The Digital Services Act (DSA) is a landmark European regulation which seeks to protect Europe's values and democratic principles in the online space, and to help counter the dissemination of illegal and harmful online content. The DSA entered into force in November 2022 and began to fully apply across the EU from February 2024. At this hybrid event, a panel of experts discusses the implementation of the DSA to date and assesses the ongoing debates relating to various features of the DSA. The panel also discusses the opportunities and challenges that may lie ahead for the future of DSA enforcement. This event is organised in collaboration with the Economic Regulators Network (ERN), a cross-sectoral group of economic regulators in Ireland. Propagandakanaler knyttet til IS har lansert kampanjen #LetsSlaughter, hvor de eksplisitt oppfordrer til angrep på folkemengder, blant annet i byer som Nürnberg, Köln og Rotterdam. Bilder viser våpen, IS-flagg og oppfordringer om å slå til mot sivile.Sikkerhetstjenestene advarer om en økende mobilisering blant radikale islamister, og hendelsene så langt i 2025 vitner om at advarslene ikke er grunnløse. Senest 3. mars ble minst to mennesker drept og 25 skadet da en bilfører meiet ned fotgjengere i Mannheim. Er hatte sich über diese Website zu einer Veranstaltung angemeldet und hierzu den Authentifizierungsdienst „EU Login“ der Kommission verwendet, bei dem er sich für die Anmeldeoption „Mit Facebook anmelden“ entschieden hatte. Der Betroffene meint, bei seinen Besuchen der Website der Konferenz zur Zukunft Europas seien ihn betreffende personenbezogene Daten an Empfänger in den Vereinigten Staaten übermittelt worden, insbesondere seine IP- Adresse sowie Browser- und Geräteinformationen. Die Vereinigten Staaten hätten aber (zu diesem Zeitpunkt) kein angemessenes Schutzniveau aufgewiesen. Die ihn betreffenden personenbezogenen Daten seien deshalb der Gefahr eines Zugriffs durch die Sicherheits- und Nachrichtendienste der Vereinigten Staaten ausgesetzt gewesen. Dem stimmt das EuG (teilweise) zu, der Betroffene habe einen immateriellen Schaden erlitten: Er befinde sich nämlich in einer Lage, in der er nicht sicher sei, wie die ihn betreffenden personenbezogenen Daten, insbesondere seine IP-Adresse, verarbeitet werden (Kontrollverlust) – weswegen das Gericht die Kommission verurteilt, an den Betroffenen 400 Euro zu zahlen. Tim spricht heute mit Deniz Dogan, Product Management Consultant bei den Product People, über die spezifischen Anforderungen, die auf Product Owner in regulierten Umfeldern zukommen. Regulierung stellt natürlich häufig eine Hürde dar, weil sie viele Freiheiten während der Produktentwicklung einschränkt. Doch dies sollte nicht nur als Beschränkung gesehen werden. Vielmehr bietet die Gesetzeslage oft auch Spielraum, wie Regelungen umgesetzt werden, was Raum für kreative Lösungen schafft. Ein Beispiel in dieser Folge ist der Digital Services Act (DSA), bei dem zwar Vorgaben zu Transparenz und Meldemöglichkeiten erfüllt werden müssen, aber nicht festgelegt ist, wie dies genau zu geschehen hat. Hier zum Beispiel hat Deniz Dogan durch sorgfältige Analyse der Vorgaben und enge Zusammenarbeit mit dem Compliance-Team innovative Ansätze gefunden, um Anforderungen effizient zu erfüllen, ohne unnötigen Aufwand zu erzeugen. Die enge Zusammenarbeit mit Compliance-Teams ist besonders wichtig, um das Produktmanagement in regulierten Branchen zu erleichtern. Deniz betont in dieser Folge, wie wichtig es ist, frühzeitig und proaktiv den Dialog mit diesen Abteilungen zu suchen. Oft wird aus Unsicherheit lieber ein konservativer Ansatz gewählt, der jedoch nicht immer nötig ist. Indem Product Owner die gesetzlichen Rahmenbedingungen genau verstehen und kritisch hinterfragen, können sie unnötige Aufwände vermeiden und gleichzeitig rechtskonform bleiben. So wird aus einem vermeintlichen Hindernis eine Gelegenheit für Produktverbesserungen und damit eine echte Chance. Besonders in regulierten Branchen zeigt sich zudem, dass Vorschriften oft nicht eindeutig sind, was Raum für Interpretation lässt. Dies führt zu Ambiguität, die zwar zusätzliche Komplexität schafft, aber auch Gestaltungsspielräume eröffnet. Dies bietet eine Chance, Wettbewerbsvorteile zu erzielen, indem Unternehmen die Anforderungen nicht nur erfüllen, sondern die Art wie sie die Erfüllung