Climate Change Litigation on Behalf of Young People, with Julia Olson (extended version)

Youth-Led Climate LitigationWorldwide, litigants are turning to the courts as a forum for fighting climate change, filing lawsuits against governments in an attempt to force climate action. Plaintiffs in these lawsuits are often children and young adults, who represent those most affected by government climate inaction. A notable early example of youth-led litigation related to climate change was in the Philippines in the 1990s, where forty-three students sued the Philippine government to protect their village's forest. Though the case was initially dismissed in lower courts on the ground that the students were children and did not have legal standing to sue, the students ultimately won their case and deforestation was halted. In the United States in 2015, twenty-one young people, the organization Earth Guardians, and climate scientist James Hansen (collectively, “plaintiffs”), represented by lawyers from the organization Our Children's Trust, sued the U.S. government in a case called Juliana v. United States of America. The plaintiffs alleged that the U.S. government, in not taking sufficient action to fight climate change, knowingly violated their Fifth Amendment due process rights to life, liberty and property, and knowingly violated its commitment to protect public lands. In 2020, the Ninth Circuit Court of Appeals dismissed the case on the ground that the legislative and executive branches have the power to address climate change, not the judicial system. Still, despite the ruling, Juliana v. United States catalyzed a climate litigation movement across the country and world, and a documentary film about the case increased its impact. The Ninth Circuit's ruling did not end the case, which was sent back to the district court for further proceedings. In June 2023, the district court granted the plaintiffs' motion for leave to amend their complaint. Plaintiffs are hoping to survive additional motions to dismiss so that the case can proceed to trial.   Our Children's Trust has sued state governments on behalf of young people in all fifty states. Although most of those cases have been dismissed, the first of these cases to go to trial was Held v. Montana in June 2023. Additionally, in September 2023, Navahine F. v. Hawaii Department of Transportation is set to go to trial. These trials are the first in the United States involving youth-led constitutional climate cases, with the plaintiffs both using language from Montana's and Hawaii's constitutions to make their case. Is Climate Change a Question for the Courts?This is an ongoing debate. The Ninth Circuit Court of Appeals rejected the Juliana v. United States case in 2020, with the majority opinion concluding that climate change is an issue for Congress and the Executive Branch to handle, rather than the judicial system. But Hawaii's First Circuit Judge Jeffrey Crabtree argued, in response to lawyers for the Hawaii Department of Transportation who made a similar argument, that Navahine F. v. Hawaii Department of Transportation should be allowed to go to trial. Judge Crabtree wrote that “the courts unequivocally have an important and long-recognized role in interpreting and defending constitutional guarantees.” A separate and difficult legal question concerns the nature and extent of the public trust doctrine and what duty might apply to the government. The courts will need to wrestle with that set of issues if the cases reach the trial stage. Who is Julia Olson?Julia Olson is Executive Director and Chief Legal Counsel of Our Children's Trust, the organization representing the youth plaintiffs in the climate change litigation discussed in this article. She earned her law degree (JD) from the University of California College of Law, San Francisco (then known as UC Hastings) in 1997 and began her legal career representing grassroots conservation groups working to protect the environment, organic agriculture, and human health. Multiple banks have pledged to clean up their fossil fuel funding with net-zero carbon commitments, but they continue business-as-usual, pushing for profit by championing destructive projects responsible for driving climate chaos. The 2022 annual report, Banking on Climate Chaos [http://www.bankingonclimatechaos.org], revealed that fossil fuel financing from the worlds 60 largest banks has reached nearly $4.6 trillion in the six years since the adoption of the Paris Climate Agreement, with $742 billion in 2021 alone. On this show recorded in 2022, we delve into the Banking on Climate Chaos report with Ruth Breech from Rainforest Action Network [https://www.ran.org/], one of the organizations that authored the report. She discusses how these findings underscore the need for banks to immediately implement policies that end their financing for fossil fuel expansion. Moreover we highlight some of these projects causing climate chaos and the worldwide movement of communities coming together to demand that the financial sector get out of the oil and gas business altogether. On this episode of the Sisters in Alchemy podcast, Crystal and Jenna go deep into Spirit Guides, including who and what they are, what you can ask them about, how they communicate with you, and what to be aware of when connecting with them. As usual, Crystal and Jenna share from their own knowledge and experience, hoping to open your mind up to new possibilities or remind you of what you already know. They discuss Spirit Teams which are teams of nonphysical beings that are assigned to each individual soul for this incarnation on Earth, either for a short time or the entire lifetime. It is a delight to share this conversation with 18yo permaculture leader, Sierra Robinson, on the show today on International Youth Day 2020. Sierra is an articulate and inspiring permaculture activist (practical activist = [pr]activist) and teacher from Vancouver Island, Canada. She gave a brilliant permaculture TEDx talk when she was 17yo in Seattle entitled Beyond Sustainability: A Call for Regeneration. Sierra is also a Regional Crew Director for Earth Guardians - a global youth organisation run by and for young people. She's an aspiring filmmaker and when we spoke to her, she had just finished her homeschooling. Sierra has been around permaculture for 10 years and completed her first permaculture design course when she was only 12yo. We talk about Adam and Connie’s organizations and backgrounds, the scale and scope of the LaVA project, its impacts, the harmful effects of road building on the ecosystem, lack of environmental analysis and oversight, similarities to the Four Forests Initiative in Arizona, rewriting the rules of the National Environmental Policy Act to allow for ambiguity, history of fires and logging on the Medicine Bow National Forest, how we should be managing our forests, the false promises of “Forest Heath” initiatives, climate change, forest resiliency and the Forest Service burying scientific information in support of their motives. Four of the Earth Guardians organization climate activists - people without solutions who demand someone else comes us with solutions, are getting press for their upcoming March 15, 2019 Climate Strike, getting youth to demand that Oasis-Crazy's Green's Newest Disaster get adopted. This is a ridiculous deal that won't achieve much of anything for a long time, while these same youth activists have been and continue to refuse to end global envir illiteracy, end our disposable society, gain individual cooperation, be leadership by example, hemp and last the clean energy that is in the ridiculous legislation they promote. So these youth activists are ridiculous and fraudulent, which I let them know in an email today. I also told them that since they continue to prevent real solutions from being implemented now, to drop their fraudulent climate case and close Earth Guardians doors.

