Dr. Michael Roberto is the Trustee Professor of Management at Bryant University in Smithfield, RI. He joined the tenured faculty at Bryant after serving for six years on the faculty at Harvard Business School. He has also has been a Visiting Associate Professor of Management at New York University's Stern School of Business. His research focuses on decision making, teamwork, and leadership. He has published three books, the latest of which is titled Unlocking Creativity (Wiley, 2019), Why Great Leaders Don't Take Yes For An Answer (2nd edition published in 2013), and Know What You Don't Know (published in 2009). Episode 72 - If you've been listening to the last few episodes, we've been breaking down the steps you need to consider before starting a business. The concepts shared in these episodes are the foundation of building a successful business, no matter what kind. Bottom line in business is You Don't Know What You Don't Know You see, too many people jump into starting a business without doing any planning. Then they wonder why they aren't finding success, as if business should just fall from the sky! For some people even if they don't plan, they might get lucky but the majority of people put in a lot of hard work, time, money and sweat equity to get their dream of owning their own business off the ground. For many people it's trial and error It's figuring out what to do as they run into trouble or finding answers when they least expect to. Even if you do extensive planning and research before you start your business, you will hit obstacles, but the more you are prepared with your foundation, the better chance of success you will have. In this episode I want to recap the top 5 things I think you should focus on when planning to open your business. I've talked about these before, but I'm hoping that if they have their own episode, you'll pay attention. Quick recap Marketing Plan Focus Business Team Capital Contracts What's your end game Ideas To Consider Have a plan. You can take courses on how to create a business plan, and your plan can be 30 pages or 3 pages. I've even heard of a one page business plan, but it's hard to get a lot of details on one page! There's two things I think are essential in your plan. The first is marketing. And I think this needs to be very well defined. Maybe you need to do a little market research to test your idea before you can create a solid marketing plan, but without this, you are doomed. I also think that when you define your marketing plan up front and look at the costs for each tactic you want to implement, then you can budget accordingly which is the se cond part of the plan that I think is essential. I'll get back to that part but let's talk about marketing first. The second is financial - For someone like me, this is the toughest part because while I understand math and some accounting, financial projections aren't something I can easily wrap my head around. I see this part as start up costs - what you need to really open your doors, how much capital do you need to pay yourself or a staff for the first year while you are growing your business and how much reserve do you need in the event things don't go as planned? Map this part out, give it to your banker friends and ask their opinions. This is essential and often overlooked by many startup entrepreneurs. It's why first year entrepreneurs have such a high failure rate. Focus on what you want to do - It's ok to pivot down the road as many companies do, but if you are starting as an agency, an insurance company or a related insurance partner, be focused. Don't try to be all things to all people. It is the greatest component of success for startups. Put together you business team. I'm not talking about staff but the other professionals that can guide you. Don't hire your family member if they don't specialize in what you need. For example, you need a business attorney, not the family law attorney. Get a good business accountant, and make friends with your banker, payroll, bookkeeper, human resources and even other insurance professionals that aren't doing what you hope to do. This ties into the financial piece, but having enough capital to get you through is essential. This is really the hardest part. So many people want to start but don't have the capital. They bootstrap it which can work but it would be so much easier if there was capital. If you are working as you are thinking about starting a business, get your loan while you are working for someone else because once you become self employed, the lending rules change and it's not easy. In 2023 when everything is out of whack from COVID, getting a bank loan is really difficult so get it before you leave your salaried income. Contracts - Be sure to read all of your contracts thoroughly. I would strongly recommend having them reviewed by your business attorney. It might cost a few extra dollars, but trust me, they'll see things in a different light than you will and offer good tips for negotiation. If you have a partner, have a contract - the more detailed the better. It needs to discuss what is involved if there is a breakup. Better to get it right before you start then pay thousands when no one is talking to each other. A business breakup is no different than a marital breakup. Your business pre-nup is the most valuable document you can create. Have contracts with business vendors, employees and review your insurance company contracts thoroughly. Don't sign on the dotted link just because you get offered a contract. This last one is a bonus idea but I think it is essential to set yourself up with the end in mind. It doesn't matter if the end is 30 years away, be thinking like that. Build a business you can sell if you need to. We don't know what life will bring us tomorrow so if you set it up right from the beginning, you don't need to worry about a surprise obstacle getting in your way. Robert Lefkowitz: A Funny Thing Happened on the Way to Stockholm Robert Lefkowitz is James B. Duke Professor of Medicine and Professor of Biochemistry and Chemistry at the Duke University Medical Center. His group spent 15 difficult years developing techniques for labeling the receptors with radioactive drugs and then purifying