According to Mary and Andrew, recent moves by President Trump's administration have been following a pattern: “If at first you don't succeed, try try again.” The co-hosts begin by breaking down the flurry of news surrounding mail voting, starting with Monday afternoon's decision by the Supreme Court to allow President Trump's executive order curtailing mail voting to proceed, though not issuing a decision on the merits of the order. They discuss that decision in conjunction with the Postal Service's announcement on Friday for a final rule that would comply with the executive order, a move that Andrew calls a proxy for the government to “have the Postal Service act in a way that has a clearly disproportionate impact on certain voters.” Then, a conversation about birthright citizenship after a motion was filed yesterday rejecting Trump's executive orders that attempt to limit the legal principle. In the third part of our What The Hell summer reading series, Judge Roy Altman joins us for a discussion on the questions posed in his book, “Israel on Trial: Examining the History, the Evidence, and the Law.” What the hell are the charges? Who the hell are the plaintiffs? Altman applies his legal and ethical training to put Israel on trial. Together, we analyze the ultimate question: guilty or not guilty? After being confirmed to a seat on the US District Court for the Southern District of Florida in 2019, Judge Roy K. Altman, at 36, became the youngest federal district court judge in the country—and the youngest federal judge ever appointed in the Southern District of Florida. He received his JD from Yale Law School, where he was projects editor of the Yale Law Journal. Altman clerked on the 11th Circuit Court of Appeals for the Honorable Stanley Marcus and was appointed a federal prosecutor at the US Attorney's Office in Miami, where he twice received the Director of the Executive Office of US Attorneys' Award for Superior Performance by a federal prosecutor. Altman was named a partner at the Miami law firm Podhurst Orseck, where he represented the victims of airplane crashes and bank fraud conspiracies. DOCKET ALERTS:   The Kennedy Center board of trustees is back on its BS. After being ordered to take Trump's name off the side of the building, they've now voted again to put it back on. They also voted to close the facility for two years. Rep. Joyce Beatty, who brought the lawsuit that forced them to back off the first time, vows to fight on.   Meanwhile musician Chuck Redd was just awarded $252,000 in attorneys fees after the Center sued him for breaching a contract he never signed.   Judge Roy Altman is Aileen Cannon-balling it up in Trump's trollsuit against the BBC. This week he allowed Trump to amend his complaint yet again for "good cause." Correspondent Rich Johnson in Seattle reports - that predicting is coming true in disastrous ways.   Vote Planned For Blanche President Donald Trump issues a new threat if two Senate Republicans don't confirm Todd Blanche as attorney general.  Correspondent Donna Warder reports the Senate Judiciary Committee is teeing up a Tuesday vote on Blanche, despite the fact two committee Republicans are still planning to vote “no.”   Israel's Hamas Question Israel still says it has serious concerns over the Hamas agreement with the Board of Peace and President Trump to disarm.  Correspondent Sam Mednick reports that Israeli Ambassador to the United Nations Danny Danon, speaking on CNN, says that while Israel hopes this time that Hamas will follow through with what they say, their charter still calls for the destruction of Israel.   RFK, Jr. Talks COVID Response Health and Human Services Secretary Robert F Kennedy Junior was on CNN's State of the Union in what was a fiery interview with the show's host Dana Bash.  Correspondent Clayton Neville reports the interview surrounded accountability for the COVID pandemic. Congresswoman's Car Crash Ohio Congresswoman Marcy Kaptur and the driver of the car she was in are in "stable" condition after she was involved in a "hit-and-run" crash on Sunday morning in Toledo on her way to a church service.    Finally   President Trump appears at odds with his US Attorney in Washington, saying he disagrees 100% with the decision of federal prosecutors to drop criminal vandalism charges against a man accused of damaging the Reflecting Pool.  Learn more about your ad choices. August 1, 2026The Department of Justice moved to dismiss the criminal charges against David Hearn, who was indicted for vandalizing the Lincoln Memorial Reflecting Pool, The filing says the damage was due to faulty installation by the contractor, a firm that was hired on a no-bid basis, The project had issues from the start, from algae blooming the day after the reservoir was filled with water to the blue epoxy which began peeling off the bottom of the pool, Hearn was trying to see what the detached material felt like but Trump immediately blamed him and others for vandalizing the pool, Jeanine Pirro, the US Attorney for DC, and Interior Secretary Doug Burgum also claimed that vandals were responsible for the problems with the pool but the DOJ's filing proves this was a lie and that the restoration was a hasty, expensive, and ill-thought-out project. The government's own dismissal filing tells the story. According to the motion, it was only after the indictment that the Department of the Interior provided additional documents showing the damage to the reflecting pool stemmed from a flawed installation by a contractor rushing to finish before the America 250 celebrations, not from vandalism. The sealant had reportedly begun peeling almost immediately after the renovation. Hawk