The Digital Services Act (DSA) is a landmark European regulation which seeks to protect Europe's values and democratic principles in the online space, and to help counter the dissemination of illegal and harmful online content. The DSA entered into force in November 2022 and began to fully apply across the EU from February 2024. At this hybrid event, a panel of experts discusses the implementation of the DSA to date and assesses the ongoing debates relating to various features of the DSA. The panel also discusses the opportunities and challenges that may lie ahead for the future of DSA enforcement. This event is organised in collaboration with the Economic Regulators Network (ERN), a cross-sectoral group of economic regulators in Ireland. The panel for this event include: John Evans, the Digital Services Commissioner,  Coimisiún na Meán Dr Eileen Culloty, Deputy Director of the DCU Institute for Future Media, Democracy, and Society (FUJO); Coordinator of the Ireland Hub of the European Digital Media Observatory Professor Natali Helberger, Distinguished University Professor of Law and Digital Technology, University of Amsterdam; Member of the project team at the Digital Services Act Observatory Irene Roche Laguna, Head of Unit, Coordination and Regulatory Compliance, DG CONNECT, European Commission The ERN is composed of Coimisiún na Meán, the Commission for Communications Regulation (ComReg), the Competition and Consumer Protection Commission (CCPC), the Commission for Regulation of Utilities (CRU), the Central Bank of Ireland, the National Transport Authority (NTA), and the Commission for Aviation Regulation.

Australian law firm Maurice Blackburn is investigating a publisher class action against Google in a strikingly similar $8 billion lawsuit already underway in Canada – led by a tiny regional community publishing boss, Lisa Sygutek, who won't be cowed. “Find your inner warrior, sign-up, go for it,” she urges Australian media owners. Miranda Nagy, the lawyer leading the Australian class action investigation, likewise calls on publishers large and small to join the proposed action. She's aiming to secure “best possible” retrospective compensation. Maurice Blackburn has come to the same conclusion as the US Department of Justice, various European regulators, and a dozen US state attorneys general. They allege Google manipulated and gamed publishers and brands for years with secret deals and projects – some in collusion with Meta – that actively sought to disadvantage them while entrenching Google's market dominance – taking billions of dollars away from publishers and fleecing advertisers in the process by charging far more than was either necessary or officially disclosed. The alleged ruses include things like ‘project Bernanke', in which Google was essentially able to “to take a bigger spread between publishers and advertisers, which means both publishers are getting less money and advertisers are paying more,” according to Adil Abdulla, the lawyer leading the Canadian legal effort through Sotos Class Actions. Then there was ‘Jedi Blue', in which Google is accused of colluding with Facebook to kill the free market publishers and the broader ad market had tried to build through header bidding, while ensuring Facebook got an ad auction advantage in return. Jason Kint, CEO of US peak publisher body Digital Content Next, says Jedi Blue's impacts “are still playing out” and forecasts “a bloodbath of lawsuits being filed”. He thinks the Trump administration will go just as hard with “eight to 10 different code name projects” to go after. While many US publishers, advertisers and agencies had been “captured” by Google, Kint reckons that “halo is starting to come off”. He urges marketers and the supply chain locally to likewise reject being strong-armed. For publishers, Future Media founder Ricky Sutton echoes that call: “This is the first window in 20 years where we've got a chance to take back some of the things that we've lost. More people in Ireland consume their news online than through any other medium, including television. This is the first time that news online has become more popular than television news in Ireland, according to the annual Digital News Report Ireland. The report, to be published by Coimisiún na Meán, also reveals that the number of Irish news consumers who paid to access news content increased in 2024. This was especially true for 18-24-year-olds, where an increase of seven percentage points, up to 26% from 19%, in people paying for digital news content was recorded. The study also found that there is evidence of real concern about what is real/what is fake online, with the number of people expressing concern up seven percentage points since 2023 (now at 71%). Commenting, Media Development Commissioner for Coimisiún na Meán, Rónán Ó Domhnaill, said: "It is encouraging to see that overall trust in news remains high in Ireland compared to other international regions, this year 46% of respondents reported that they can trust most news most of the time. The continuing trend toward news consumption online presents both opportunities and challenges for the media in Ireland. This year's