the four different receptors that were known and thought to exist for adrenaline. In 1986 Bob and his team transformed the understanding of what had become known as G protein coupled receptors, when he and his colleagues cloned the gene for the beta2-adrenergic receptor. Today, more than half of all prescription drug sales are of drugs that target either directly or indirectly the receptors discovered by Bob and his trainees. These include amongst many others beta blockers, angiotensin receptor blockers or ARBs and antihistamines. He has received numerous honors and awards, including the National Medal of Science, the Shaw Prize, the Albany Prize, and the 2012 Nobel Prize in Chemistry. He was elected to the National Academy of Sciences, the Institute of Medicine, and the American Academy of Arts and Sciences. He is the author with Randy Hall of A Funny Thing Happened on the Way to Stockholm: The Adrenaline Fueled Adventures of an Accidental Scientist. Episode 6: In this episode, Timalyn discusses how, as a business owner, you need to take 5 steps to avoid a tax nightmare. Timalyn has seen many business owners actually go out of business because they either didn't know about or avoided important steps related to taxes. Timalyn wants you to understand important tax issues, so you don't run into problems with the IRS. You Don't Know What You Don't Know Timalyn comments that in our Do It Yourself (DIY) society, many people try to handle taxes on their own. If your income and expenses are fairly simple, you might be okay using one of the online services. However, many people have situations that are much more complicated than they realize. Having an experienced professional helping you is a significant way to reduce your risk of a tax nightmare. Step 1 – Know Your Filing Obligations Most people are aware of the April 15th tax filing deadline. However, your business may have other filing deadlines, depending upon the type of structure your business has. Timalyn spends a significant amount of time working with clients who missed tax filing deadlines and are now faced with failure to file penalties. In some cases, she's able to abate (i.e. remove) those penalties, but it's a case by case basis. Single Member LLC/Sole Proprietor – April 15th is the typical deadline. A single member LLC is a state-designation. You'll file a Schedule C for your business operations, as part of your personal income tax return (1040). Corporation – April 15th is the deadline. You don't have to be a large business to be a corporation. Many doctors, attorneys, accountants and other professionals form corporations as their business entity structure. Partnership – March 15th is the deadline. If 2 or more people come together to form a business, they have a partnership. It's important to realize you're not treated as 2 or more sole proprietors. The tax classification defaults your entity to a partnership. You have to file a 1065. Remember, your personal tax return (1040) is due on April 15th. Your state return deadline depends on the state you're in. Your business can elect to be taxed as a corporation or S-Corp, but the default results in your entity being treated as a partnership. S-Corp – (April 15th) The S-Corp is a hybrid of a partnership and corporation. This entity files an 1120S but does not pay tax at the federal level. The profits are divided among the shareholders and that taxable income will be reported on your personal tax return. Non-Profit – May 15th is the deadline. Unlike the above entities if a non-profit fails to file on time, the failure to file penalties are assessed on a daily basis. This type of business could risk being shut down or losing its tax-exempt status. As a business owner, officer, partner or shareholder, it's easy to get confused by the various filing deadlines. This can sometimes lead to a sense of feeling overwhelmed. Resist the temptation to ignore the situation. Timalyn often reminds us that neither the ostrich-approach or the pray-and-wait approach is an effective way to deal with the IRS. Step 2 – Know Your Tax Payment Obligations When people make the transition from W-2 employee to being self-employed, you have to remember you're responsible for both the employer and employee contributions to social security and Medicare. This is called self-employment tax (if you have a Single-Member LLC, you're a Sole Proprietor or you're in a Partnership). independent contractors (1099 status) are sole proprietors by default. Even if you made less than $10,000 in income for your job or side-gig, you still are responsible for paying your self-employment tax (FICA). This actually surprises a lot of people. More importantly, it's a significant 15.3% tax. You do get a self-employment tax deduction for half of that amount, but you have to pay the tax before you get to take the deduction. As a business owner, you're also responsible for making quarterly, estimated tax payments. These payments will be counted toward your year-end tax liability. Timalyn clarifies the difference between a tax liability and a tax refund. The liability is what you owe to the government. A tax refund is sent to you, because you overpaid your taxes. Some people want to avoid getting a tax refund. This means they're managing their revenues and expenses in a way that minimizes their tax liability. Others, however, like to get that check in the mail, once they've filed their taxes. If you fail to make your quarterly, estimated tax payments (or decide not to), you'll still be responsible for the total tax liability at the end of the year. The IRS will assess an under-payment penalty because you didn't make the quarterly payments. Timalyn recommends that you treat your quarterly tax payments as a normal business expense, just like the electric bill. Know you're responsible for them and play accordingly. The IRS doesn't ignore tax revenue. If you fall behind, the IRS can issue a tax lien or a tax levy to recoup the money owed. Step 3 – Have a Tax Plan The purpose of a tax plan is to develop a strategy to help you cope with your taxes, going forward. It's not just about the current or upcoming year. An effective tax plan forecasts the growth of your business and lays out a plan to help you minimize