In a copyright case closely watched by content creators, the U.S. Supreme Court held, 7-2, that the first fair use factor—“the purpose and character of the use” —weighed against Andy Warhol's use of Lynn Goldsmith's black-and-white photograph of Prince to create a colorful silk-screen illustration of the musician that was later licensed to Vanity Fair without Goldsmith's consent. Justice Sonia Sotomayor, writing for the majority, first explained that courts analyzing the first fair use factor should balance “the degree to which the use has a further purpose or different character” against the “nature of the use,” whether commercial or nonprofit. Under that rubric, the Court next found that even though Warhol's illustration “adds new expression to Goldsmith's photograph,” the first fair use factor favored Goldsmith because the works shared “substantially the same commercial purpose”—Goldsmith's photograph and Warhol's illustration were both “portraits of Prince used to depict Prince in magazine stories about Prince.”

Do Beat Tags Actually Prevent Theft? Producers use beat tags to prevent theft of their beat. If you catch someone using your beat without buying the proper rights (license), this is grounds to proceed legal action.. But, the beat WITHOUT a beat tag is still your copyright.. the beat tag is just one of those things like an extra layer of security to prevent theft, but if someone had amateur audio skills, they could still cut out your beat tag, and keep the beat looping over and over.. The fact is, it's YOUR COPYRIGHT, and a beat tag doesn't change that.. it just helps prevent theft, and helps your brand. Should you still use beat tags? Yes, of course! They help your brand, and prevent theft by making someone do extra work to steal it.. but your copyright to that beat remains regardless of your beat tag over your beat or not. Agreements Regarding Copyright Ownership.. The power of digital products is non-exclusivity. You can re-sell it over and over.. and if someone wants the exclusive-rights to something, that's when the big money can come in.. but even then, exclusive-rights is very dangerous and can hinder your business because you may never benefit from it again.. unless you state it in the terms! You must think about NOW and in the FUTURE to decide the offer presented is worth it to you. If you think $300 today is worth it, then that's the decision you made! If you find out 3 years later that your work is generating $10,000+ a year.. it's a lesson learned! Even now, in the age of serial divorces and polyamory, when marriage is as flexible – and even disposable – as it ever has been, devoted husbands and wives succumb to temptation.When looking for evidence, partners usually turn to spy apps. These secretive phone apps track everything a person does and where the person goes.In addition, camera technology has advanced a lot in the past few years. They keep getting smaller and smaller, making it possible to conceal them any which way.Spycam manufacturers have been creative in producing some of the most cleverly disguised (and tiny) camera/DVR systems, complete with HD video, motion detection, large storage card support and remote controls.In many ways, technology makes infidelity easier to pull off. Spouses can hold erotic video chats, send “pins” that mark their favorite meeting spots, and exchange images and text with their lovers in countless different ways. An actual tryst requires people to be physically present in the same place, but foreplay can happen anytime, anywhere – and the faithful may have no idea.At the same time, years of marriage will hone a spouse's instincts, and we often know when something seems funny. Computers, tablets, and smartphones absorb adulterous evidence like a sponge, and once suspicions are aroused, tech can offer many clues about a potential dalliance.Let me be clear: The best thing you can do is have a frank and honest conversation with your spouse about your marriage. Couples therapy can work wonders. However, if your relationship wasn't healthy to begin with, or you need something tangible before starting divorce proceedings, these are basic methods for busting a cheater.1. A Hidden or Locked PhoneMany people turn their phones away from others to protect their privacy. However, most of us don't hide our phones from our spouses. This gesture is subtle, but it can suggest illicit text conversations. Cheaters are often protective of their phones; they don't share their passwords, and they even change their passwords to keep their phones' content a secret.Push notifications are a nightmare for unfaithful spouses, because they may show snippets of conversation – from texts, emails, and so on – that could incriminate both parties. Spotting a suspicious push notification, or even noticing the sudden absence of them, can be suggestive.2. A Second PhoneThe easiest way to keep two romantic lives separate is to buy two separate phones. That way, the cheater doesn't get confused and text the wrong person by mistake. The existence of this second phone is also a