"The Face-Off" In this week's episode, we watch Micah and Moriah drink their feelings at brunch just like their mom taught them...and speak of the devil! Kim tries to squeeze out sympathy for her (most recent) DUI, but we're not buying. Lydia's home is held together by Post-it Notes, and Ethan and Isaac tag-team some major jerk energy at the most uncomfortable family dinner since...last week. Oh, and Micah's not at a Coldplay concert, but he's definitely cheating on Veronica. Find All Our Links in One Place: beacons.ai/survivingpodLove the Show? Steve Palmer sits down with Troy Hendrickson, our resident law student, for a deep dive into what law school doesn't always teach you—this time, focusing on the mysterious world of grand juries. They break down what a grand jury is, the differences between grand and trial (petit) juries, and why the standard of proof is much lower at the indictment stage than at trial.Steve and Troy use the recent Epstein case as a jumping-off point, discussing the secrecy surrounding grand jury proceedings, why those records are generally kept under wraps, and who gets to peek behind the curtain (hint: it's a very short list). They unpack the legal and historical reasons for keeping grand jury information confidential, the ongoing court battles about whether transcripts should be released for so-called 'public interest' reasons, and the potential for the Supreme Court to settle this debate once and for all.Plus, the conversation veers into attorney-client privilege, conspiracy theories about the Epstein case, and how high-profile cases influence the direction of legal rules. And, as always, they share their thoughts on what law school could do better—hint: more real-life cases, less rote memorization.Moments00:00 Probable Cause and Legal Standards03:19 Grand Jury Process Explained06:44 Memory Lapses in Consent Cases12:47 Judge Denies Release of Transcripts15:44 National Injunctions and Judicial Authority19:11 SCOTUS on Judicial Authority Limits21:35 Epstein's Suicide Theories Discussed25:48 Nixon, Pentagon Papers, Legal Precedents28:12 Beyond Law School DiscussionsHere are three key takeaways:Grand Jury Process Is Often Misunderstood: Many people—even in law school—mistake the role of a grand jury. Unlike the trial jury (“petit jury”), the grand jury's only job is to decide if there's enough evidence (probable cause) to indict, not to convict. Defense attorneys are usually kept in the dark and rarely present evidence or have the right to transcripts.Grand Jury Testimony Is Highly Confidential: The secrecy rules are strict—defense can only access transcripts upon showing a “particularized need.” The rationale goes back to witness safety, protection of ongoing investigations, and safeguarding victim identities—concerns that remain deeply relevant today.Legal Precedents Shape Access—Not Public Interest: While there's massive public interest around cases like Epstein, courts have repeatedly ruled that historical or public curiosity is not enough to override the secrecy of grand jury proceedings. Real reform, if any, must come from Congress, not the courts.Submit your questions to www.lawyertalkpodcast.com.Recorded at Channel 511.Stephen E. "And first and foremost, we look for objections. So if the trial lawyer, if the defense lawyer says, object, this evidence shouldn't come in, or object, I want this evidence to come in and you're not letting me do it." - Steve PalmerI'm pulling back the curtain on how I approach analyzing trial transcripts during the criminal appeals process. I'll walk you through my method for preparing an appeal—from my first pass through those massive transcripts, to zeroing in on key objections, carefully reviewing the jury instructions, and finding the connective threads that could make or break a case. I'll share why I always read the closing arguments first, what I'm really searching for as I flag important moments, and how all these details come together when building strong assignments of error. Whether you're a fellow legal professional or just curious about what happens behind the scenes of an appeal, I think you'll find this episode packed with insights. And as always, if you have questions about the appellate process or want me to cover a specific topic, reach out at LawyerTalkPodcast.com. Here are my top 3 takeaways:Start with the End in Mind: Glenn always jumps to the closing arguments first. This helps him identify what both sides thought was most important, setting the stage for a focused, thorough read-through.Look Beyond the Obvious: Spotting objections is important, but so is reading between the lines. Sometimes, critical appellate issues crop up in jury instructions or voir dire, places many skip over.Find the Thread: Building a strong appeal is about connecting dots—assignments of error, evidentiary mistakes, and even courtroom themes need to be woven into a compelling narrative that judges can follow.Copyright 2025 Stephen E. A devastating car crash in Wisconsin exposes the deadly cost of sanctuary policies, as an illegal immigrant with a prior DUI kills two teenagers while driving drunk—despite a standing ICE detainer. The tragedy ignites outrage over Democrat-run jurisdictions that prioritize politics over public safety. Meanwhile, Trump-era intelligence leaders are dismantling the Russia collusion hoax, revealing it was a Hillary Clinton–approved smear campaign buried by Brennan, Comey, and Obama's inner circle. Across the Atlantic, Europe descends into authoritarianism as the UK launches a government-backed censorship force to arrest citizens for criticizing migrant crime. Yet Donald Trump, standing beside UK Prime Minister Keir Starmer, says what Brits now risk prison time for merely posting online. From lawless immigration to weaponized intelligence and mass censorship, the fight for truth and sovereignty has never been more urgent.
