John McAfee is the founder of the software company McAfee Associates. McAfee Associates achieved early success as the creators of McAfee, the first commercial antivirus software. Since leaving McAfee Associates, he has founded the companies Tribal Voice (makers of the PowWow chat program), QuorumEx and Future Tense Central, among others, and has been involved in leadership positions in the companies Everykey, MGT Capital Investments and Luxcore, among others. His personal and business interests include smartphone apps, cryptocurrency, yoga, and all-natural antibiotics. He resided for a number of years in Belize, but returned to the United States in 2013. McAfee is also a political activist, who sought the 2016 Libertarian Party nomination for President of the United States in the 2016 election, losing to former New Mexico governor Gary Johnson. McAfee announced his second bid for president in June 2018, for the 2020 presidential election. His main campaign issue is to promote the use of cryptocurrencies. He stated that he will either again seek the nomination of the Libertarian Party, or form his own party; he ultimately ran as a Libertarian. In a tweet, on March 4, 2020, McAfee simultaneously suspended his 2020 presidential campaign and announced his campaign for the Libertarian party vice presidential nomination. The next day, he returned to the presidential field, reserving the suspension of his bid, as "No one in the Libertarian Party would consider me for Vice President." The next month, he endorsed Adam Kokesh; he simultaneously became Kokesh's vice-presidential candidate. We’ve got electricians, we’ve got plumbing and we’ve got mouse ears! That’s right, the Short Time Wrestling Podcast is heading to Orlando. My wife and kids and I will head to Disney World. We’ll be hitting a few different places, spending time by the pool, sweating, having breakfast with Cinderella and everyt hing else that goes with it. My seven-year-old has been writing about this on the dry erase board for months, while my three-year-old would rather watch PJ Masks, which isn’t a Disney thing. This, however, is the Short Time Wrestling Podcast and I’m still working without a proper studio, so I’m still doing the solo show topic episode. Last time, we had a lot of great feedback with the pro wrestling topic. Before we get to all that - a quick hit on the Yianni-Zain thing. While I wasn’t at the NWCA Convention, I did get word there were some ideas being tossed around about the NWCA All-Star Classic and the future of that event. This prompted me to ask you what your favorite All-Star Classic match of all-time was. So before we get to those answers, let’s give you a little bit of backstory on the event. The East-West All-Star Classic first started in 1967 and was held after the season in Stillwater, Oklahoma. The event continued to be an East-West dual meet through 1987 when the team scoring component was taken out of the event. In 1973, the event moved to an in-season event, taking place in late January or early February until 2004. The NWCA opted to put the event in November to avoid matchups being dumped amidst concern for seed protection and coaches citing injury concerns so close to the postseason. The late November date went for eight seasons before the NWCA moved the event to the opening weekend of the college wrestling season in order to make it a kickoff weekend for college wrestling. The last two events have featured a large presence of women’s college wrestlers, which the NAIA has already created women’s wrestling as an invitational sport, while the NCAA is close to granting women’s wrestling emerging sports status. One of the most recent complaints coming from fans is that the event hasn’t been a real “All-Star” event because there are so few No. 1 vs. No. 2 wrestlers. Statistically, only one dual in recent memory (Penn State vs. Ohio State in 2017-18) featured as many All-Americans and top-ten wrestlers than the All-Star Classic typically does. Denver in 2018-19 was a notable exception as the card was split between men and women. This will be the 54th edition of the NWCA All-Star Classic. No, I do not yet know where the next edition will be, but before I get to your responses on your favorite All-Star Classic match of all-time, let’s go back to Stillwater, Oklahoma and then-Gallagher Arena, they didn’t add the Iba until later. Of the 11 weight classes – yes 11 – we had eight individual NCAA champions, and 21 of the 22 wrestlers were All-Americans. In addition to the eight champions, we had three runners-up, three thirds, two fourths, three fifth-place wrestlers and two sixth-place finishers. How many 1 vs. 2 rematches did we have? NONE! That’s right. But we did have a number of weights that shifted. At 115 pounds, third-place Glenn McMinn of Arizona State beat runner-up Jim Anderson of Minnesota 3-2. The two didn’t meet during the tournament, with McMinn falling in the semifinals to eventual champion Rick Sanders of Portland State. Sanders pinned McMinn in the quarters and then beat Anderson 19-2, in the pre-technical fall era, in the finals. 