The act also allowed the U.S. Department of Agriculture (USDA) to provide guidance to implement a program that would help establish the regulatory framework regarding the production of hemp throughout the United States.   Following the Agricultural Improvement Act of 2018, Senate Bill 1020 in Florida was signed. This bill provided a state plan for the regulation of cultivating hemp within Florida. Under the bill, hemp-derived cannabinoids are not controlled substances so long as the hemp derivates do not exceed a total delta-9 tetrahydro cannibal (THC) concentration of 0.3 percent on a dry weight basis. Any product with a THC concentration over 0.3 percent is considered a controlled substance. It is important to note that the sale of topical CBD products is not required to be licensed by the FDACS and is rather regulated by the Florida Division of Business and Professional Regulation. Professional regulatory authorities are government agencies or public organizations that have authority delegated by law from government. They provide oversight and certification to specified regulated occupations in B.C. (Government of BC, 2024). Professional regulation of the nursing profession has undergone significant change over the last decade with the Health Professions Act [HPA], primarily with professional associations and amalgamation of all nursing and midwifery colleges in BC. Listen as Patrick describes the evidence needed for both decision-making and evaluation with regulatory review, reform, and modernization. As professional regulatory competence, conduct, and discipline of health providers shifts to greater transparency and governmental oversight, is the public better protected? Patrick Chiu is an Assistant Professor in the Faculty of Nursing at the University of Alberta and an Adjunct Assistant Professor at the School of Nursing at the University of Victoria. He has held several policy and professional practice positions in professional associations, regulatory bodies, and government. He holds a Bachelor of Science from McMaster University, a Master of Public Health from Simon Fraser University, a Doctor of Philosophy from the University of Alberta (2022), and a Certified Global Nurse Consultant (CGNC) designation through the International Council of Nurses & CGFNS. The Democratic president was to address his latest efforts to curb gun violence in a speech in this suburban Los Angeles community, where a gunman stormed a dance hall and shot 20 people, killing 11, following a Lunar New Year celebration in January. He was also meeting with families of victims and with first responders from that day. Biden’s rhetoric has grown ever stronger about guns — he routinely calls for banning assault weapons — in pushing a vocal gun-control platform even tougher than during the Obama administration when he was vice president. He has been emboldened by the midterm electiions when his regular talk of gun control didn't result in massive losses, and he's expected to continue to argue for strong changes as he inches toward a 2024 reelection run, his aides say. Biden was greeted at the Los Angeles airport Tuesday by Brandon Tsay, the 26-year-old who wrestled the semiautomatic pistol away from the gunman in Monterey Park. The two shook hands; Biden had invited Tsay to his State of the Union address in January where he praised the young man's heroism. But the president has only limited power on guns to go beyond bipartisan legislation passed by Congress last summer after the killings last year of 10 shoppers at a Buffalo, New York, grocery store and 19 students and two teachers at a Uvalde, Texas, elementary school. Tuesday's action does not change U.S. government policy. Rather, it directs federal agencies to ensure compliance with existing laws and procedures — a typical feature of executive orders issued by presidents when they confront the limits of their own power to act without cooperation from Congress. Biden, in the order, acknowledged Congress' opposition, but said, “In the meantime, my administration will continue to do all that we can, within existing authority, to make our communities safer.” The order directs the Cabinet to work on a plan to better structure the government to support communities suffering from gun violence. The plan calls on Attorney General Merrick Garland to shore up the rules for federally licensed gun dealers so they know they are required to do background checks as part of the license. Biden is also mandating better reporting of ballistics data from federal law enforcement for a clearinghouse that allows federal, state and local law enforcement to match shell casings to guns. But local and state law enforcement agencies are not required to report ballistics data, and many do not, making the clearinghouse less effective. And the president is asking the Federal Trade Commission to issue a public report analyzing how gun manufacturers market to minors and use military images to market to the general public. The bill passed last year, known as the Safer Communities Act, is viewed by gun control advocates as a good start but one that doesn't go far enough. After the law was signed, there were 11 other mass shootings, according to a database of mass killings since 2006 maintained by The Associated Press, USA Today and Northeastern University. Those killings don't include shootings in which fewer than four people