It's now been eight months since Hurricane Helene wreaked havoc in western North Carolina and permanently altered numerous communities. And while the recovery work continues, one vitally important area that deserves much greater attention than it's receiving is preparation for the next natural disaster. Depressing but true: we're hurtling toward human-caused climate collapse and our political-economic system, captured by capitalist elites intent on squeezing out profits until the day our civilization collapses, is effectively incapable of responding by itself. It must be forced: but how? Petitions haven't worked. Rallies haven't worked. Posting on Instagram hasn't worked. And ****ing up pipelines, sexy though it might be, hasn't worked. So while purists call for mass eco-insurgency and liberals circulate change.org petitions, the A22 Network has responded by organizing and mobilizing huge numbers of committed militants around the Western world, using large-scale civil disobedience as a tactic to push governments to adopt basic climate policies. These tactics have been controversial but successful: Just Stop Oil, the British branch of A22 perhaps best known for throwing soup at a Van Gogh, recently disbanded itself because its main demand — that the UK government cease approving any new oil and gas exploitation projects — has been adopted. In Episode 81 we chat with Laura Sullivan, a spokesperson for Last Generation Canada, which is the Canadian branch of the A22 Network. We talk about Last Generation's demands, the tactics used by the group, combating the freeze response often provoked by discussions of climate collapse, and preparing for revolutionary conditions as things inevitably deteriorate. This week on the Hemp Podcast we bring you Part One of our coverage of the Lancaster County Hemp Circuit, a two-day, four-farm hemp event that shone a bright light on hemp in Pennsylvania and attracted attendees from all over the U.S. and a few foreign countries. On Part One of our Hemp Circuit coverage on the podcast, we hear from a handful of out-of-state attendees. We'll hear a few impressions of the county. “It's beautiful farmland,” said Larry Smart, a plant breeder and head of the hemp program at Cornell University. “I'll just say the roads here are twisty and turny. We're used to straighter roads in the Finger Lakes, but the landscape is just spectacular.” We'll hear how Pennsylvania fits into the national hemp industry landscape. Bert James, a North Carolina farmer and co-founder of hemp seed distributor KonopiUS, called Pennsylvania a “hemp playground, in the way that they have access to so many different varieties. There's a good latitude. They've got good soil.” “So there's a lot of potential here, but we're going to obviously need to get some processing online to serve this opportunity,” he said. And we'll hear why Pennsylvania might just be the perfect place for the intersection of business, innovation and opportunity. Larry Serbin, from Hemp Traders in California, is impressed with the farmers and Amish machine shops in Lancaster County. He said he is working with some folks in Pennsylvania to develop “green decorticating” techniques. “The hemp would be decorticated in the field, which would result in farmers earning a lot more money for the crop and the cost of the hemp raw materials, like the hurd and bast fiber, to be about half what they are now,” Serbin said. On this episode, we will hear from: Morris Beegle, WAFBA;  Eric Singular, International Hemp; Larry Smart, Cornell University; Wendy Mosher, New West Genetics; Larry Serbin, Hemp Traders; Laura Sullivan, University of Vermont; Bert James, KonopiUS; Rusty Peterson, IND HEMP; David Suchoff, NC State;  Keith Harvey, UGP Global Energy Upcoming Hemp Events: Sept. 11 Kifcure Hemp Harvest Open House https://kifcure.com/event/kifcure-hemp-harvest-open-house/ Sept. 12 Cornell University Fiber & Grain Field Day https://rchemp.com/2024-hempcrete-workshop/ Sept. 20-22 Right Coast Hemp Hempcrete Workshop https://rchemp.com/2024-hempcrete-workshop/ Thanks to our Sponsors! Friends of the late Boston police officer John O'Keefe took the stand in Norfolk Superior Court Wednesday, offering emotional testimonies in the ongoing Karen Read murder trial. This came after key witness Jennifer McCabe endured a third day of grueling cross-examination. The trial, centering on the death of O'Keefe, who was found unresponsive outside a Canton home on January 29, 2022, has seen dramatic developments, particularly surrounding McCabe's involvement and testimony. Defense attorney Alan Jackson's cross-examination of McCabe focused on alleged inconsistencies in her accounts and controversial Google searches made on her phone. Jackson presented data showing McCabe searched "how long to die in cold" hours before O'Keefe's body was found. J McCabe, visibly emotional, defended her actions, stating, "I did not make that search at that time. I never would have left John O'Keefe out in the cold to die because he was my friend that I loved." She claimed she was researching a basketball team for her daughter around that time and that the search for how long it takes someone to die in the cold was conducted later at Read's request.   