Violation of Statute Allows Suit for Negligent Failure to Resolve Insurance Claim Post 4706 Christine Moody, individually, and in her capacity as the Personal Representative of the Estate of Steven "Troy" Moody, Deceased v. Oregon Community Credit Union, aka OCCU, an Oregon entity, association, union, or corporation et al., Defendants, and Federal Insurance Company, an Indiana corporation, 371 Or. 772, SC S069409, Supreme Court of Oregon (December 29, 2023) Plaintiff, whose husband was accidentally shot and killed during a camping trip, brought this action against defendant, a first-party life insurer, claiming, among other things, that defendant had negligently failed to investigate and pay her claim for policy benefits, causing her to have fewer financial resources to navigate the loss of a bread-winning spouse and, consequently, to suffer economic harm and emotional distress. FACTS In the case now before the Supreme Court it must consider whether plaintiff has alleged a legally protected interest sufficient to subject defendant to liability for emotional distress damages. To decide whether that alleged interest is a legally protected interest sufficient to subject defendant to liability for emotional distress damages. Plaintiff has alleged a viable common-law negligence claim against defendant for emotional distress damages. Therefore, the trial court erred in granting defendant's motions to dismiss plaintiffs negligence claim and in striking her claim for emotional distress damages. ZALMA OPINION The state of Oregon, like many states, has enacted statutes punishing insurers for bad faith claims handling. The insurer, after a change in allegations, paid the plaintiff the $3,000 life insurance limit, only to find itself sued for negligent claims handling. The suit was dismissed by the trial court and reversed by the Court of Appeals and the Oregon Supreme Court. Since the statute requires fair claims handling the plaintiffs allegations allowed it to sue the insurer for emotional distress damages when it initially refused to pay because of an exclusion.  This is a limited decision and stretches the obligations of an insurer beyond fairness and even with a clear and unambiguous exclusion it can be sued for emotional distress. Reynolds Tobacco Company's cigarettes. Building upon the success of the 1994 Engle class action lawsuit comprised of Florida smokers, trial lawyer Eric Rosen successfully took Broward County, Florida jury members on a journey back in time to when smoking was deeply ingrained in American society, helping them see how that environment influenced Vivian's decisions as well as the actions of R.J. Some elder care attorneys handle subjects that most people know something about, such as probate, guardianship, estate planning. Other eldercare lawyers focus their practice on other areas of law such as special needs planning, VA benefits planning, and Medicaid planning. So, what is Medicaid planning? Medicaid planning is a way to protect people's assets from the threat of long-term care expenses. Many clients are between 65 and 95, own their own homes, and have between $25,000 and $750,000 worth of assets in addition to the house. What many people don't realize is exactly how expensive long term care expenses can be – In 2020 the average costs of a skilled nursing facility, in New York is $14,250.00 per month. Someone can be solidly middle class or upper-middle class, have saved their whole life, and think that they'll have plenty of money for whatever happens only to suffer a stroke, major heart attack or get an Alzheimer's or Parkinson's diagnosis and need help with their activities of daily living. If they have this six-figure per year care expense, many people spend everything. Medicare does not pay skilled nursing home expenses after 100 days. An elder care attorney, who handles Medicaid planning, is able to legally and ethically protect people's assets to get them qualified for Medicaid. Medicaid, unlike Medicare, has excellent long-term care benefits. This helps them supplement their lifestyle with their own assets (to improve the quality of their life while alive) and make it more likely that they will have something to pass onto their heirs after they pass away. Probate is another one of those words many have heard and it's probably something you're told you want to avoid, but not many people have experienced or truly understand what it entails even if they know what the term means. Probate is the legal word for the Court process of handling the assets and obligations of a person when they pass away. Assets in a person's individual name (without having a beneficiary designation) have to go through probate to transfer to the beneficiaries So – what does probate entail? Probate can be formal (with lots of Court oversight) or informal (with little or no Court