liability, even if it is described as a “work” or “emergency” phone.Another technique is to purchase a separate SIM card, which can be switched out of phones that have been “jail-broken.” This is a lot of work and unlikely for most cheaters, but if you find a SIM card lying around, you may be able to extract its data by inserting it into another phone.3. Scanning Any Digital ReceiptsReceipts are often sent by text message or email. If you have access to your spouse's online accounts, you may be surprised to find these digital receipts for products and services you've never heard of. (Read: hotels, restaurants, jewelry stores). Most people don't leave a physical “paper trail,” but virtual documentation often persists.The same goes for frequent flyer miles and credit card points, which a cheater may spend on a fling. Cheaters often go to great lengths to avoid using their checking and credit card accounts, but there are many other ways to pay for a rendezvous, from Groupon to Paypal to Venmo, and they will still leave a trace of their transactions.4. Try to Find Their PhoneMany popular devices utilize some form of location technology and often make it easier to have the service turned on than to disable it. If your spouse uses an Apple device that is connected to a family account and they have enabled location sharing, you can locate their device by logging on iCloud.com and clicking on Find My iPhone or by using the Find My Friends app.If your spouse uses an Android phone and is logged on to Google on a shared computer, you can type "Find My Phone" into the search bar, and you'll be provided with the phone's location.5. Then, Look to GPSAs we become more reliant on GPS these days, you may also want to take a peek at your spouse's location history. For Google users, the "previous destinations" menu option on the navigation system may chronicle your spouse's movements; for Android users, the Google Timeline feature (found in the Google Maps app or Google Maps online if they are logged in) functions similarly.If your spouse uses an iPhone, there is one place to be sure to look. Many people don't even know this treasure trove of tracking exists.You can find their frequent locations in Settings > Privacy > Location Services > System Services > Significant Locations. It takes a fair amount of effort to consistently disable or delete these types of settings so if they are up to no good, you're likely to find something here.6. Search Every Letter of the AlphabetCheaters would have to be pretty stupid not to clear the search histories on their browsers. If they routinely access dating sites, especially hook-up services like Ashley Madison and AdultFriendFinder, they will probably think to cover their tracks, unless they like flirting with disaster as much as attractive strangers.Auto-fill is harder to remember. Search engines like Google do a remarkable job of guessing your search parameters, based on everything you have ever searched before.If you share a computer with a suspect spouse, you may intend to type “Megalodon,” and instead the words “Megan Granger home phone number” flash across the field. Take this a few steps further. Start typing each letter of the alphabet and see what pops up.7. Check Any Cloud ServicesThe most dangerous habit for cheaters is to send photos and video. These media may spice things up, but they are vivid evidence of an affair, and such materials can be used as evidence in divorce proceedings – especially if a betrayed husband or wife can save or download copies.To keep these images and video covert, cheaters may have a special cloud service. For example, the Keepsafe Photo Vault is designed to both store these media files and prevent others from accessing them. Many customers use Keepsafe for work or personal reasons, but if you notice that your spouse has a Keepsafe account and you can't figure out why, you may be onto something.Two similar services are Vault and Hide It Pro, which were created to store photos and video and protect them with a PIN. They also function similarly to cloud services like Google Drive, Dropbox, and Apple's Cloud, but security is their top priority. Be sure to check on Amazon Prime because this service gives you a place to store your photos, too.8. Secret Messages Hidden in Audio or Photo FilesIf your cheater is savvy, he or she may know how to secretly embed an image into an audio or picture file. You think it's a familiar song or a landscape shot but a steamy pose might be hidden behind the notes and trees.It's easy to make these files and even easier to distribute them unnoticed. Tools like DeepSound or QuickStego make this point-and-click work for the casual cheater. The snoop usually suspects nothing unusual. The files appear to be ordinary. You need to know a special keystroke or code to unlock the files.Technological espionage is the least-healthy way to address these problems, and you should only use these techniques as a last resort. Infringing on your spouse's privacy can cause even more damage, and certain kinds of infringements are bona fide illegal.