Read, charged with second-degree murder, among other charges, has pleaded not guilty, with her defense team arguing that she is being framed. During cross-examination, McCabe was questioned about her relationship with state police investigators and conversations she had about the case in group chats.  Following McCabe's testimony, Kerry Roberts, Laura Sullivan, and Marietta Sullivan took the stand, each sharing emotional recounts of their interactions with O'Keefe and the events surrounding his death. Roberts, one of O'Keefe's closest friends, described the frantic search for him, ending with Read discovering his snow-covered body. She recounted the panic and efforts to revive him, stating, "Read panicked and ran around the scene, asking if she hit him and whether he was dead." The Sullivan sisters provided context to the relationships and tensions leading up to O'Keefe's death, particularly an incident during a New Year's trip to Aruba. Laura Sullivan recalled Read accusing O'Keefe of kissing her sister, causing apparent tension.  As the trial progresses, the defense continues to challenge the credibility of the prosecution's witnesses, while the prosecution aims to solidify the timeline and motivations behind the tragic events. The case remains a focal point of public and media attention, with the court sessions revealing intricate details about the night of O'Keefe's death and the complex relationships between those involved. This case remains critical in understanding the complex interplay of relationships, alleged actions, and the tragic outcome that led to O'Keefe's untimely death. Historical markers dot the American landscape. They are on the sides of roads, in parks, rest areas, in the middle of nowhere. They purport to offer a glimpse into the past, marking a moment or place of significance worth remembering. But a year-long investigation by NPR's Laura Sullivan found these makers present a fractured and confused telling of the American story. Some share humor and joy but many present a version of history that's been distorted or outright fictionalized with offensive lies.Learn more about sponsor message choices: podcastchoices.com/adchoicesNPR Privacy Policy

This week on the show, rabble labour reporter Gabriela Calguay-Casuga sits down with Laura Sullivan, a spokesperson from On2Ottawa.  “We are ordinary Canadians stepping into nonviolent civil disobedience to get urgent government action on the climate crisis, starting with the formation of a permanent, professional national firefighting agency sized to meet the enormity of the crisis.  The climate crisis is real and it is now. We face the consequences daily. Canadians are dealing with fire, flood and drought because our governments have been failing us for decades. Until we zero our emissions it will keep getting worse.” – https://on2ottawa.ca/   On2Ottawa is calling on the government to implement a National Firefighting Agency that trains and employs 50 000 firefighters, and legally binding citizen's assemblies to address the climate crisis. The campaign is in the midst of its first action phase, disrupting traffic to call for action on these demands.  Sullivan has been with On2Ottawa since its creation early this year. She's been arrested twice, for painting Woolly the Mammoth, a statue in the Royal BC Museum, and painting the iconic "Toronto" sign in Nathan Phillips Square to draw attention to the On2Ottawa campaign.  