Everything You Want to Know About the CFPB as Things Stand Today and Lots More - Part 1

Our podcast show being released today is Part 1 of a repurposed interactive webinar that we presented on March 24, featuring two of the leading journalists who cover the CFPB - Jon Hill from Law360 and Evan Weinberger from Bloomberg. Our show began with Jon and Evan chronicling the initiatives beginning on February 3 by CFPB Acting Directors Scott Bessent, Russell Vought and DOGE to shut down or at least minimize the CFPB. These initiatives were met with two federal district court lawsuits (one in DC brought by the labor unions who represents CFPB employees who were terminated and the other brought in Baltimore, MD by the CFPB and others) challenging one or more of these initiatives. Jon and Evan described the lawsuits in detail. While the Baltimore lawsuit was dismissed on the basis of lack of ripeness under the Administrative Procedure Act, Judge Amy Berman Jackson issued a TRO freezing the CFPB from terminating more CFPB employees through the end of March while she decides whether to enter a further injunction with respect to the CFPB's initiatives. Ballard Spahr partners, Rich Andreano and John Culhane, then gave an up-to-date status report on CFPB (a) final rules being challenged in litigation and/or eligible to be challenged under the Congressional Review Act; (b) final rules not being challenged in litigation which may be repealed or amended or whose effective or compliance dates may be extended under the Administrative Procedure Act; (c) proposed rules; and (d) non-rule written guidance. Rich and John paid particular attention to the following final rules: 1.  The Small Business Loan Data Collection and Reporting Rule under Section 1071 of      Dodd-Frank 2.  The Non-bank enforcement order Registry Rule 3.  The Fair Credit Reporting Act “Data Broker” Rule 4.  The Residential Property Assessed Clean Energy (PACE) Financing Rule 5.  The Residential Mortgage Servicing Proposed Rule 6.  Credit Card Penalty fees under Reg Z (Late Fee Rule) 7. Personal Financial Data Rights (Open Banking) Rule under Section 1033 of Dodd-Frank 8.  Overdraft Lending Rule Applicable to very large financial institutions 9. Prohibition on creditors and consumer reporting agencies reporting medical debt under Reg V Part 1 of our podcast concludes with Rich and John describing the fact that supervision and examination of banks and non-banks is apparently on hold. A Deep Dive Into Judge Jackson's Preliminary Injunction Order Against CFPB Acting Director Vought

Our special podcast show today deals primarily with a 112-page opinion and 3-page order issued on March 28 by Judge Amy Berman Jackson of the U.S. District Court for the District of Columbia in a lawsuit brought, among others, by two labor unions representing CFPB employees against Acting Director Russell Vought. The complaint alleged that Acting Director Vought and others were in the process of dismantling the CFPB through various actions taken since Rohit Chopra was fired and replaced by Acting Director Scott Bessent and then Acting Director Russell Vought. This process included, among other things, the termination of probationary and term employees and possibly another 1,300 or so employees through a reduction-in-force , the issuance of a stop work order, the closure of the CFPB's main office in DC and branch offices throughout the country, the termination of most third-party contracts, the decision not to request any additional funding from the Federal Reserve Board for the balance of the fiscal year and the voluntary dismissal of several enforcement lawsuits. Alan Kaplinsky, Senior Counsel and former chair of Ballard Spahr's Consumer Financial Services Group, and Joseph Schuster, a Partner in the Consumer Financial Services Group, discuss each part of the preliminary injunction issued by Judge Jackson which, among other things, required the CFPB to re-hire all probationary and term employees who had been terminated, prohibited the CFPB from terminating any CFPB employee except for just cause (which apparently does not include lack of work because of the change in focus and direction of the CFPB), required the CFPB not to enforce a previous “stop work” order or reduction-in-force.  We observed that Judge Jackson's order has required the CFPB to maintain for now a work force that is not needed for the “new” CFPB. We also discuss that the preliminary injunction order does not require the CFPB to maintain any of the regulations promulgated or proposed by Rohit Chopra or to continue to prosecute any of the enforcement lawsuits brought by Director Chopra. DOJ filed a notice of appeal on March 29 and on March 31 filed a motion in the DC Court of Appeals to stay Judge Jackson's order. (After the recording of this podcast, the DOJ filed in the Court of Appeals a motion seeking a stay of Judge Jackson's order. Pending a hearing on April 9th, the Court issued an administrative stay of Judge Jackson's order. The 3-Judge panel is composed of two Trump appointees and one Obama appointee.) We also discuss another lawsuit initiated by the City of Baltimore and one other plaintiff against Acting Director Vought in Federal District Court for the District of Maryland seeking to enjoin him from returning to the Federal Reserve Board or the Treasury funds held by the CFPB. The Court denied the motion for preliminary injunction on the basis that it was not ripe for adjudication under the Administrative Procedure Act because the CFPB never actually returned any funds. Finally, Alan expresses surprise that the Acting Director has not relied on the argument that all funds received by the CFPB after September, 2022 were unlawfully obtained because the Dodd-Frank Act stipulates that the CFPB can be funded only out of “combined earnings of the Federal Reserve Banks” and the fact that there have only been huge combined losses of the Federal Reserve Banks since Sept 2022 which continue through today and are likely to continue through the foreseeable future.