What should you do if you feel like your attorney isn't really on your side? I get calls like this more often than you'd think, and let me tell you—it's not as straightforward as just hiring someone new. I'll walk you through the realities of “firing” your lawyer, the ethical boundaries I have to consider when talking to someone who's already represented, and why communication breakdowns trigger most problems between clients and attorneys. I'll share stories from my own experience, offer advice on how to approach these tough conversations, and explain what happens if you're thinking of switching lawyers—especially if your case is moving fast toward trial. If you've ever felt left out by your lawyer or just want to understand how these situations are handled behind the scenes, you're in the right place. Key Takeaways:Communication is Everything: Most issues between attorneys and clients stem from miscommunication or a lack of updates. Before considering a switch, have a candid conversation with your current lawyer.Don't Wait Until the Last Minute: If you decide to change attorneys, do it well before important deadlines (like a trial date). Last-minute changes can put your case—and the new lawyer—in a challenging position.Follow Proper Steps: Formally terminate your current lawyer before contacting a new one. This avoids ethical complications and ensures a smoother transition.Got a question you want answered on the podcast? Call 614-859-2119 and leave us a voicemail. Omaha Mom Gets 180 Years for Drunk, Fiery Crash That Took Her Children's Lives It was 12:50 a.m. on a September night in Omaha when Rachel Bickerstaff turned her Dodge Charger into a death machine. Clocked at 142 mph with a blood-alcohol level nearly three times the legal limit, she blew through a red light—and obliterated two cars, four lives, and any chance at redemption. Three of the dead were her own daughters: one just 11 days old. The other victim, 70-year-old Michael Sales, was just trying to make it home from work. His daughter later told the court that she wasn't even allowed to see his body. The fire from the crash was too intense. Bickerstaff had prior DUIs. Lost custody of four other children. And while awaiting trial for this case, she allegedly assaulted a fellow inmate. Her sentence? Up to 180 years in prison. She'll be eligible for parole when she's 104. This wasn't just a crash. It was a preventable massacre—one that left first responders traumatized and four families permanently shattered. #rachelbickerstaff #omahadui #drunkdrivingfatality #nebraskamurder #vehicularhomicide #duicrash #momkillskids #duisentencing #truecrimepodcast #michaelsales Want to comment and watch this podcast as a video? This week on Driving Law, Kyla Lee and Paul Doroshenko discuss Vancouver's decision to extend bar hours to 4 a.m., raising concerns about transit access and impaired driving enforcement at a time when the city's traffic unit is severely depleted. They explore how the change could affect public safety, particularly in the absence of roadblocks and routine DUI checks. Next, they examine a series of questionable policing decisions involving Constable Keith McCready of the Prince George RCMP, including issuing IRPs in odd circumstances. Public backlash intensified after an arson site near a weigh scale was tagged with graffiti: “Good job McCready.” Kyla and Paul reflect on community trust, internal misconduct, and the difficulty of holding officers accountable. They also dissect a troubling video from Florida showing a Black man violently pulled from his car during a traffic stop despite being compliant—another example of systemic issues in policing. The Ridiculous Driver of the Week is a man in Brampton caught on video speeding along a sidewalk in a Lexus to skip traffic. In a bonus local story, a Vancouver man with a handicap placard was filmed illegally dumping a mattress in a public park. Get ready for a wild ride as the Rizzuto Show dives headfirst into the crazy world of viral videos, illicit activity from some locals, and England's largest swingers convention complete with butt plug bingo! We kick things off by chatting about a jaw-dropping incident where an influencer made headlines when she shared a video of herself splashing around in what she believed was harmless sea foam while vacationing in Cape Town, South Africa. Little did she know, the foam was actually a product of sewage runoff from a nearby pipe. The crew can't help but laugh at the sheer absurdity of it all as we dive into the hilarious reactions that flooded social media. We also tackle some jaw-dropping news stories, including another bizarre tale about our favorite local chimpanzee handler, Tonia Haddix, who's found herself in some serious legal hot water, and another local St. Peters woman who's facing the music (possibly a 5 year