The Supreme Court has long had incredible authority to make decisions that affect millions of Americans. But in recent years, it has increasingly used its power to make stealth emergency decisions without public hearings or explanations. The cases that we often hear about on the high court's so-called merits docket only represent about one percent of what the court decides. Since the mid-2010s, 99 percent of SCOTUS rulings, including ones increasingly related to consequential issues like abortion, immigration and COVID restrictions, have taken place on what some legal scholars have taken to calling “the shadow docket.” What does this obscure procedure mean for each of us? Steve Vladeck is the Charles Alan Wright Chair in Federal Courts at The University of Texas School of Law. He's also author of a new book, “The Shadow Docket: How the Supreme Court Uses Stealth Rulings to Amass Power and Undermine the Republic.” He joins WITHpod to discuss how we got to this moment, what the shadow docket means for the rule of law and strategies for ameliorating inconsistencies in the court's process.
It's Hump Day! Sam hosts Ian Millhiser, senior correspondent at Vox, to discuss the upcoming cases that will be before the Supreme Court this term. Sam starts off by touching on the recent revelations surrounding Tucker Carlson's text messages disclosed from the Dominion lawsuit, and how he still isn't buying that these are the reasons Fox ultimately let him go. Then, he touches on former Bush Attorney General and "Serious Person" Michael Mukasey's appearance at the Senate Judiciary Committee hearing, and how Mukasey, if he were a judge, wouldn't potentially ruin a friendship by not going on their private jet. Then Ian joins the program, with Sam and him starting off by discussing the Supreme Court writ large, in an attempt to pinpoint just how long the institution has been fundamentally broken (hit: dating back to the Dred Scott decision, so over 100 years.) They then touch on Loper Bright Enterprises v. Raimondo, the newest case the court has taken in their desperate attempts to gut the federal regulatory state. Ian also discusses the recent "judge-shopping" that's been going on, i.e. anti-abortion advocates angling to get their cases on abortion medication like mifepristone into Amarillo Texas judge and right-wing theocrat Matthew Kacsmaryk's courtrooms so he can ideally rule in their favor. They then talk about Glacier Northwest v. Teamsters, a potentially landmark case that could determine when and how workers are allowed to strike. Finally, Ian provides a bit of a primer on cases that will be decided on this term, including cases involving affirmative action, student loan forgiveness, and Moore v. Harper, the case surrounding the validity of "independent state legislature theory" deciding contests in presidential elections. On Sunday, February 19, authorities disbanded the congregation of the Kemah Daud Christian Church in Bandar Lampung in the middle of their worship service, reports International Christian Concern. John 4:23 says, “The true worshipers will worship the Father in spirit and truth, for the Father is seeking such people to worship Him.” The devil hates when Christ followers worship their Lord. Ironically, the forced closure of the church was contrary to Indonesian President Jokowi's recent appeal and undermined the Indonesian Constitution, which guarantees freedom of worship and religion for all. In response to pushback from church leaders in this Muslim-majority nation, authorities granted the church a worship permit for the next two years while the building permit the church has submitted is being processed. Please pray for the protection and promotion of religious freedom in Indonesia. Pence and DeSantis boycott CPAC over homosexual controversy Neither former Vice President Mike Pence nor Florida Governor Ron DeSantis will appear at the Conservative Political Action Conference, reports ABC News. No doubt both likely presidential candidates are distancing themselves from Matt Schlapp, the chairman of CPAC, who has been accused of unwanted homosexual overtures. According to a report from The Daily Beast, Schlapp "groped" and "fondled" a Herschel Walker staffer on October 19th on a drive back from an Atlanta bar. The male staffer filed a lawsuit against Schlapp and his wife, Mercedes, seeking $9.4 million for sexual battery and defamation, reports Politico. Abortion Kill Pill could be declared illegal A pro-life, Christian federal judge in Texas, named Matthew Kacsmaryk, could single-handedly outlaw the abortion Kill Pill in all 50 states, reports Slate.com. A graduate of Abilene Christian University and the University of Texas School of Law, the 45-year-old Kacsmaryk served as Deputy General Counsel for First Liberty Institute, a conservative Christian legal group before President Donald Trump boldly nominated him in 2019 to serve as a United States district judge. The Washington Post reports that when Kacsmaryk was a 22-year-old law student, his 17-year-old sister got pregnant, and chose to place her baby with an adoptive married couple. That solidified his belief that every pregnancy should be treasured. According to the pro-abortion Guttmacher Institute, the abortion Kill Pill now accounts for the deaths of 53% of pre-born babies in the womb. Beyond the death of the child, medication abortion has serious side effects. They include fever, infection, pain, vomiting, diarrhea, feeling dizzy, a severe headache, heavy, prolonged bleeding for multiple weeks, incomplete abortion requiring surgical follow-up, short-lasting hot flashes, hemorrhage, blood clots, and possibly an undetected ectopic pregnancy, which is life-threatening. Plus, permanent infertility could result if a woman takes the abortion Kill Pill if an Rh negative mother is not administered RhoGAM as is done with dangerous "no-test" and telemedicine chemical abortions. Pray that Judge Matthew Kacsmaryk protects mothers and their unborn babies across the nation from the abortion Kill Pill. So, we just knew that he was very cold and needed to be rewarmed. So that was one of the main tasks that the team in Petrolia had to do and the other was providing high quality CPR.” Waylon's mother, Gillian, said she owes a lifetime of gratitude to the care team.