Today's podcast show features a discussion with David Dayen, executive editor of the American Prospect, which is an online magazine about ideas, politics, and power. He's the author of “Chain of Title: How Three Ordinary Americans Uncovered Wall Street's Great Foreclosure Fraud,” which was published in 2016. David has written and published about 10 or so articles in which he chronicles in great detail the apparent effort by the Trump Administration, acting through Scott Bessent and Russell Vought, to dismantle the CFPB by abruptly ordering a cessation of all activities and layoffs of probationary and term employees and a plan to layoff 1,300 or so additional employees. Because this plan would have crippled the CFPB, two lawsuits were initiated in rapid fashion against Acting Director Vought seeking to enjoin him from pursuing this strategy. One lawsuit was brought by the two labor unions representing CFPB employees and others in the I.S. District Court for the District of Columbia and got assigned to Judge Amy Berman Jackson. The second lawsuit was brought by the City of Baltimore and others in the U.S. District Coury for the District of Maryland. David describes in detail the case pending before Judge Jackson, including the hearings at which several CFPB employees testified. Those employees painted a very grim picture of the effort to shut down the agency. The DOJ lawyer stated that there was never an intent to shut down the CFPB and that the steps taken by the Acting Directors to “freeze” the CFPB were similar to steps taken by any new Administration in order to provide time to evaluate the situation and decide what changes should be made to reflect the new Administration's policy objectives. Shortly after the recording of this podcast, Judge Jackson issued on March 28 a 112-page opinion and 3-page order in which she required the reinstatement with back pay of all CFPB employees that had been terminated, enjoined the CFPB from terminating any employees except for good cause related to the individual employee, fully maintain the consumer complaint portal, ordered the defendants to reinstate all third-party contracts which had been earlier terminated, ordered the defendants to not enforce a February 10 stop-work order and required that the CFPB not destroy any records. The defendants have filed a notice of appeal to the D.C. Circuit Court of Appeals. On March 29. On March 31, the defendants filed a motion in the Court of Appests to stay Judge Jackson's order. See this blog for more detail about Judge Jackson's opinion. Because of the importance of Judge Jackson's opinion, Alan Kaplinsky and Joseph Schuster have recorded a special (additional) podcast show, where we dissected Judge Jackson's opinion and order and the other lawsuit brought by the City of Baltimore against Acting Director, Russell Vought, challenging his consideration of returning operating finds to the Federal Reserve Board or Treasury. That podcast will be released tomorrow, Friday, April 4. The Judge in the City of Baltimore case, in which the plaintiffs had not established nearly as complete a record as the case before Judge Jackson, denied the motion for a preliminary injunction based on the Court's belief that there was no final order which could be challenged under the Administrative Procedure Act. We also discussed the possibility that Congress could subject the CFPB to funding through Congressional appropriations by putting such language in the Budget Reconciliation bill which can be enacted by a simple majority and not 60 votes in the Senare. Alan Kaplinsky, former Chair for 25 years and now Senior Counsel of the Consumer Financial Services Group, hosts the discussion.

