It’s the subtle build in Sophie’s vocal and she’ll be here again at some point. 46.59 MARTYN BATES – The Rhyme Of Miracles – Arriving Fire, CD only – Ambivalent Scale – 2014 Martyn instils presence in a tune like few others for me. 50.28 JOSE FELICIANO – First Of May – 7″ b-side – RCA – 1969 ‘Feliciano seems to be on a heavy Bee Gees kick… after ‘Marley Purt Drive,’ he now does ‘First Of May’ and ‘Gotta Get A Message To You.’ And with his highly stylised projection, Jose manages to make them sound totally removed from anything the Gibb brothers originated’. – Disc (edited review of the album, 10 to 23), 15.11.69. As far as I know the Bee Gees tune was only ever released on a 7″ (my ‘format of choice’) for Jose in Mexico, New Zealand, Philippines and Spain and never as an A-side and arranger, Al Capps most probably winced if he ever got to see the NZ pressing below. Strangely, Jose’s very rarely performed the song live. I’ve only noted it three times, including two at London’s Jazz Cafe, in 1996 and again in 1998 and at the former it surfaced nearly under duress. With the audience (maybe unsurprisingly) constantly shouting out for past JF favourites Jose countered, ‘You know there’s a lot of songs you people ask me for that unfortunately… and I’m not being rude, a lot of artists are rude, they do it on purpose, but some of the songs that you ask me to sing, do you know that I haven’t sung them in years and I’ve forgotten the words and rather than make an ass out of myself that’s why I don’t sing them, OK? So, don’t take it personal… I don’t sing those songs anymore. But I’ll tell you what though there’s some that you ask for that I do remember, like this one. Nah, I was five when Z-Cars kicked off but the theme (based on the traditional folk song, Johnny Todd) still brings a fuzzy feel. And Wikipedia will give you the full story on why Everton FC players come out to the tune at home games. 01.13.22 MARC COHN – ‘Walking in Memphis (Mahna Mahna)’ – Stream only – 1990’s? Cohn definitely wouldn’t have seen this coming, as the self proclaiming Mahna Mahna and the Snowths duo upstage him in a short but cheeky mashup (of sorts) I happened on via Youtube a couple of decades ago. I’ll openly admit I was a Muppets fan when they first aired on UK TV back in the mid ’70s and with Statler & Waldorf the stars for me I remember walking my girlfriend of the time, Jill home from work and then running up the hill to my house to record the show. Pre the age of video recorders, at one point there was a stack of ten to twenty AGFA(!!) cassette tapes of the shows in my bedroom. Getting back to Cohn, the fact he’s ‘racing’ a bit here actually adds to the cheeriness and I salute whoever was involved. 01.14.44 BERNARD CRIBBINS – The Hole In The Ground – 7″ – Parlophone – 1962 And like the Z-Cars theme I was five when this was released and I’d have definitely been singing this one in the years close after – and weirdly, although it’s the second tune from ’62 on this show, it’s not the last. 01.16.27 THE BOTS – Fuzzy Math – George W. Bush Greatest Hits, v/artists, CDr only – Spin The World – 2004 I heard this cut and paste work of art somewhere around its ‘release’ and as of 2004… ‘… utilizing the revolutionary Presidential Truth Filter(PTF). The PTF operates like this: All presidential statements are recorded, and made into a huge database. The database is searchable by speech, phrase, keyword, emotional intensity, etc. In parallel, an analysis is made of the historical circumstances of the particular presidency. The question must be asked, what is this man (all men so far…) really all about? What is a defining characteristic of this presidency? The final question which must be addressed by the PTF is, how can we use the assets in the database to concatenate the truth, and make the President speak it? The first attempt was Bushwack, in 1992. This turned into a huge hit before the Presidential election in 1992, though BMI denied that it was ever on the air at all. Through October of that year, stations such as San Francisco’s Live105 were playing it almost hourly. In 1997 Rock The House was a popular download at an early digital music download startup, muzic.com. In 2003 Bushwack2 was released at about the start of the Iraq war. The mood of the song is quite grim, as the truth of those times was interpreted by the PTF. In 2004, the PTF was reprogrammed to emphasize economics and general silliness, and Fuzzy Math was born. We think it’s the best one yet. Writer, Robinson’s own version is actually the third to make it to 41 Rooms and his vocal arrangement sounds more like a remake than either Kiki Dee’s ‘straighter’ take or even the Supremes and Temptations stab at the song, when chronologically they both followed this Miracles single. 01.46.14 SMITH & MUDD – Blue River – 2LP – Claremont 56 – 2007 Electronic… downtempo… shuffling… drifting… or maybe flowing. 01.48.38 MERZ – A.M. Aided by Jazz The Glass, we pitched her down slightly and then I took out a chunk of the poem in the second half. Com 117 drones acionados remotamente, aviões de guerra da Rússia foram atingidos. O surpreendente: os drones estavam camuflados em caminhões estacionados em solo russo, posicionados estrategicamente perto dos alvos. E ainda mais surpreendente: os drones custaram apenas US$ 500 dólares cada, e causaram um prejuízo de US$ 7 bilhões de dólares, segundo o governo ucraniano. Aretha Franklin got her start at an early age in Gospel music.  As the granddaughter of Gospel great Mahalia Jackson and the daughter of a prominent Baptist preacher, Franklin was heard on her father's "gospel caravan" tours at the age of twelve.  By the time she became an adult in 1960 she had decided that she wanted to go into more pop music, and moved to New York for this purpose.  She signed a deal with Columbia Records, in 1960, but her career would not really take off until moving to Atlantic Records in 1966.  