This week, I review a Dalhousie Law School graduate who challenged the Alberta Law Society's requirement to swear allegiance to the Queen, the Federal Crown asking the court to impose a retroactive publication ban (and then threatening to charge the Halifax Examiner with violating that publication ban) after an embarrassing display from a witness protection program witness, indigenous fishers charged in 54 cases in Nova Scotia, and a warning from the Supreme Court of NS about lawyers using artificial intelligence in their legal arguments. Before getting into the big stories, I mention the Trump lawyers who plead guilty this week to election interference charges, the Saskatchewan Parents' Bill of Rights passing, and the five year anniversary of the legalization of cannabis in Canada.

Do you ever wonder what happens when a small claims lawsuit is baseless? Unlike in Supreme Court, judges cannot award costs to the successful party in Small Claims Court. Costs are intended to both cover some of the legal and other expenses related to a court case. They can also encourage the settlement of meritorious claims and discourage needless litigation.  There is, however, a Small Claims Court rule that permits a judge to award a penalty of up to 10% of the amount claimed if someone proceeds to trial with a claim that has no prospect of success. This 10% penalty can be applied to each party that has a baseless claim brought against them. On the show, a baseless claim made by the purchasers of a home against the couple who sold it is discussed, along with the resulting penalty imposed by the trial judge who concluded the plaintiffs were simply trying to get someone else to pay for renovations they decided to do. Also, on the show, a claim against Google and Apple is discussed. The small British Columbia company was unable to pursue a claim against the large tech companies alleging an overcharge for advertising because of an arbitration clause included in the online agreement to purchase the online ads. Large companies often insert arbitration clauses into user agreements to avoid being sued. Because arbitration can be expensive and requires claims to be made individually, rather than as a class action, these provisions can stop claims completely because they become too expensive to pursue individually. Lastly, we step into the world of murder cases, and autopsy photos. Because judges have an obligation to determine if a piece of evidence would be more prejudicial than probative of an issue in a case, they need to determine if gruesome autopsy photos should be shown to a jury. If, for example, the only issue in a murder case was whether the accused was the person who committed a murder, showing jurors disturbing photos of a dissected body would likely serve no purpose. If, however, the issue was whether the amount of force used in self-defence was excessive, it might be very important for jurors to see images of a fatal injury. In the case discussed, the number of photos was reduced by agreement, and the judge ordered that a particularly disturbing photograph that included late stages of the autopsy dissection be cropped to only show the injury at issue in the case. Tamiza HockenhullMy current employment as a Commissioner requires that I apply my knowledge of the law concerning family, criminal, juvenile and civil matters. I must also apply my knowledge of specific California codes including the Vehicle, Penal, Evidence, Civil, Civil Procedure and the Code of Judicial Conduct.  I currently handle general civil and traffic assignments and I regularly cover our court's child support calendar.  On a daily basis, I exercise judicial temperament and demeanor whether I am presiding over general civil cases including Law and Motion, Small Claims, Unlawful Detainer, Civil Harassment and Domestic Violence Restraining Orders as well as child support or traffic cases.  I am also responsible for issuing Emergency Protective Orders in domestic violence matters. While the Copyright Act also offers the possibility of obtaining statutory damages and attorneys' fees, these benefits are not always available and may not be recovered until after a long court battle that can entail significant up-front costs. In a significant new development in this field, the Copyright Alternative in Small-Claims Enforcement Act of 2020 (the CASE Act) was enacted on Dec. 27, 2020. This week on Legally Speaking with Michael Mulligan:The BC Government has proposed police roadblocks to enforce travel restrictions between health authorities, in order to reduce the spread of COVID-19.Because there are significantly different rates of infection in different parts of the province, this objective is understandable. Unfortunately, contrary to the premier’s assertion that police will be able to conduct roadblocks of this kind without any new authority, that is not the case. Police have the authority to stop vehicles for motor vehicle-related purposes, such as to ensure the sobriety of the driver, that the driver has a valid licence, and the vehicle is properly insured and mechanically sound. Police do not have the authority to stop vehicles for other kinds of investigations unless, at a minimum, they already have reasonable grounds to suspect that the occupants are connected to particular criminal activity. The police would not be permitted to, for example, pull cars over at random, or set up a roadblock, to search for drugs or stolen property.In