sentence) for arson in Puerto Rico. And don't forget about England's largest swingers festival, Swingathon, which descended on the tiny town of Allington. The three day festival consists of frisky play tents, pole dancing, foam parties, mobile dungeons and sex games like Butt Plug Bingo. Yep... So close to the weekend, I can almost taste it! Going to be busy, but still looking forward to it. After yesterday's tribute to the late, great Ozzy Osbourne, we attempted to get back to normal on the show. Office Cora joined me just after 8am to talk about what she's up to this weekend in the 715. Started the show with the Thursday Song, and in the news this morning, the body of Eliotte Heinz was found yesterday…as was the body of UW-Plattevill student, Emma Jacob. Also in the news today, the WI DNR has issued an air quality advisory for today, and update on the death of Malcolm-Jamal Warner, and the sentencing of Brian Kohberger. In sports, the Brewers got back to beating the Mariners yesterday, the Packers annual revenue-sharing report reveals how prosperous the NFL really is, and the Bill Belichick effect on ticket sales for UNC. Elsewhere in sports, NASCAR is officially coming to San Diego, and Red Cedar Speedway has action tonight. Let you know what's on TV today/tonight…and even though Jean's still out on vacation, Office Cora & I asked each other a hypothetical question on "Hypothetical Thursday"…mine was: " Hers was: " Heroic story about a military Veteran who helped stop a lunatic on a plane who was ranting and raving and trying to get into the cockpit & open the door while the plane was in flight! Plus, a couple of heart-warming animal stories involving a long-lost cat…and a long-lost dog. Have you ever heard of the "Solid Snake" method of dealing with an awkward conversation? Neither had I. And in today's "Bad News with Happy Music", we had stories about an "influencer" swimming in raw sewage, a deputy who got popped for DUI in his patrol vehicle, a #FloridaMan who tried to set a gym on fire & then tried to hide in a tanning bed while naked, a dude in Oregon who was wearing a shirt that said "Master Baiter" and got arrested for illegally catching fish, a potential homebuyer who discovered the skeleton remains of a man who had previously been living in the home he was looking to buy, and a married couple from CT who tried to join the Mile High Club while sitting in their seats on the plane.See omnystudio.com/listener for privacy information.

I'm taking you behind the scenes of a fascinating aspect of criminal appeals that most people overlook: the cross appeal. Now, I know it might sound boring or routine at first, but trust me—once you're in the thick of appellate work, it gets a whole lot more interesting.I'll be sharing a recent experience from my own legal practice, where, after winning a significant post-conviction case, the state decided they weren't ready to walk away and filed an appeal against our victory. That put me at a crossroads—should I file a cross-appeal to cover the few issues the judge didn't rule in our favor on, even though we'd already won big?I'll break down the strategic reasons behind a cross appeal, the importance of preserving every argument for my client, and why sometimes, in appellate law, thinking several moves ahead is the key to real justice. If you've ever wondered about the nitty-gritty of criminal appeals, why every detail matters, or what it takes to go toe-to-toe with the government after a win, this episode is for you. Key Takeaways from this episode:A cross appeal preserves your arguments: If the opposing party (like the State) appeals a favorable decision, you may need to file a cross appeal to ensure all the issues you raised get reviewed—crucial for “playing chess” with the appellate process.Protecting future rights: By raising every possible issue on appeal, you protect your client's ability to bring those arguments to higher courts, like the Supreme Court, if needed. Failure to do so could waive those issues forever.Specialized appellate expertise matters: Appellate practice is a different world from trial work. Having a lawyer who understands the finer points of state and federal appeals can make all the difference for your case's outcome.Submit your questions to www.lawyertalkpodcast.com.Recorded at Channel 511.Stephen E. RUNDOWN Here's a wild behind-the-scenes story involving the viral CEO from the Coldplay concert — did Mitch actually reached out? Mitch and Hotshot slide into Ottawa trivia, highlighting hometown music legends like Alanis Morissette and songwriter Paul Anka. Mitch and Hotshot Scott recap the Mariners' gut-punch loss on Sunday after taking the first two games from Houston, focusing on a costly JP Crawford error that flipped momentum in an 11-3 collapse. Despite the disappointment, the M's remain in playoff