance on how legal privilege applies in the context of the use of artificial intelligence tools.[03:00] Oliver discusses and compares two recent U.S. decisions; United States v. Heppner, 25 Cr. 503 (S.D.N.Y. Feb. 10, 2026), and Warner v. Gilbarco, 820 F. Supp. 3d 629 (E.D. Mich. 2026), each of which considered the impact of the use of AI tools on legal privilege. The cases reached different outcomes, highlighting how fact-specific these determinations are likely to be.[08:38] They then consider a UK Upper Tribunal decision, UK and R (on the application of Munir) v SSHD [2026] UKUT 81 (IAC), in which it was suggested that the use of open-source AI tools is likely to breach client confidentiality and result in a waiver of legal privilege, while noting that closed source enterprise AI systems may present a lower risk.[10:03] Tom and Oliver discuss the implications of these decisions in a New Zealand context and in the absence of more direct guidance from New Zealand courts.[10:51] Oliver then talks through four practical takeaways from these cases for practitioners and clients navigating AI use in a legal setting.Information in this episode is accurate as at the date of recording, 5 June 2026.Please contact Tom Maasland, Oliver Sutton or our Litigation team if you need legal advice and guidance on any of the topics discussed in the episode. And don't forget to rate, review or follow MinterEllisonRuddWatts wherever you get your podcasts. If you're curious about how AI is changing criminal defense, attorney-client relationships, and the law itself, you'll want to listen in.I'm Steve Palmer, and I'm digging into a topic that's becoming increasingly important in the legal world—"AI is NOT Your Attorney."In this episode, I start by reflecting on a classic lesson from law school: a lawyer isn't a bus, and now, more than ever, a lawyer isn't a robot either. That idea sets the stage as I walk you through a recent case out of New York—United States vs. Heppner—where the defendant used AI to analyze his legal defense. The government seized those AI-generated results and saw them as a strategic goldmine, raising big questions about attorney-client privilege in our high-tech age.I break down why plugging legal advice into AI isn't protected by privilege—once you enter that information into a digital system, you might be waiving your rights to confidentiality. From Zoom recordings to AI transcription tools, these digital conveniences can easily erode the protection clients expect.I share practical advice for lawyers and clients on safeguarding privilege in a tech-driven landscape, and offer my thoughts on the legal precedents just beginning to take shape.Remember, I'm not giving legal advice here—just sharing insights and real talk on today's pressing legal challenges.3 Key Takeaways:AI is Not Privileged: Plugging sensitive legal information into AI tools—even for personal analysis—can destroy attorney-client privilege. AI is a third party, just like any non-lawyer in the room.Old Rules, New Tech: Courts are applying existing privilege rules to AI, meaning that any communication shared with or processed by AI platforms could be discoverable by opposing counsel or the government.Be Ultra-Cautious: Lawyers and clients must be careful with technology in legal settings. From transcription devices to Zoom recordings with disclaimers—if a third-party tool is present, privilege may be lost.Got a question you want answered on the podcast? Are you risking your legal case by chatting with open AI platforms like ChatGPT or Claude? You're not alone, and this episode reveals critical insights that could save your case—whether you're a lawyer, a client, or someone handling sensitive info. In this eye-opening discussion, Kevin Szczepanski dissects two landmark cases—US v. Heppner and Warner v. Gilbarco—that show how courts are scrutinizing AI communications in both criminal and civil contexts. Learn why, in the Heppner case, prompting AI without your lawyer's guidance led to the betrayal of attorney-client privilege, and why, in Warner, a pro se litigant's use of AI didn't waive work product protections. These rulings might seem straightforward, but they hold powerful lessons for anyone using AI to handle sensitive legal, financial, or personal information. Listen in for Kevin's analysis and stay tuned for updates on this increasingly relevant and complex topic.