By 1968 she was considered by many to be the most successful singer in the nation, and already crowned the "Queen of Soul."Franklin toured outside the US for the first time in late April 1968 through May 1968.  She performed in Paris on May 7, 1968, and this concert would be released as the live album Aretha in Paris in the fall of 1968.  It was Franklin's second live album, and the first for Atlantic Records where most of her hits were recorded.Some have criticized the backing band as not up to the task of supporting Franklin.  However, this album captures Franklin at the top of her game at a time when she was cranking out some of the biggest hits of her career.  It would be difficult for any supporting band to keep up, particularly one assembled for an overseas tour.  Regardless, this is a great album to explore as a snapshot of Aretha Franklin at the height of success.Lynch brings us a high energy live soul album from the Queen of Soul in her prime for today's podcast. (I Can't Get No) SatisfactionThis Rolling Stones cover is the lead-off track to the album and to the concert.  The Stones had released this song in 1965, and it had become their first number 1 song in the States.  Franklin takes the tempo up for this cover.(You Make Me Feel Like) A Natural WomanCarole King and Gerry Goffin wrote this song for Franklin based on an idea from producer Jerry Wexler.  It originally appeared on Franklin's album "Lady Soul", and went to number 8 on the U.S. charts.  It would make history when it hit the UK charts a week after Franklin's death in 2018, 51 years after the single was first released. (Sweet Sweet Baby) Since You've Been GoneThe original single for this live song was released on the "Lady Soul" album, and reached number 5 on the Billboard Hot 100.  This song was written by Franklin and her then-husband Teddy White. The studio version of this song utilized the talents of the Muscle Shoals Rhythm Section, who were flown in from Alabama to record in a New York City studio.Chain of FoolsSongwriter Don Covay wrote this song in his youth, and presented it to producer Jerry Wexler as a song for Otis Redding.  Wexler decided to have Franklin record it instead of Redding.  It was a big hit, taking the number 1 slot on the R&B charts for four weeks, number 2 on the Billboard Hot 100, and delivering Franklin a Grammy for Best R&B Vocal Performance. ENTERTAINMENT TRACK:Theme from the television comedy show “Laugh In”This sketch comedy show would capture a lot of American counter-culture of the time from Tiny Tim to "sock it to me!" STAFF PICKS:Ride My See Saw by the Moody BluesWayne kicks off the staff picks with a psychedelic song from the second Moody Blues album, "In Search of the Lost Chord."  The song is about leaving school and finding that the world isn't what you thought it would be.  On the album, the song is preceded by a spoken word introduction called "Departure."Harper Valley PTA by Jeannie C. Feliciano v. Department of Transportation the Court was presented with the question of whether a federal civilian employee called or ordered to active duty under a provision of law during a national emergency is entitled to differential pay even if the duty is not directly connected to the national emergency. The Federal Circuit had initially held that Nick Feliciano, an air traffic controller with the FAA and reserve officer in the coast guard was not entitled to differential pay for parts of his time when he had been called to active duty during the early and mid-2010s. The Supreme Court heard oral argument on December 9, 2024, and on April 30, 2025 a 5-4 court reversed the decision below. Justice Gorsuch penned the majority opinion, and Justice Thomas wrote the dissent, which was joined by Justices Alito, Kagan, and Jackson. In this case, the court considered this issue: Is a federal civilian employee called or ordered to active duty under a provision of law during a national emergency is entitled to differential pay even if the duty is not directly connected to the national emergency.The case was decided on April 30, 2025.Nick Feliciano, an air traffic controller with the Federal Aviation Administration and a Coast Guard reserve petty officer, was called to active duty in July 2012 under 10 U-S-C §12301(d). He served until February 2017, primarily escorting vessels to and from harbor. Despite his active-duty service, Feliciano did not receive differential pay, which compensates federal civilian employees for the pay gap between their civilian and military salaries when called to active duty during a national emergency.Feliciano sought relief from the Merit Systems Protection Board, claiming he was unlawfully denied differential pay. The Board rejected his claim, and Feliciano appealed to the United States Court of Appeals for the Federal Circuit. He argued that under 5 U-S-C §5538(a) and 10 U-S-C §101(a)(13)(B), he was entitled to differential pay because he was called to active duty under a provision of law during a national emergency. The Federal Circuit, referencing its decision in Adams v Department of Homeland Security, held that Feliciano needed to show a substantive connection between his service and a particular national emergency, which he failed to do.The Supreme Court of the United States reviewed the case and reversed the Federal Circuit's decision. The Court held that a federal civilian employee called to active duty under "any other provision of law . . . during a national emergency" is entitled to differential pay if the reservist's service coincides temporally with a declared national emergency. The Court determined that no substantive connection between the service and the national emergency is required. The case was remanded for further proceedings consistent with this interpretation.The opinion is presented here in its entirety, but with citations omitted.
