English speakers have had gumption (the word, that is) since the early 1700s. Gumption originally referred to common sense, but it is now more commonly used to refer to the kind of courage and get-up-and-go that makes undertaking difficult things possible. Art historians may know a couple additional applications for the word: gumption was historically used both to refer to the art of preparing painters' colors, and as a synonym of megilp, which refers to a mixture of linseed oil and mastic varnish that is used as a vehicle for oil paints.

The wait is over — BYU Football game week is officially here. KSL Sports BYU Insider Mitch Harper opens today's show buzzing with energy as No. 14 BYU enters the final countdown to Saturday's season opener against Utah Tech at LaVell Edwards Stadium (6 p.m. MT, ESPN+). After a 12-2 campaign in 2025, this is one of the most anticipated season openers in BYU's modern era, and Mitch sets the table for what's ahead. First up, Kalani Sitake revealed the 2026 Team Leadership Council on Monday morning — a 20-member group voted on by the players, featuring eight captains and 12 co-captains. Returning as captains for the second straight year are running back LJ Martin and defensive tackle Keanu Tanuvasa. Joining them on offense are sophomore quarterback Bear Bachmeier, senior center Bruce Mitchell, and Oregon transfer tight end Roger Saleapaga II. The defensive captain group rounds out with linebacker Isaiah Glasker, Cal transfer linebacker Cade Uluave, and cornerback Evan Johnson. The transfers earning captain nods before playing a single snap as Cougars is a notable storyline, and Mitch breaks down what it says about the locker room culture. The 12 co-captains include repeat selections Raider Damuni and Andrew Gentry, plus standouts like Walker Lyons, Jojo Phillips, Bodie Schoonover, Therrian Alexander III, Hunter Clegg, and kicker Matthias Dunn. Mitch also makes the case to get an invite to Influencer Night in 2027 at LaVell Edwards Stadium. The uniform combo for week one also dropped Monday, and BYU is going with an all-royal-blue helmet, royal-blue jersey, and white pants for the opener — the first time this combination has been worn in the Big 12 era. Day one of Tyler Robinson's preliminary hearing on July 6, 2026, largely centered on prosecutors beginning to construct a timeline of Charlie Kirk's killing at Utah Valley University and establishing the authenticity of the surveillance footage and investigative records they intended to use against Robinson. Former UVU police officer Chris Bagley described the moment the gunshot rang out during Kirk's September 10, 2025 event and the chaos that followed, while Utah State Bureau of Investigation agent David Hull walked the court through the enormous video-review effort undertaken after the shooting. Hull testified that investigators examined hundreds of hours of surveillance footage and ultimately tracked a person they believed was Robinson moving around the UVU campus at several different points that day. Prosecutors introduced surveillance recordings from multiple locations as they attempted to connect the person seen approaching the campus, moving toward the area surrounding the Losee Center, and later leaving the area to Robinson. Three separate videos depicting Kirk being shot were admitted, although Judge Tony Graf determined that their graphic nature warranted restricting their display to the attorneys' and judge's monitors rather than broadcasting them throughout the courtroom. Kirk's widow, Erika, and his parents left the courtroom while the videos were reviewed. Prosecutors also introduced Kirk's autopsy report through Hull, which listed his cause of death as a gunshot wound to the neck and the manner of death as homicideThe defense spent much of the first day attacking the manner in which the prosecution was getting its evidence into the record rather than attempting to disprove the entire prosecution theory at that stage. Kathryn Nester and Robinson's attorneys repeatedly raised hearsay, foundation and authentication objections, arguing that investigators were being permitted to introduce reports, statements and records created by other people without those individuals appearing personally to testify. Judge Graf overruled most of those objections, reflecting the substantially lower evidentiary threshold governing a Utah preliminary hearing, whose purpose was only to determine whether probable cause existed to send Robinson to trial rather than whether prosecutors could prove guilt beyond a reasonable doubt. One significant exception involved an edited compilation of surveillance footage, which Graf declined to admit in that form and required prosecutors to replace with the underlying unedited material. Hull's testimony also revealed the scope of the prosecution's surveillance theory: investigators claimed Robinson had appeared on or around the UVU campus multiple times on September 10 and that they were attempting to stitch those appearances together into a continuous identification of the alleged shooter. By the end of day one, prosecutors had established the killing itself, the medical cause of Kirk's death, the existence and authenticity of substantial video evidence and the beginnings of their effort to identify Robinson as the person captured in that footage. They had not yet presented many of the pieces expected to become more consequential later in the hearing, including the rifle and DNA evidence, Robinson's alleged communications and admissions, and testimony concerning his roommate Lance Twiggs.to contact me:bobbycapucci@protonmail.com

