Can Mexico win its battle with US gun companies?

The Mexican government has won its appeal to bring a civil lawsuit against a number of American gun companies. Mexico, which has extremely restrictive gun laws, claims that the ‘deliberate' business practices of these US firms results in the illegal flow of firearms into Mexico, contributing to the gun crime violence in the country. They are now seeking as much as ten billion dollars in compensation. The gun companies, which include some of America's oldest established names in the firearms business, deny any wrongdoing. Since 2005, these companies have being granted immunity from prosecution under the ‘Protection of Lawful Commerce in Arms Act'. This law protects the firearms manufacturers and dealers from being held liable when crimes have been committed with their products. But Mexico's argument is that PLCAA, as it's also known, only applies within the United States and therefore doesn't protect the companies from liability.It's a case which is also resonating with other Latin American countries who have been impacted by illegal gun trafficking from the United States. Some of these countries have supported Mexico's claims in the courts. In this episode, we continue our discussion with Nathan B. Oman, the W. Taylor Reveley III Research Professor and Co-Director of the Center for the Study of Law and Markets at William & Mary School of Law. Nate specializes in Contract Law, the Economic Analysis of Law, Jurisprudence, Law and Religion, and Legal History. Today, we're discussing his 2009 article, Specific Performance and the Thirteenth Amendment, published in the Minnesota Law Review. As I mentioned in episode 1, the article first came to my attention this summer, when the internet erupted with suggestions that the specific performance clause in the Elon Musk (more precisely, X Holdings) merger agreement with Twitter wasn't enforceable because of the 13th Amendment. As you heard in our last episode, Nate strongly disagrees with that take.  I've split my discussion with Nate into two parts. In Episode 1, largely driven by questions from UVA Law 3Ls Bridget Boyd and Jenn Scoler, we discussed the Musk-Twitter litigation and the various provisions of the merger agreement, including the specific performance provision and the termination fee. In this episode, we delve more deeply into Nate's analysis of the scope of the 13th amendment's prohibition against indentured servitude and its relation to the specific performance of personal service contracts. The Jeffrey Town Education Association based in Toronto, Canada, is making its mark in the St Mary community. Patrick Buchanan, the president and one of the founders of the association, notes that both students and teachers at the all-age school and residents of the community get support from the body.On September 6, 1998, a fire destroyed the Jeffrey Town All-Age School. The institution, which was built in the 1950s, is the only public school for many students of six neighbouring communities.Some travel a far distance to get to there. Six years after the fire, the Jeffrey Town Education Association was founded in Toronto in 2004. Critical race theory has become a rallying cry for both Republican politicians and conservative parents alike.  The COVID-19 pandemic forced parents to become more aware of their children's curriculum as they attended school virtually. While school officials maintain educators are not teaching students that racism is systemic, some parents — and Arizona lawmakers — want to make sure it isn't allowed to happen.  As in-person school board meetings returned, parents packed local school board meetings denouncing critical race theory during public comment. Conservative media and Republican politicians have taken cue from former President Donald Trump as he continues to criticize the study.  But what is critical race theory? When did it begin? Virtual reality is well known for immersing people in activities such as flying, traveling in time, or in fictional worlds. But virtual reality can also be a powerful training tool. My guest in this episode has developed a virtual reality training experience that helps people to develop the capabilities to advocate for diversity, equity, and inclusion in higher education. Prof Jason Chen is the Gerdelman Family Term Distinguished Associate Professor of Education at the William & Mary School of Education in Virginia, USA. The questions that drive his research have to do with the variety of ways innovative technologies can be used as a tool for motivation, engagement, and learning. In 2016, with funding from the National Science Foundation, Jason and his multidisciplinary team of geoscientists, social scientists, theater professionals and technologists created a program called GeoDES. This program involves the use of innovative virtual reality simulations designed to help university faculty practice advocating for more diverse, equitable and inclusive departments. Ashley Reynolds Marshall is currently the chief executive office of the YWCA of Central Virginia in Lynchburg. Marshall is a Roanoke native with degrees from Hollins University, William of Mary School of Law and Virginia Tech, where she is currently pursuing a Ph.D. in public administration and policy. The new position will oversee the Human Services and Social Service Departments as well as the Police Civilian Review Board and the Office of Human Rights. Marshall begins work on May 10, 2021. The city is also seeking a new city attorney, neighborhood services development director, social services director, and