addition, police are independent of government: they are not obliged to set up roadblocks at the direction of the government. Some police representatives have already made clear that they are not prepared to participate in the proposed scheme. Finally, the province has not provided vaccines to police officers so asking them to conduct roadblocks of the type suggested would put both the police officers and people being stopped, at risk. There is, however,  a safe and lawful means to accomplish the government’s objective. Section 23 of the Public Health Act permits health officers to stop a person or vehicle for purposes including determining if “a health hazard exists or likely exists in or on the vehicle or place, or in relation to the activities of the person…”. The government could designate nurses, or other medical professionals, as health officers pursuant to section 71 of the Public Health Act.Unlike police, the designated medical practitioners would have the legal authority to conduct checks or cars at ferry terminals or elsewhere. They would also be vaccinated. This approach would also address many of the concerns expressed by the BC Civil Liberties Association, The BC Assembly of First Nations, the Criminal Defence Advocacy Society, and others relating to the use of police checkpoints. Also on the show, a COVID-denier, who attended a Flat Earth conference in South Carolina, had his claim against the Premier, AG, and others, dismissed after he was arrested and held in jail for 4 days following three alleged breaches of the Quarantine Act, upon his return to BC. In dismissing the man’s claim, the judge hearing the case said that he was not without sympathy, because the man learned the hard way that laws do not work on an “opt-in” basis. Finally, on the show, Small Claims rules for civil claims between $5,001 and $35,000, have been amended as a result of COVID-19 to permit various steps in the process to be conducted by phone or video connection. Other steps, such as a trial, would presumptively be conducted in person. On application, a judge has the authority to depart from the default online or in-person option.  In today’s podcast, Richard L. Duquette discusses the economics of justice in a small bike injury case. Richard provides a realistic perspective in Economics of a Small Bike Injury Case to help you decide how to proceed with your case.   Historical Overview   The legal claim field has titled to the side of the insurance adjuster. In the 80’s a typical case settled for 3 times the medical bills. This provided for pain and suffering in addition to paying for the medical bills. Everyone walked away generally happy.   In the 90’s insurance companies began pumping millions of dollars into tort reform via advertising and politics. This changed things drastically.   Today, the victim is being offered just medical bill repayment. The changes over time have shifted the burden of proof over to the victim in order to pursue a case.   This process can be so overwhelming and confusing for many so they just give up. The big corporations win and the victims lose.   Fight Back   Don’t give up. You can still fight with a small case if there is proof of clear liability or fault and limited damages. This might include some bicycle damage and a sprain, strain, whiplash, abrasions, contusions and even some non-displaced fractures.   Computers and Evaluation   Each person and their injuries are like a snowflake, they are unique. Because of the insurance company's stance of deny, delay and defend, the discretion available to the front-line adjusters is very limited. Your case is probably going to be determined by a computer instead.     Appointed Judges and Politicians   With the onset of appointed judges and politicians came a movement of anti-consumer views. This change can be seen with respect to your personal health insurance (collateral source) versus your medical bills. If this new legislation passes, Creatives will be able to recoup lost income from those who steal their work. The process directly applies to damages LESS than $30,000, will involve no lawyers, no court appearance, no travel. Small claims court has many different rules and procedures than other courts. It has many more of the elements “as seen on tv,” as very little is documents or correspondence is exchanged between attorneys, or the plaintiff and defendant. Usually attorneys are retained on a flat fee basis, and work is not performed hourly. Discovery rarely happens because the court wants to keep everything moving. A defendant does not even need to file an answer or disclose witnesses in small claims court. If a defendant chooses not to file an answer, the court will assume all allegations are denied. You are allowed to file additional pleadings, such as a counterclaim, but must ask the court for leave to file it. Many surprises can happen the day of trial, since both sides are uncertain as to who will be called as a witness and what evidence will be presented. Both parties will see all documents each side will offer up for the first time at trial. All rules of evidence do apply in small claims court, but in order to enhance efficiency, the court and counsel are usually more relaxed on objections when a witness is testifying or when a document is being requested to be admitted into evidence. Although small claims court is in the same court as all other litigation, it truly has its own policies and procedures.