If you like the show please consider subscribing on Apple Podcasts, Spotify, or wherever you find your podcasts. On this week's podcast we talk to Laura Sullivan, a fiber artist living and working in Vermont. She works at University of Vermont Extension, growing hemp fiber in the research trials at Borderview Research Farm in Alburgh. Through her work with textiles and hemp, she has come to a revelation that clothing is agriculture — or at least should be agriculture. She points to traditional ways of spinning and weaving. “Almost every culture around the world did this,” Sullivan said. “So it's almost universal in that way. And those fibers were all derived from the soil. So in that sense, to me, clothing is originally agriculture and can also be agriculture again in the future.” Her work at the Extension fiber trials gives her access to hemp fibers. But because there is no infrastructure in the Vermont to process hemp fiber, she does it all by hand. “I use all antique hand equipment to do my processing, and it's not ideal by any means,” she said. From retting and breaking, to sketching and hackling, spinning and scouring, she takes us through the whole process. During the interview she talked about the importance of fibersheds. “A fibershed is a commitment to work within the geography of a land base,” Sullivan said. “It's a way to belong to each other and the land.” The fibershed movement asks: Where is fiber in our environment, and how can we work with it? Domestically produced textiles are at an all-time low, thanks to the now-replaced North American Free Trade Agreement, she said. “In 1990, 50% of clothes worn in the U.S. were made here,” Sullivan said. “And now that figure stands at 2%. So in a very short amount of time, we have completely offshored the entire industry.” And at what cost? “The textile industry was the biggest employer of people in rural America, and namely women and those without diplomas. So we've really lost a lot in that, especially in a state like Vermont, where we are largely rural and agrarian. It's just a huge missed opportunity,” she said. Sullivan is hopeful that industrial hemp can revitalize the domestic textile industry. Criminal procedure (2023): Post-sentencing: Exoneration + Habitual offender

Law School

Play Episode Listen Later Feb 9, 2023 7:30

Exoneration occurs when the conviction for a crime is reversed, either through demonstration of innocence, a flaw in the conviction, or otherwise. Attempts to exonerate convicts are particularly controversial in death penalty cases, especially where new evidence is put forth after the execution has taken place. The transitive verb, "to exonerate" can also mean to informally absolve one from blame. The term "exoneration" also is used in criminal law to indicate a surety bail bond has been satisfied, completed, and exonerated. The judge orders the bond exonerated; the clerk of court time stamps the original bail bond power and indicates exoneration as the judicial order. Based on DNA evidence. DNA evidence is a relatively new instrument of exoneration. The first convicted defendant from a United States prison to be released on account of DNA testing was David Vasquez, who had been convicted of homicide, in 1989. Recently, DNA evidence has been used to exonerate a number of persons either on death row or serving lengthy prison sentences. As of October 2003, the number of states authorizing convicts to request DNA testing on their behalf, since 1999, has increased from two to thirty. Access to DNA testing varies greatly by degree; post-conviction tests can be difficult to acquire. Organizations like the Innocence Project and Centurion are particularly concerned with the exoneration of those who have been convicted based on weak or faulty evidence, regardless of DNA evidence. As of October 2003, prosecutors of criminal cases must approve the defendant's request for DNA testing in certain cases. Monday, April 23, 2007, Jerry Miller became the 200th person in the United States exonerated through the use of DNA evidence. There is a national campaign in support of the formation of state Innocence Commissions, statewide entities that identify causes of wrongful convictions and develop state reforms that can improve the criminal justice system. As of December 2018, 362 people in the U.S. had been exonerated based on DNA tests. In nearly half of these cases, faulty forensics contributed to the original conviction. Per February 4, 2014 NPR article, Laura Sullivan cited Samuel Gross, a University of Michigan law professor stating that exonerations were on the rise, and not just because of DNA evidence. Only one-fifth of the exonerations last year relied on newly tested DNA, a little less than a third of exonerations occurred due to further investigation by law enforcement agencies. According to a 2020 study, DNA exonerations in rape cases "strongly suggest that the wrongful-conviction rate is significantly higher among black convicts than white convicts." --- Send in a voice message: https://podcasters.spotify.com/pod/show/law-school/message Support this podcast: https://podcasters.spotify.com/pod/show/law-school/support

