“A company can't produce income without assets. So protecting assets is critical to the survival of every company.” – Hendrith Vanlon Smith Jr Jason A. Duprat, Entrepreneur, Healthcare Practitioner, and Host of the Healthcare Entrepreneur Academy podcast, talks about Asset Protection and decreasing the risk of being involved in a lawsuit. In this episode, Jason shares real-world scenarios faced by successful but unprepared individuals as well as relevant advice to avoid getting caught up in a similar situation. Hire a qualified attorney specializing in Asset Protection. EPISODE HIGHLIGHTS: During the pre-filing phase, law firms hire private investigators to do public record searches to figure out how many potential assets their target defendant has. Make sure that anything that you own is not going to show up in a public record search. In another episode, Jason talked about Asset Protection. Certain states have something called "Tenancy by the Entirety" which creates strong protection for your home. Here's an example of assets you want to keep hidden: houses, cars, boats, and businesses. Problems sometimes arise when people create their business by filing with their Secretary of State themselves. They tend to make mistakes such as listing themselves as the registered agent and the manager of the business and revealing themselves to the public. Settlement Value Calculation: What attorneys use to determine whether or not they're going to pursue a case. Jason follows YouTuber Attorney Toby Mathis who talks about this same concept and refers to it as Security through Obscurity. Work with a qualified attorney who specializes in Asset Protection. TAKE NOTE: There are business attorneys who have no experience in Asset Protection. To make your house undiscoverable, you can use a Land Trust. The title goes into the Trust's name and there's a trustee assigned. To get yourself off of a vehicle's title, have an LLC own it. If you own businesses, you don't want them directly tied to your name. Paying for a registered agent will keep your name off the Secretary of State's website. If you're going to settle, make sure you're settling within insurance limits, that you have plenty of insurance, that you appear as if you own nothing, and you remove yourself from the public record. How do you know if a person is "right for the job?" In this episode, Jason A. Duprat teaches you never-before-heard secrets and best practices on his hiring process. Developed by his amazing Executive Assistant, Jason's screening method pinpoints all the crucial factors to dig into before hiring someone, and we'll even get to hear some of the interview questions he personally uses. EPISODE HIGHLIGHTS Jason's original screening method was to interview applicants based on character traits and then train them on whatever skills they're lacking later on. It costs a small fortune to train somebody who doesn't know what they're doing. To save time on training, assess excellence from the very start. They have partners elsewhere. J.M. primarily focuses on auto, home, and life insurance. They are currently partnering with many mortgage brokers and realtors, which is driving growth. Don’t get held up on price. Find an agent you can meet with face-to-face and help them learn what’s important to you. When an agent knows what’s important to you, they can help you get the proper protection. The price of premiums goes up and down. Often in life, you get what you pay for. When it comes down to Airbnb, lots of people are choosing to stay in homes instead of hotels. Perks of staying in a short-term rental include more space for large groups, kitchens to cook in, free parking, and proximity to local attractions. Rules and regulations for short-term rentals are constantly changing in Ohio. For example, in Tennessee you need a short-term rental permit to rent out your property short-term. In Ohio this is not required. The rules for insurance coverage vary based on whether you live in the home you’re renting out or not. What companies will cover, and how they’ll cover it varies, just as it varies with regular insurance. Make sure you’re taking advantage of annual reviews. Tell your insurance company every time you make an upgrade to your home. This will often lower your premium. If you do upgrades, get it protected. If you have a basement, make sure you have a water backup. Get protected the right way. Insurance is built for catastrophic claims. 3 Key Points: Make sure you disclose what’s important to you to your insurance agent so they can make sure you are properly protected. Local regulations are constantly changing with Airbnb and short-term rentals. Follow the rules and regulations for your area. Erik gives an example of working with someone who he was looking to help financially but did not take immediate action because he said he could not afford it and had to figure it out. Fortunately he did not close the door and set an appointment to follow up and determine whether he could take action to pay himself instead of just other obligations. We have to learn from the situations we are in and always trust our gut when things are not on the right track.