notes the filing tries to shift blame to the Interior Department, which he argues only underscores that felony charges were brought against an American without an independent investigation. Hawk sets the dismissal against Donald Trump's repeated public claims that he had photos and video of a 350-foot gash being cut into the pool, evidence never produced. He places it in a pattern of high-profile cases out of the D.C. US Attorney's office that have stumbled, and argues it reflects what happens when prosecutorial power is used to pursue targets rather than evidence. Roger Rogoff is the new U.S. Attorney in the Western District of Washington. Or he was. He started this morning, but was fired by President Trump less than an hour after being sworn in. Rogoff is a former King County Superior Court judge and a former federal prosecutor. He was appointed to be the U.S. Attorney by the Western District’s federal judges. His firing has set off an expected legal fight that will once again pit the President against the judiciary with no clear idea what the future holds. DOCKET ALERTS:   House Speaker Mike Johnson sent everyone home for vacation rather than deal with a dissident faction in his own caucus that keeps demanding a vote on the vote-suppressing SAVE America Act Trump keeps braying for.   A federal judge in New Hampshire became the tenth to dismiss a DOJ lawsuit seeking full, unredacted state voter rolls — or eleventh if you include the Sixth Circuit.   In 2024, Florida sued to force DHS to bulk verify citizenship data so states could "audit" their voter rolls. In 2025, DHS entered into a "settlement" with Florida, Iowa, Ohio, and Indiana agreeing to do it, and handing power to a Trump-appointed judge in Florida to ensure compliance. But that database has now been enjoined by a judge in DC for violating the Privacy Act of 1974, so Florida is moving to enforce the settlement in Florida.    And in DC, Judge Emmet Sullivan barred the Post Office from complying with Trump's executive order requiring the mailman to claw back ballots from any voter not on an approved list. This order violates a 2021 settlement the government made with the NAACP after Trump's last postmaster general tried to mess with mail-in ballots.   A judge in Louisiana has dismissed a lawsuit against several academics associated with the now-shuttered Stanford Internet Observatory. The online wingnut plaintiffs alleged that they had been "censored" by scholars who pointed out that they were violating Facebook's TOS.   Former CIA Director John Brennan is suing Acting Attorney General Todd Blanche in DC, seeking an injunction forcing prosecutors investigating him to retain all records. He hasn't been indicted yet, but, with Trump's minions planning a giant conspiracy indictment in Florida, he wants an order to preserve evidence for an eventual motion to dismiss for vindictive prosecution.   Prosecutors trying to convict a former US Attorney in Florida for emailing herself a copy of Special Counsel Jack Smith's report on the stolen documents case were forced to admit that they'd done the exact same thing, sending copies of it to defense counsel in discovery disclosures.    MAIN SHOW:   The Supreme Court issued its final opinions of the term.    In Trump v. Barbara, a narrow majority upheld birthright citizenship, refusing to invent some kind of exception to the plain terms of the 14th Amendment.   The conservative justices continued to tear down barriers to corruption in politics, invalidating the Federal Elections Campaign Act's bar on campaigns coordinating spending with outside committees in NRSC v. DOCKET ALERTS: Maryland became the ninth state to beat back a lawsuit from the DOJ's Civil Division seeking to seize its full, unredacted voter rolls.   In Massachusetts, a judge allowed states to proceed with a lawsuit to block an executive order requiring DHS to maintain a master list of voters and barring USPS from delivering mail-in ballots from anyone on the list.    DOOFUS OF THE DAY: Sixth Circuit Judge Amul Thapar, who was featured in a Bloomberg Law story about judges embarrassing themselves by trying to get nominated for SCOTUS if/when Justice Alito announces his retirement in July. Thapar, who is 56, started a Substack to talk about how his fitness regimen means he's really only 43.   MAIN SHOW:   In Minnesota, Chief Judge Patrick Schiltz quashed DOJ subpoenas for Gov. Tim Walz, Minneapolis Mayor Jacob Frey, AG Keith Ellison, and several other state officials. The court held that the subpoenas were plainly levied for an improper purpose, namely to punish state officials for refusing to cooperate with Trump's immigration raids. That's a violation of the Tenth Amendment.   Also in Minnesota, charges were dropped against yet another protester from the winter immigration surge into the Twin Cities. ICE/CBP conduct here was egregious, and the US Attorney claims to be investigating.   Since the satirical newspaper The Onion is planning to launch an InfoWars parody on July 2, we revisit all of the bankruptcy court shenanigans to date and talk about what might happen next in court.   Finally, we check in on the Trump insurrectionist slush fund and the administration's continued refusal to actually promise in court, under oath, that it won't resurrect the idea. In the Eastern District of Virginia, the administration simply refused to file declarations ordered by the presiding judge. At the eleventh hour, the Center's Board appealed the order to take Trump's name off the building, citing a new rule that would strip all funding from the institution if Trump's name came down. The trial judge denied the requested stay, and so did the Circuit Court.
