Republicans are going to control the House in the next Congress, but two races in California remain too close to call. The Democratic challenger has taken the narrowest of leads in one Orange County contest, while the Republican incumbent remains barely ahead in the other race, in the Central Valley. By our count, the GOP has clinched 218 seats in the next Congress, so that's enough to control the majority and re-elect Mike Johnson as Speaker of the House. Welcome back to our miniseries on Senate Bill 389. Despite California Cattlemen's Association's initial opposition, the group later shifted its stance to neutral by the session's end, and the bill was ultimately signed into law by Governor Newsom.

The California legislature has passed two bills, now awaiting Governor Gavin Newsome's signature, that potentially open up a new frontier in environmental law and climate action. As law professor MICHAEL GERRARD and Wharton professor ERIC ORTS explain, SB 253 would require that companies disclose their carbon emissions, and SB 261 their vulnerability to climate-related risks, in a standardized, verifiable way, making it more difficult for them to hide behind vague mission statements and inflated carbon offsets. In their discussion with political scientist Audrey Jaquiss, Gerrard and Orts point out that, while these laws would not directly mandate emission reductions, they would put a powerful tool in the hands of activists, legislators, shareholders and consumers to demand measurable progress in the fight against climate change. They also discuss potential roadblocks, both in the form of legal challenges and relentless lobbying efforts to weaken the final regulations, but remain hopeful that, as it has in the past, California's laws might have an impact well beyond its borders.

The Mass Casualty Commission focused its attention today on masculinity, past violence committed by Gabriel Wortman, and gender-based violence in rural Nova Scotia. Two California professors presented their research on how data in the US shows how men tend to be the perpetrators in mass shootings, there was a Foundational Document presentation on Wortman's past violent behavior, and there was an expert on family and gender-based violence in Atlantic Canada. This agenda is the beginning of a week where the MCC will focus on family violence and gender-based violence more generally. The week will culminate with Wortman's common-law spouse of 19 years, Lisa Banfield, speaking on Friday. The MCC would say that Ms. Banfield is “testifying” on Friday, but whereas she will not be cross-examined by any other lawyers, I prefer Patterson Law lawyer Michael Scott's description – that we will be getting an oral version of a statement that was given behind closed doors. I took some time to review the statements that Ms. Banfield has provided to the MCC. You may have noted that MCC lawyer Emily Hill has been publicising that Ms. Banfield has sat down for five ‘lengthy' interviews and has provided documents to the Commission. There is something slightly misleading about this statement. Listening to it, one might expect that Ms. Banfield has sat down for five sessions with Commission investigators in recent months, since having her criminal charge referred to restorative justice (which effectively means the charges have been dropped), but in fact four of those five interviews were done in the ten days following the events of the mass shooting back in April, 2020.

Two California women face murder charges Monday as a consequence of connection with an illegal butt implant surgery that results in the death of an aspiring social media star.Libby Adame, 51, and Alicia Galaz, 23, were both arrested Aug. 5 in Riverside. The pair are reportedly mother and daughter.According to LAPD Detective Robert Dinlocker, the two women performed an unauthorized and illegal procedure on 26-year-old Karissa Rajpaul of Encino on Oct. 15, 2019. Rajpaul had posted pictures of the procedures on a now-defunct social media account.LAPD Deputy Chief of Police Alan Hamilton said Adame and Galaz called 911 after Rajpaul developed complications following the September 2020 procedure, but they then fled the home, KTLA reported.“They took people's cash and we know in a couple of incidents, it resulted in murder,” Hamilton said.
Two California men have been charged with plotting to blow up the Democratic Party's headquarters in the state capital, a bombing they hoped would be the first in a series of politically-motivated attacks, federal prosecutors said Thursday. The pair used multiple messaging apps to plan to attack targets they associated with Democrats after the November 2020 presidential election, the U.S. Attorney's Office said in a statement. Their first intended target was the John L. Burton Democratic Headquarters in Sacramento, prosecutors said. “According to the indictment, the defendants planned to use incendiary devices to attack their targets and hoped their attacks would prompt a movement,” the statement said. They received 4.3 million views on YouTube, and Elon Musk tweeted, "Docs make good points."The Houston doctor who said hydroxychloroquine is a cure and that you don't need masks from the steps of Capitol.A leading scientist from one of the top AMCs in the country rallied a group of peers to convince President Trump back in the spring that coronavirus was overblown, not enough of a threat, and to not lock down the U.S. — with no credible data.Other examples we're seeing:Rogue doctors are showing up at school board meetings advocating for reopening with fringe claims.Rogue doctors are holding press conferences, sometimes from a hospital's property.Rogue doctors are on TV, social media, etc.Addressing Rogue Doctors from a Communications PerspectiveDo it in a way that you're not taking on the physician, but the data and science — use a credible clinician like a Chief Medical Officer, infectious disease expert, or Chief Nursing Officer to deliver the message, not a CEO or communications member.There's a continued obligation for systems to be the arbiters of truth — clinicians have had incredibly high trust scores during COVID-19.When public safety is involved, health systems have an obligation to use this trust clout to counter growing conversations related to misinformation or false viewpoints.Speaking out also doesn't just have to be just when physicians are going rogue, it can be related to conversations happening within your communities about how schools should go back, mask wearing, etc.Legal OptionsDepending on the situation, rogue doctors represent, at best, a headache for system leaders, and at worst, a real risk to their brand reputation.We spoke with Dan Higgins, partner at Dentons, the world's largest law firm, to identify what options systems might have to address physicians that exacerbate the spread of misinformation.Except for when a health system directly employs physicians, there are limited recourse options, given physicians' rights to share their medical opinion with patients and the public.However, if there is significant conversation surrounding a physician, a health system can counter a negative message with one of its own.Point to the facts and science in these situations, ideally leveraging the Chief Medical Officer for a doctor-to-doctor comparison to the public.If the affiliated physician uses a logo or the health system's platform without permission, the health system can ask for the physician to retract its statement.When an employed physician is involved, there are additional steps a health system can weigh.Health systems should consider proactively drafting a high-level policy focused on patient precautions for staying safe and well.The system can note that it wants to guide the strategy for the organization's COVID-19 communications, and that while they respect the first amendment and the physician/patient relationship, no one except those authorized by the health system should speak on behalf of the health system in relation to COVID-19.This restricts physicians from any use of the health system's logo without consent. If there is any violation of this policy, the health system has the option to take employment action.Leaders Have a Voice and Have a ResponsibilityWith all of this said, health systems are needed and expected to be the voice of truth — continuing to focus on the facts — even if that lands them in hot water with policymakers and community members.Given their position, health systems have a societal obligation to correct any misinformation that may be spreading in their communities.Beware of the shaming and guilt language in your communications. Consumers are looking for us to be a stable, objective resource of facts and truth.

Charles Marshall will discuss today two seminal unlawful detainer (UD) cases, in which respectively in each case the lower Court there found per usual for the institutional UD Plaintiiff against the 'former' homeowner who was foreclosed on by an instutiional trust, aka 'lender-in-succession'. Yet on appeal of the UD judgment, in both these separate cases, the appellate courts reversed the judgment and remanded the cases. First up for discussion today is Bank of New York Mellon (BNYM) v. Preciado, the appeal decided in August 2013. The second case is US Financial, L.P. v. McLitus, decided on appeal in August of 2016, which appeal decision was published in November 2016. Both appellate courts found that neither UD Plaintiff had perfected title, as required by CCC 2924. Will discuss the reasons for this on today's show.