were killed — and gun violence is also rising nationwide. Pro-gun groups said the order would do little to stop growing gun violence. “The reality is that nothing in the president’s executive order today would have done anything to prevent the recent mass shootings in California, Michigan or elsewhere,” said Katie Pointer Baney who is the Managing Director of Government Affairs for the U.S. Concealed Carry Association. “It’s time for the president and political leaders across the country to have an honest conversation with the American people and acknowledge there is no legislative fix that will permanently solve the issue of gun violence.” Biden will also direct his Cabinet to make sure law enforcement agencies understand the benefits of the new law, particularly around red-flag laws, also known as extreme risk protection orders, which are intended to temporarily remove guns from people with potentially violent behavior and prevent them from hurting themselves or others. Last month, the Justice Department sent out more than $200 million to help states and the District of Columbia administer red-flag laws and other crisis-intervention programs. https://dailycaller.com/2023/03/14/desantis-admin-liquor-license-sexually-explicit/ DeSantis Admin Moves To Revoke Liquor License From Hotel That Hosted Sexually Explicit Show For Kids Republican Florida Gov. Ron DeSantis’ administration is moving to revoke a hotel’s liquor license after it ignored a warning and proceeded to host a sexually explicit show with children present, according to a Tuesday administrative complaint. On Dec. 27, the Hyatt Regency Miami hosted “A Drag Queen Christmas” advertised for “all ages” where performers allegedly wore “sexually suggestive clothing” and “prosthetic female genitalia” while displaying “simulated sexual activity” in front of children, according to an administrative complaint. Prior to the show, the Florida Department of Business and Professional Regulation warned the hotel it would lose its liquor license unless the venue ensured that children were not permitted at the event. Under Florida law, sexual organs cannot be exposed in public in a vulgar or indecent manner and obscene content cannot be shown to minors, the complaint stated. Violation of the law can result in the loss of a license for the sale and consumption of alcoholic beverages. “On December 27, the Florida Department of Business and Professional Regulation warned the Hyatt Regency Miami against hosting a sexually explicit show with children present,” Griffin told the DCNF. “The venue proceeded with their plans and, according to an investigation by the Department, the venue (Respondent in the complaint) violated Florida statutes as outlined in the attached complaint.” https://thepostmillennial.com/zuckerberg-sacks-10000-more-meta-workers-during-year-of-efficiency?utm_campaign=64487 Zuckerberg sacks 10,000 more Meta workers during 'Year of Efficiency' On Tuesday, Meta CEO Mark Zuckerberg announced that the tech giant would be laying off around 10,000 workers, with some set to find out whether or not they still have a job as early as tomorrow. The move is just the latest in Zuckerberg's quest to make 2023 the "Year of Efficiency" as he and other top executives work to restructure the company. Tech groups, he added, would find out in late April, with those in business groups being informed in late May. Zuckerberg noted that in certain cases, such as for those on international teams, layoffs could take until the end of the year to be finalized. Police Benevolent Association President Patrick Lynch called it a “staffing emergency” that is “approaching the point of no return.” The statistics show a 117% increase in retiring officers since 2021. The shocking stats show 239 officers tapped out in January and February, a 36% spike from the 176 who fled in the same period last year and a disturbing 117% jump from the 110 in 2021, NYPD pension data show. That’s the highest number of resignations for the first two months of a year since 250 members quit in 2007 during a contentious contract dispute. According to the report, there seem to be a number of converging factors contributing to the massive loss of personnel in the Big Apple. The Black Lives Matter-led movement to defund police departments across the country has almost certainly created a combination of shrinking budgets to retain employees and a strain on remaining resources. However, corruption and poor management also seems to be a debilitating issue. Prolonged school closures, COVID vaccine mandates and unnecessary masking of small children has led to a learning crisis in government schools. Rampant homelessness and open-air drug use make for unsafe streets and public transportation. According the report from The New York Post, 262 city cops retired in just the first two months of 2023, a 3% increase in retirements in the same time period last year. The payout will include all bonuses and salaries earned during the fiscal year. The two also agreed to forego any legal actions over the incident and to hold each other blameless going forward. “Adams hereby agrees to the release of any and all claims against TTU and Texas Tech University System and their employees, appointees, regents and representatives relating to his employment, whether known or unknown, as of the date of this Agreement and TTU agrees to release any and all claims against Adams,” the school’s settlement reads, according to USA Today. “This Agreement is not, and shall not in any way be construed, as an admission by the Parties of wrongdoing whatsoever against each other or that the Parties violated any federal, state or local law, which both Parties deny,” the statement added.