Digital News Report Ireland serves as a valuable dataset to help ensure that the transition to news online is implemented in a structured and successful manner." "Coimisiún na Meán's support for journalism in Ireland continues. We recently concluded a public consultation on two new journalism schemes supporting high-quality coverage, in both Irish and English, of local authorities and Circuit and District Court hearings. These schemes, and an ancillary funding measure, are due to commence this summer, financed by a fund of €6 million allocated from the Minister for Tourism, Culture, Arts, Gaeltacht, Sports and Media, Catherine Martin TD." Research for the Digital News Report is undertaken by the Reuters Institute for the Study of Journalism at the University of Oxford and is the largest ongoing comparative study of news consumption in the world. The Irish data forms part of the larger survey, which this year is conducted in 47 markets. Ireland's participation has been facilitated this year by Coimisiún na Meán, Ireland's commission for regulating broadcasters, on-demand services and online media and supporting media development. Analysis of the Irish data is provided by researchers from the DCU Institute for Future Media, Democracy and Society (FuJo). Key findings from this year's report include: Interest in News: Irish consumers retain their interest in news. Some 88% of respondents were either 'extremely', 'very' or 'somewhat' interested in news. This is higher than in the UK (82%), the US (84%), or when measured against the European average (85%). However, if only the two categories of 'extremely' or 'very' interested in news, are selected, then there is a significant difference between those who are aged 18-24, who register at 30% and those who are 65+, who register at 73%. There are also major differences between the genders, with men registering 61% (extremely' or 'very' interested in news), and women 46% (extremely' or 'very' interested in news). Trust in News: Trust in news is down slightly overall, but selected outlets have seen a rise in their percentage points. At the top of this ranking, RTÉ (+1pp) and The Irish Times (+2pp) remain the most trusted outlets. Source of News: For the first time 'online, excluding social media' (33%) has overtaken TV viewing (31%) as 'the main source of news'. Paying for News: There has been an increase of two percentage points (from 15% to 17%) among Irish news consumers who have paid to access news content in 2024. News subscriber numbers are behind the US, but ahead of the UK and European average. There has been a significant increase of seven percentage points in the number of people aged 18-24 paying for digital news content. It's not sexy but like AI, it's going to affect your job – and your company. Another salvo in the fast approaching privacy regime set for tabling in parliament in August was fired last week by the ACCC around how personal information is collected and used by data firms – Experian, Nielsen, Publicis-owned Epsilon and Woolworths-owned Quantium were among those flagged by the competition regulator last week in its eighth interim report as part of the multi year Digital Platforms Inquiry. And to be blunt, any professional working in ecom, marketing, customer experience, digital advertising and data and analytics is going to have a rude shock for what they can do now versus what is likely in a year or perhaps a bit longer. But UNSW Business School's Professor of Practice, Peter Leonard, says last week's release by the ACCC of its Data Products and Services interim report makes “every firm in this economy a data firm.” And in the short-term, that's not good news for most companies because their data readiness and maturity is not matched by the “fundamental change” which will force everyone to “rethink their understanding” of what even defines personal information” according to ADMA's Director of Legal and Advocacy, Sarla Fernando. There's so much happening on the regulatory front it's dizzying, so Mi3 called in the experts for an update - and it's proven rather revealing: Despite intensive lobbying from loyalty scheme operators and beyond, Australia's sweeping privacy law overhaul remains on course to land this year – with massive implications for just about every business. “It's now clear that we will see a substantial broadening of what is regulated as personal information,” according to Data Synergies Principal, Peter Leonard. “That will include use of online tracking codes and techniques such as fingerprinting, which enable the targeting of individual consumers – and I think we will see that regulation encompassing not only online targeted advertising, but also targeting of content.” Which gives publishers something to ponder – especially those making major martech investments, says Civic Data's Chris Brinkworth. Across all sectors, Brinkworth warns companies are leaking data on a wholesale basis “in a way that contravenes current Australian Privacy Principles let alone future Australian Privacy Principles”. The broadening of personal information definitions will also govern use of CX data within martech stacks, effectively limiting