oversight). The process for both formal and informal probate begins with an application for administration. Informal is always preferred over formal for the simple fact that there is less cost, less oversight, and a shortened process. That being said, when there is conflict sometimes Court oversight is required to effectively move the process along. After an application for administration is filed and accepted by the Court, a Personal Representative is appointed. The Personal Representative (other states call this person an executor) is the person who will put in the work to settle the estate: publishing notices; informing creditors; filing an inventory; compiling and liquidating the assets; paying last expenses, outstanding bills, and administrative costs; and filing any needed tax returns. After the work is complete and an accounting of the process put together, the Personal Representative can distribute the assets according to will. Or, if no estate planning was done, according to the state's intestacy laws. I just went over a simplified version of the probate process. A typical probate can last about a year. A contested process can take years. There are also costs associated with probate - Court costs, attorney's fees, and accountant's fees on top of the ordinary costs of administration. Finally, probate is a public process, which means creditors are more likely to come forward; beneficiaries are more likely to contest; and strangers are more likely to learn about your business. It is important to sit down and plan your estate. Deciding not to have a plan, is still a plan. Be mindful of what your actions (or inactions) mean and what the process will entail after you are gone. Also, you cannot obviously force our loved ones to make their own plans. If you find yourself in a situation where you are facing probate for a friend or family member: Don't panic. Tuesday, March 22, 2022 Hoover Institution, Stanford University   The Hoover Institution and Japan Society of Northern California host US Japan Global Dialogue on Tuesday, March 22, 2022 from 12:30pm - 7:30pm PT. In a rapidly changing Indo-Pacific region, Japan remains America's core ally, Asia's most stable democracy, and the world's third-largest economy. The US-Japan alliance is poised to enter a new era and expand its focus to cooperate on next-generation technology, development issues, civil society development, and maintenance of security. The Hoover Institution's US-Japan Global Dialogue explores the future of this critical relationship. The dialogue launched on March 22, 2022 (United States) / March 23, 2022 (Japan) with a private, one-day hybrid conference hosted by the Hoover Institution. Attendees included both US and Japanese senior government officials, eminent scholars, and leading private-sector actors. The conference began with a lunch hosted by the Hoover Institution and the Japan Society of Northern California followed by a panel discussion with Senator Bill Hagerty (R-TN), Japanese ambassador to the United States Koji Tomita, and former US ambassador to Japan John Roos in discussion with LTG (ret.) H. R. McMaster, moderated by Dr. Michael Auslin. It also included a Hoover Institution Library & Archives exhibit Histories Connect: Special Exhibitions of Japanese and Japanese American Collections with Dr. Kaoru (Kay) Ueda, Curator of the Japanese Diaspora Collection. Later in the day, a closed hybrid conference covered the following topics: 1) improving security cooperation between the United States and Japan and with other partners; 2) deepening economic and financial cooperation; 3) deepening cooperation in the development and application of new technologies; and 4) protecting liberal values and democratic sovereignty in Asia and beyond. At the conference, one American and one Japanese expert each presented short papers on each topic. With my work representing the Personal Representative to the late Cpl. Lionel Desmond in the Desmond Fatality Inquiry coming to an end, I have an announcement on my next project. The Nova Scotia Mass Casualty Commission, which will examine the tragic events of April 18-19, 2020 in Portapique and other locations throughout Central Nova Scotia, is set to begin hearings on October 26, 2021, and conclude by November 2022. This is to be an independent public inquiry into the events, and is designed to let us know what happened, and make recommendations for changes wherever that may be appropriate. As one of the very few active private practice lawyers in Nova Scotia with any experience in an Inquiry setting, I will use the skills and insight I have acquired over 15 years as a leading inquiry, litigation, and criminal defense lawyer in Nova Scotia to provide insider coverage and legal analysis for those following the Mass Casualty Commission. I have been following the developments