I imagine you and I are similar in many ways. When creating my editorial calendar, I try to craft a broader narrative of the design and architecture industry. I view this show as a time capsule being both created and consumed in real time. In 2018, you might have heard a conversation I published from the LA Design Festival on the topic of intellectual property rights, IP law and how it was affecting the industry. In the following episode, I will be introducing you to Andrew McBride, Partner @ Adams & Reese and Carter Pope, Associate @ Adams & Reese. I found Andrew and Carter while on a journey of exploration, there is a case moving it's way through the legal system called Aaron and Samantha Judge v. Drew Designs, LLC. This is a case about a design relationship gone wrong rife with communication issues, contract issues and a litany of other things that make for a messy professional relationship that winds up in the courts. McBride and Pope authored an article called, “Hidden Ball Trick” - Yankees' Aaron Judge Case Involving Deception Carries Lessons for Contractors. I've added a link in the show notes and I highly recommend this for contractors, architects and designers. The following conversation covers a number of issues that led to both parties winding up in court and as you are going to hear, much if not all of this could have been avoided. In addition to this case, we also explore, the Judd Foundation v. Clements Design, Inc. in a case that will surely affect the future of dupes as well as another case winding it's way through the courts like a medieval knight moving through the digestive tract of a money guzzling dragon, Gifford v. Sheil. Perhaps the metaphor is too graphic, I'll rethink that one. But it fits. The law is a complicated knot of ideas and it seems to me the best way to avoid legal entanglements is to do good business in the first place and when disagreements come up, and they will, you work hard to find common ground and squash it. Tennants of Elgin is a family quarrying business that has been operating out of the North East of Scotland for fifty years. They have had numerous impressive contracts across Europe, but have recently begun some work that's a little closer to home – providing the granite for Aberdeen's Union Street works. Mark went along to meet with Director Gavin Tennant, and find out more about the quarrying process.Muirburn is a polarising issue at the moment in Scotland, particularly in light of recent wildfires across the country. Helen Needham met with Stuart Smith from the James Hutton Institute to find out more about the latest research on these land management practices.Buckhaven on the East coast of Fife was once a thriving fishing port, although the town's harbour has since been lost to time. Pupils at the Mountfleurie Primary School have been uncovering their local history in conjunction with the Scottish Fisheries Museum in Anstruther. Rachel met up with the head curator Linda Fitzpatrick to find out more about the town's hidden history.Rachel visited a community woodland in Gifford, East Lothian, to try her hand at some birch tapping. She met with Rupert Waites from Buck and Birch, who use birch sap in a number of ways, combining it with other foraged materials to make liquors and spirits, that harness the taste of the Scottish landscape.Kris King joins Mark and Rachel on the programme to tell us more about the Highland Ultra taking place next week. This race takes place in three stages, across the Knoydart Peninsula - what he calls the UK's last true wilderness. Optimism for the future and helpful advice for long-term care professionals who hope to advance were in deep supply recently when the 2025 McKnight's Pinnacle Awards winners gathered to receive their honors. In this special installment of the McKnight's Newsmakers Podcast, honorees David Gifford, MD, and nursing leader Robert Francis Amoloria give their thoughts on the makings of success — personally, professionally and for the sector in the years ahead. “I'm very optimistic,” says Amoloria, the chief nursing officer for Legacy Healthcare, which operates 125 facilities in three states. “Amidst the commotion, the bluster, the upheaval, the noise, I still have faith in the healthcare industry and the profession's noble calling to service. I sincerely believe we're all going to rise above the fray against all odds and use our powerful calling to make a difference.” He urges colleagues to keep up with the swift technological changes hitting the sector — which should be viewed as opportunities as well as challenges, he reminded. “We are getting there,” he says in reference to post-acute care catching up to acute-care partners in adopting tech. Gifford, chief medical officer for the American Health Care Association / National Center for Assisted Living, also is encouraging, noting “huge” opportunities for job entry and growth in the coming years. Gifford notes he's continually impressed by the current senior care workforce and its desire to elevate care. He says that even in tough times, he sees direct caregivers — as well as housekeepers, activities professionals and others — having a profound impact on patient care and quality. “Don't give up,” he prods. “It's the greatest place to work. There's no better job than taking care of the elderly.” Gifford prioritizes four areas where sector professionals need to focus attention. Frank Gifford was one of the great football broadcasters. A staple on Monday Night Football with Howard Cosell and Don Meredith, it's fair to say that most people remember Gifford for calling a game. But how many remember him for what he did on the field, or even know that he was one of the best to ever play? As a halfback and flanker, Gifford combined to score 77 touchdowns during his Hall of Fame career with the New York Giants. An all-around star, he also kicked (on occasion), played in the defensive backfield where he also scored a touchdown, and he holds the NFL record for most touchdown passes in a career by a non-quarterback with 14. Yes, Gifford could burn you in so many ways. His career at the University of Southern California was also spectacular. In fact, two years prior to his enshrinement into the Pro Football Hall of Fame, Gifford was enshrined into the College Football Hall of Fame. His No. 16 is retired by the Giants as well. Alysia Adams, a woman from Caddo County, Oklahoma, declined to plead guilty on Wednesday to the murder of 4-year-old Athena Brownfield, reversing her decision moments before a scheduled court hearing. The unexpected move has reinstated the possibility of the death penalty if she is found guilty at trial. Athena's grandparents had traveled four hours to attend the hearing, anticipating a guilty plea from Adams. "Very disappointed; we have been patiently waiting for almost 22 months for some sort of justice for our granddaughters, and it's postponed again. Justice keeps getting postponed," said Misty Faircloth, Athena's maternal grandmother. In January 2023, Alysia Adams and her estranged husband, Ivon Adams, were arrested after Athena, who was in their care, went missing. Following their questioning, agents from the Oklahoma State Bureau of Investigation (OSBI) discovered Athena's body in a shallow grave in Rush Springs. Investigators allege that Ivon Adams beat her to death on Christmas Day in 2022. A medical examiner later concluded that Athena died from pneumonia and malnutrition, weighing only 23 pounds at the time of her death. Alysia Adams' social media posts in the days following Athena's death showed her attending social events and spending time with a new boyfriend. The plea deal, set to be considered at Wednesday's hearing, was taken off the table by Adams just minutes before proceedings were scheduled to begin. District Attorney Jason Hicks announced in court that he would have withdrawn his request for the death penalty if she had pleaded guilty. With the plea deal now void, Hicks stated he plans to seek the death penalty at trial. Legal experts noted the rarity of such a last-minute decision. "This is a decision that few people really ever have to realize what they're doing and the ramifications of such," said Oklahoma City criminal defense attorney Robert Gifford. He suggested that Adams may have changed her mind due to a belief in her innocence or the gravity of the decision. Gifford explained that the plea withdrawal opens the door for a lengthy and complex trial process. "You don't go into a death penalty case like you would any other case. You have to have enough resources. You have to have investigators. You have to have a mitigation specialist," he said, emphasizing the extensive preparation required for such cases. The case has already garnered significant media attention, which could complicate the selection of an unbiased jury. Gifford highlighted the challenges ahead, stating that the defense would need to navigate the heightened scrutiny and public interest. Athena's disappearance on January 10, 2023, prompted a massive search after a postal carrier found her older sister, Adina, wandering outside their home in Cyril, Oklahoma, about 70 miles southwest of Oklahoma City. The 5-year-old told the carrier she had been alone and was tired, leading to the involvement of law enforcement. The search concluded a week later when OSBI agents recovered Athena's remains. "Very disappointed; we have been patiently waiting for almost 22 months for some sort of justice for our granddaughters, and it's postponed again.