what banks and retailers, for example, can do with customer data unless they can explain it to “someone of below average intelligence,” per Leonard - and provided it passes a test of ‘fair and reasonable' use. If not, prepare to fall foul of the Privacy Act, face class action lawsuits and massive fines. The Feds, warns Leonard, are getting firmer on their position, and industry is not being heard “at the same level that privacy advocates and a number of the consumer organisations are being heard in Canberra”. Meanwhile, the ACCC's probe of data brokers is expected back from Treasury as early as this week, with fallout likely for Australia's marketing supply chain. “We're all talking about Meta and Google hoovering up data, but I think the biggest operator in terms of data brokerage in Australia is Woolworths' Quantium,” per Laurel Henning, Legal and Regulatory Affairs Correspondent at Capital Brief. But across the pond, Google now faces genuinely existential challenges, says Future Media's Ricky Sutton, as the US Justice Department and Federal Trade Commission “have both said that what they're seeking is a breakup of Google. How much influence does the public have on the decisions made by government? Should they have more? And how should that work? People want a greater say in the decisions that affect them and their lives, with polling by UCL's Constitution Unit finding that 77% of people felt they had too little influence over how the UK is governed. There is often a disconnect between the public and the UK's representative institutions. So what needs to be done to bridge this gap between citizens and the state? This event, part of the Institute for Government and Bennett Institute for Public Policy's Review of the UK constitution, explored ambitious ideas for reinvigorating democracy in the UK. From new digital technologies, tools for allowing people most affected by policies to help design them, and citizens' assembles on the most important policy challenges facing the country, our panel will pitch their proposals to improve the UK constitution and bring decision making closer to the people. Biden's looking to make diplomatic progress on migration and the economic devastation and violence that drives it. Can he succeed? Voters went to the polls across the country this week, with some big primary races in states like California. The Conference on the Future of Europe is a joint undertaking by the European Parliament, Commission and Council which aims to open a new space for debate and engagement with citizens from all corners of Europe on the future of the EU and incorporate their views on key economic, environmental and geopolitical issues into EU policymaking and strategy. This webinar explores the role of the European Parliament and of national parliaments like the Oireachtas in shaping Europe's future, and what it may mean for Ireland and the EU. This event is part of a series co-organised with the European Parliament Liaison Office in Dublin ahead of the European Citizens' Panel. About the Speakers: Guy Verhofstadt has served as an MEP since 2009, and is a former Belgian Prime Minister and a former president of the Alliance of Liberal Democrats for Europe group (ALDE) in the European Parliament. He is a member of the Committee on Constitutional Affairs (AFCO) and the Delegation for relations with the United States, and was the chair of the European Parliament's Brexit Steering Group. Deirdre Clune is an MEP representing Ireland South for Fine Gael and currently serves on the Committee on the Internal Market and Consumer Protection (IMCO), as well as the Delegations for relations with the countries of Central America (DCAM) and to the Euro-Latin American Parliamentary Assembly (DLAT). Before joining the European Parliament, she served as Lord Mayor of Cork, T.D. for Cork South-Central and a Senator for the Cultural and Educational Panel. Senator Alice-Mary Higgins was elected as an Independent on the NUI panel in 2016 to Seanad Éireann, and re-elected in 2020, where she leads the Civil Engagement Group, and is a member of the Committees on Environment and Climate Action, Finance and Public Expenditure and Reform, and on Disability Matters. Before her election to the Seanad, she was policy coordinator at the National Women's Council of Ireland, a member of the Executive of the European Women's Lobby in Brussels, and has worked for NGOs including the Older and Bolder alliance, Trócaire and Comhlámh on homecare, climate change, peace-building and anti-racism. Jane Suiter is a Professor in the School of Communications at Dublin City University (DCU), Director fo the DCU Institute for Future Media, Democracy and Society, and is an expert on the information environment in the public sphere, scaling up deliberation and tackling disinformation. She is the senior Research Fellow on the Irish Citizens' Assembly on gender equality, a founding member of We the Citizens, Ireland's first deliberative experiment and a member of the Stewarding Group on the Scottish Citizens' Assembly and of the OECD's FutureDemocracy network. Professor Suiter was named the Irish Research Council's Researcher of the Year in 2020.