your tax liability over the next 10-15 years. Step 4 – Maximize Your Tax Deductions Timalyn recommends that you form a team of advisors including a tax professional, a financial advisor and a business attorney. The IRS does have a very useful small business center. When you evaluate people to potentially become one of your advisors, make sure they have practical experience working in your niche. They need to understand your type of business. Not all accounting professionals have the same type of experience. Not all attorneys focus on the same area of law. Find an expert who knows your industry. Step 5 – Outsource Your Tax Planning and Tax Preparation The DIY society is alive and well. However, taxes are complicated. The consequences of getting it wrong, missing deadlines, etc. can be devastating to a business. The IRS estimates the Schedule C takes 10-12 hours to prepare. Remember, the Schedule C is only one part of the sole proprietor and Single Member LLCs tax return. Timalyn asks you to consider how valuable your time is and what you could have done or earned with that 10-12 hours (and more) spent preparing your taxes. It's often worth the money, the frustration and the time to outsource your tax preparation to an experienced professional. The IRS information on its website to help you to better understand the various types of professionals who are authorized to help you with your tax returns. Is your preparer actually authorized to do your taxes? Remember, these 5 steps are important. Back taxes shouldn't ruin your life. They shouldn't force you to close down your business. We talked with Dr. Michael Roberto, a Professor of Management and Leadership at Bryant University in Smithfield, RI. He joined the tenured faculty at Bryant after serving on the faculty at Harvard Business School.Professor Roberto published Unlocking Creativity and wrote two previous books: Why Great Leaders Don't Take Yes For An Answer and Know What You Don't Know. Dr. Professor Roberto also has created three audio/video lecture series for The Great Courses: The Art of Critical Decision Making, Transformational Leadership, and Critical Business Skills: Strategy. Welcome to ‘You Don't Know What You Don't Know – A Learning Disabilities Specialist's Perspective.' Our guest is author and speaker Elizabeth C. Hamblet. Elizabeth has worked as a learning disabilities specialist in college disability services offices for more than two decades. In addition to working at a university, she is a nationally-requested speaker on preparing students with disabilities for successful college transition. She is the author of a book and a laminated guide on this subject, and her work has appeared in numerous journals and online. In this episode, we learn her origin story (special education was her second master's degree) and discuss some of the important differences between high school and college. We also discuss why some students do not request accommodations: some students don't think that have a disability; others want to shed the disability part of their identity as they transition to college.Here are some highlights:The biggest thing parents should worry about is their student's willingness to seek help.Accommodations won't matter if the student does not understand the content.College is not meant to be an extension of high school. It is hard.When assessing the appropriateness of a school, parent and students should check documentation requirements and call the disability services office to ask questions. Parents may be surprised at how independent students are required to be. Disability services notwithstanding, a good fit is still paramount. The landscape of disability services is evolving. As of June 30th, homeowners with a federally backed loan could no longer apply for forbearance under the terms laid out in the CARES act. The last year and a half has been a game changer in so many different ways, and like any huge change there's a great deal of misinformation and rumors floating around regarding what the market will look like moving into the future. On this episode, we're going to go over the reality of the market and how we as real estate agents can best serve our clients and avoid the mistakes of the past. Stay Confident and Think Outside the Box There's lots of fear in the air right now that there will be a “huge surplus of homes” because of the end of forbearance, or that the market is looking to burst the same as it did in 2008. While we can't predict the future, there's not a lot of evidence that suggests any of that. The reality is that even with the end of this form of forbearance, clients are still going to be looking to sell their home and get into other properties. If they decided that forbearance was an option they needed to take, then that is just another variable that will need to be factored when you as their agent is working with them. In this episode, we speak with Kelly Zitlow from Cornerstone Home Lending about what details need to be considered and she has some great strategies for agents looking to go the extra mile for their clients. “You Don't Know What You Don't Know” Being proactive with your clients, especially in a time of uncertainty like we're in now, is going to be the difference between being a good agent and a great one. It's highly likely that the average homeowner has no idea what this will all mean for the future of their mortgage, and there's opportunity there for you as the agent to educate them and guide them through these uncertain times. “Clarify with data, don't terrify with it.” - Bernie “There's a number of things there that you want to talk to your clients, because remember, part of our job as agents is to help our clients build wealth and save money.” – Steve “There was a time when you wanted to put your head in the sand and not talk about this. We are in an opportunity now where agents can be proactive to have the conversations to learn about what's happening to their clients and/or potentially new clients and helping people understand what's really available to them.” – Bernie “They (real estate agents) think that forbearance was like a nasty, ugly word back (in 2008), right? Forbearance today, it's just part of the cycle. We can deal with it.