115-pound champion Rick Sanders went up to 123 pounds where he tied Michigan’s Bob Fehrs, the runner-up at 123, 2-2. Fehrs had just finished second a third straight year, losing to Lehigh’s Mike Caruso in the finals. That’s not second just a third year in a row. Fehrs lost to Caruso all three years in the finals. At 130 pounds, it was Caruso, the aforementioned champion at 123, who went up to defeat Colorado’s Jim Hanson 6-3. Hanson was fourth, having fallen to Michigan State’s Don Behm 9-5 in the semifinals. Hanson fell to Caruso’s teammate, Joe Peritore, 11-5 in the consolation final. So is that what you get? You lose to the 130-pounder, so they feed you the 123-pound champion? At 137, Don Behm, who finished second at 130, fell to Oklahoma State’s Gene Davis, who was third at 137 just a few weeks earlier. Davis fell in the semifinals 1-1, 0-0 in a referee’s decision to Portland State’s Masaru Yatabe. Yatabe would then lose to Michigan State’s Dale Anderson. At 145 pounds, Oklahoma State’s Jim Rogers finished fourth at the weight and got the nod against 137-pound All-American Don New of Cornell. New was fifth, having lost to Yatabe on the top side and Gene Davis in the consolation semis. Rogers lost in the opening round to Mike Gluck of Wisconsin, the eventual finalist. Back in those days, we had something that’s pretty much the repechage back then. Seriously. The only difference is there’s no double bronze back in 1967, which proves, yes, even us Americans had systems that were completely “meh” at times. Rogers would win this one 8-5. At 152 pounds, UCLA’s Lee Ehrler, who was third at 160 pounds, came down to defeat Michigan NCAA champion Jim Kamman 8-7. Ehrler was one of three wrestlers who came down to new weights in the event. Kamman defeated Oklahoma’s Wayne Wells 6-5 in the 1967 finals, while Ehrler was bested by Vic Marcucci of Iowa State 10-8 in the semifinals. Marcucci would beat Cleo McGlory of Oklahoma in the finals. At 160, Joe Domko of Southern Illinois, known then as SIU-Carbondale, knocked off Marcucci 3-2. Domko, a three-time qualifier, came into the 1967 NCAA tournament as the fifth seed. He was pinned in the opening round by Adams State’s Don Apodaca. Apodaca was then beaten by No. 4 seed Jeff Smith of Oregon State, eliminating Domko. Domko was the only non-All-American in the meet. At 167 pounds, George Radman of Michigan State, a Granby High School alum from Virginia, beat Washington State’s Fred Fairbanks in a matchup of wrestlers who met at their postseason weights. Radman won the national championship, beating Mike Gallego of Fresno State in the finals. Gallego, who was the College Division champion, put Fairbanks into the consolation bracket in the second round with a 7-1 decision. At 177 pounds, Northern Iowa’s Don Parker came down from 191 pounds and topped Moravian’s Dave Mucka 5-3. Porter was sixth, falling to Syracuse’s Tom Schlendorf in the quarterfinals. Well, coming “down” isn’t exactly accurate. Parker wrestled the University Division at 191 after winning the College Division earlier at 177 pounds, where Mucka was fourth. So while Parker went up and placed sixth, Mucka stayed at 177 for the University Division where he too would finish sixth. At 191 pounds, Syracuse national champion Tom Schlendorf beat Iowa State’s Don Buzzard in the NCAA finals 5-0. Schendorf would face off with 177-pound national champion and future world champion Fred Fozzard of Oklahoma State. Schlendorf would prevail 5-3 in the ONLY head-to-head matchup of NCAA champions. Fans waited with anticipation to talk about the results 14 days later when the results arrived via First Class Mail in Amateur Wrestling News. What if the message boards existed in that era? Man, the stories our predecessors would be able to tell us. At Unlimited, Dave Porter of Michigan got a little bit of redemption as he pinned NCAA champion and future Pro Football Hall of Famer Curley Culp of Arizona State at 3:38. Porter was the top seed in the NCAA tournament and the returning champion. Would-be messageboards would have melted down after he was upset 5-4 by NAIA champion Nick Carollo of Adams State in the quarterfinals. Porter fought back after Carollo made the finals. Culp dispatched with Carollo in the NCAA finals in just under a minute. So there’s your look back at the FIRST NWCA East-West All-Star Classic. Adam Kokesh is a man on a mission. A while back, I put out a call to my audience for interesting guests I might bring on the podcast. Adam was one of the first names dropped, and was quickly seconded. He was ready to make that happen, so we got the ball rolling, and I'm very glad we did. The dude has passion flooding out of him, and it's all about dismantling the onerous federal government in a methodical and systematic way, then returning the function of government back to the states, and removing the compulsory participation in any government whether federal, state, county or city. Many of you know I'm a radical personal-sovereignty advocate, and this is a message I can get behind. It was a pleasure to sit down and have a conversation