dieser Regulation meistern zu einem Selling Point machen. Ein Beispiel hierfür ist die Barrierefreiheit, bei der sich Unternehmen durch besonders proaktive Maßnahmen im Markt differenzieren können. Letztlich kommt es darauf an, als Product Owner nicht nur die Vorschriften zu erfüllen, sondern den Mehrwert darin zu erkennen, wie ein Produkt dadurch besser und sicherer gestaltet werden kann. Wer bereit ist, die Regeln genauer unter die Lupe zu nehmen und in den Dialog mit den richtigen Stakeholdern zu gehen, kann auch in streng regulierten Märkten innovativ agieren und sich einen Vorsprung verschaffen. Im Produktmanagement in regulierten Branchen geht es also nicht nur darum, sich an Gesetze zu halten, sondern diese auch als Chance zu nutzen, Produkte nachhaltig besser zu machen. The case involves TikTok Lite, a low-bandwidth version of the app released in Spain and France. It allowed users to earn points for things like following creators, liking content, or inviting friends to join TikTok. The points could be exchanged for Amazon vouchers and gift cards on PayPal. TikTok said rewards were restricted to users 18 years and older, who had to verify their age. Users could watch up to one hour a day of videos to earn rewards, which were capped at the equivalent of one euro ($1.09) a day. The commission opened an investigation in April due to concerns that TikTok has not done a diligent assessment required under the act of the feature's potential "addictive effect," especially for children, "given suspected absence of effective age verification mechanisms on TikTok." The resolution of the TikTok Lite investigation does not affect an earlier probe launched against TikTok focusing on concerns about the protection of minors, advertising transparency, data access for researchers, and mitigating risks of "behavioral addiction" and harmful content. Digital Services Act and Digital Markets Act will help tackle disinformation, boost safety of minors online and dilute Big Tech's market power. Different regulatory philosophies are still being ironed out, with Ireland's principals-based approach contrasting with continentalEurope's more prescriptive enforcement. For those who have observed the financial sector over the past two decades, watching tech companies understand their obligations under Europe's Digital Services Act (DSA) and the Digital Markets Act (DMA) may evoke a sense of deja vu. Since the turn of the millennium, Europe has seen significant developments in financial regulation, particularly in response to the 2008 economic crisis. Frameworks such as the Markets in Financial Instruments Directive (MiFID) and European Market Infrastructure Regulation (EMIR) sought to increase competition and offer greater consumer protection as regulators navigated a landscape of competing interests and complex ecosystems. The early days of these rules were marked with fraught exchanges as companies worked their way through implementation. Before long, they just became another cost of doing business. Tech companies are experiencing a similar shift in regulatory philosophy from a light touch to a more proactive, stringent approach as the DSA and DMA follow GDPR and the Network Information Security Directive amid a broader trend towards tighter regulation. As we approach the first independent auditor reporting period for very large online platforms (VLOPs) and very large online search engines (VLOSEs) such as Meta and Google under the new digital regime, we are in a similar spot marked by gradual adaptation, responses to emerging challenges, and a balancing act between innovation and oversight. Time to show your cards After a long, complex gestation involving various stakeholders, including the European Parliament, the Council of the European Union, and the European Commission, the proposed regulation is a new reality as tech companies enter their first reporting periods. For tech companies, this represents a significant shift as they now shoulder the burden of showing compliance with strict rules on content moderation, advertisingtransparency, and greater user choice to control what they see. The DSA and DMA are part of a single set of new rules that apply across the entire EU to regulate digital services such as online marketplaces, social networks, content-sharing platforms, app stores, and