a deputy city manager for operations. Ashley Reynolds Marshall (Credit: City of Charlottesville)The Charlottesville Police Department issued a press release this afternoon asking for community support in the wake of a series of shootings this month. The release lists four incidents where officers reported to shots fired. One man was shot Sunday evening in the 100 block of Hammond Street, a cul-de-sac in the Fry’s Spring neighborhood. “In addition to the major events over the weekend, CPD responded to 3 additional shots fired calls, 3 stolen vehicles, 29 disorders, and numerous mental health related calls,” the release continued. The cases are under investigation. Last Thursday, the Thomas Jefferson Planning District Commission got an update on the possibility of a regional cigarette tax. The TJPDC is leading efforts to create a body that would collect and distribute the revenues to participating localities. The Albemarle County Board of Supervisors had received an update at their budget work session on March 22. Lori Allshouse is the director of budget and performance management for Albemarle County. “During the 2020 General Assembly, they authorized the county to impose a cigarette tax of up to 40 cents per pack for counties,” Allshouse said. “Up until this time, only Virginia cities, Virginia towns, and Arlington and Fairfax counties have been able to impose a cigarette tax,” Allshouse said. If Albemarle proceeds with going through the various steps to levy the tax, any revenues would go to the general fund. Those steps include adoption of an ordinance following a public hearing. The tax has also been reviewed by the county’s Office of Equity and Inclusion (OEI)“As part of that process we began our consideration of this proposed tax by seeking first to understand who could be most affected by this tax and how could those impacts be experienced and mitigated,” Allshouse said. The Board will hold a work session on the equity impact assessment in August. Research on this topic found the cigarette tax would impact the poor and black, indigenous, and people of color (BIPOC). Jason Inofuentes is a project and policy associate in OEI who cited a University of Pittsburgh study on the effects of taxation and smoking rates.“Where you see the highest decrease in smoking is in the highest incomes,” Inofuentes said. “There is overall some amount of decrease. There isn’t however any noticeable decrease in low-income communities.” Credit: Albemarle County If implemented, the goal is to have all localities in the area impose the tax so no one locality has a competitive advantage. David Blount is the legislative liaison for the TJPDC and he addressed the Board of Commissioner on Thursday. “I think from here we see that following this meeting within the next week or so that we would send out some materials to every jurisdiction in our region, which would be the city and the five counties as well as the four towns in our region, but also casting the net a little bit wider to some of the counties that adjoin our member counties,” Blount said. Blount is asking localities to consider resolutions to express interest in participating and to authorize their staff to participate in the discussion.“Certainly not asking anybody at this point to commit to anything, commit to participating, or commit to anything beyond just an interest,” Blount said. “I think by the time we get to summer time with June and July rolling around, we really want to be looking at what does this regional board look like? What are its functions? What is the make-up of the board? What is the legal makeup? Those types of things.” Greene County Supervisor Dale Herring representatives said his locality was interested. “I think what the TJPDC is doing is the direction we need to go on,” Herring said. Fluvanna’s representatives also said they were interested. Albemarle Supervisor Donna Price told the TJPDC that her county wants to pursue the regional approach. “We don’t anticipate that the revenue that is generated is going to be significant enough to result in a reduction of our property tax,” Price said. No referendum would be required if localities agree. Jesse Rutherford is on the Nelson County Board of Supervisors.“Real quick, just want to say we’re looking at lowering our machine and tools tax as well as lowering our personal property tax rates,” Rutherford said. The public hearing for the Nelson County’s $41.7 million budget is scheduled for May 4 with adoption expected on May 11. (budget website)Tommy Barlow is on the Louisa County Board of Supervisors.“We’re still struggling along with our budget trying to figure out what to do with that and get it resolved,” Barlow said.Louisa’s proposed budget does not appear to be available on the county’s budget website. Adoption is expected on April 19. Albemarle has completed their cycle of five budget work sessions and adoption is scheduled for May 5.“We were able to cancel the last work session that we were going to have on the budget,” Price said. “We’re looking at getting about $10 million in the first tranche of funds from the federal government in May and the same amount next year. We know that at some point the federal government can’t continue to be providing these funds but they really have been a lifesaver for us this year.” Fluvanna County will have its public hearing on its budget on April 14 with adoption scheduled for April 21. Their proposed budget is based on a property tax rate of $0.884 per $100 of assessed value, down from the current rate of $0.925. Tony O’Brien is a member of the Board of Supervisors. “In our budget we’ve included taking out a loan of about $25 million to work on a new administration building and update some of our fire and rescue vehicles as well as the sheriff and busses as well too,” O’Brien said. Herring gave an update on Greene County’s budget.