with a man who's making a serious attempt to win the presidency so that he can abolish the position immediately after signing the necessary executive orders to abolish the federal government. In the conversation, we touch on his motivations for this mission, a brief rundown of how it would work, why he thinks it's possible to make this work, and quite a lot more. There's no end of concepts and principles in this episode, and it will lead you to consider things in a new light if you're not already of the Libertarian bent, and even if you are, the actual prescription for accomplishing the goal is much more lucid and rational than the narrative of thoughtless abolishment of the government in favor of instant anarchy. It was a great conversation, which went well beyond the hour which Adam was originally prepared share. He was very easy to talk to, charismatic and relatable, and there's an obvious and open depth to the man that is truly refreshing in a man running a campaign to become President of the United States, even if for only a day. On June 5, 2017, the Supreme Court decided Kokesh v. Securities and Exchange Commission. In 2009, the Securities and Exchange Commission (SEC) alleged that Charles Kokesh had violated various securities laws by concealing the misappropriation of roughly $35 million in various development ventures dating back as far as 1995. Since the 1970s, the SEC has ordered disgorgement in addition to monetary civil penalties in its enforcement proceedings. In effect, the violator must not only pay monetary civil penalties, but also “disgorge” the profit he or she gained by the unlawful action. Under 28 U. S. C. §2462, however, a five-year limitations period applies to “an action, suit or proceeding for the enforcement of any civil fine, penalty or forfeiture” when the SEC seeks monetary civil penalties. In Kokesh’s case, the District Court concluded that the five-year limitations period did not apply to disgorgement. The U.S. Court of Appeals for the Tenth Circuit affirmed, holding that disgorgement was neither a penalty nor a forfeiture within the meaning of section 2462. As a result Kokesh could be required to disgorge the full $35 million, with interest. -- By a vote of 9-0, the Supreme Court reversed the judgment of the Tenth Circuit. In an opinion delivered by Justice Sotomayor, a unanimous Court held that disgorgement, as it is applied in SEC enforcement proceedings, operates as a penalty under section 2462. On June 16, 2017, the Department of Justice (DOJ) issued a Declination to Linde North American Inc. and Linde Gas North America LLC (collectively “Linde”). This is the first Declination issued by the DOJ in the era of the Trump Administration. For that reason alone, it was instructive and should be studied by the compliance profession. However, the case presented several interesting factors which merit consideration so we are discussing in depth to present lessons to be learned for the Chief Compliance Officer (CCO) or compliance practitioner. The Bribery Scheme Linde acquired Spectra Gases, Inc. (Spectra Gases) in October 2006. In November 2006, it purchased certain assets from the National High Technology Center (NHTC) of the Republic of Georgia. One of the keys to this purchase was a piece of equipment called the ““boron column,” which were used to produce boron gas.” Sales of boron gas after the acquisition helped fund the purchase price and payout to Spectra executives who stayed on after Linde purchased Spectra Gases. Unfortunately, the three Spectra executives who stayed on were in cahoots with corrupt offices from the NHTC who made the sales agreement with Linde. Part of the Earn-Out by the former Spectra (now Linde) officials was paid to these corrupt government officials, both directly and through certain third parties. But the funding scheme to pay the bribes was quite creative and demonstrates once again to the compliance practitioner the myriad ways in which funds can be generated to pay bribes. For reasons not made clear, Linde did not purchase the boron column outright but allowed the former Spectra executives and the corrupt NHTC officials to form two new entities to own and operate the boron column, Spectra Investors LLC (Spectra Investors) and Spectra Gases Georgia, which was wholly owned by Spectra Investors. Spectra Investors was owned 51% by the corrupt NHT officials and 49% by the Spectra Gases executives who now worked for Linde. Spectra Gases Georgia was formed as a separate management company, by the NHTC officials, which was claimed to provide services to Spectra Investors for which it would receive recompense. Of course, there was no evidence of services being delivered under this arrangement as it was simply a mechanism to funnel monies to the corrupt officials. As a result of the ownership structure of Spectra Investors, with 51% being owned by corrupt NHTC officials and the management services contract, the corrupt NHTC officials received “approximately 75% of the profits generated by the boron column” while Spectra Gases received 25% of the profits. Clearly even with