MR: This week on Minnesota Native News, a new state judge brings a wealth of Indian Country expertise.  And a new partnership gives Native students a place to practice traditional ways. I'm Marie Rock.MR: How can a lawyer who works on behalf of tribes make the most impact? Reporter Emma Needham tells us how and why Colette Routel became a judge.EN: Colette Routel is a professor of law and co-director of the Native American law and sovereignty Center at Mitchell Hamline School of Law in St. Paul. Her role is about to change.  The Walz administration just appointed her to be a  judge for the Hennepin County 4th Judicial District. CR: 1:25 One of the reasons that drew me to apply for this position is just looking at the unfortunate disparities that exist. In Minnesota, and in particular in Hennepin County.2:40 I know that native people often get left out in statistical studies, that you don't even realize the disparity exists.2:19 I thought, this is a way to use kind of my expertise and knowledge, as well as to you know, once you identify a problem, then you can also seek to find a solution to it.EN: Over the course of her 20 year career, Colette Routel has primarily represented Indian tribes. She has also worked on the bench for the White Earth and Shakopee Tribes. Routel sees this experience as both a benefit and a chance to make change. CR: 5:03 I think having the diversity of experience that you have when you're representing tribes doing criminal work doing Child Protection work during, during treaty rights, housing, you know, all of that will assist me when I'm handling a really broad docket of cases in Hennepin County. EN: Hennepin County judges handle around 40,000 cases a year, a number that some lawyers might find daunting.  12:08 But for me, it gives you an opportunity, I think, to make to make an impact.19:19 No matter how the system is set up, if you have a really good judge, you can make a great impact.EN: Colette Routel has worked hard to make sure the Mitchell Hamline law degree is accessible to Native people wherever they live. Most of the curriculum is online. 8:51 our primary emphasis for many years, and I would say that continues, is really to attract, admit and graduate native attorneys who are going to work for their home communities. EN: Routel says she hopes one of them might fill HER shoes at Mitchell Hamline.CR: 20:50 I think my experience kind of shows that it's, you know, how helpful it is to have representation and hopefully there will be many native people appointed to the, to the bench in the next several years.MR: New funding from the legislature means more teaching AND learning in Afton. Here's Emma Needham again. EN: Anishinaabe Academy is not your average Minneapolis Public School. This K-5 Environment provides Anishinaabe and Dakota Programming through the native cultural lens.LS: my my Winnebago name is Jorge meninga, or do the walks at night. So I am to your clan.EN:  Laura Sullivan is a member of Ho-Chunk Nation and has been principal of Anishinaabe Academy for about 10 years. The school has both Anishinabe and Daktoa tracks, including language learning.EN: Anisinaabe Academy already devoted their courtyard to native medicines. This fall thanks to Legislative Funding, Anishinaabe Academy will partner with the Belwin Conservancy. Belwin provides conservation, education, and immersive experiences on 1,500 acres in the Saint Croix Valley. LS: And so we start brainstorming, how can we bring our medicines here so our kids could actually harvest our medicine. So sweet grass and sage, more specifically, we do have cedar trees, as well. But how can we have have that be a part of who we are here, and as far as a school and community, um, and so then when we started talking to belwin, and sharing, you know, what our dream was, we were just blown away by their offer of, well, let's write something together so that we can make this happen. EN: Principal Sullivan says the partnership will benefit both the students at Anishinaabe Academy, and the scientists at Belwin. LS: One of the one of the exciting things is, and I loved it, because Belwin folks right away said, they really want it to be a two way partnership, that they realize that there's lots that they can learn from us.The gift there is it's not only that learning for themselves, but there's also knowledge that they can share with other folks that come to Belwin. EN: Anishinaabe Academy Prinicipal Sullivan says that changes are already happening, and that the school is open to working with other programs and schools. She encourages interested parties to reach out.  LS: We are we are very much an open door. people ever have any questions we also have not just our website our school website has some stuff but our Facebook anishnaabe Academy Facebook if people want to find out more about who we are that's the place to go.

