The Presidency must depend on immunity from suit for things done as part of the job.Meese, Calabrese, and Lawson filed in the DC Court of Appeals a carbon copy of the Amicus brief SCOTUS never got to rule on when they kicked the case back to the DCCA. And that brief argues that Smith is not a legitimate prosecutor. His cases should be dismissed. Of course, everything he touched becomes Fruit of the Poisonous Tree. Both is prosecutions would be kicked to the curb, and all evidence is tainted.

An extremely radical Democrat party wants to destroy the Executive branch in order to stop Donald Trump from becoming president, and if the Supreme Court gets involved it could be a disaster. Jack Smith and Tanya Chutkan, backed by the Biden Department of Justice, insist that once you leave the presidency your protection is gone and have used that to bring 4 bogus charges against Trump. Jack Smith only cares about getting a conviction for Trump as quickly as he can so he can interfere in the 2024 election. Also, Democrats in the media kiss up to Hamas and report their propaganda, and now are blaming Benjamin Netanyahu for the Hamas terror attack in October and are calling for him to be removed as prime minister. What they don't want to report is that nearly 75% of Palestinians support the October 7 terror attacks against Israel. The Supreme Court has said so as well, but under President Biden and Merrick Garland not a single U.S. Attorney has brought charges against anybody. Also, Mark speaks with journalist Julie Kelly about another effort by Jack Smith and an extraordinary effort by the Department of Justice to go after Donald Trump. We don't know what the Supreme Court will do next, but if they get involved, they may rule the wrong way because John Roberts has been weak among others. This would do severe damage to the presidency and the country as we continue our descent into a banana republic. Jack Smith and Tanya Chutkan are doing the bidding of Merrick Garland and Biden by rushing Trump's case along in order to affect the 2024 election. SEASON 2 EPISODE 68: COUNTDOWN WITH KEITH OLBERMANN A-Block (1:44) BULLETIN: The District of Columbia Court of Appeals Friday afternoon halted Judge Chutkan's gag order against Trump for at least the next 17 days. Rather than deal with it on an emergency basis, it scheduled the first in-person hearing for NOVEMBER 20. The members of the three-judge panel consisting of two judges appointed by Obama and one appointed by Biden should be impeached and disbarred because they actually fell for not just a pathetically weak 1st Amendment excuse but also for a series of arguments based on the delusions-of-grandeur, megalomaniacal premise that this madman Trump believes a 100,000,000 Americans are somehow being deprived of their right to hear him because a judge had ruled no, Trump was not allowed to threaten the judge and the court officials and the prosecutors and not allowed to try to convince his cultists to try to kill them. He had already been given – BY the Judge who issued the gag order – the right to continue to insanely claim that the prosecution of his attempt to overthrow the government and foment violent revolution in this country and install an authoritarian regime with him as its permanent dictator was actually a political vendetta personally ordered by the President of the United States. All she wanted to stop was the continued attempt by Trump to use the social media site he OWNS and the propaganda video networks that make their only money by platforming him and the fascist rallies he stages to say it in just the right way to get somebody to KILL special counsel Jack Smith and to KILL judge Tanya Chutkan and to call in bomb threats to the court room and to doxx the jurors, the way he got hundreds of his cultists to attack the Capitol on January 6 and the way he doxxed Obama and one of his cultists went to Obama's neighborhood and hunted him, with the ultimate goal being obvious and evil: to institutionalize political violence and turn it into the determinative factor in how this country is not governered but RULED. Donald Trump is a terrorist. A. TERRORIST. And he has been using terrorism by proxy to destroy the laws and rules of this country, without interruption by the law or the courts for fully EIGHT years now. And when the justice system FINALLY stands up on its feet and the courts FINALLY stand up on their feet and recognize that after ALL of our other institutions have utterly failed and ALL of our leaders have failed to protect the nation against domestic terrorism in the form of Trump and his family and his enablers, when SOMEBODY finally BEGINS to do SOMETHING about it, this DC Appeals court say well, no, maybe the legal system of this country has been bending over backwards to protect the rights of this man who would destroy it and KILL anybody in it he doesn't like, but we don't see that in bending over backwards it has yet severed its own SPINE yet, so we're going to grant an “administrative stay” until at least November 20th to prove that we're great legal scholars and we're giving Trump every opportunity to get Jack Smith or Merrick Garland killed and why, yes, if there HAD been some sort of legal case against Osama Bin Laden before us in the summer of 2001 we would have delayed the injunction against him for two weeks because it's FAR more important to give people bent on destroying the United States every last ounce of their rights, than it is to protect the LAWS of this country or the JUDGES of this country or the REPRESENTATIVE FORM OF GOVERNMENT of this country itself. (17:48) The rest of this edition of the podcast is a repeat of Friday's 67th episode and if you've heard it there is no reason to listen again after this point.  