Biden’s rhetoric has grown ever stronger about guns — he routinely calls for banning assault weapons — in pushing a vocal gun-control platform even tougher than during the Obama administration when he was vice president. He has been emboldened by the midterm electiions when his regular talk of gun control didn't result in massive losses, and he's expected to continue to argue for strong changes as he inches toward a 2024 reelection run, his aides say. Biden was greeted at the Los Angeles airport Tuesday by Brandon Tsay, the 26-year-old who wrestled the semiautomatic pistol away from the gunman in Monterey Park. The two shook hands; Biden had invited Tsay to his State of the Union address in January where he praised the young man's heroism. But the president has only limited power on guns to go beyond bipartisan legislation passed by Congress last summer after the killings last year of 10 shoppers at a Buffalo, New York, grocery store and 19 students and two teachers at a Uvalde, Texas, elementary school. Tuesday's action does not change U.S. government policy. Rather, it directs federal agencies to ensure compliance with existing laws and procedures — a typical feature of executive orders issued by presidents when they confront the limits of their own power to act without cooperation from Congress. Biden, in the order, acknowledged Congress' opposition, but said, “In the meantime, my administration will continue to do all that we can, within existing authority, to make our communities safer.” The order directs the Cabinet to work on a plan to better structure the government to support communities suffering from gun violence. The plan calls on Attorney General Merrick Garland to shore up the rules for federally licensed gun dealers so they know they are required to do background checks as part of the license. Biden is also mandating better reporting of ballistics data from federal law enforcement for a clearinghouse that allows federal, state and local law enforcement to match shell casings to guns. The bill passed last year, known as the Safer Communities Act, is viewed by gun control advocates as a good start but one that doesn't go far enough. After the law was signed, there were 11 other mass shootings, according to a database of mass killings since 2006 maintained by The Associated Press, USA Today and Northeastern University. Those killings don't include shootings in which fewer than four people were killed — and gun violence is also rising nationwide. Pro-gun groups said the order would do little to stop growing gun violence. “The reality is that nothing in the president’s executive order today would have done anything to prevent the recent mass shootings in California, Michigan or elsewhere,” said Katie Pointer Baney who is the Managing Director of Government Affairs for the U.S. Concealed Carry Association. “It’s time for the president and political leaders across the country to have an honest conversation with the American people and acknowledge there is no legislative fix that will permanently solve the issue of gun violence.” Biden will also direct his Cabinet to make sure law enforcement agencies understand the benefits of the new law, particularly around red-flag laws, also known as extreme risk protection orders, which are intended to temporarily remove guns from people with potentially violent behavior and prevent them from hurting themselves or others. On Dec. 27, the Hyatt Regency Miami hosted “A Drag Queen Christmas” advertised for “all ages” where performers allegedly wore “sexually suggestive clothing” and “prosthetic female genitalia” while displaying “simulated sexual activity” in front of children, according to an administrative complaint. Prior to the show, the Florida Department of Business and Professional Regulation warned the hotel it would lose its liquor license unless the venue ensured that children were not permitted at the event. Under Florida law, sexual organs cannot be exposed in public in a vulgar or indecent manner and obscene content cannot be shown to minors, the complaint stated. Florida Insurance Commissioner David Altmaier told a legislative committee in late September that the state's property insurance market is in “critical condition” with a growing number of insurance companies losing money and consumers facing continued double-digit rate increases.  A new set of reforms designed to help is already being challenged in federal court by roofers and restoration companies.Former Florida Deputy Insurance Commissioner Lisa Miller sat down with Jose Pagan, a former fraud regulator who is now one of Florida's leading insurance defense lawyers, to discuss the legal challenges to the new reform law, the ongoing litigation abuse and unlawful activity in the marketplace, and how consumers are ultimately losing.Show NotesJose Pagan, Partner with the Walton, Lantaff, Schroeder & Carson Law Firm, said the issues in Florida's property insurance market today have their roots in the aftermath of 1992's Hurricane Andrew in Miami, where he and host Miller worked together as insurance regulators.  