In this episode, Kevin Szczepanski walks through the details of United States v. Heppner. In this landmark case, a federal judge ruled that a client's use of Claude, an open AI platform, is not protected. As Kevin explains, the court determined that using the AI to “do his own research” exposed the client and waived protections so that neither the attorney-client privilege nor the work product doctrine applied. Hear about why communications with open AI platforms like Claude, Gemini, and ChatGPT aren't confidential; how courts analyze whether a client is seeking legal advice via AI; and practical steps for attorneys and clients in the era of generative AI. This episode is essential listening for lawyers, compliance officers, and legal tech adopters who want to avoid costly mistakes and leverage AI responsibly. If you rely on AI to assist your legal work—or plan to—listen in.

Long before the 1969 Woodstock festival put the town on the map, it had been a center for artists and free thinkers who found refuge in its rural setting. Longtime citizens were often shocked by the arrival of these newcomers who brought new values and attitudes to their once-isolated village. From the transformative arrival of artists in the early twentieth century to the influx of musicians and young people in the 1960s, Woodstockers worked and struggled to balance everyday life in a small, rural community with the attention and notoriety the outside world brought to it.  Presented chronologically, Woodstock: From World War to Culture Wars (SUNY Press, 2024) examines the nature of change within Woodstock's uncommon story as it emerges from the Great Depression, confronts the realty of World War II, moves through the 1950s and into an unimagined and unintended future with the arrival of the Sixties through today. At its core, this is a story of how Woodstock's cultural and political institutions, its citizens, and its physical landscape met the ever-changing challenges of changing times. Evolved Caveman
Episode 1: Why Masculinity Is Now A Central Theme In Politics