SPECIAL COMMENT: Dementia J. Trump's lawyers last night filed a 35-page document to the U.S. Court of Appeals for the District of Columbia, one or two paragraphs of which asks that court to BAR Judge Tanya Chutkan from reinstating the gag order on him. The rest of it is about how wonderful he is and how much he leads in the primary polls and it sounds like the dialogue they gave Rita Moreno in the last scene of the Jack Nicholson movie “Carnal Knowledge.”  From the first (!) page: “President Trump's uniquely powerful voice has been a fixtue of American political discourse for eight years, and central to the American fabric for decades.” Well, true, like car alarms. Or Herpes. From Item 4, on Page 11: "The Gag Order violates the rights of tens of millions of Americans to receive President Trump's speech: A restriction on President Trump's speech inflicts a reciprocal injury on the rights of over 100 million Americans who listen to him…" Listen to him bout how big and strong he is and how he is better, more beautiful, more powerful, more perfect, more strong, more masculine, more extraordinary, more virile, more domineering, more irresistible and more up in the air and I may have added a little something to the text there. More importantly, but less entertainingly, Judge Chutkan hits the gas, Judge Engoron hits the roof, Judge Cannon does NOT hit the pause button. Chutkan sent a not so subtle sign to the Trump Cult that the Subversion trial will start as planned 123 days from now, and Jack Smith let Cannon know that Trump was playing her like a two dollar banjo. It began with a post by Roy, explaining why he moved to stop the vote to censure Representative Tlaib. Then Barney Rubble sub-tweeted him: “You voted to kick me out of the freedom caucus, but keep CNN wannabe Ken Buck and vaping groping Lauren Boebert…” to which Roy replied “Tell her to go-chase so-called Jewish space lasers if she wants to spend time on that sort of thing.” And Greene responded “Oh shut up Colonel Sanders” and predicted that this would all end with him reciting “powdered wig soliloquies as Americans are marched to the firing squads”and no, I don't get the reference either. Curiously silent through all this was Vaping Groping Lauren Boebert. (8:47) The remainder of this bulletin is a repeat of Friday's Episode #62 and if you've heard it there's no reason to continue to listen. Although you'll have a damn good time if you do! SPECIAL COMMENT: Trump threatens the New York judge, while Jack Smith goes not for a stronger gag order but something closer to a Hannibal Lecter mask.  “This is judicial misconduct, coupled with prosecutorial misconduct, and somebody from the state of New York must step in and stop this complete and total miscarriage of justice,” unquote. BECAUSE Trump had earlier suggested that New York's GOVERNOR should “get involved” and because he capitalized the word “State” in State of New York, he kept one foot in that shadowy region in which he's lived that life and his attorneys could argue that he was NOT asking “somebody from the state of New York” to “step in and stop this” by attacking somebody like the judge or the district attorney. The rest of the filing shows that Trump IGNORED the New York Gag Order, IGNORED it again, was called to the witness stand to explain what he said, LIED ABOUT IT – PERJURED HIMSELF – and has proven to be unrestrainable even with the Gag Order as presently constituted. Jack Smith isn't telling the Judge that Trump has violated her GAG ORDER. He is telling her that Trump has violated the ORIGINAL CONDITIONS under which she did NOT jail him until the trial starts. To resume the quote. “Accordingly, the court should modify the defendant's conditions of release by making compliance with the Order a CONDITION or by clarifying that the existing condition barring communication with witnesses about the facts of the case, INCLUDES indirect messages made publicly on social media or in speeches.” Plus, Trump's faint grip on sanity seems to be slipping and the tell on that is: he has reverted to the genuinely unfathomable dog analogies that he fell into during the most stressful times of 2015-2016. When Trump starts claiming dogs get fired, he's about to lose it. And Speaker Mike Johnson, Day 2: For a man who spent twenty years advocating for sending gay people to prison for having sex, advocating for sending doctors to prison for providing family planning, advocating for a national abortion ban, advocating for fewer laws against guns, advocating for more laws against divorce, advocating for gutting of the entire societal safety net, advocating for disenfranchising minorities and entire states, advocating for using the constitution to destroy the constitution, advocating for the forced conflation of church and state, advocating for a conservative group that makes employees swear an oath to Jesus, advocating against transgenderism, advocating against men wearing women's clothes, advocating against women wearing MEN'S clothes, advocating restrictions against Muslims, advocating against federal disaster relief, advocating for more oil and gas and against