Over the weekend, a federal judge ruled that Donald Trump's firing of the head of the Office of Special Counsel was unlawful, and ordered that the head – Hampton Dellinger – be reinstated. The case is likely to head to the Supreme Court after this, but Judge Amy Berman Jackson absolutely torched the administration in her ruling, and that's going to be quite a hurdle to overcome at the High Court. During an appearance on The Joe Rogan Experience on Friday, the world's richest man and government parasite Elon Musk declared that Social Security was a “ponzi scheme.” This phrase has been used by Republicans for years to describe virtually any financial plan that they don't like, but they have been particularly forceful with slapping this label onto Social Security. Musk and his fellow Republicans want people to suffer and work forever, that's the bottom line.Donald Trump continued his mass firings last week, on Thursday hitting the National Oceanic and Atmospheric Administration (NOAA) and the National Weather Service. By removing the very people that we rely upon for weather forecasting and warnings, Trump has endangered the entire country – right as severe weather is about to become a major concern for the very Red State citizens who put him back in office. Donald Trump and JD Vance's behavior during their meeting with Ukrainian leader Volodymyr Zelensky late last week was so atrocious that it may have permanently destroyed alliances that have existed for decades or longer. This Day in Legal History: Belva Lockwood Admitted to SCOTUSOn March 3, 1879, Belva Lockwood shattered a major legal barrier by becoming the first woman admitted to practice before the United States Supreme Court. A pioneering attorney and women's rights advocate, Lockwood had faced repeated obstacles in her legal career simply because of her gender. After being denied admission to the Supreme Court bar multiple times, she successfully lobbied Congress to pass a law allowing qualified female attorneys to argue cases before the nation's highest court. With President Rutherford B. Hayes signing the bill into law, Lockwood was finally sworn in, marking a historic step toward gender equality in the legal profession.Lockwood wasted no time in making use of her hard-won status. In 1880, she became the first woman to argue a case before the Supreme Court, representing a Cherokee Nation land claim in United States v. Cherokee Nation. Her success paved the way for future generations of female attorneys, proving that women could handle complex legal issues at the highest levels. Beyond her legal career, Lockwood also made history as one of the first women to run for U.S. president, campaigning in 1884 and 1888. Her groundbreaking achievements challenged the deeply entrenched biases of her time and expanded opportunities for women in law and politics.A federal judge in Seattle has extended an order blocking the Trump administration from withholding federal funding from medical providers in four Democratic-led states—Colorado, Minnesota, Oregon, and Washington—that offer gender-affirming care to transgender youth under 19. Judge Lauren King ruled that Trump's executive orders were unconstitutional, as they interfered with Congress' authority to allocate federal funds and violated the Fifth Amendment's equal protection guarantee by discriminating based on sex or transgender status. One of Trump's orders, issued on his first day in office, mandated that the federal government recognize only two biologically distinct sexes and barred grant funds from supporting "gender ideology." King criticized this move, stating it aimed to erase transgender individuals from federal recognition. A temporary restraining order was previously issued on February 14 while the judge considered a longer-term injunction. Another federal judge in Maryland has also temporarily halted Trump's orders nationwide. The lawsuit follows a second executive order from Trump that prohibits federal funding for gender transitions for minors. What’s not to love with this guy? How does Ivanka Trump do.. No wait, she doesn’t do anything. Donald Trump, the black swan president, meets his black swan threat with Coronavirus-19, and finds his usual dosage of lies non-efficacious. International Olympic Committee member, Dick Pound, isn’t just going to stand around and… “twiddle his thumbs”... waiting for action. It’s no surprise that successful hostage negotiator Robert O'Brien has found some success “working with” Donald Trump. Trump’s doctor tried hiding vegetables into Donald’s food, but he found out.  Roger Stone tried to force Judge Amy Berman Jackson to recuse herself because she praised the jurors for serving with "integrity”. Trump wants the two female Supreme Court justices to recuse themselves because… well, he’s still working on that rationale. Hang on, Ginni Thomas is volunteering to sub in for them. The 14th Amendment says states that infringe the vote must lose representation in Congress. They do a lot of that, so David looks into what can be done.

The Trump “administration” has left the schools, like everybody else, twisting in the wind, and just winging it with their plans for the fall. Will they be defunded? Or will they get even more funding? Or are they just offering “more funding” so they can take that funding away and call it defunding? Why bother finding out? Let’s just have chaos and burn all our money! Of course, we could all go back to what we were doing if there was a vaccine. But what if there was a vaccine, but no little glass bottles to put them in? Or what if there was a vaccine and lots of little bottles, but no syringes to inject them with? Don’t sweat it! Trump’s giving the contract to make hundreds of millions of syringes to two companies who don’t make syringes, or have never made anywhere near so many. (Oh, and we still don’t know if there really is immunity to be had, or how long it lasts.) Trump and paperwork, man! Judge Amy Berman Jackson heard the news about Stone’s commutation of sentence, but she demanded to see the paper. It might (maybe) just do the trick, but of course, it was a little hinky. Did you lose your job during the COVID-19 pandemic? Ivanka Trump says you should find a new one. Why didn’t we think of that? SCOTUS rules in favor of allowing states to bind their electors. Does that mean they can bind them to the National Popular Vote Compact? Sure! But because this is SCOTUS… mmmmaybe. Trump sentences himself to 10 years in prison. (Ten bucks says he screws up his own pardon.) Joan McCarter dropped by to assure us that all is pretty much as expected. That is, the enhanced Unemployment Insurance program barely keeping people afloat (if that) during the pandemic is set to expire in just 11 days. And Congress isn’t coming back for another five. Meanwhile, that other program meant to keep people afloat isn’t doing the trick, either. A lot of us are having difficulty keeping ourselves occupied during our social distancing. But not Portland, OR! They’re fully occupied. And soon, hospitals around the country can look forward to the same!