In all the dozens of podcast interviews broadcast by the Holywell Trust, one idea to strengthen our society has been put forward repeatedly – citizens’ assemblies. They are not universally popular – both DUP and Conservative Party politicians have expressed concerns they would undermine the link between elected representatives and their constituents, threatening politicians’ legitimacy. But the experience of Ireland’s citizens’ assemblies has inspired many. Assemblies provided routes to resolving politically challenging issues: same sex marriage, abortion, climate change and, now, gender inequality. And in Northern Ireland we seem bound into a future programme of the assemblies given that New Decade New Approach commits to at least one per year, possibly more, and incoming DUP leader Edwin Poots has promised that all of the NDNA will be implemented. The principle behind citizens’ assemblies is that a randomised selection of the population, representative of the population, comes together to consider in detail a policy challenge. Members will be informed by experts and then deliberate carefully, before reaching their conclusions. The format has not only produced intelligent and careful proposals, but has been trusted by the wider population to be fair and balanced. In the latest Holywell Trust Forward Together podcast, Jane Suiter of Dublin City University provides her expert view of how citizens’ assemblies work and their strengths and weaknesses. She is one of the people most closely involved in Ireland’s citizens’ assemblies. The current state of the modern-day media then sparks a rant mainly through its poor treatment of Pep Guardiola after Manchester City were eliminated from the Champions League. Will, and more importantly should, Ole Gunnar Solskjaer be the Manchester United manager next season? We give our thoughts on United's future as well as the drama surrounding the Jadon Sancho transfer. Finally, we wrap up the show discussing Chelsea, Everton, Wilfred Zaha and the Premier League opening day fixtures. Citizens’ forum The Irish Citizens’ Assembly was formed in response to the severe social and economic crisis caused by the global financial meltdown of 2008. A group of political scientists, led by Jane Suiter and David Farrell, advocated for citizens to be included in debates about the necessary political reforms to address the failures of the executive. Deliberative mini publics innovate democracy by engaging citizens in constructive dialogue about the issues facing society. While many in parliament assumed citizens would always favor more spending and lower taxes, it turned out that voters who were presented with detailed information came to develop nuanced policy positions. After listening to presentations by experts, they actually favored higher taxes in certain areas and reached complex compromises about government spending. By doing so, they proved to lawmakers and skeptics that ordinary Irish citizens could be trusted with vital policy work. The case of abortion rights The first Citizens’ Assembly considered the issue of overturning the ban on abortion in the Irish constitution. Over the course of five weekend-long sessions, everyday citizens heard arguments from impartial experts, medical professionals, as well as activists on both sides. At the end of their deliberations, they produced a series of recommendations, which were sent to the Irish Parliament in June 2017. 64% of the Citizens’ Assembly participants recommended that abortion be legalized. In turn, Parliament put the question of legalizing abortion to the Irish public in a nationwide referendum in May 2018. It passed with 66% of the vote. The result indicates that the counsel of the Citizens’ Assembly was an accurate and meaningful representation of the Irish electorate. Since then the Assembly has given policy recommendations on issues such as how the state can make Ireland a leader in tackling climate change and how to respond to the challenges and opportunities of an aging population. Ireland is a Beacon for Democracy The Assembly has strengthened trust and communication on both sides of the democratic equation – citizens and politicians – and has bolstered the legitimacy of democracy at a time when democracies around the world are under attack. Through the innovation of using citizens’ assemblies, the Irish experience is showing a path to overcome the problems of democracy in decline. Politicians learned about the willingness and capacity of everyday people to make serious, nuanced policy choices for the good of the country. The Assembly has led many in Parliament to consider the advice of constituents in a new way, and to seek advice from their voters. Conversely, Irish citizens see the Assembly as a way to augment their democracy beyond voting. Other countries have noticed this. At the launch of Scotland’s Citizens’ Assembly earlier this year, the constitutional minister for the Scottish government praised Ireland’s success as an example to follow. Find out more: David Farrell and Jane Suiter