bribery and corruption, it was a bad business deal. In January 2010, Linde dissolved Spectra Gases and became its successor-in-interest and at some point later discovered the illegal conduct. Prior to the time of the dissolution, Spectra Gases had “received approximately $6,390,000”. After Linde became the direct owner, it “received approximately $1,430,000 as a result of the corrupt” actions. The Declination While there is a dearth of fact about how the matter came to the attention of Linde and when it disclosed the matter to the DOJ, the decision to decline to prosecute was based on the following factors: (1) Linde’s timely self-disclosure; (2) a “thorough, comprehensive and proactive investigation” [emphasis supplied]; (3) Linde’s full cooperation and meeting the Yates Memo requirement for disclosing all known relevant facts about the “individuals involved in or responsible for the misconduct”; (4) full profit disgorgement; (5) Linde’s enhancement of its compliance program and internal controls; and (6) Linde’s full remediation, including termination or discipline of the three Spectra executives and lower-level employees involved in the misconduct; termination of the fraudulent management contract between the corrupt NHTC officials and Spectra Investors and termination of the Earn-Out payment due to the former Spectra executives who became Linde employees. The company also made the following payments. Lessons Learned This was yet another Foreign Corrupt Practices Act (FCPA) action where a company performed insufficient due diligence in the acquisition phase. The timing of the Linde purchase of Spectra Gases and Spectra Gases’ purchase of the income producing assets is too close in time to be a coincidence. It would certainly appear that Linde purchased Spectra Gases to facilitate its acquisition of the boron column and other assets. If your company is going to make such a multi-step acquisition, you must perform due diligence on all the actors and the assets involved. The Byzantine corporate structure created for the ownership of the boron column, its operation and management contract are clear red flags that any CCO should sniff out immediately. While I am sure the internal corporate excuse for this clear ruse was the ubiquitous ‘tax considerations’; every such transaction should be reviewed by compliance as well. Anytime there is more than one entity to accomplish one task, there is the possibility of fraud present. Further, it is not clear how Linde could not have been aware of the ownership interests of a company which it ultimately controlled. It would seem that the company did not even make any inquiry. Even in 2006, the Republic of Georgia’s reputation for bribery and corruption was quite high. The 2006 Transparency International-Corrupt Perceptions Index (TI-CPI) listed Georgia at 99 out of 176 countries listed so that alone warranted red flag scrutiny. If you are purchasing an entity in a country with such well known affinity for corruption, extra care is warranted. Perhaps back in 2006, Linde did not view the FCPA as something which it would deal with in such a situation. Yet even with all the apparent miss-steps and non-steps of compliance, the company was able to secure a declination from the DOJ. While there may be some additional penalties or sanctions by the Securities and Exchange Commission (SEC) for the failures of internal controls, the result obtained by Linde was certainly a superior result. The company would seem to have met the four pillars under the FCPA Pilot Program through (a) self-disclosure, (b) extraordinary cooperation, (3) full remediation, and (d) profit disgorgement. Interestingly, the profit disgorgement in this case would appear to have been beyond the five year of limitations for profit disgorgement under the recent Supreme Court decision in Kokesh. If there is a FCPA enforcement action brought by the SEC perhaps additional facts will be recited in any resolution documents. Nevertheless, kudos are due to Linde and its counsel for obtaining this declination. Every CCO should study it for both the superior result received and underlying facts to see if you face anything similar in the Republic of Georgia or elsewhere. In the case of Kokesh v. SEC, the US Supreme Court held the profit disgorgements operate as a penalty under the Securities and Exchange Act of 1934, as amended. As such “any claim for disgorgement in an SEC enforcement action must be commenced within five years of the date the claim accrued.” The position of the Securities and Exchange Commission (SEC) at the Supreme Court and in all other matters involving this issue was that profit disgorgement were not punitive, hence not a penalty but rather remedial in nature so the SEC could clawback all monies generated as a result of the illegal action. The decision, authored by Justice Sotomayor, was a 9-0 opinion which in the rarified world of Supreme Court decisions is about as clear a message as one can get. The Court first determined that profit disgorgement met the definition of a “penalty” under two basis, “First, whether a