University of San Diego law professor Donald Dripps joins us to educate us on the plea bargain system which has essentially replaced what we think of as our criminal justice system. Prof. Dripps explains why defendants waive their right to a jury trial by pleading guilty, why defense attorneys recommend taking a plea, why prosecutors offer up "deals" for alleged criminals, and the ramifications of "self-conviction." He discusses which cases tend to get pled out, in what jurisdictions, and if folks who have pled guilty are ever exonerated. He explains how mandatory sentencing minimums increase the pressure to take a plea, along with trial delays, the "trial penalty," and overburdened public defenders. Despite some of its injustices, the plea option acts like a pressure valve on our bloated criminal justice system. Prof. Dripps describes some improvements that could be made and warns us that, in its current state, the system is vulnerable to certain strategies which could bring about its collapse. The chairman of the Tel Aviv District of the Israeli Bar Association argues that even though Attorney General Avichai Mandelblit leaves office at the end of the month, Netanyahu still has enough time to reach such a deal. "If Netanyahu agrees to the conditions proposed, the technical/legal part could be wrapped up quickly. It is not a complex agreement," he says. Having said that, he notes that in the broader sense, this could prove to be much more complicated. "You must take into account the personality of the defendant Netanyahu, as well the necessity to agree on very specific wordings in which the former premier pleads guilty to some of the charges," says Becher. This is a special episode of All the Presidents' Lawyers with Carissa Byrne Hessick, professor of law at the University of North Carolina. As we've discussed previously on the show, some federal judges have been wondering (sometimes aloud, in their courtrooms) whether the Capitol Riot defendants are getting off too easy. More than six hundred people have been charged so far — a few with felonies and most with misdemeanor charges. Of those charged, about one hundred people have accepted a plea bargain. There are a lot of reasons why plea bargains are part of the American justice system, but is plea bargaining good? With how overwhelmed D.C. courts are, how are prosecutors thinking about getting defendants to just plead guilty? And what's the political messaging behind these cases? Carissa Byrne Hessick says plea bargaining is a bad deal and she's here to talk about it.