What came of French President Emmanuel Macron’s call for ordinary citizens to lead a European political renaissance? Well it happened. Sort of. Twenty-six other European Union member states minus the UK agreed to go along with the French idea. During the past year hundreds of consultations, dialogues and debates have been held across Europe. These events amount to a new and experimental approach to connecting citizens to Europe. But they also look a lot like a Tower of Babel, lacking a common format, branding and goals, because national and European authorities retained so much individual control. We talk to Corina Stratulat of the European Policy Centre and Laura Sullivan of WeMove.EU about a form of democracy that's only going work if authorities Let it Go. Don't miss Laura's tribute to Queen Elsa who, by relinquishing her gloves and tiara, gained more mastery over her powers. Surely there's a message for Europe. First, Tom and James talk acronyms and abbreviations — including those that designate organisations and institutions meant to open up Europe to citizens and to quell criticism from eurosceptic forces. Using laptop-straining technical wizardry, and with the expressed intent of moving into more accessible, mainstream territory, Sam and Chris get stuck into a glut of new dispatches. Central to this episode are two outside contributions. Chris presents a dispatch from Laura Sullivan, who brings us some stories of strangers from Australia, and Sam bags an exclusive interview with 'The Guy From Star Wars'. In between is the patented DFTCB mix of songs, poems and borderline unlistenable sound art about subjects as various as rust, new year's resolutions and contactless card payment systems. Genuinely surprised that one or both of their laptops didn't die in the process, Sam and Chris may have accidentally forgotten the plan to be more mainstream and accessible...

People from Australia, Brazil, Israel, Croatia, Korea, Kenya, India, and many other countries, participated by making videos on their cell phones and sending them to Laura and will make you so happy. A group of children in Uganda, who were once homeless, sing and dance like they are the richest kids in the world. A fire department of tough guys from New Jersey gives it their all. The result: EPIC. 27 languages included in one song and video about love and unity. The video was released on April 9, 2014. It received over 50,000 views, and was accepted on the Ellen DeGeneres online Tube channel the first week of its release. “I was hoping to get a lot of participation, but what I received back was beyond my wildest dreams. People from all over the world and from every walk of life sent in incredible videos.  Watching them moved me to tears. I hope I have honored these hundreds of wonderful people by including them in the video.” says Laura. The resulting video, with the blending of the many voices, faces, and languages, creates a powerfully moving experience that shines a light on the unifying power of love in our world. 50% of the music proceeds of 900 Voices are going towards the national nonprofit Little Kids Rock. This organization partners with economically disadvantaged school districts to run music programs. To date they have served more than 325,000 children in 13 states.

No two individuals are exactly alike, and no schema can fully capture our particular essence or personality. Yet it is sometimes helpful to speak about different temperaments or "personality types." One of the largest personality type groupings distinguishes between "extroverts" and "introverts," with certain studies recognizing between 30 and 50 percent of people as introverts. Society at large, and Mormonism in particular, seems to have a bias toward extroversion--fitting more easily those persons with larger, perhaps more recognizably adventurous personalities, often seeming more at home in large group social situations. For this reason, we often find more extroverts than introverts in leadership positions, and most cultural forms seem to forget that many people are not extroverts! We are missing a lot! Each personality type has wonderful strengths, and lead individuals to different approaches to life situations and problem solving, and involve preferences and abilities that are distinct and unique--and quite complementary of each other. In this episode, panelists Laura Sullivan, John Hatch, John Shaw, and Greg Nelson--who all self-identify as introverts--join Mormon Matters host Dan Wotherspoon in a wonderful tour of the various ways the world presents itself to introverts. The discussion describes aspects of the introverted personality type and preferences, debunks misconceptions and stereotypes, and highlights introverts' strengths and the areas and types of interaction in which they excel. Each panelist also shares their own stories of how wonderful it has been for them to come to see themselves as introverts and to embrace it rather than constantly trying to bend themselves toward society’s (wrongheaded) "extroversion ideal." After defining introversion in general terms, the panelists share experiences in Mormonism that they experience differently than do extroverts, and how their introversion strongly shapes their interests and spirituality in terrific, wonderful ways that Mormonism would be all the richer for if it were to recognize them, as well as come to better utilize the introvert's gifts. This is a fantastic episode for introverts, parents and spouses and friends of introverts, and church and community leaders!
