On this episode of Establishing Your Empire I host Joah Spearman. Joah is the CEO and Founder of Localeur who has helped more than 5 million people experience traveling like a local from insiders who share authentic recommendations on their favorite local places to eat, drink and play. Joah started Localeur in 2013 by asking a dozen friends in Austin to recommend their favorite local spots before the South by Southwest Festival. Joah’s path has been anything but straight. His career started by working for the Texas Longhorns while in college, then a speechwriter in D.C. His first business was a social media consulting company helping to turn Austin’s Rainey Street into a nightlife district. After that, he opened a sneaker boutique in Downtown Austin, underneath the mayor’s office at City Hall. Then he convinced the founders of SXSW to let him create and run the first-ever fashion part of the festival. Somehow, the combination of all these experiences gave Joah a unique perspective on what a traveler really wants when they visit a new city: authentic recs from locals. Now, some 180 cities later, it seems to all make sense.

Josh Fogelman of Austin and Justin Hill teamed up to represent a nice lady injured when a ceiling tile fell and hit her on the head. The ceiling tile had become soaked with water due to an improper AC repair. This leak was known and never fixed. When the tile hit her in the head, she suffered serious psychological and neurological injuries. Transcript: Justin Hill: Welcome to Hill Law Firm Cases, a podcast discussing real-world cases handled by Justin Hill and the Hill Law Firm. For confidentiality reasons, names and amounts of any settlements have been removed. However, the facts are real, and these are the cases we handle on a day-to-day basis. [music] Justin Hill: Occasionally, on this podcast, we get to have our friends, our colleagues, our co-counsel/co-workers on to join us and discuss cases and issues and other things we've worked together. I have Josh Fogelman here with me today who's an injury lawyer in Austin, a really good friend of mine and classmate from Baylor Law School. Him and I had the occasion over time to work on a few things together, but today, we're going to talk about a case we worked on out of Austin. We're not going to say the name, Josh. We're not going to say any amounts. It was a really fascinating case with a really fascinating client that had a really fantastic result. Tell me what you remember about the factual scenario. Josh: This was definitely an interesting one. We represented a woman who was visiting Austin from out of state with her husband. They were staying at a hotel in Downtown Austin. Our client was sitting in the lobby of the hotel waiting to speak with the concierge desk and a ceiling tile collapsed and fell and struck her while she was sitting there in the lobby. It was an interesting injury case because this particular client had a pretty extensive history of some physical and psychological injuries. She'd actually been a civil rights activist who was very involved in the civil rights movement. Because of her involvement in the civil rights movement, she had actually been subjected to a number of physical attacks that had left her with permanent injuries, as well as some pretty serious post-traumatic stress syndrome. When she was hit by this pretty heavy falling object, she was not expecting to strike her. It triggered both her physical and psychological injuries in a permanent manner. Justin Hill: One of the things that was interesting about that case was the incident was on video, correct? Josh: It was. There was some security camera footage of the incident. It was pretty alarming. Justin Hill: Yes, which takes away some of the defenses that we've seen. We talk about that on this podcast a lot. These frivolous defenses, made-up defenses, you see them in all the cases. I always have to tell clients, "No matter what your facts are, if it's on video, they're still going to have a defense to your case." In our case, it seemed like the defense ran the gamut from, "Okay, that happened, but blame all these other people," to then, "Okay, maybe it was our fault. Now, let's blame her pre-existing injuries and her pre-existing psychological issues." What did you find to be the toughest element of that case? Josh: I thought the toughest element of that case was proving the extent of her harm. One of the things that we struggle with with personal injury lawyers is so many of the cases that we see, you can actually look at photographs of the physical injuries. It's very clear what has happened to a person. Oftentimes, they will walk into the courtroom with a permanent reminder of what those physical injuries were, whether it's the loss of the limb or some permanent scarring, something of that nature. But when you're dealing with primarily psychological injuries, it can be a little bit more challenging to really present that in a way that you feel comfortable and confident a jury will identify with and understand. This was one of those cases....