sanction represents a penalty turns in part on “whether the wrong sought to be redressed is a wrong to the public, or a wrong to the individual.” Second, a pecuniary sanction operates as a penalty if it is sought “for the purpose of punishment, and to deter others from offending in like manner” rather than to compensate victims.” [citations omitted] Thus, if a statute provided a compensatory remedy for a private wrong, it should not be characterized as penalty. The Man", Kokesh has been a passionate activist upon his return from the Iraq War. Today, Kokesh joins The Higherside to educate us on the violent role of the federal government and detail how he believes a society rooted in personal responsibility is the most viable option to restore freedom and circumvent oppression. 2:22 As an activist, author and champion of causes ranging from Iraq Veterans Against the War to gun rights, Kokesh has a rich and complex history of advocacy. Greg and Adam begin by walking through a few experiences that helped set him on a path to activism. Adam explains, his experience of Libertarianism began as far back as high school, slowly proliferated into a more philosophical perspective, and eventually expanded into an ethical examination of our society and political system. Kokesh also elaborates on how his military experience facilitated his disenfranchisement, the circumstances that lead to his 2010 Congressional campaign, and the inspiration behind his book "FREEDOM!". 9:42 Adam discusses how his activism landed him in jail. He begins by elaborating on the catalyst that put him on the radar, his Youtube video "Freedom Plaza", in which he loads a shotgun in close proximity to the White House. As a passionate proponent of gun rights, Kokesh articulates on how he believes matters such as gun control should be decided and what the future holds for technological advances in weaponry. 14:37 Greg and Adam debate the merits of gun rights and whether gun control should be deemed a violent policy, or if the very presence of weapons can be considered an act of aggression. 19:50 Despite understanding the elite's agenda to create a fearful and obedient society, using false flags and coordinated acts of terrorism being sold as random chaos, escaping the campaign of mass manipulation can be difficult. And, while we would love to believe it is only institutionalized acts of bloodshed that pose the real threat to public safety, stupidity is another factor that cannot be ignored. Adam examines not simply the tools of violence, but the prevalence of violence in society, and how it's foundation is rooted in the nefarious actions of governments worldwide. He also addresses critiques of this anti-government perspective and offers possible approaches to achieving this Libertarian utopia. 27:00 Kokesh clarifies the finer points on how we can ensure everyone evolves equally and there is a shift in paradigm even with the absence of an enforcement class. Adam Kokesh is a self-described "anarcho capitalist," talk show host, activist, and author of "Freedom." A decorated Marine, Adam served during the Iraq War. The atrocities and inhumanity he witnessed during that conflict convinced Kokesh of war's fundamental immorality. He began to campaign for peace and to advocate nonviolent resistance to the abuse of power. Indentifying himself, as, among other things an anarchist, voluntaryist, agorist, and libertarian, Kokesh has called for a "new American revolution" and for the "orderly dissolution of a federal government he claims is drunk on power to the point of oppressing its' citizenry. Kokesh and other activists participated in a flash mob silent dance at the Jefferson Memorial in Washington, D.C. in protest of a recent ruling against dancing in the monument. Kokesh along with four others were arrested by US Park Police for demonstrating without a permit.
THE BARN BIRDS are a collaboration between veteran North Carolina Americana songsmith/guitarist Jonathan Byrd and Northwest singer/fiddler/guitarist Chris Kokesh, known for her work with Misty River. Jonathan and Chris Kokesh met in 2007 and dubbed themselves the Barn Birds when they made their first recordings together. The duo's self titled album is an album about romantic love expressed with sophisticated musicality, smart songs and great sound. Byrd and Kokesh include songs written with and by Amy Speace, Anthony da Costa, Carey West, Corin Raymond, Anais Mitchell, Rob Vaarmeyer, Luke Dick, and the late Jack Hardy. MELISSA FERRICK signed to Atlantic Records in the mid-�90s. Ferrick was part of a new wave of alt-rock females�including artists like Liz Phair, PJ Harvey and college-mate Paula Cole�who sang about womanhood with sharp, unchecked honesty. Morrissey proved an early champion when he personally invited her to tour as his opening act, and Ferrick eventually went on to found her own label and release a string of albums and EPs (more than 16 to date) in which she played almost every instrument herself. She tours regularly and plays to packed houses across the U.S. Her latest is 'the truth is' on MPress Records.
