Im Fall Charlie Kirk wird damit die Frage, wer noch in der Schusslinie stand, über Leben und Tod des Angeklagten Tyler Robinson entscheiden.Ein Kommentar von Sabiene Jahn.„Damit ein Mord in Utah mit der Todesstrafe geahndet werden kann, müssen Staatsanwälte einen spezifischen erschwerenden Umstand nachweisen – über den vorsätzlichen Mord hinaus“,erläutert Paul Cassell, Professor für Strafrecht an der University of Utah (1). Während in Kalifornien schon das „vorsätzliche Lauern“ genügt, verlangt Utah nach § 76-5-202 Utah Code einen zusätzlichen Beweis: Der Täter muss „wissentlich eine große Todesgefahr für eine andere Person“ geschaffen haben – außer für das Opfer und sich selbst (2). Cassell betont:„Die behaupteten Tatsachen machen deutlich, dass Robinson vorsätzlich handelte. Aber dieser Vorsatz allein reicht nach Utahs Gesetz nicht für die Todesstrafe. Entscheidend ist, ob er zugleich eine Gefahrenzone schuf, die andere Personen in unmittelbare Todesgefahr brachte“ (1).Dieses Konzept der „Gefahrenzone“ ist zentral. Es geht nicht nur um den Getöteten, sondern darum, ob andere Menschen durch die Handlung objektiv in akuter Lebensgefahr waren. Das bedeutet: Schon wer mit einem einzigen Schuss eine weitere Person gefährdet, erfüllt nach Utahs Lesart potenziell die Voraussetzungen für Kapitalmord.Die Konstruktion ist eine Folge der US-amerikanischen Todesstrafenentwicklung. 1972 erklärte der Supreme Court im Falle Furman vs. Georgia die damaligen Gesetze für verfassungswidrig, weil sie zu willkürlich angewandt wurden (3). Vier Jahre später legitimierte er im Fall Gregg vs. Georgia modernisierte Gesetze, die auf erschwerende Umstände setzten (4). Viele Bundesstaaten orientierten sich am Model Penal Code (MPC). Utah wählte 1973 bei der Reform seines Strafgesetzbuches eine Variation: Nicht „viele“, sondern schon „eine andere Person“ genügt, um die Schwelle zur Todesstrafe zu überschreiten (5).Die Gerichte Utahs haben seitdem Maßstäbe gesetzt. Im ersten Fall, State vs. Pierre (1977), gab es drei Tote, zwei Personen wurden schwer verletzt. Das Gericht sah eine eindeutige Gefahrenzone und bestätigte die Todeswürdigkeit (6). Beim zweiten Fall State vs. Johnson (1987) erschlug der Täter den Ehemann im Keller, während sich dessen Ehefrau in einem anderen Raum befand. Das Gericht verneinte die Gefahrenzone, da die Frau räumlich getrennt und nicht unmittelbar bedroht war (7). Im dritten Fall gegen Sosa-Hurtado (2019) bejahte das Gericht die Gefahrenzone – auch ohne weitere Todesopfer. Die Schüsse im Tabakladen verfehlten zunächst eine Person, trafen dann tödlich eine andere (8). Diese Fälle zeigen, wie stark die konkrete Situation über den juristischen Ausgang entscheidet: Nähe, Wahrscheinlichkeit und Wissen des Täters sind ausschlaggebend.Für die Staatsanwaltschaft Utah County ist die Gefahrenzone offensichtlich: Robinson feuerte nicht in einem abgelegenen Raum, sondern vor Hunderten Zeugen. Kirk stand auf einer Bühne, flankiert von Mitarbeitern und Zuhörern, während ein Fragesteller direkt vor ihm stand. In the first half-hour, we welcome back Leonardo Flores, to talk about the US' most recent escalation against Venezuela. Leo debunks the absurd US claims of drug trafficking, contextualizing them in a longer history of using drugs as a cover for violent escalation against nations in Latin America. Leo also talks about the remarkable critical media literacy of the Venezuelan people – something that the government has nurtured for almost 30 years via a varied and healthy media landscape that promotes independent and local media rather than a centralized corporate system. Next, Nolan Higdon comes back on the show to examine Artificial Intelligence through the lens of critical media literacy. Nolan highlights the importance of not leaning on AI for foundational skills such as reading comprehension and critical media literacy, notes that AI is not some superior intellect but rather a system built by vehemently anti-democratic and indeed anti-human minds. Leonardo Flores is a co-founder of the Venezuela Solidarity Network. He previously worked as an organizer with Code Pink and as an analyst with the Venezuelan Embassy in the U.S. Leonardo was born in Venezuela and maintains close ties to the social movements that have transformed the country over the past twenty-six years. Nolan Higdon is an author, a lecturer in the Education Department at the University of California, Santa Cruz, and a frequent guest on the Project Censored Show.
