This Day in Legal History: Alcohol Control Administration CreatedOn December 4, 1933, President Franklin D. Roosevelt established the Federal Alcohol Control Administration (FACA) by executive order, a pivotal moment in the transition away from Prohibition. This action came under the National Industrial Recovery Act, as part of Roosevelt's broader New Deal agenda aimed at economic recovery. FACA was designed to regulate the burgeoning alcohol industry, which was reemerging after years of prohibition, ensuring it operated within fair competition guidelines. The administration focused on creating voluntary codes for brewers, distillers, and wineries to prevent monopolistic practices and maintain equitable market conditions.FACA's creation coincided with the formal repeal of Prohibition under the 21st Amendment, which took effect later that month. However, the agency's lifespan was short-lived. By August 1935, it was replaced by the Federal Alcohol Administration (FAA) through new legislation. The FAA consolidated alcohol regulation within the Treasury Department, laying the groundwork for modern alcohol oversight. Today, the Alcohol and Tobacco Tax and Trade Bureau (TTB), a successor to the Bureau of Alcohol, Tobacco, and Firearms (ATF), continues to fulfill the regulatory role first envisioned by FACA. The establishment and swift evolution of alcohol regulation reflect the complexities of ending Prohibition and integrating alcohol back into the economy under federal oversight.A federal judge in California dismissed Hunter Biden's tax case but criticized the presidential pardon issued by President Joe Biden. Judge Mark C. Scarsi expressed skepticism about the validity of the pardon, noting that it was supported only by a press release and could be interpreted as covering actions beyond its signing date. He questioned the argument that the charges against Hunter were politically motivated, highlighting that the investigation was conducted under the supervision of the President's own Department of Justice.The judge also pointed out inconsistencies in statements by the President, who claimed his son was treated unfairly compared to others with similar tax issues. However, Hunter Biden had admitted to evading taxes while sober, contrary to claims of addiction-related leniency. Despite these critiques, Scarsi determined that the part of the pardon covering Hunter's past conduct required dismissal of the charges in his Los Angeles tax case. The case underscores the legal and political complexities surrounding Hunter Biden's prosecution and the implications of presidential pardons.Judge Slams Hunter Biden Pardon but Tosses California Tax CaseCoinbase CEO Brian Armstrong issued a warning to law firms that hiring former government officials involved in crypto enforcement could result in losing Coinbase as a client. Mazzant III ruled in favor of the plaintiffs, including a firearms retailer and the Libertarian Party of Mississippi, who argued that the law exceeded Congress's constitutional authority under the Commerce Clause by targeting all incorporated entities, even those not engaged in commercial activity.The CTA aimed to combat anonymous shell companies and deter financial crimes like money laundering and terrorism financing. However, Judge Mazzant criticized the law as a "quasi-Orwellian statute" that oversteps constitutional limits, asserting that Congress cannot mandate such disclosures solely for law enforcement purposes. New York announced a $100 million settlement with Coinbase over what state officials called significant failures in the cryptocurrency trading platform's systems for spotting potential criminal activity. According to the state Department of Financial Services, Coinbase's anti-money laundering program and its system for monitoring transactions for suspicious activity were inadequate for a company of Coinbase's size and complexity. The department said that the volume of alerts generated by Coinbase's transaction monitoring system grew so fast that reports of suspicious activity were sometimes filed months after the suspicious activity was first known to Coinbase. “It is critical that all financial institutions safeguard their systems from bad actors, and the Department's expectations with respect to consumer protection, cybersecurity, and anti-money laundering programs are just as stringent for cryptocurrency companies as they are for traditional financial services institutions,” Financial Services Superintendent Adrienne A. Harris said in a news release. “Coinbase failed to build and maintain a functional compliance program that could keep pace with its growth.” Under the terms of the settlement, Coinbase will pay a $50 million penalty to New York State and will invest another $50 million in its compliance program. An independent monitor installed by the state will work with Coinbase for a year to oversee compliance. Paul Grewal, Coinbase's chief legal officer, said in a statement that the company has taken substantial measures to address the shortcomings identified by the New York investigation “and remains committed to being a leader and role model in the crypto space, including partnering with regulators when it comes to compliance.” Grewal added, “We believe our investment in compliance outpaces every other crypto exchange anywhere in the world, and that our customers can feel safe and protected while using our platforms.” This article was provided by The Associated Press.

We begin the episode discussing Paul's early career as a trial lawyer where he had to find ways to explain complex concepts, often involving technology, to ordinary jurors.  Paul describes how he learned to do this, particularly with argument by analogies that were accessible to jurors.We then move to discuss Paul's years as a Judge in the Northern District of California, where he presided over many civil jury trials.  As a judge, Paul was in a good position to observe and comment on the quality of the lawyering.  He saw what worked and what did not work in front of juries.  He also developed views about how to improve civil jury trials to produce fairer and better results.Following Paul's time on the bench, we became of the senior attorneys at Facebook, responsible for managing Facebook's litigation across the globe.  Paul shares what he learned about digital media from that experience and provides his take on the current debate between first amendment open media and the role of social media platforms, like Facebook, in the dissemination of propaganda, conspiracy theory and false and misleading information.Finally, we move on to discuss Paul's current position as general counsel at Coinbase, an online cryptocurrency trading platform. In this episode I speak with Paul Grewal who currently serves as the Chief Legal Officer and Corporate Secretary at Coinbase, the leading cryptocurrency exchange in the United States where he and his team were recently responsible for overseeing the company's massively successful IPO. Before joining Coinbase in September 2020, Paul spent four years as a Vice President and Deputy General Counsel at Facebook. Before that, Paul was an accomplished intellectual property litigator, law firm partner, and federal Magistrate Judge in the Northern District of California. Early in Paul's legal career he served as a law clerk both in the Northern District of Ohio and on the Federal Circuit. Paul is a graduate of MIT and the University of Chicago Law School. In our conversation we discuss what it is like to work as a lawyer for companies focused on emerging technologies such as Coinbase and Facebook, how to stand out as a junior lawyer even in these new industries, what he learned as a federal Magistrate Judge before moving in-house, the reasons that he thinks we are in a "golden age" for lawyers, and the future of "remote first" practice of law. Today's Commexis Cast discusses Blackberry's lawsuit against Facebook Inc. for allegedly infringing on multiple patents related to messaging apps, Instagram, and WhatsApp. The complaint states, "Defendants have used BlackBerry's own intellectual property to compete with it in the mobile messaging space. These applications are ever expanding, including Facebook Messenger, Facebook Messenger Lite, Facebook Pages Manager, Facebook.com and Facebook Workplace Chat, the WhatsApp Messenger application made by WhatsApp Inc., and the Instagram application made by Instagram, Inc. The importance of mobile messaging is emphasized by the reported $19 billion dollars Facebook spent to acquire WhatsApp." Some of the alleged infringements include basics of online messaging apps, including notifications for unread messages, read receipts, and photo tagging. Paul Grewal, Facebook general counsel, told CNBC, “Blackberry's suit sadly reflects the current state of its messaging business. Having abandoned its efforts to innovate, Blackberry is now looking to tax the innovation of others. We intend to fight.” Blackberry is seeking damages and injuctive relief for profit lost. However, Blackberry also seemed interested in partnering with Facebook in the future. "As a cybersecurity and embedded software leader, BlackBerry's view is that Facebook, Instagram, and WhatsApp could make great partners in our drive toward a securely connected future," a Blackberry spokesperson said in the statement to CNN.