“Our tax rate will stay the same,” Herring said. “Our assessments did go up. We would have probably looked at lowering our [tax rate] this year if it wasn’t for our debt associated with our [Rapidan Service Authority] water authority.”For more details on that issue, read Terry Beigie’s story on the on-going issue. The Greene County Board of Supervisors convened this afternoon to vote on a resolution requesting that Orange and Madison counties allow Greene to leave the Rapidan Service Authority. The RSA objects with a plan to impound White Run to create a new reservoir and did not allow Greene to use a facility fee that had been charged to cover the cost of the project. Schematic image for White Run Reservoir projectThe application window opened today on a new grant program Albemarle County is offering to a specific industry affected by COVID-19. The Albemarle Agribusiness Resiliency Grant Program is aimed at farms and agricultural operations who have bit hit by the downturn. Awards of up to $10,000 are available for direct-market agribusinesses such as orchards, wineries, cideries and more. “One of our region’s greatest assets is the wealth of local farms, food businesses, and the resilience of our food system,” reads the pre-application. “COVID-19 has caused this system to be challenged in ways unimaginable.”The window closes on April 21. Finally today, local governments in the area as well as the University of Virginia have set ambitious goals to reduce greenhouse gas emissions 45 percent by 2030 and to be carbon neutral by 2050. Tomorrow, the Environmental Resilience Institute at UVA begins a series of virtual events designed to help connect many of the pieces together. Karen McGlathery is the director of ERI.“We decided to call it the Climate Ambition Summit because we have ambitious goals that we need to reach by 2050 if we’re going to have any chance of bending the curve with regard to climate change and climate warming,” McGlathery said. At 1:30 p.m. UVA Provost Liz Magill will interview Environmental Sciences Professor Scott Doney on what’s been learned in the last five years since the latest report from the Intergovernmental Panel on Climate Change. “Frontiers of Climate Science is essentially what we’re calling it,” McGlathery said. “Essentially what’s happened in the last five years in terms of climate research that can really help us develop realistic strategies to address climate change both in terms of reducing the amount of carbon dioxide going into the atmosphere but also taking it out of the atmosphere.” The next event on Friday at 2 p.m. explores Climate Risk and the Opportunity for Private Capital. A Climate Justice panel will be held on April 13 at 2 p.m. “So we’ll be thinking about [how] every climate change issue is an environmental justice issue so both on the local scale but also on the broader regional and national scale,” McGlathery said. The final event in the four-part series is another interview between a top UVA official and an expert in the field.“The final event we have in the series is a conversation between President Jim Ryan and Dr. Arun Majumdar from Stanford University who was the head of the transition team for President Biden for the Department of Energy,” McGlathery said. “They’re going to be having a conversation about how we can as a society meet these ambitious net-zero carbon goals in the future.”The events are open to the public and will be recorded, very much in keeping with how our lives have been lived in the past year. McGlathery said there are lessons to be learned from the pandemic.“What the pandemic has taught us is that it’s possible to come together to address a broad societal issues that’s urgent and that seems almost insurmountable in the beginning, but the success of coming out with a vaccine in such a small time period shows that it’s possible to have a global strategy, to have an actual strategy,” McGlathery said. Visit the ERI website to learn more. There have been plenty of stops in between though. I’m a first generation immigrant, twice over. I’ve been a citizen of three different countries and lived in nine cities. I am, as Goethe, said, “nothing but a wanderer […] on this earth.” Living among different people, in different countries at fascinating times in their histories, has shaped both my view of the world and my writing. Ultimately, human beings are the same everywhere (despite the fact that they tell themselves, everywhere, that they are different from each other), and the theme of this fundamental human unity informs everything I write. As to my life outside of writing, I went to the William and Mary School of Law, and before that attended the University of Toronto, where I studied English Literature. I am currently practicing as an attorney and must “measure out my life in coffee spoons” on a daily basis. Some members of my family will tell you that I’m also a poet. This isn’t true. I wrote a few poems in Urdu when I was a teenager, and I’ve never heard the end of it…which I wouldn’t mind, honestly, if they were any good. As it is, I’m very happy living in prose, thank you very much. Other interests include good food, video games, sitcoms, and books of all kinds. Most of my time that doesn’t go to writing or billable hours is consumed by my two children, four and two years of age.