Evolved Caveman

Play Episode Listen Later Sep 9, 2024 61:44

Millions of men are tired of the way in which MAGA Republicans have defined masculinity in the traditional, restrictive fashion - emphasizing the “hard” side of men and shaming the “soft” side. This includes prioritizing independence over interdependence, thinking over feeling, autonomy over connection, and emotional suppression over vulnerability.  The old view is “power over” others rather than “power with”. The old view is to exert control over women which is demonstrated by MAGA's views on abortion and birth control. The solution is not to prioritize the hard side of masculinity over the soft side. Nor is it to prioritize the soft side over the hard side. The solution is to create a climate which values all sides of masculinity (or even better, humanity!), so that we may bring the best aspects of ourselves to any situation as needed. The solution is to stop shaming men when they feel natural, healthy human emotions (think of how Gus Walz was treated when he displayed love, connection and pride over his father at the DNC). What is the Man Box?  It's the rules you absorbed as a boy about what it means to be a “real man”; rules that have made you emotionally constipated, caused conflict in your romantic relationship, encouraged you to chase material things, and caught up in a hyper-competitive rat race. The rules include such classics as be tough, hide your feelings, dominate women, be self-reliant, don't be feminine, and don't be homosexual. Research shows that this restrictive, tired view of masculinity has negative effects on us. The more we subscribe to traditional Man Box beliefs, the lower our self-esteem (Cournoyer & Mahalik, 1995), the more difficulties we have in romantic relationships and friendships (Fischer & Good, 1997; Sharpe & Heppner, 1991), the more we act in violence (Franchina, Eisler, & Moore, 2001), and the more depressed and anxious we feel (Cournoyer & Mahalik, 1995; Hayes & Mahalik, 2000).Join Dr. John Schinnerer and Mark Greene in a fascinating conversation about the Man Box culture, and how it's playing out in politics right now. The solution is not to flip the script so that we overvalue the soft aspects of men over the harder aspects.  The goal is to honor both the hard and the soft sides of our humanity equally. It's giving men permission to tap into all aspects of their humanity so that they are comfortable bringing the best parts of themselves to a particular situation. This is not a problem at an individual level. It is a cultural issue, a culture in which the full spectrum of our humanity has yet to be valued fully. The thing I love about the Man Box idea is that none of this is your fault. You didn't ask to be socialized like this. You had no control over it. It just happens. So keep in mind that while this is not your fault, it is your responsibility to evolve beyond the Man Box. And that's what we are seeking to do in this election, discover more ways to evolve our masculinity.About Dr. John's Esteemed Guest, Mark Greene:Mark Greene works to engage men in creating diverse, equitable, and inclusive workplace cultures. We are humbled to meet our next guest, Kristina Heppner, in her small room at the halfway house where she currently resides with her boyfriend, James, as they await the paperwork to move into their new apartment. As we set up the table and chairs, the room exudes a warm and inviting atmosphere, giving us a sense that Kristina's stories will be powerful and healing.Kristina had a privileged middle-class upbringing, with a wonderful childhood and a stay-at-home mom, while her dad worked as an engineer. It was an idyllic and beautiful American childhood. However, she distinctly remembers the events of 9/11, which triggered anxiety and separation anxiety with her mom, manifesting as she progressed through third grade. As time went on, she started experimenting with drugs and alcohol in high school, leading to a fateful night where she unknowingly consumed a laced drug, plunging her into a dark and challenging place.Subsequently, Kristina's life took a tumultuous turn, as she found herself in and out of mental hospitals, spending a year on the streets, and experiencing various foster homes. Her story is undeniably difficult, but amidst the hardships, there is a glimmer of hope and courage that shines through. We explore this resilience in the episode. One of the toughest moments in the interview was discussing the heart-wrenching decision to give up her children when they were just three and four years old, a consequence of her addiction and illness. Like many guests of The Jar who have traveled challenging paths, we often find that hope is embedded within their stories. For Kristina, that hope lies in the prospect of having her own apartment, a chance to start anew and take control of her life's trajectory. We invite you to join us as we sit down with Kristina and listen to her story through The Jar, witnessing her journey of struggle, but also witnessing her unwavering hope and determination to rebuild her life. For more of The Jar, visit:Website: https://www.thejar.live/Youtube: https://www.youtube.com/channel/UCaTqB1dhDvl0Oh505ysdxTgFacebook: https://www.facebook.com/podcast.thejarInstagram: https://www.instagram.com/thejar_podcast/Disclaimer: The views stated in this episode are our guest's opinions and do not represent the views, beliefs or opinions of The Jar Podcast. In this episode of Agency Intelligence podcast, host Jason Cass interviews Dwight Heppner, Manager of Digital Strategy at Guild Insurance Group. Episode Highlights: Dwight discusses his roles as the Manager of Digital Strategy, what Guild Insurance does, and how they utilize robotic processing automation. (5:47) Dwight explains that after doing a thorough cost analysis, they discovered that it takes the brokers 5 minutes to complete the pre-renewal procedure, but the bot they built with Quandri just takes 30 to 40 seconds. (8:03) Dwight explains how they conduct their full cost analysis and identify the process's pain points. (11:39) Dwight explains that their next step is in Epic, which will pull up both policies in electronic data format, and the bot will compare the old and current policies and then bring back that information and put it in an activity for the broker. (14:18) Dwight mentions that his next goal with Quandri is to analyze their whole book of personal lines policies ahead of time. (16:58) Dwight explains the importance of brokers having accurate data or background information while working with clients. (21:38) Dwight shares that in the personal lines market, they have 12,000 policies for homeowners that they are working on. (25:08) Dwight believes that robotics improve people's capacity to handle a bigger volume of business. (32:22) Key Quotes: “My next goal, and it's something you know, I've talked to Quandri about, and it's definitely possible, it probably takes a little bit from their back end, is to do that analysis on our full book of personal lines policies beforehand.” - Dwight Heppner “We might get to a point where innovation is starting to help us with the size and what we're doing with our clients. I think that that's a huge piece to all of this, for sure. ” - Dwight Heppner “I've talked to a lot of people in the last little while, and they're like, “How do I start?”, “What do I do?” And it's, get your data cleaned up, right? Try and make sure you have good data, because when you move it in Epic, that doesn't mean it's clean, right? Your opportunity is now to do that.” - Dwight Heppner Resources Mentioned: Dwight Heppner LinkedIn Guild Insurance Group Reach out to Jason Cass Agency Intelligence