On today's episode of Loud & Clear, Brian Becker and John Kiriakou are joined by Jim Kavanagh, the editor of thepolemicist.net, and Sputnik news analyst and producer Nicole Roussell.There was a bare-fisted street brawl in Las Vegas last night, and a Democratic presidential debate broke out. Indeed, the New York Post called last night’s debate “the single best debate in the history of American politics.” That may be a stretch, but Mike Bloomberg looked unprepared, angry, and defensive. Elizabeth Warren looked like the big winner of the evening, as she relentlessly pummelled Bloomberg. Pete Buttigieg seemed to hold his own, and Bernie Sanders appears to have come out on top with no real damage other than over his medical records. Thursday’s weekly series “Criminal Injustice” is about the most egregious conduct of our courts and prosecutors and how justice is denied to so many people in this country. Paul Wright, the founder and executive director of the Human Rights Defense Center and editor of Prison Legal News (PLN), joins the show. One of Julian Assange’s London-based attorneys said yesterday that President Trump had authorized former Congressman Dana Rohrbacher to tell Assange that he would be pardoned if he showed proof that Russia was not behind the hack of DNC computers in 2016. Assange has repeatedly said over the years that no state actor was involved. But Rohrbacher issued a statement several hours later saying the report was not true, and that he had made the offer on his own volition. Brian and John speak with independent journalist Diani Barreto, and Joe Lauria, the editor-in-chief of Consortium News, founded by the late Robert Parry. Roger Stone was sentenced today to 40 months in a federal court in Washington DC. Judge Amy Berman Jackson sided with prosecutors in their demand for real prison time for Stone, and she read several of Stone’s text messages to his friend Randy Credico into the record, including messages where Stone threatened Credico and his dog. This is despite the fact that Credico wrote to the judge and asked not to give Stone any prison time at all, saying that he never took Stone’s threats seriously. Coleen Rowley, a former FBI special agent who in 2002 was named Time Magazine person of the year along with two other whistleblowers, joins the show. Fighting broke out in Syria’s Idlib Province today after two Turkish soldiers were killed and five wounded in a Syrian Army air attack. The Turks responded, saying later that they killed more than 50 Syrian troops. A Turkish government spokesman said that move does not constitute a Turkish attack on Idlib, while a Russian government spokesman said that both sides need to stand down. Meanwhile, reports circulated that were denied by Turkey that it had asked the US to deploy two Patriot missile batteries on its southern border to protect Turkish troops from Syrian air attacks. Ambassador Peter Ford, the former UK Ambassador to Syria, joins Brian and John. The U.S. government issued harsh new restrictions on Chinese public media outlets this week that would put them in the same legal category as foreign missions. This dramatic move is being denounced as yet another escalation of the war on alternative media. In retaliation, several Wall Street Journal reporters in China had their credentials revoked. KJ Noh, a peace activist and scholar on the geopolitics of Asia, and a frequent contributor to Counterpunch and Dissident Voice, joins the show.A regular Thursday segment deals with the ongoing militarization of space. On Monday's Mark Levin Show, Judge Amy Berman Jackson should act as a judge instead of a special pleader for four rogue federal prosecutors seeking a steep prison sentence for Roger Stone, a long-time friend of the President of the United States. Even though Mark is not a fan of Stone, it doesn't change the fact that Stone is getting screwed by a liberal activist in a black robe. Four line prosecutors blackmailed an interim U.S Attorney in order to pursue the charges they wanted and the heightened charges for his case. While Bill Barr was surprised by the unusually long sentencing recommendation by the four prosecutors he's pointed out that his actions to review the case occurred well before President Trump tweeted his disdain for the case. What would the left do without a billionaire to fund their activism? After all, it was one of the eBay founders from "Protect Democracy" that funded a letter citing 1,100 former DOJ employees. Later, the American Oligarch, Mike Bloomberg has taken aim at farmers saying that it doesn't take much brains to plant seeds in the ground. Bloomberg has already spent hundreds of millions of dollars on his campaign and hasn't once stepped on the debate stage, this is all to protect his massive investment in China with his good friend Xi Jinping. Afterward, the Democrats are in love with their programs like police-state health care, in love with their big-government bureaucracies, but they're not in love with you — this is a truly a sick party.