The mediation program for property insurance claims created after Andrew was such a success that the legislature made it standard protocol for handling all future claims.  “While those programs still exist to try to resolve cases pre-litigation, a cottage industry has developed of a very small segment of the legal community as well as some contractors and some public adjusters who are really abusing the system,” said Pagan, an insurance defense lawyer with more than 25 years' experience in the insurance industry, including as an insurance agent and fraud investigator.He cited Insurance Commissioner David Altmaier's report to the Florida Legislature earlier this year that Florida has 8% of all homeowners' claims in the U.S., yet 76% of all homeowners' claims lawsuits.  “And moreover, if you look at some of the information that was provided…. it's really only a handful of law firms that was generating a majority of all of those lawsuits,” he added.  “Those are the cost drivers that ultimately are generating the premium increases for all Floridians in this marketplace.”To stem the abuse and stabilize the marketplace, the Florida Legislature last spring passed Senate Bill 76 (SB 76, now Florida Statute section 489.147) its most recent property insurance reform law.  Yet just two weeks after Governor Ron DeSantis signed the bill into law in June, the first of two lawsuits was filed in federal court in Tallahassee by a roofing and restoration company, complaining that the section of the law dealing with prohibited advertisements and soliciting infringes on its constitutional right of free speech.  The section establishes that contractors and public adjusters, or unlicensed persons acting on their behalf, may not solicit or incentivize a residential property owner to file a roof damage insurance claim.  Violations carry a fine up to $10,000.Chief U.S. District Court Judge Mark Walker granted a preliminary injunction on the section in July, pending full trial scheduled for spring of 2022.  “Clearly, Judge Walker indicated that there was a significant government interest in attempting to address fraud and abuse in litigation…(but) his assessment, at least on the preliminary injunction side of it, looked at it in terms of commercial speech…and he was able to reach the conclusion that it was an infringement upon commercial speech,” said Pagan, who outlined the series of court tests the judge used.  “It's pretty clear to me that the legislature was trying to just stop some of the high pressure sales tactics by solicitors knocking on front doors that we see every day, read about on social media, and experience in our own neighborhoods,” said host Miller.Miller and Pagan also discussed a second lawsuit, filed by the Restoration Association of Florida in the same federal court.  It seeks to throw-out the entire law, which includes a series of provisions, including broadening the longstanding one-way attorney fee statute formula where fees are now awarded instead based on a percentage of recovery of the disputed amount of the claim.  The suit claims the law impinges on protected free-speech rights, interferes with contract law and commerce, and due process.“There is nothing in the legislation that hasn't been the case for decades…whether it is regulating the contracting industry under Chapter 428, or the insurance industry under Chapter 626,” said Pagan.  “Dating back as far as in the early 90s, during Hurricane Andrew and thereafter, the law was very well defined, and everyone knew or understood that you could act as a contractor, you could act as a public adjuster.  But unless you were licensed in both, you could not act as both a contractor and a public adjuster.”  He said that “some of those lines became a little blurred” and “there have been so many different actions either taken by the courts or not taken by the regulating entities that have allowed questions to arise,” that the legislature needed to provide clarification through SB 76.Another provision in the new law focuses on presuit settlements.  It requires that insurance companies receive a ten-day notice and demand before a lawsuit is filed by first-parties, such as homeowners or commercial building owners.  And it gives carriers 10 days to respond in writing to such notices.  The idea is to settle claims before they become lawsuits.  Host Miller asked Pagan how that part of the law is working so far, especially given conflicting opinions in the market to which cases that applies. “Most of the attorneys and the carriers are certainly utilizing the Notice of Intent provision, in an effort to try to get to a quick resolution, rather than having to litigate these cases to the nth degree.  That is, I think, most beneficial for not only the policyholders, but all of the other stakeholders as well,” Pagan said.  Those cases that are unresolved are usually because of a communication breakdown and benefit from having another person from the insurance company review the claim, he said.The stakes are high for the future health of Florida's property insurance market.  “The problem that we face is affordability,” Pagan said.  “Because of the small amount of participants who are abusing the system and are creating such high premium increases, affordability becomes huge.  And that's especially acute for senior citizens who are living on a fixed income.  