It can happen - Learn how and what to do about it
Like any long-term relationship, marriage, or business, America's history includes successes and sadness, trials and triumphs, horrors and happiness, and mistakes and milestones. Through it all, Americans have protected life, liberty, and the pursuit of happiness. Infringing upon those rights always leads to turmoil. Those rights have been put to the test in 2020 in ways we've never seen in our long history. The continued masking and muzzling of Americans and the growing expectation of mandatory vaccinations are three examples. Inquiring about the logic leads to malice and hatred from the mob that chooses to comply without question. Asking for proof of safety and effectiveness leads to attacks of one's credibility. Meanwhile, many businesses remain closed. People see other people everywhere, wearing masks, which further reinforce fear. In my opinion, it's even worse for the kids who go through this. And taking this beyond COVID-19, people are more afraid than ever to have an opinion about anything. If they do, and the wrong person hears it or takes it out of context, the mob will come after them, their career, or their reputation. As a result, many Americans aren't standing up for other Americans anymore. They're only standing up for the mob. More than ever, we need Americans to stand up for the rights afforded all of our citizens and the values that make our nation the greatest in the world. That's why I will remain unmasked, unmuzzled, unvaccinated, and unafraid. Unmasked Why do so many people willingly cover their faces with masks that have no proof they reduce the risk of spreading coronavirus? After all, wearing a mask to keep the virus from escaping your mouth is like covering yourself with a chain-link fence in the woods, so you don't get bit by a mosquito. Why do people wear a mask when there's no science to show it's safe for extended periods? Breathing in your expired air is lower in oxygen and higher in carbon dioxide than unmasked air. There is no long-term research to show that’s smart or safe. Of course, if you choose not to wear a mask, you're immediately labeled as selfish. People will tell you you're going to kill others. "You don't wear a mask for yourself; you wear it for others." Or, "You wear a mask to slow the spread." Nice try with the peer pressure. Prove that the masks stop a 125 nm virus particle. Prove that breathing through a piece of cloth is harmless. Heck, even prove that keeping people from getting infected is a good idea. Nobody has shown that a mask is effective at anything other than spreading more fear, and providing a way to trigger virtue signaling. Unmuzzled The first amendment states: Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.U.S. Constitution As of late, this amendment only applies to people with specific ideologies. If your values are different from the far-left mob, you're likely to be silenced, threatened, or canceled. You could put your career on the line if you say, "I support President Trump." When the threat to your livelihood or reputation is significant enough, what do you do? Most people give in to the pressure and remain silent. They avoid speaking out, posting on social media, or joining a march against the "wrong" cause. As long as they keep their opinions to themselves, they can remain safe from persecution. Do you know where that sort of behavior takes place? In communist countries. Not in America. You’re supposed to be able to say whatever you want. As long as your words don’t constitute a physical threat, you’re free to share them. In the words of Martin Luther King, Jr., A man dies when he refuses to stand up for that which is right.

They are censoring – and, in fact, facilitating the expungement – of information that will allow people the opportunity to decide for themselves, and now they are attempting to intimidate those who don’t agree with their preferred narrative.This is – and I mean this literally – the institution of Orwell’s “Newspeak”:“Newspeak is the language of Oceania, a totalitarian superstate that is the setting of George Orwell's dystopian 1949 novel Nineteen Eighty-Four. To meet the ideological requirements of English Socialism (INGSOC) in Oceania, the ruling Party created Newspeak,[1] a controlled language of simplified grammar and restricted vocabulary, meant to limit the freedom of thought – personal identity, self-expression, free will – that threatens the ideology of the régime of Big Brother and the Party, who have criminalized such concepts into thought crime, as contradictions of INGSOC orthodoxy.”Is this not exactly what Facebook is doing? They are deciding – for you – what is harmful and what is not; what is truth and what is not; what is acceptable and what is not. They are dictating what the truth is, even as relevant questions abound on the issue of COVID-19 and how the government has handled the event. This is the very antithesis of freedom, by definition.Facebook will hide behind their stance that because they are a privately owned company they have the right to execute censorship on such a grotesque level. But because their product has an extraordinary effect on shaping our cultural narratives, I suggest they are bound by laws that safeguard our First Amendment rights to freedom of speech, freedom to redress government, and freedom of assembly, titrated to the 21 Century modes of communication.To that extent, it is without a doubt – and would be extremely hard to argue otherwise (although I am not about to be as hypocritical as Facebook as to say only my opinion counts) – that Facebook is:• Infringing on every user's constitutional free speech right by way of filtering information to only a preferred narrative (censorship)• Infringing on every user's constitutional right to redress their government by stifling opposing viewpoints to the government-issued narrative (censorship)• And infringing on every user's constitutional right to freely assemble by way of intimidating people into demurring their true thoughts on a subject for fear of being openly ridiculed (read: warned) by the Facebook “community standards” thugs.Merriam-Webster Dictionary defines “monopoly” thusly:“...exclusive ownership through legal privilege, command of supply, or concerted action; exclusive possession or control; a commodity controlled by one party...”In that definition, they use an analogy by Helen M. Lynd that applies, “No country has a monopoly on morality or truth.” This necessarily needs to be true of social media behemoths as well. No all-encompassing social media entity has a monopoly on morality or truth. This is especially applicable to Facebook and Google (the former of which owns Instagram and the latter of which owns YouTube), who both have a disproportionate stranglehold on information on the Internet.It is well past time that the US Department of Justice takes action against Facebook and Google in the form of antitrust lawsuits meant to break their monopoly over information on the Internet. The precedent for this move comes in the break-up of the Bell System in 1982.We, the American people, are at a moment in time – boots on the ground real-time – when Facebook and Google are making a grab at our freedom to acquire information, all under the emotional guise that they are protecting the public interest. They are not protecting the public interest. They are stealing freedom from the people.It is time that we stand up to this tyranny before Newspeak is commonplace, and freedom is redefined.
