Averill's Book, Love in the Lav Series, Episode #2 of 4. In 1746, Charles Hamilton, a doctor, married Mary Price in Wells, England. Hamilton was a traveling doctor, selling patent medicines and dubious medical advice, and had met Mary when staying in a rented room. After the wedding, Mary joined Charles in traveling and selling cures for a couple of months until suddenly, she decided she no longer wanted to be married – and to get out of the relationship, Mary went to the local court and reported that her husband Charles Hamilton was, in fact, a woman. The revelation that Hamilton was assigned female at birth but lived their life as a man enchanted the public, and, as much as something could in the 18th century, went viral. Hamilton's story was then immortalized in a fictionalized story called The Female Husband. Thus, the concept of a “female husband,” or a person assigned female at birth but living as a man, including serving as a husband, entered into the consciousness of the Anglo-American world. The history of female husbands like Charles Hamilton and many others prove not only that queerness has always existed, but that gender itself has always has been messy, flexible, and contested. Political analysts are thinking a lot these days about the rule of law: where it comes from, what sustains it, how it can break down. Those are hard enough questions in themselves. And, yet — they simplify away an important complexity. They assume that there is only one law that rules. As our guest today, Dr. Egor Lazarev – assistant professor of political science at Yale – points out to us, in many parts of the world, the question is not just whether the law will rule – it's also which of many legal orders will prevail. In his recent book State-Building as Lawfare: Custom, Sharia, and State Law in Postwar Chechnya, Egor studies a setting in which different legal systems have evolved over time and coexist side by side – with matters like marriage, divorce, and murder sometimes being adjudicated by state judges, sometimes by religious courts, and sometimes under customary rules.Egor first gives us a helpful primer on the Chechnyan civil wars and their central role in the making of Putin's Russia. We then talk with him about how customary law, Sharia law, and state law operate alongside each other in Chechnya and how those seeking the protection of the law decide which legal order to turn to. As Egor explains, Chechnya is far from unique in displaying what he calls “legal pluralism.” Scholars estimate, for instance, that over 60 countries formally recognize some form of customary or traditional law alongside state law.For the most part, this is a conversation about two things. First, we might expect that government actors would do all they can to suppress competing legal systems and ensure the primacy of state law. Why, then, do we sometimes see state leaders doing exactly the opposite? Egor tells us about the strategic conditions under which government officials will choose to intentionally strengthen customary or religious law relative to state law – and why a strategy that looks like it would diminish the power of state actors can actually enhance their legitimacy and authority.This is also a conversation about gender and the law. In his book, Egor argues that the core social divide at the center of legal pluralism is a gender cleavage. Many struggles over social control often revolve around the regulation of female sexuality, around marriage and divorce, property inheritance, and honor and shame – and the different legal orders handle these issues very differently. We talk with Egor about the gendered impacts of state, customary, and Sharia law and about why Chechen women – particularly in the wake of two brutal, socially disruptive civil wars – have been turning to the state judiciary far more than Chechen men.We hope you enjoy this conversation. About Kent Lehnhof Kent Lehnhof earned a BA from Brigham Young University and a PhD from Duke University. He is Professor of English at Chapman University, where he specializes in early modern literature and culture, especially the works of William Shakespeare. Dr. Lehnhof has published two dozen scholarly articles, has co-edited two essay collections, and is coming out with a new book in October titled Voice and Ethics in Shakespeare's Late Plays. In this book and in many of his articles, Dr. Lehnhof treats Shakespeare's plays like lively enactments of ethical philosophy. He believes that one of the things that makes Shakespeare's work distinctly Shakespearean is its interest in exploring what it's like to be in relation—what it's like to be tied to other people, some of whom love you, some of whom hate you, and some of whom pay you no mind at all. At present, Dr. Lehnhof is finishing a guidebook for Arden Shakespeare called Understanding Shakespeare's Plays: A Candid Companion to All the Drama. This book goes through all the play, one by one, giving an overview of each and offering insights and analysis as to what it offers. Between 304 and 589 CE, China was divided into rivaling regimes occupying North and South China. While the north was controlled by a series of non-Han Chinese peoples, ultimately culminating in the Xianbei Northern Wei, the south was ruled by ruling houses of Han Chinese descent. In this companion episode to the interview ith Scott Pearce on the Northern Wei, Professor Andrew Chittick joins us to discuss the Southern Dynasties, from their development, to their society and culture, to their relationship with their northern neighbor, and finally to their legacy. Contributors: Andrew Chittick: Andrew Chittick is the E. Leslie Peter Professor of East Asian Humanities and History at Eckerd College, St. Petersburg, FL. His research focuses on the culture of early south China and maritime trade relations with Southeast Asia. He is the author of numerous articles and two full-length books: Patronage and Community in Medieval China: The Xiangyang Garrison, 400-600 CE (SUNY Press, 2010) and The Jiankang Empire in Chinese and World History (Oxford University Press, 2020). The latter book introduces a ground-breaking new perspective on the history and political identity of what is now south China in the early medieval period (3rd-6th centuries CE), including its evolving ethnic identity, innovative military and economic systems, and engagement with broader Sino-Southeast Asian and Buddhist cultures. Yiming Ha: Yiming Ha is the Rand Postdoctoral Fellow in Asian Studies at Pomona College. His current research is on military mobilization and state-building in China between the thirteenth and seventeenth centuries, focusing on how military institutions changed over time, how the state responded to these changes, the disconnect between the center and localities, and the broader implications that the military had on the state. His project highlights in particular the role of the Mongol Yuan in introducing an alternative form of military mobilization that radically transformed the Chinese state. He is also interested in military history, nomadic history, comparative Eurasian state-building, and the history of maritime interactions in early modern East Asia. He received his BA from UCLA, his MPhil from the Hong Kong University of Science and Technology, and his PhD from UCLA. He is also the book review editor for Ming Studies. First, we'll discuss what the experience of immigrant communities was like in England during the Tudor and early Stuart periods--were the English people xenophobic or welcoming to others? We'll look specifically at experiences of Dutch and French immigrants, who made up the majority of immigrants to England in the mid-late 1500s. Then, we'll take a look at England's attempt to colonize Ireland through Essex's campaign in the late 1590s and how English anxieties about foreign invasions while also attempting to invade Ireland may have influenced Shakespeare's writing of King Henry V.