position heading into a daunting series with the red-hot Brewers and their 103-mph phenom Jacob Misiorowski. With the trade deadline approaching, Mitch speculates on bullpen help and a potential return for Eugenio Suarez. Mitch is joined by Brady Farkas and Joe Doyle [Mariners No-Table] to unpack a frustrating Sunday collapse that spoiled a potential sweep of the Astros, despite strong starts from the rotation and promising moments from Julio Rodríguez. The crew breaks down playoff odds, bullpen trade needs, and the logic behind a potential Gino Suarez rental deal. They preview a tough week ahead against the red-hot Brewers and tricky Angels, with bold predictions for Dom Canzone and the M's pitching staff. MLB Pipeline's Jim Callis returns to Mitch Unfiltered to discuss how Kade Anderson unexpectedly fell to the Mariners at No. 3—despite Callis saying it was highly unlikely just two weeks earlier. He explains why it wasn't a knock on Anderson, but a cost-saving move by the Nationals and Angels. Callis breaks down Anderson's strengths, how he compares to Paul Skenes, and when fans might expect to see him in the big leagues. He also weighs in on the Mariners' other top draft picks and gives the front office high marks for its overall haul. In this week's KJ-Aren'ts, Mitch and Jason Puckett relive the viral backlash from Mitch's tweet doubting Cal Raleigh's Home Run Derby chances with his dad pitching. Mitch explains the misunderstood context, while Puckett gleefully replays clips and receipts. The segment spirals into a hilarious debate on bad takes, freezing cold tweets, and All-Star innings, with both hosts taking their lumps. Full episode available to Mitch Unfiltered patrons. The “Other Stuff” segment dives into Scotty Scheffler's historic British Open win and streak of dominance, before veering into a whirlwind of quirky, controversial, and surprising headlines—from Jay Cutler's endangered species scandal to In-N-Out Burger's move to Tennessee. I tackle a topic that sparks a lot of debate: why do people who seem obviously guilty still enter a "not guilty" plea in court? After a recent conversation with a sharp, strong-willed friend who was baffled by this, I decided it's time to break down what really happens at an arraignment. I'll share why starting with a not guilty plea isn't about denying the facts, but about making sure everyone gets the full benefit of due process and constitutional rights. I'll explain how this plea allows me, as a defense attorney, to fully review the evidence, negotiate charges if necessary, and ensure that any decision is made knowingly and intelligently. If you've ever found yourself frustrated or confused by this part of the courtroom process—especially when you see it play out in high-profile cases—I'm here to unpack the real reasons behind it. Here are 3 key takeaways for anyone interested in justice and due process:A Not Guilty Plea Is About Process, Not Denial: Entering a not guilty plea at arraignment isn't a claim of innocence. It's an essential first step to protect a defendant's rights and ensure full discovery and review of evidence.“Guilty” Pleas Without Understanding Are Dangerous: Our system requires that a plea be made “knowingly, intelligently, and voluntarily.” Without complete discovery and legal counsel, it's impossible for anyone to meet that standard.Every Defendant Deserves Due Process: Sometimes the charges are overblown, the evidence is flawed, or constitutional rights may have been violated. Pleading not guilty gives defense (and prosecution) time to negotiate, review, and ensure fair outcomes, not just political theater.Got a question you want answered on the podcast? BREAKING: Gators Lineman Arrested for DUI
www.patreon.com/dopeypodcastThis week on Dopey! It's ChrisMiss Time Again - and we remember Chris and think about what we've lost in our latest ChrisMiss episode. We are joined by Ted and Colin—two of Chris's closest friends—for a long, emotional, laugh filled but ultimately tragic journey through grief, memory, relapse, recovery and death. They recount wild and deeply human stories of Chris: his powerful magnetism, his “whatevs” persona, and the time he hugged a drunk driver who had just killed someone. Then, we go deep into Chris's relapse, the shame that may have surrounded it, and the fear of losing connection. From Mountainside to Katz's Deli, from a poetry slam to the drunk tank, from legacy to myth to bionic legs traded for heroin—this episode is everything that made Chris unforgettable. PLUS: a classic Dopey voicemail from Tim in Philly involving coke, Cookie, and crackhouse head, and a replay of Episode 71 with Chris. It all ends with the classic version of “Bad Card” and a full-circle Dave and Chris musical outro. Stay strong Dopey Nation, and fucking toodles for Chris.Opening:Dave recalls Dave Marshall, the