out of the tragedy since the beginning, and already see many areas that would benefit from the scrutiny that can be provided by an Inquiry process. I will watch the Inquiry proceedings and provide live analysis, along with short daily articles and video summaries of the proceedings. I will talk about the legal strategies of the various Parties, the relevance and quality of the evidence that is presented, the thinking that goes into specific lines of questioning, any political angles behind the scenes, and the media coverage of the proceedings. I also happen to know many of the lawyers and police officers involved in the case, and so can provide those personal insights to the public as well. My goal is to provide regular citizens with insight into what is really happening in the Inquiry and why it might matter to them. This is designed to be a public service, and so most of my content will be available to anyone free of charge. I will have an option for those who would enjoy some extra content, or else just feel like supporting the project, to make donations or become a subscriber. As October 26th approaches, I will post some content to set some context for the inquiry, or as any announcements are made by the Commission. In his keynote address, UN Special Envoy for Syria, Geir Pedersen, addresses the conflict in Syria and prospects for peace. He argues that a decade of devastation has shown that the only viable path forward is a negotiated political settlement as envisaged in UN Security Council Resolution 2254, backed by concerted international support. Furthermore, he contends that global players have shared interests in Syria, and their constructive diplomatic engagement is more needed than ever, as is a united Security Council. As part of the IIEA's Global Europe project, this webinar is supported by the Department of Foreign Affairs. About the Speakers: Geir O. Pedersen became UN Special Envoy for Syria in January 2019, as appointed by Secretary-General, Antonio Guterres. He previously served the United Nations in various roles, including as Special Coordinator for Lebanon (2007 to 2008), Personal Representative of the Secretary-General for Southern Lebanon (2005 to 2007), and Director of the Asia and Pacific Division in the Department of Political Affairs. In his national capacity, Mr Pedersen most recently served as Norway's Ambassador to the People's Republic of China (2017 to 2018) and as Permanent Representative to the United Nations (2012 to 2017). Between 1998 and 2003, He served as Norway's Representative to the Palestinian Authority and previously was the Chief of Staff for the Norwegian Foreign Minister. In 1993, he was a member of Norway's team to the Oslo negotiations that led to the signing of the Declaration of Principles.

Today we speak to Francisco Siervent, Owner of Keystone Law Firm speaking on the 3 Thing missing from Most Living Trust. Let's dive into these 3 missing items. 1. Don't Avoid Living Probate - within a living trust, there is verbiage that informs your loved ones if something were to happen and you become incapacitated such as a Stroke, Dementia, Head Injury, or any other reason you could not make decisions for yourself. This is called a Guardianship. A Guardianship is when someone needs to step in and help make decisions for medical, medication, or you're all over health and well being. The other part of this would be a Conservatorship. A Conservator is someone who would help make financial decisions and help pay for the bills of the loved one. In Arizona, we are one of the few states with Mental Health Power of Attorney. When someone does not have these documents within their Living Trust, even when they are living, they would need to go to the Probate Court and have the Courts assign a Conservator and Guardian. This can be very messy and extremely expensive. When coming from another state, check into the Mental Health Power of Attorney's as some state may not require this document. 2. Doesn't get Created Early Enough - When there is a situation with an urgent problem, such as someone is in Hospice or has been given a short amount of time to live. When someone is in this situation, it's hard for a loved one to put a Trust together. What Fransico explains that when in this situation, a Will, which is written instructions, is needed. At this point, the person will still go to Probate, but the instructions will be in writing so the Probate Courts will at least know what direction to go. This isn't the most ideal situation, but at least you have something written for the Family, Attorney, and Court to go by. 3. Too Complicated to update them - Many families who had made Trust years ago, don't think or don't want to get a review because they feel it will take too long, be too expensive, or just don't want to make any more decisions about