So when we are talking about double digit premium increases year over year, that means that in a very short amount of time, we're doubling, sometimes tripling the premiums for your home.”Host Miller noted that the Florida Legislature is now in the middle of committee weeks, leading to the start of the regular session in January 2022.  Further insurance reform is already being discussed.  “I believe that SB 76' purpose was to restore, rebalance, and revitalize, if you will, the insurance industry for all of its policyholders, to stop these premium increases, and protect consumers from what appears to be out of control litigation, solicitations, and high pressure sales,” said Miller.  She urged listeners to contact their state representative and state Senator and share their story, whether as a consumer or someone working in the industry. Links and Resources Mentioned in Linda has been a Florida REALTORS® Faculty Member since 2013.   Since 2016, Linda has been an approved instructor with the Georgia Association of REALTORS® through their Partners in Education Program and an approved provider and instructor through the Tennessee Real Estate Commission.   The classes that Linda has authored and teaches in Florida, Georgia, and Tennessee are centered on environmental concerns, green/energy efficiency, commercial real estate, the development process, residential construction and negotiating, networking, and commercial and vacant land contracts.   Linda has been awarded the National Association of REALTORS® Green Designation and is an approved Instructor for the NAR's Green Designation Program as well as their Discovering Commercial Real Estate course.   Linda has a Bachelor's degree from Michigan State University in Wildlife Management and a Master of Science degree from the University of Florida in Ecology. To help us understand it, we are thrilled to have with us the General Counsel of the State Bar herself, Paula Frederick.   Paula Frederick: Paula Frederick is General Counsel for the State Bar of Georgia, a unified bar organization with over 50,000 members.  As General Counsel, Ms. Frederick is responsible for interpreting the ethics rules for lawyers, prosecuting lawyer discipline cases, and providing legal advice to the officers and directors of the organization.  She has served in the Office of the General Counsel for 33 years and was Deputy General Counsel for Discipline before becoming General Counsel in 2009. Ms. Frederick is a 1982 graduate of the Vanderbilt University School of Law and a 1979 graduate of Duke University.  Prior to joining the Office of the General Counsel, she spent six years as a staff attorney with the Atlanta Legal Aid Society handling civil legal matters for low-income people. In the six months since legislative reform, insurance companies report the number of Assignment of Benefit (AOB) claims in Florida are way down as are related lawsuits.  But they're also seeing new strategies by contractors and their attorneys to work around the reforms.On the other side, contractors complain that without the “old AOB,” they're getting shortchanged by insurance companies and homeowners for work they've already performed.Host Lisa Miller, a former deputy insurance commissioner, talks with Tanaz Salehi, an insurance defense attorney, and Mohammad Sherif, a plaintiff attorney, on the reform's impact, its unintended consequences, and the potential solutions to ongoing claims problems.Show NotesAn Assignment of Benefits (AOB) contract is a legal agreement between the contractor and homeowner, which allows the contractor to receive payments directly from insurance companies for work they perform at a policyholder's home, without the homeowner having to pay money upfront.  In past years, unscrupulous vendors and their lawyers have taken advantage of the AOB to take control of a homeowner's policy, then inflate the scope and cost of claims and sue the insurance company if it refuses to pay the inflated bills.  The Florida Legislature passed AOB reform in 2019 establishing tighter rules to stem the abuse and fraud, while putting more responsibilities on insurance companies, too.The reform, in part, revised Florida's one-way attorney fee system, to make fee awards fairer.  “Insurance carriers have been filing motions to strike plaintiff attorney fees under the new law and have been prevailing in different counties across Florida,” said Salehi, managing shareholder with the Salehi Boyer Lavigne Lombana law firm in Miami.  She represents insurance companies.Both Salehi and Sherif agree that while the reform is working, as evidenced by the reduction in lawsuits, there are now issues with loopholes being exploited and unintended consequences for both sides.Host Miller noted reports of various workarounds to the reform law.  These include plaintiff attorneys making bulk deals with contractors to recommend the homeowner hire the attorney upfront to represent them at First Notice of Loss, to avoid using an AOB.  Also, there are reports of some restoration contractors splitting out “Emergency Services” they provide over several days, in order to get around the $3, 000 statutory limitation.“That ($3,000 cap) applies to emergency mitigation services,” said Salehi.  “That leaves a huge void for the roofing contractors that are now charging maybe ten to twenty times what it actually costs to replace the roof and submitting permits to the county for repairs for a fraction of what they're charging the insurance companies.”Sherif said there are bad actors on both sides and lots of misinformation and confusion in the industry about what the reform did and the expectations going forward.  “There are front end desk adjusters at insurance companies who may be overzealous in applying the new law to hold vendors accountable,” said Sherif, a partner with Mubarak & Sherif, a Tampa law firm that focuses predominantly on helping homeowners in the Florida Panhandle with Hurricane Michael claims. Both Sherif and Salehi agree the reform has had unintended consequences, too, especially for contractors who want to work but want to be guaranteed payment.“What I'm seeing is a lot of vendors who don't want to use assignments anymore but who are having difficulty getting paid.  And the expectation has always been that ‘if I can't go against the insurance company directly, what recourse am I left with as a contractor?'” said Sherif.Salehi, who also advises contractors, said there are some cases where a contractor will submit an estimate, the insurance company will approve and cut a check to the policyholder, who then doesn't pay the contractor for the work already performed.    “The carriers were willing to work with him, but it was the insureds who were not turning over the check.  There were other instances where the carriers were not putting his company's name on the check,” said Salehi, who is also an IICRC-certified water damage technician.The podcast discusses the AOB alternatives available to help prevent and resolve claims disputes among contractors, policyholders, and insurance companies.  They include the use of a “Direction to Pay” that among other things, allows the insurance company to put the contractor's name on the claim payment check.  Another form is the “Letter of Protection” that serves as a lien on any monetary proceeds, including but not limited to insurance payouts related to repair work performed.  (See “Links and Resources Mentioned in This Episode” below for examples.)But even these AOB alternatives are raising questions.  “The more sophisticated vendors are now just removing the assignment language altogether from their contract and just leaving in there the provision that is a direction to pay,” said Sherif.  “But what carriers are seeing is sometimes an additional power of attorney and if they get both of them together, the issue, at least from my perspective, is how is that not an assignment?”Host Miller, a former Florida deputy insurance commissioner, noted the heightened hassle is discouraging contractors from doing work in areas where they are most desperately needed, such as the Florida Panhandle after Hurricane Michael.   She asked if regulators such as the Florida Department of Financial Services, Office of Insurance Regulation, Department of Business and Professional Regulation, and the Florida Bar are doing enough to police the marketplace.“The legislative fix is always a possibility, but it's never a way to deal with the problems in the law as they currently exist,” answered Sherif, a former regulatory and senior litigation attorney for the Florida Office of Insurance Regulation.   “That's where I think the regulator could have had more involvement and more guidance.”  He and Salehi noted that follow-up enforcement of bad actors and more publicity around such cases would improve accountability.“We urge all stakeholders here – whether you are an insurance company claims handler, defense or plaintiff attorney, contractor, public adjuster, or regulator – to show personal leadership and openly communicate with one another about issues and offer constructive solutions that are fair to all parties concerned,” concluded host Miller.  “Give me a call and let's work A surprise inspection by the Department of Business and Professional Regulation led to a one-day closure of the Southern Pearl Restaurant, at 3601 U.S. Highway 90 in Pace. NAVARRE — A restaurant was temporarily closed Aug. 14 after an inspection found several violations including roaches and a mold-like substance. Two area restaurants were forced to temporarily close after health inspectors found multiple violations. Peking House in Navarre received a follow-up inspection following an inspection May 8 in which 12 violations were cited, including four dead roaches in the kitchen, "no MSG" advertised while a container of MSG was in the kitchen, and chicken in standing water placed on the floor, according to an inspection report from the state Department of Business and Professional Regulation. During the follow-up inspection May 10, Peking House was closed after two high priority, two intermediate and nine basic violations were found. Violations included 72 live roaches found in the kitchen, roach feces, a roach egg on the floor and two eggs under the grill. The inspector also found the wall in the back of the kitchen soiled and "slimy/mold-like build-up" in the walk-in cooler gaskets. The restaurant re-opened May 11 after health inspectors found issues with prior inspections had been fixed, minus four basic violations. The inspection had stemmed from a complaint to the state from a customer. Jin Jin in Crestview was also temporarily closed May 8 after inspectors cited five violations, including finding of 20 live roaches and raw animal foods not separated, according to the inspection report.
