Co-hosts Mike O'Donnell and Bethany Abele welcomed to the podcast special guest John Crowley, New Jersey State Counsel for Stewart Title Guaranty Company. Among other things, John tracks legislative developments and case law affecting the title arena for Stewart Title, acting as liaison between all business units. He is also head of Stewart Title's CLE programming. John provided several nuggets of advice for title agents and potential insureds, including: Involve underwriting counsel early and often, as document review can take time depending on the transaction's complexity. Include all related files and documents to underwriting counsel and advise as to what the potential issue/concern is. Be flexible with expectations and open to compromise. He also identified some of the key challenges for underwriters, and New Jersey specific challenges, including (i) tax sale foreclosure issues, which have been nationally impacted by the Hennepin case and in New Jersey the Roberto case, both of which dictate how tax sale foreclosures are handled; (ii) New Jersey Tidelands issues; (iii) foreclosure and bankruptcy proceedings; (iv) complex corporate structures, and the underwriting complexities that may result when foreign entities are involved; and (v) various types of fraud. John shared some interesting war stories, including attempts by “train pirates” to gum up big development deals by claiming abandoned railroads are not actually abandoned, seeking payoffs to go away. John is also President of the New Jersey Land Title Association, and explained the role of the New Jersey Title Insurance Rating Bureau, setting rates for title insurance and creating approved forms for transactions. The Association works to protect and advance the multi-billion dollar title industry in New Jersey by monitoring cases and legislation that could impact the industry, working with bill sponsors, lobbyists and county clerks' offices. Mike then interviewed Riker Danzig associate Kori Pruett about a recent case in the Southern District of Florida, where two land parcels were fraudulently transferred by three unidentified individuals. In Tek Grubu Gayrimenkul Franchising Pazarlama ic ve dis Ticaret Anonim Sirketi v. Coretitle LLC, No. 1:23-cv-21026-LEIBOWITZ/LOUIS, 2024 U.S. Dist. LEXIS 181682, at *11 (S.D. Fla. Oct. 3, 2024), Coretitle served as the agent, and was sued for negligence. In the case, the Court looked closely at procedural posture and admonished both parties for failing to adhere to local rules. Key takeaways from this case are: The court emphasized the importance of compliance with local procedural rules, as failure to do so limited the court's ability to assess the facts. Parties moving for summary judgment bear the burden of demonstrating that no genuine issue of material fact exists. In this case, both parties failed to meet this standard due to insufficient evidence and unclear legal arguments. A lack of record evidence and case law to support arguments can result in denial of motions. Properly identifying standards of care and citing relevant law are critical in disputes involving professional duties. This case underscores the need for practitioners to present clear, comprehensive arguments that incorporate relevant legal standards and factual details to enable effective judicial review.

Do you think these policies will stick around in 2021?Rick Triola: I think so. RON is pretty much here to stay. It's proven over the last couple of years for the offices that have used us as far back as three or four years ago that it has become very sticky. Sadly, during this pandemic there's a greater need for it today than there was three or four years ago. I think going forward I think going forward; it makes a lot of sense that all of this will become sticky. I can't imagine any legislation reversal.HousingWire: Looking at a national level, what is the state of the Senate's SECURE Notarization Act?Rick Triola: It's an interesting, timely question because as of [Wednesday] the American Land Title Association has put together a letter to Congress, and I signed off on that. It's needed, as it just gives a standard that everybody could abide by. I think the challenge faced when it first came out, with the pandemic, it was a good idea. But there were a lot of things going on in the world that kind of put that on the back burner. But there's no question that in 2021 and as far as I'm aware of, there are no objections to national RON standards. Welcome to Season One Episode Fifteen of the HECHO Corpus Christi Podcast, the podcast featuring Corpus Christi’s Creators Makers Doers and Builders. Jordan Anderson is our guest on this episode. Jordan is the local president of Stewart Title Company and was raised in Corpus Christi from the time that she was nine years old. After graduating from Ray High School, Jordan moved to Dallas, San Antonio, back to Dallas, and then home to Corpus with her husband in 2005. She is a lawyer who practiced law with a local firm for a handful of years before starting both a family and a title company in 2010. Alongside her father in law, Jordan started Bay Area Title Services, which Jordan then grew into three offices and a booming business, a business doing so well that it was acquired by Stewart Title Company. Stewart Title Company is one of the oldest and biggest title insurance companies in the country. Not only has Jordan excelled in her leadership of Stewart Title Company, she has also volunteered a tremendous amount of time locally, serving on local boards including at the Art Museum, the regional economic development corporation, the united chamber of commerce, and serving at her children’s school. Jordan’s story should inspire other local entrepreneurs that, through excellent customer service and putting others first, they too can build successful, attractive businesses here in Corpus Christi. Jordan’s experience can be duplicated and should inspire others to repeat it in the industries they are in. As Jordan has shown, Corpus is a great place for business and a great place for family. Episode 5 - Ethan is a talented technologist that brings insights in how to accelerate your career in the digital age by taking a people first approach to technology solutions. He takes into account navigating the political waters of a corporate organization while exploring modern concepts like crowd sourcing and "citizen developers" Ethan learned early in his career to seize the day after a near fatal car accident. Ethan Pack is the Director of Enterprise Architecture and Solutions Delivery at TDECU and has over two decades of experience as an information technology leader. In March 1998, while approaching the finish line of his high school experience, he began his career as a software developer at a small corporate performance management start-up in the Nashville, TN area. In July 2003, a near-fatal car wreck put his career on pause as he was faced with the prospect of potentially not walking again. Ethan embarked on a nearly two-year long recovery from wheelchair, to walker, to cane, to walking unaided again. Toward the end of this healing process, Ethan and his family moved to the Houston area. Ethan is now a technology executive who leads cross-functional teams and enterprise-wide change initiatives. As the Director of Enterprise Architecture and Solutions Delivery at TDECU, the largest credit union in the greater Houston metropolitan area, Ethan heads enterprise architecture, project management, and software development. The majority of Ethan’s career has been in the financial services industry working with firms such as Bisys and Stewart Title before joining TDECU in 2017. Ethan previously served on the Residential Governance Committee for the Mortgage Industry Standards Maintenance Organization (MISMO), the volunteer standards development body for the mortgage industry. He has written for various print and online publications and is well regarded as a leading voice in enterprise architecture, digitalization, and the importance of culture, people, and fearlessness for success in digital transformation. His blog, Enterprise Architecture in the Digital Age, launched in February 2018 on CIO.com. A frequent speaker at Houston-area technology events, Ethan believes in transformational servant leadership, bringing passion and an inspirational vision of the future while seeking to help, serve, and develop others to bring out the best in individuals, teams, and organizations.