first Dopey community member to die. Dave, Chris, and Dave Marshall once recorded a now-lost episode that ended in a bizarre fight—possibly because Chris was trying to impress Marshall.Talking Grief:Dave asks Colin and Ted how they grieve Chris. Colin mentions laughing at dumb things and feeling like Chris is still there. Ted recalls vivid dreams where Chris walks him through his relationship with his wife, like a ghostly Scrooge-style guide. The dream was so powerful he woke up crying.Dreams of Chris:Dave shares that Chris is always dead in his dreams, and that he recently had one with both Chris and his mother (also deceased). Chris always knows he's gone in the dream—making them painful but powerful.Trend of Death:The conversation shifts to the changing trends of death in recovery: less overdoses, more suicides, including people they knew.Settlers of Catan:Chris's obsession with the Settlers board game—cheating newbies, logging fake wins on a wooden log, and playing alone while stacking stats. The actual Settlers Log might be lost.Connection & Community:Colin reflects on connection as the heart of Dopey and recovery. Chris embodied that connection for many. Why Did Chris Relapse? They dive into theories around Chris's relapse:He was doing well—finished his master's, in a stable relationship, BTN job picking up.Dave wonders if Chris thought the promises of recovery would be better high.Colin and Ted say Chris might've feared losing relationships if he admitted he was using.Shame and stigma—not about being an addict, but about breaking the recovery identity—were likely massive.Chris's Persona:“Whatevs” was Chris's favorite line, but everyone agrees—he actually cared a lot. He just didn't want people to know.Origin Story:Chris and Dave met at Mountainside, where Chris became Dave's “Eskimo”, showing him that 12-step worked.Chris used to visit Katz's Deli to impress Dave and his girlfriends. They texted or talked every single day from 2015 to the day Chris died. The Fatal Crash Story:Ted and Chris are en route to a poetry slam when they stumble on a deadly car crash—they are first on scene.Ted goes into shock.Chris takes action—calls 911, finds a guy with smashed legs, then chases the drunk driver into the woods. The driver is blackout drunk, crying, and doesn't know what happened.Chris hugs the man, tells him he killed someone, and holds him as he cries.Later, Chris keeps in touch with the man, who is sentenced to 30 years in prison. It was his seventh DUI.Synchronicity:A year later, Chris relapsed. Ted and Colin had to call the cops on him.The same officer from the crash scene showed up to arrest Chris and put him in the drunk tank.Chris's Duality:Dave sums it up: “We're the same people who kill people. We're the same people who help people. And we can turn up totally wasted again at the drop of a dime.”Recovery Today:Ted no longer goes to meetings. He stays clean through fatherhood, meditation, self-help, spirituality, and service.Colin is still active in both 12-step and Dharma recovery, running meetings and staying connected. The Island & The Source:They call the Berkshires “The Source” (or “the island from Lost”) and reflect that Chris might have needed to stay there.Dopey Origins:Ted recalls Chris calling Dave from their house, excited about starting something. They joke about Ted's long resistance to appearing on Dopey, and how his job working with kids made him hesitant to be publicly associated with drug stories. He recently shared his full story with his students.Legacy of Chris & Dopey Growth:Dave reflects on how Chris's death helped grow the show in ways that feel bittersweet.Ted and Colin say they thought Dopey was “so dumb” when it started but now are blown away by what Dave's done with it.Robot Legs Story:Ted shares a picture of Chris's titanium leg braces, used to treat ankle issues from drinking.Chris once tried to trade the $5,000 robotic legs for heroin—the dealer said no.Cookie & Classic Dopey Returns:Dave plays a classic voicemail from Tim in Philly:Shoots coke in KensingtonReggie and Cookie join himReggie says Cookie gives “the best head”Tim says no, but once the coke hits—he caves instantlyThey do the drugs in Reggie's mom's house, possiblyClassic filthy, funny, dark Dopey stuffThrowback to Dopey Episode 71:Dave plays a full classic Chris segment:Shooting cokeEuphoric recallLego hot dog standsMeeting speakers“Built-in forgetters”Chris's obsession with scale, smell, and push“Favorite part was waiting for the rush before it hit”Final Thoughts:Dave shares how much he misses Chris.Notes the podcast would not exist without him.Chris is still part of it every week.Reflects on his old sponsor telling him “you have to step over bodies,” which he rejected.Chris's death has saved lives.Dopey grew because of him—but Dave would trade it all to have him back.