Day one of Tyler Robinson's preliminary hearing on July 6, 2026, largely centered on prosecutors beginning to construct a timeline of Charlie Kirk's killing at Utah Valley University and establishing the authenticity of the surveillance footage and investigative records they intended to use against Robinson. Former UVU police officer Chris Bagley described the moment the gunshot rang out during Kirk's September 10, 2025 event and the chaos that followed, while Utah State Bureau of Investigation agent David Hull walked the court through the enormous video-review effort undertaken after the shooting. Hull testified that investigators examined hundreds of hours of surveillance footage and ultimately tracked a person they believed was Robinson moving around the UVU campus at several different points that day. Prosecutors introduced surveillance recordings from multiple locations as they attempted to connect the person seen approaching the campus, moving toward the area surrounding the Losee Center, and later leaving the area to Robinson. Three separate videos depicting Kirk being shot were admitted, although Judge Tony Graf determined that their graphic nature warranted restricting their display to the attorneys' and judge's monitors rather than broadcasting them throughout the courtroom. Kirk's widow, Erika, and his parents left the courtroom while the videos were reviewed. Prosecutors also introduced Kirk's autopsy report through Hull, which listed his cause of death as a gunshot wound to the neck and the manner of death as homicideThe defense spent much of the first day attacking the manner in which the prosecution was getting its evidence into the record rather than attempting to disprove the entire prosecution theory at that stage. Kathryn Nester and Robinson's attorneys repeatedly raised hearsay, foundation and authentication objections, arguing that investigators were being permitted to introduce reports, statements and records created by other people without those individuals appearing personally to testify. Judge Graf overruled most of those objections, reflecting the substantially lower evidentiary threshold governing a Utah preliminary hearing, whose purpose was only to determine whether probable cause existed to send Robinson to trial rather than whether prosecutors could prove guilt beyond a reasonable doubt. One significant exception involved an edited compilation of surveillance footage, which Graf declined to admit in that form and required prosecutors to replace with the underlying unedited material. Hull's testimony also revealed the scope of the prosecution's surveillance theory: investigators claimed Robinson had appeared on or around the UVU campus multiple times on September 10 and that they were attempting to stitch those appearances together into a continuous identification of the alleged shooter. By the end of day one, prosecutors had established the killing itself, the medical cause of Kirk's death, the existence and authenticity of substantial video evidence and the beginnings of their effort to identify Robinson as the person captured in that footage. They had not yet presented many of the pieces expected to become more consequential later in the hearing, including the rifle and DNA evidence, Robinson's alleged communications and admissions, and testimony concerning his roommate Lance Twiggs.to contact me:bobbycapucci@protonmail.com

Tyler Robinson's defense team is asking Judge Tony Graf to block electronic media coverage of the September 1 hearing, arguing that allowing cameras and livestreaming would create an unnecessary risk to Robinson's right to a fair trial. The lawyers contend that the proceeding will center heavily on evidence presented during the preliminary hearing, much of which came into the record as hearsay under Utah's comparatively permissive probable-cause standard and might never be admissible before a trial jury. Broadcasting attorneys discussing that material, they argue, would effectively preserve and distribute potentially inadmissible accusations to a massive audience long before jury selection begins. The defense also says the extraordinary publicity surrounding the case has already demonstrated how quickly courtroom material can spread online and shape public perceptions, pointing to what it characterizes as real-time evidence of developing bias. Robinson's attorneys maintain that cameras add pressure and distraction for lawyers, witnesses and other courtroom participants, arguing that proceedings should remain focused on evidence and legal argument rather than presentation for a national audience. In one of the filing's sharpest lines, the defense declares that Robinson's prosecution “is not and should not be made into a reality TV show.”The filing also builds on the defense's broader argument that extensive media exposure is making it increasingly difficult to preserve an impartial jury pool in a case that has attracted enormous national attention. Robinson's attorneys say witnesses whose statements were admitted as reliable hearsay during the preliminary-hearing process have already faced harassment from media organizations and interested third parties, which they offer as another example of the consequences of unrestricted exposure. Their concern is particularly acute because the September 1 proceeding is not a trial but an oral argument over whether prosecutors have established enough probable cause to bind Robinson over for trial, meaning the public could hear extensive discussion of evidence without the protections and evidentiary restrictions that would apply before a jury. The defense therefore asks Graf to treat the proceeding as a judicial hearing rather than a media event and to prohibit cameras from broadcasting arguments that could become part of the permanent public narrative even if portions of the underlying evidence are later excluded. Top federal prosecutors from the Four Corner states are descending upon the Phoenix metro this week as part of an annual conference meant to tackle crime and justice in Indian Country. KJZZ's Gabriel Pietrorazio has details. A hotel room full of victim advocates, attorneys, and tribal law enforcement personnel congregate in Glendale. Arizona's top prosecutor, U.S. Attorney Timothy Courchaine, reminds them why they are all meeting. “It may sound like priorities are elsewhere in this administration, but all of the U.S. attorneys up here and every member of leadership in the Department of Justice will tell you: Indian Country is always a priority.” From Phoenix and Albuquerque to Denver and Salt Lake City, Courchaine stresses they are all on the same team. “If you work with a rural tribe, whether it's in Utah, Colorado, New Mexico or Arizona, it might feel like you are at the ends of the earth.” Three cubs belonging to Osso in the Anan Wildlife Observatory at Tongass National Forest. The U.S. Forest Service acknowledges the project could affect