have been collaborating in research focused on Irish citizens’ assemblies for over 10 years. During the economic crisis of 2008-2009, they led a group of political scientists who proposed that citizens should be brought into the heart of debates over constitutional and political reform. This culminated in the establishment of We the Citizens – Ireland’s first national citizens’ assembly. In 2012 the Irish government established the Convention on the Constitution: David and Jane led the academic advisory group. This was followed, in 2016, by the Irish Citizens’ Assembly: David and Jane secured Irish Research Council funding to provide research leadership. David Farrell is Head of the School of Politics and International Relations at University College Dublin. He is also a member of the Royal Irish Academy. He is formerly the research leader of the Irish Citizens' Assembly and currently a member of the Stewarding Group of the Scottish Citizens’ Assembly. Jane Suiter is Director of the Institute for Future Media and Journalism at Dublin City University as well as an Associate Professor in the School of Communications. She helped found the Irish Citizens’ Assembly (2016-2018) and the Irish Constitutional Convention (2012-2014). She is also a founding member of We the Citizens (2011), Ireland’s first deliberative experiment. The Irish Citizens’ Assembly is an exercise in deliberative democracy, placing the citizen at the heart of important legal and policy issues facing Irish society. With the benefit of expert, impartial, and factual advice, 100 citizen members have considered the Eighth Amendment of the Constitution (on abortion); making Ireland a leader in tackling climate change; challenges and opportunities of an aging population; manner in which referenda are held; and fixed term parliaments. There was a full house at the Smock Alley Theatre in Dublin when we put on this discussion about media in an age of fake news as part of the International Literature Festival Dublin. We were joined by Kevin Donnellan (UK editor, Storyful), Lois Kapila (co-founder and managing editor, Dublin Inquirer), Jane Suiter (School of Communications DCU and Director of the Institute for Future Media and Journalism) and Cathal McMahon (Irish Independent) to discuss misinformation on social platforms, fact-checking practices, the journalistic compromises made in the name of clickbait and the problems which occur when readers want to believe the fake news that they see. It was, as you are about to hear, a hell of a discussion.

Russ Johns - Entrepreneur and Podcaster Russ Johns started out years ago as a professional drummer. In 1987, Russ took a fall while working on a billboard. He fell 36 feet and nearly lossed his right arm. When people shake his hand they are startled because the reconstructive surgery left him without much grip in his hand. He went through about two years of surgery. Because of this accident, he got into technology. Russ has been in the technology industry since the early 90's. He was relocated several times and landed in Houston. His position was eliminated and so he started working on the entrepreneurial side of things to help business owners. He was recruited to operate a couple radio stations where he started broadcasting local high school sporting games. This is what got him into podcasting. Share on Twitter Having helped a lot of people with their shows and delivering podcasts or "radio on demand" to radio stations in a tradition format. He continues to think outside the box. He likes to say that he rents his brain out to business owners when they have to think outside the box. Russ really enjoys talking to other in the industry that he can bounce ideas off of. Sometimes it takes a different lens to see a new perspective. - Russ Johns Russ Johns Understands the Shift in Technology and Media Media is changing. In the industrial age, there was a big requirement for building things and assembly lines for building things. Now that we are in the information age, we are more aligned with the "Story telling 2.0" through online communities. When you have something to share, it's based on abundance and not competition. People are more likely to share rather than hide their knowledge. It's not far-fetched to have a community of 1,000 people, get engaged and involved in your community so that everyone does well. If you like at the big picture of media creation, you are in control now. Future Media Association is based on words, images, video and audio. Russ and his colleagues rotate each one of these focuses each week to share what's going on with technology and these tools with business owners each week. Russ and his partner in crime, Maryanne LaSalle, hold live meetings every Tuesday. After the meeting, they record a video called Raw and Ready. They then repurpose the video in audio form and submit it to several different platform. They've generated interest to open up additional chapters in Wisconsin and Dallas/Ft. Worth so that others can share their knowledge with the group.