their Trust. Francisco explains that it's easier then you think. Many times you just need to amend the Trust you already have or just add the documents, such as the Mental Health Power. Francisco explains that the easiest way to get started either in the beginning or when updating a Trust, start with a few small steps such as asking these two simple questions, "Who's in Charge" and "Where do my items go". These questions will at least get you the bare minimum of how to start with a Trust. Then each year start to add more to your Trust. Leaving your final wishes to someone else can be a daunting prospect. Your Personal Representative or Successor Trustee could steal it all, but it is very unlikely if you plan correctly. Technically...They Could Take It All Just a likely they could rob a bank. In reality is Personal Representative and Successor Trustees don't steal from estates. Most often your estate is protected because you picked a trustworthy person. In Oregon, the Probate Court will keep an eye on your estate. Beneficiaries will also keep a close eye on the Personal Representative or Successor Trustee. If they smell anything fishy, they have options for correcting the situation. The Powers They Do Have Personal Representatives and Successor Trustees have lots of power. Their power comes from your Will or Trust and the State Laws. Generally, they can do most anything that achieves your wishes and desires. However, they can't do anything illegal. Personal Representatives and Successor Trustees Have Similar Duties There are really four main duties for both Personal Representative and Successor Trustees. Gather all of your assets. Pay creditors. Disburse your assets pursuant to your wishes, or the State Laws if you don't have an Estate Plan. Close your Estate. A couple that I worked with this year was surprised to learn that they need a Will to go along with their Trust based Estate Plan. This couple came to me with a Will based Estate Plan that they had for years. These was nothing wrong with their plan when it was setup. However, as time passes, circumstances change as to your Estate Planning needs. After learning about their current circumstances, we all agreed that a Trust based Estate Plan was right for them. When they came in for their signing cermony, we reviewed their Trust and other documents. The couple was surprised that switching form a Will based to Trust based Estate Plan would require them to still have Will. There Are Two Main Reasons You Need a Will With Your Trust REASON #1 - You pass away before your Trust is fully funded.  This can happed if you pass away before you have time to fund your Trust, or if there is a mistake/oversight and an asset is properly funded into your Trust. In this case, your Pour-Over Will directs that you are leaving your probate assets (those not funded into your Trust) to your Trust. Once the Probate is complete, all of your assets are then handled pursuant to the terms of your Trust. REASON #2 - Your Trust is invalid for some reason.​ It doesn't happen often, but there is always a change that your Trust can be found to be invalid.  It could be an error in executing your Trust, or due to an heir challenging your Trust in Court. No matter the reason, if your Trust is invalid that you assets will need to go through Probate. In this case, your Pour-Over Will directs your Personal Representative to setup a new Trust with the same goals, heirs and wishes as your invalid Trust. Then all of your assets are left to the new Trust and your assets will go where you wanted them to go in the first place. Hopefully Your Pour-Over Will Never Gets Used. As you've heard me say in the past, a goal of having a Trust is to avoid Probate. That means that our goal is to never use your Pour-Over Will. Despite our goal, we never want to put all of our eggs in one basket and having the Pour-Over Will is an insurance policy for your Estate Plan. Robert Fowler has had a distinguished career as a Canadian diplomat and public servant.  From 1989 - 1995 he was deputy minister of National Defence; from 1995 - 2000, Canada's ambassador to the United Nations, and, following that, ambassador to Italy  from 2000-2006. Over the years he has served as foreign policy advisor to three Prime Ministers, and as Personal Representative for Africa. On Dec. 15, 2008, when he was in Niger as special envoy to the United Nations responsible for reconciling rebel and government forces, Fowler and his assistant Louis Guay, were kidnapped and held captive for 130 days by regional members of al-Qaeda. He tells the story of this ordeal in his book A Season in Hell. We talk about it and, among other things, Coleridge's 'Rime of the Ancient Mariner', sanity, religious fanaticism, mental illness, the Newtown massacre, and the clear and present threat posed to Mali, and Africa, by al-Qaeda.