Earth Guardians Youth Director Xiuhtezcatl Martinez is a 17-year-old indigenous climate activist, hip-hop artist, and powerful voice on the front lines of a global youth-led environmental movement. At the early age of six Xiuhtezcatl began speaking around the world, from the Rio+20 United Nations Summit in Rio de Janeiro, to addressing the General Assembly at the United Nations in New York city. He has worked locally to get pesticides out of parks, coal ash contained, and moratoriums on fracking in his state and is currently a lead plaintiff in a youth-led lawsuit against the federal government for their failure to protect the atmosphere for future generations. Xiuhtezcatl has traveled across the nation and to many parts of the world educating his generation about the state of the planet they are inheriting. His message has inspired youth to join the front lines to combat the environmental and climate crisis that is impacting their future, as well as form Earth Guardian crews in over 30 countries. His work has been featured on PBS, Showtime, National Geographic, Rolling Stones, Upworthy, Aljazeera, The Guardian, Vogue, Bill Maher, Skavlan, WE Day, AJ+, CNN, MSNBC, HBO, VICE, and many more. In 2013, Xiuhtezcatl received the 2013 United States Community Service Award from President Obama, and was the youngest of 24 national change-makers chosen to serve on the President’s youth council. He is the 2015 recipient of the Peace First Prize, recipient of the 2015 Nickelodeon Halo Award, 2016 Captain Planet Award and the 2016 Children’s Climate Prize from Sweden. Bill Mckibben of 350.org calls Xiuhtezcatl “an impressive spokesman for a viewpoint the world needs to hear.”

As Buffalo Springfield sang in 1967, “There’s something happening here…” But today’s youth revolution is happening far beyond the Sunset Strip. The Trump administration’s dismissal of climate change as a legitimate concern is energizing a new generation of teenage activists. Emboldened and supported by groups like Earth Guardians, Heirs to Our Oceans and the Alliance for Climate Education (ACE), young people are taking their knowledge of climate science into the streets and into the courts, pressing for environmental change and for more government action now to protect their future and ours. UPDATE: Since this discussion was held the fossil fuel trade association, which aligned itself with the federal government, changed their minds, and asked to withdraw from the case. Phil Gregory, one of the attorneys representing the 21 young people suing the federal government, explains what that withdrawal means. Saving energy tops the list of more and more people who are improving their homes and for the people who do the work to improve them. The latest issue of Green Builder magazine surveyed contractors and other green pros about who’s best when it comes to lights, water heaters, deck materials and other stuff used in building and improving homes. Joining us is CEO Sara Gutterman. More than half of all marine species may be at risk of extinction by within the next 100 years unless we make significant conservation efforts. That’s according to the organization WildEarth Guardians, which has been making a lot of those efforts including helping the six types of fish which were just added to the list of protected species by the Endangered Species Act. Joining us is Bethany Cotton from Wild Earth Guardians.

As Youth Director of the international youth activist group, Earth Guardians, Xiuhtezcatl has spoken to many students around the world, addressed the United Nations General Assembly, served on the US President’s Youth Council, and received the US Community Service Award from President Obama.

At the end of November, national leaders will meet in Paris, France for the United Nation’s COP 21 to try to put together a new treaty to replace the Kyoto Treaty which expires in 2020. With atmospheric CO2 levels continuing to rise, this may be too little too late.It is up to our communities to take action now. Courtney White who has published a new book, “Two Percent Solutions for the Planet: 50 Low-Cost, Low-Tech, Nature-Based Practices for Combatting Hunger, Drought and Climate Change” speaks about ways that communities can work together now to lower carbon footprints and sequester carbon. Xiuhtezcatl Martinez, youth director of the Earth Guardians, works locally and globally fighting pollution and fossil fuel extraction.