deer harvests relied on by communities in Southeast Alaska, where the Tongass has long supported Alaska Native cultural and subsistence practices. Conservationists are now pushing back against plans to log thousands of acres of old-growth forest, as Mark Moran reports. Conservationists are pushing back on a massive old growth logging plan by the Forest Service that would carve new roads through thousands of acres of Alaska’s Tongass National Forest. The agency says it will revitalize the logging industry and improve habitat and ecosystems for native species. The Revilla Integrated Research Project aims to log 4,000 acres of old growth trees in the Tongass near Ketchikan, harvest 83 million board feet of timber, and build more than 40 miles of roadway. Southeast Alaska Conservation Council’s Nathan Newcomber says the development plan threatens the habitat of a number of animals. He says even the Forest Service has acknowledged the risk. “Deer, bears, wolves, birds like the Queen Charlie Goshawk. They also state that they acknowledge the significant likelihood of impact to subsistence, including on deer harvest.” There were at least 120 objections to the plan during a public comment period, but the Forest Service says it intends to begin the work and address legal challenges later. Southeast Alaska has been transitioning away from clear cutting old tree stands in favor of what’s known as young growth logging, which Newcomber and other environmental advocates support, even though the practice now comprises only about one percent of the region’s economy. “To go back to this bygone era from the 1970s where you just clear-cut landscapes, it makes absolutely no sense. Nobody supports it apart from extractive industry and politicians. But local communities in Southeast Alaska, they wanna protect what we have. It’s our cultural way of life. It’s the way that people live up here.” Southeast Alaska is also highly dependent on tourism to support local economies. Driven largely by cruise ship traffic, the region sees as many as two million visitors a year, according to Alaska’s Southeast Conference. Confederate Brig. Gen. William L.. Cabell, left, and Union Col. William F. Cloud led troops during the skirmish. And on this day in 1863, fighting broke out near Camp Pike in the Choctaw Nation, in what is now Oklahoma. The skirmish came during the Civil War, when Indian Territory became a battleground involving Union and Confederate forces. The Big 12 Conference "unanimously adopted a conference rule" that prevents Big 12 member institutions from fielding professional athletes in any conference-sponsored sport. That raises the question for BYU fans: How does it affect BYU basketball commit Jaxon Kohler? KSL Sports BYU Insider Mitch Harper answered that question and got a follow-up answer from the Big 12 Conference. He breaks down the timeline regarding Jaxon Kohler, his eligibility, and what's next. (Courtesy PGA) The PGA Tour has bestowed one of its highest honors, the Payne Stewart Award, to a four-time PGA Tour winner who is also a citizen of the Navajo Nation. KJZZ's Gabriel Pietrorazio has details. Born and raised in Albuquerque, New Mexico, Notah Begay III excelled at swinging a club. His success on the fairway afforded him the chance to play college golf beside Tiger Woods at Stanford University – winning a national team championship in 1994. Begay is widely considered the first Indigenous golfer to compete on the PGA Tour. When accepting the award on Tuesday, Begay noted how Native Americans have the lowest graduation rates and life expectancies in the U.S. among all ethnicities. “So for me to be standing up here as a Stanford graduate with a degree in economics, four-time PGA Tour winner and a television broadcaster accepting this prestigious award is a miracle.” Entrance to White Mesa Mill in southeastern Utah. KNAU's Chris Clements reports that is according to House Democrats, who have launched an investigation into Energy Fuels for potential insider trading. Two House Democrats allege the Trump administration may have tipped Energy Fuels off about the cut to Bears Ears National Monument before it happened, leading company executives to invest in their own firm. One of the Democrats is U.S. Rep. Jared Huffman, D-California. “The timing and the volume of these stock purchases are conspicuous and speak for themselves.” Huffman asked the company to send a year's worth of communications with the feds, as well as its lobbying contracts, by August 24, but Energy Fuels did not provide the materials by that deadline, according to a spokesperson for Huffman. In a statement, the company said it strongly rejects the idea that anything improper took place, but did not deny that it missed the deadline. Energy Fuels stands to benefit from less protections to the uranium-rich monument, the lawmakers argue, because the company owns the White Mesa Mill, the only conventional uranium processing mill in the United States. Gov. Tim Walz, D-Minnesota, has signed an executive order blocking new state mineral leases and halting permitting work for proposed nonferrous mining projects in the Rainy River Headwaters Watershed near the Boundary Waters. The National Congress of American Indians praised the move, saying it protects treaty rights, Tribal resources, and culturally significant lands from potential mining-related pollution. NCAI also recognized the Bois Forte, Fond du Lac, and Grand Portage Bands of Lake Superior Chippewa. The three 1854 Treaty Tribes have pushed for protections in the region and earlier this year joined the Red Lake Nation and an Anishinaabe First Nation in Canada in a cross-border effort to protect the watershed. NCAI Executive Director Larry Wright Jr. says the order provides immediate relief, but permanent protections are still needed. The organization is calling for federal legislation permanently withdrawing the Boundary Waters and Rainy River Headwaters from mineral leasing and development. The letter came during Pontiac's War, when a confederation of Native nations fought British forces around the Great Lakes and Ohio Valley. Amherst also supported efforts to spread smallpox among Native people, one of the most infamous examples of biological warfare discussed during the colonial era.