online travel and accommodation platforms. The DSA specifically targets online intermediary services by imposing strict obligations, with additional rules and obligations imposed on very large online platforms and search engines with more than 45 million monthly users in the EU. On the other hand, the DMA focuses on very large digital platforms designated as gatekeepers providing digital services allowing for a fairer business environment for users and new entrants into the market. Tech companies have been actively working to comply with the new regulations. They have changed or stopped activities they have done previously while engaging with the Commission to provide information and documentation following formal requests for information. The DMA demands that platform giants like Apple, Alphabet, and Meta become more open to competition by imposing a new set of legal requirements on more than twenty of their core platform services (CPS). De Europese Commissie start een onderzoek naar TikTok, op de eerste werkdag nadat de Digital Services Act (DSA) is ingegaan. Joe van Burik vertelt daarover in deze Tech Update. What about promises kept? In the debt-ceiling deal outlined Sunday and due to be inked later this week, McCarthy has allowed the lion’s share of that extra IRS funding to remain unmolested: preserving $78.1 billion of the $80 billion. As rebel GOP Rep Dan Bishop put it: “So there will be 85,260 more IRS agents rather than 87,000 to eat you alive. Big win.” Overpromising and underdelivering is what turns voters off the GOP. You don’t mount a powerful six-month fear campaign about 87,000 new, armed IRS agents ready to break down people’s doors, and then meekly capitulate at the first sign of resistance. Even if those fears were exaggerated, your credibility rests on delivering a lot more than 2% of what you promised. In any case the fears about a weaponized IRS targeting Biden’s opponents are very real. If anything, the IRS is worse today than it was during the Obama administration, when Lois Lerner presided over the targeted harassment of Tea Party groups and other conservatives. Not a single IRS employee was held accountable for the scandal. Lerner retired on a full pension without even a slap on the wrist. This is the same IRS which went after journalist Matt Taibbi last December, three weeks after he started reporting on the so-called “Twitter Files,” which revealed that censorship on the social-media platform had been coordinated by federal government agencies such as the FBI and CIA. On March 9, when Taibbi was testifying in Congress about, ironically enough, the weaponization of the federal government, IRS agents showed up unannounced at his New Jersey home. The IRS file on Taibbi was opened the day he posted his ninth and most explosive Twitter file, detailing how agencies including the Pentagon and the State Department had colluded with Twitter to stifle dissent. It was Christmas Eve, a Saturday, which shows what an unusual priority it was for an agency that normally goes to sleep for two weeks over Christmas and whose standard work week is Monday through Friday. Under questioning from Judiciary Committee Chairman Jim Jordan, the IRS has claimed it had concerns about “identity fraud” with Taibbi’s 2018 and 2021 tax returns, and that he was sent two letters before the home visit. Yet Taibbi says he and his accountant never received any letters. Even more “unnerving” as Taibbi puts it, was the fact that an IRS case agent had compiled a dossier on him which included personal information such as his voter registration records and whether he had a concealed-weapons permit or a hunting or fishing license. On Friday, a source familiar with the situation told the outlet, "The studio signed an overall deal with BLM co-founder Patrisse Cullors at some point in 2020" but the "Deal expired at end of October 2022." "The deal unfortunately did not result in any produced shows," the source added. The agreement was a multi-year, multi-platform deal in which Cullors would produce original material, including scripted comedies and dramas, animated shows, and documentary series, that would focus on black stories. The content would go out on the distributor's broadcast, cable, and streaming platforms. Variety first reported on the deal in 2020 but did not disclose its value.