Took the Soma Ether out for a night! There seems to be no end to what sounds can be caught with this wonderful EMF receiving 'anti-radio' from Soma Labs / Vlad Kreimer. Just received the Ether from Russia via USPS this morning. Here's raw audio of an hour in downtown Austin. Only had it for a day but finding it's very variable. In quieter environments, Ether can find produce/receive very calming ambient tones and purr along with some very polite static and reception. You can play it like a theremin, too, attenuating and gesturing on a signal frequency, and loop on something (or a device) til it fades out of reach. But this is a demo of how loud and nicely argumentative it can be as a noise source outside among a lot of activity. It feels like a nice audio photograph of the evening and street. Pam spent nearly 21 years writing about fitness, adventure and travel for the Austin American-Statesman, Austin’s daily newspaper. It was there that she wrote a weekly column called Fit City. And it’s a befitting column for someone who considers herself to be an Outdoor Junkie. While she had done a number of things over the years that tested her confidence and really forced her to stretch herself, she declared 2017 as her Year of Adventure and she set out to purposely do things that she was uncomfortable with. In her article declaring her year of adventure, she ends with this, “Take a flying leap, splash hard, get your hair wet and smudge your makeup.” During her adventurous year, she jumped off a 10-meter diving board, she ran a naked 5K race and she rappelled down a 38 story high-rise in Austin (dressed in a Wonder Woman suit, of course!) – all of which she describes in this episode. Then, to the degree that I make sense of something – like, okay, CO2 is actually a problem – then I have no idea how the fuck to act on it. Today we continue in our water law series by focusing on surface water. If you missed the episode focused on groundwater, click here. I'm joined by Carlos Rubenstein.  His experience in Texas water is vast, including former Rio Grande Water Master, to a Commissioner on the Texas Commission on Environmental Quality to Chair of the Texas Water Development Board.  Water is certainly a passion of Carlos' and he has had really interesting experiences. We walk through the definition of surface water in Texas, the legal concept of prior appropriation that governs the vast majority of surface water in Texas, the TCEQ permitting process, and how people can go about obtaining rights to use surface water.  We also talk a bit about the role of watermasters in Texas. We then talk about a number of disputes and cases including the LCRA curtailing water rights for rice farmers, Texas Farm Bureau v. TCEQ, The Aransas Project v. TCEQ, Texas v. New Mexico, the 1944 Texas-Mexico Treaty on the Rio Grande, and issues on the San Saba River. When asked about a law he would like to see changed, Carlos said he would like to modify the current rules regarding interbasin transfers of surface water.  In Texas, a person who utilizes an interbasin transfer (moving water from one basin for use in another) does not maintain seniority of right from the original basin.  Instead, the user in the new basin is deemed junior. Full Podcast Transcript NASIR: Welcome to our podcast where we cover business in the news and add our legal twist. My name is Nasir Pasha. MATT: And I’m Matt Staub. NASIR: That’s correct. MATT: All right, that’s it. NASIR: That’s actually the first time you got that right. MATT: Yeah. Well, you know the phrase, “260th time’s a charm.” NASIR: Yeah. Wow. 260, huh? MATT: Yeah. NASIR: We’re getting up there. MATT: It’s a good amount – close to 300. NASIR: Closer to 300 than it was closer to 200, that’s true. MATT: Yeah, definitely. NASIR: Have you ever been to South by Southwest? MATT: Oh, is that what that means? I thought it was Swiss… I don’t know. I was going to try and pronounce it as a word. No, I haven’t. Never even been to Austin. NASIR: Oh. Most people compare Austin to San Diego – or I should say they see some comparables to it. I would agree, actually. The atmosphere, it’s a big small town just like San Diego. I have been in Austin during SXSW. It was crazy. MATT: Yeah, I remember that. NASIR: You remember that? But I was there because I was meeting with the Texas Department of Insurance – with eight or nine people from there – in this old office building. You know those old government buildings where smells of old books or something? And I was in the boardroom with, like, six or seven different people and, literally, outside – and this is Downtown Austin – there was like band music going off and drums and they were like, “Oh, yeah, that’s been going on all day and all week,” or whatever and I’m just thinking, “I drove all the way to Austin and SXSW is going on and I’m just sitting in this boring Texas Department of Insurance meeting.” But, anyway, that’s my experience. MATT: You didn’t even really partake in any of the… NASIR: No, I walked around a little bit. I needed to head home but, yeah, I just walked around. There were some activities going on. I don’t even think I ate lunch there. That was horrible. MATT: Time well spent. NASIR: Yeah. MATT: Well, is it this Friday? NASIR: I think it starts this Friday, yeah. MATT: Okay. NASIR: At least maybe the interactive part. Don’t ask me. I always forget there’s like all these Austinians? What are they called – Austinites? MATT: Austines? NASIR: Austines? MATT: Austinites is probably right. NASIR: Okay. They’ll be upset that I don’t know but, if I recall correctly, it’s divided into two or three segments – one of them being South by Southwest Interactive which is all the startup scene and things like that then you’ve got the music and something else, too. I don’t know. MATT: Austonians, maybe. NASIR: Austonians. MATT: I don’t know. NASIR: Yeah. MATT: It’s a tough call. Well, anyway, the reason we’re talking about that is – I didn’t know about this. You told me about it so I’m not going to pretend like I knew about this beforehand but the Austin mayor is encouraging people to work from home or take a half day on this Friday which I’m assuming will be the previous Friday from when people from when people are actually listening to this. That’s why I asked about the dates but that’s fine. NASIR: By the way, Austinites, according to Wikipedia. Demonym I guess is what the term is – a word to identify residents or natives of a particular place. MATT: This’ll be a fun episode to transcribe. NASIR: I know. Sorry. Okay. MATT: Yeah. So, the mayor is saying to anticipate heavy traffic. Part of the reason is because SXSW. Another reason is because the President is going to be in town and I assume another reason is probably there’s just traffic there in general. It is a big city with a lot of people in it. NASIR: Yeah. MATT: I’m not going to act like I know what the traffic is like because San Diego traffic really isn’t that bad and there’s a ton of people in San Diego, too.