She is the CEO of the YWCA of Central Virginia and the Chair of the Virginia Women’s Council.Ashley is an inspiring leader in the nonprofit community of the Commonwealth of Virginia. She embodies the mission of YWCA of Central Virginia: YWCA USA is on a mission to eliminate racism, empower women, stand up for social justice, help families, and strengthen communities. They are one of the oldest and largest women’s organizations in the nation, serving over 2 million women, girls, and their families. She is a compassionate, wise, and a true leader. She is truly a bright light. Ashley holds a B.A in Psychology from Hollins University, a J.D from the College of William & Mary School of Law, and an M.P.A. from Virginia Tech. Currently, Ashley is also currently a Ph.D. student at the Center for Public Administration and Policy at Virginia Tech, working on her dissertation focused on Corporate Social Responsibility and Collective Impact/Collaborative Programming. 'What if There's Too Much Privacy?' with Michele Gilman (Ep. 211) Policymakers often discuss privacy as something that is lacking. But what if there is too much privacy? Michele Gilman joined Joe Miller to explain.  Bio  Michele Gilman (@profmgilman) is the Venable Professor of Law; Director, Saul Ewing Civil Advocacy Clinic; and Co-Director, Center on Applied Feminism at the University of Baltimore School of Law. She is also a faculty fellow at Data & Society in New York, where she focuses on the intersection of data privacy law with the concerns of low-income communities.  Before joining the faculty, Professor Gilman was a trial attorney in the Civil Rights Division at the Department of Justice; an associate at Arnold and Porter in Washington, D.C.; a law clerk to United States District Court Judge Frank A. Kaufman of the District of Maryland; and an editor of the Michigan Law Review. Professor Gilman's scholarship focuses on issues relating to poverty, privacy, economic inequality, and feminist legal theory and her articles have been published in the California Law Review, the Vanderbilt Law Review and the Washington University Law Review, among others. She was a visiting associate professor at the William and Mary School of Law during the 2005-06 academic year and a professor in the University of Aberdeen summer program in summer 2009. In 2009, she received the Outstanding Teaching by a Full-Time Faculty Member Award.  Professor Gilman directs the Saul Ewing Civil Advocacy Clinic, in which student attorneys represent individuals and community groups in a wide array of civil litigation and law reform projects. She is involved in numerous groups working on behalf of low-income Marylanders. She is a member of the Committee on Litigation and Legal Priorities of the ACLU of Maryland and the Judicial Selection Committee of the Women's Law Center. She is the past president of the board of the Public Justice Center, where she served from 2004-2014, as well as a past member of the Maryland Bar's Section Council on Delivery of Legal Services. She received the 2010 University System of Maryland Board of Regents' Award for Public Service. Professor Gilman is the former co-chair and a member of the Scholarship Committee of the AALS Clinical Legal Education Section, and a former editor of the Clinical Law Review Review and the Journal of Legal Education. She is also a co-director of the Center on Applied Feminism, which works to apply the insights of feminist legal theory to legal practice and policy. She is a member of the Maryland and District of Columbia bars.  Professor Gilman will be a faculty fellow at Data & Society in New York during the 2019-2020 academic year.  She will be focusing on the intersection of data privacy law with the concerns of low-income communities.  Resources   University of Baltimore School of Law  The Surveillance Gap: The Harms of Extreme Privacy and Data Marginalization by Michele Gilman (New York University Review of Law & Social Change, 2019).  News Roundup  Uber wins against woman in driver rape lawsuit  Uber was victorious last week in a sexual assault lawsuit brought against it by a woman who says she was raped near a San Francisco shopping mall last year, by a suspended Uber driver who still had the Uber decal on his window. In her pleadings before U.S. Magistrate Judge Jacqueline Scott Corley, the victim claimed that the suspended driver was acting within the scope of his employment and that she legitimately thought it would be a safe ride. But the court disagreed.  Judge Corley did find, however, that the victim had made out a plausible claim for negligence and permitted her to refile for punitive damages for negligence stemming from Uber’s apparent failure to ensure the driver removed the decal from his window. The driver still faces a criminal trial which could send him away for life.  Separately, Uber has begun videotaping rides. But the effort has faced resistance from privacy advocates.  Prisoners in West Virginia prisons to be charged $.03 per minute to read e-books  West Virginia prisoners will have to pay $.03 per minute to access e-books via Project Gutenberg, which otherwise offers the public free access to over 60,000 books. The West Virginia Division of Corrections and Rehabilitation (WVDCR) entered into a deal with Global Tel Link (GTL) to provide tablets to 10 prisons in West Virginia which will also allow inmates to watch videos and send written messages and photos. But the rates for those services, ranging between $.25 and $.50 per minute, are still very high relative to the $.04 per hour to $.58 per hour prisoners can earn in wages. The prisons will lift a current restriction on accessing books in print. But advocates who oppose the exploitative $.03 per minute fee for e-books note that the use of books in print comes with many more restrictions.  DC AG sues DoorDash for wage theft  DC Attorney General Karl Racine is suing DoorDash for pocketing tips the company solicits from customers. The Office of the Attorney General has been investigating the company since March, and now says that evidence shows that DoorDash routinely kept the tips to reduce the amount they had to pay drivers in wages.  Congresswoman Val Demings introduces bipartisan digital evidence bill  Florida Congresswoman Val Demings, a Democrat, has introduced new bipartisan legislation to improve law enforcement’s access to digital evidence from tech companies. The bill would create a new Office of Digital Law Enforcement within the Department of Justice to train law enforcement on how to handle digital evidence. It would also create a Center for Excellence for Digital Forensics to centralize tech expertise and legal assistance within the same building. The bill would also set up infrastructure for the DOJ to issue digital evidence program grants, as well as a Technology Policy Advisory Board to advise the Attorney General on digital evidence best practices.  Brooklyn landlord nixes facial recognition plan  A Brooklyn landlord has cancelled plans to install facial recognition technology after resistance from tenants and advocacy groups. Robert Nelson, President of Nelson Management Group, owns the 700-unit Atlantic Plaza Towers building in Brownsville where most tenants are black. Tenants and their supporters are now pushing for statewide legislation that would outlaw facial recognition technology throughout the Empire State.  Democrats call out Oracle on Diversity  Democratic lawmakers who are members of the House Tech Accountability Caucus, the Tri-Caucus, and the Congressional Black Caucus’ Diversity Task force called out Oracle for its lack of diversity in a letter to Oracle CEO Larry Ellison. The letter notes that Oracle has 0% board diversity, saying it is unacceptable given Oracle’s attempts to earn business from firms that serve people of color.

Who hasn’t indulged the childhood fantasy of playing in a band with your best friend and promising to stay together forever (and ever)? Only in the case of Kira Leyden and Jeff Andrea—co-leads of the Akron Ohio based The Strange Familiar. The pair met and played in their first band together as pre-teens at Immaculate Heart of Mary School in Cuyahoga Falls, Ohio. Lead vocalist & keyboardist Leyden and guitarist Andrea parlayed their musical partnership into a bond of matrimony. The couple recently had their first child, daughter Rayne. Alongside talented band-mates and fellow Ohio-bred musicians Nicholas Sainato on drums and Frank Freeman on bass, The Strange Familiar has certainly earned its namesake. In 2008, they made their recorded debut with the indie EP release You Can't Go Back and followed up it up with two indie album releases This Is Gravity (2009) and Chasing Shadows in 2012. Their songs have been prominently featured on popular shows such as Pretty Little Liars, NBC’s The Biggest Loser and The Vampire Diaries, “Switched at Birth,” ABC’s “Brothers and Sisters,” Teen Nick’s “Degrassi” and LMN’s “The 19th Wife.” Their song “Courage" was used for the series premier of “Secret Life of an American Teenager” and became the un-official theme song by the show’s fans. With all this growing exposure, the band was nominated and won MTVu’s Freshman Challenge.