science that has proved we are all going to be KILLED by more oil and gas, advocating for that idiot Amy Coney Barrett since he met her in 1988, advocating for a limit of three terms in the House and then running for this one – his FOURTH, and advocating for the overthrow of the duly-elected government of the United States throughout the end of 2020 and the beginning of 2021. For a guy who has done nothing but comment on everything, all the time, and always wrong… so far… he sure has been Speaker of The House Mr. No Comment. B-Block (31:08) IN SPORTS: Oh boy. SEASON 2 EPISODE 55: COUNTDOWN WITH KEITH OLBERMANN A-Block (1:44) SPECIAL COMMENT: Trust me: I think the Trump Gag Order is an extraordinary and terrific thing and I've invested all my money in popcorn futures. But the real headline coming out of Judge Tanya Chutkan's courtroom is her vow not to alter the start date of the Subversion Trial: March 4, 2024. This means it doesn't get postponed beyond the election and it also SEEMS as if she is taking the idea of starting it early as a punishment for WHEN Trump violates the gag order off the table. If that's the case - and she's promised a full written statement detailing the "sanctions" if he doesn't seal his lips closed with epoxy - then there are few options for her. She can fine him, or jail him. And even if she goes for the first one he'll eventually do it so many times she'll have no choice but to go to the second one. REVOKE. HIS. BAIL. Trump already began testing the boundaries, and trying to see if he can get his Renfields to carry his water for him. And there were many tea leaves from the hearing to read - and all of them look bad for your favorite traitor. Plus I have some stuff on the Jordan Speaker vote and Israel-Hamas. But the story that actually stuns me was one I thought I saw coming. As predicted here, the other shoe after NBC going soft on Trump on The Meet The Press interview has fallen: NBC gets the 3rd Republican Presidential debate. But they have debate "partners" including the appalling Rumble (Nick Fuentes and Andrew Tate claim homes there) and Salem Radio (Charlie Kirk, Dinesh D'Souza, Jenna Ellis, Hugh Hewitt). Hewitt may be a co-moderator. Where are NBC's liberals here? When is enough enough? How much money is enough for my old protege to say "I refuse to be associated with any of this. Drop it or I'm out." I took a stance like that and I sleep well every night because of it. Rachel Maddow's voice still matters here and she's not using it. Assuming it's still - at $31,000,000 per annum - HER voice. B-Block (24:24) IN SPORTS: Marlins prove sexism still flourishes in baseball by humiliating successful General Manager. The worst National Anthem you've ever heard. (30:09) THE WORST PERSONS IN THE WORLD: PBS correspondent is genuinely startled Democratic house members correctly call Jim Jordan an "insurrectionist" (wait'll she hears about the gymnasts). Charlie Kirk's Turning Point USA gets whacked at ASU. Lauren Boebert barely knew the man she made sweet music with at "Beetlejuice" - except her campaign spent $300 at his bar. SEASON 2 EPISODE 31: SPECIAL COMMENT A-Block (1:43) Breaking: one-legged Trump invites rivals to an ass-kicking contest: “I hereby challenge Rupert Murdoch and sons, Biden, WSJ heads, to acuity tests!” Today, impossibly, infuriatingly, embarrassingly, we have now circled back to what – with the benefit of hindsight – appears to be the saddest possible thing: THE highlight of his presidency – July 2020 or perhaps earlier, when he was told to memorize an endless string of complicated, unconnected, ill-defined words and then not just remember them, but remember them… in the exact order: PERSON. WOMAN. MAN. CAMERA. TV. “I proved I was all there,” Trump said proudly, horrifyingly, again and again and again, to every interviewer, at every campaign speech, to everybody who would hold still long enough, beaming like a toddler who managed to poop in the potty chair. Mostly. “I aced it. I aced the test.” We thought those were the most humiliating things he could ever say about himself and that test, which on the mental or intellectual soundness scale is slightly above ‘put a mirror under his nose to see if he's still breathing.'  We were wrong. For last night, somebody told him about a Wall Street Journal poll showing 73 percent of registered voters believed Joe Biden is too old to run for president – a not unexpected number given that the poll was run by… a former TRUMP pollster. But in that context the second number was shocking. FORTY-SEVEN percent of registered voters in the pro-Trump poll think TRUMP is too old to run. And after a typo in the first sentence of his rage-post last night he got right to it. “A few years ago I was the only one to agree to a mental acuity test and ACED IT” (aced it, is in caps) “Well I hereby challenge Rupert Murdoch and sons, Biden, WSJ heads, to acuity tests! I will name the place and the test, and it will be a tough one. Nobody will come even close to me!” He trashed the Journal. He called it globalist. Damaged goods. Phony and rigged. He is enraged again. And that was just the start. It devolved into his claim that the true test of NON-MENTAL strength… is golf. Quote: “We can also throw some physical activity into it. I just won the Senior Club Championship at a big golf club,” (as an aside, he means his own, he said so, earlier; he cheats at all golf courses; he cheats at HIS golf courses with impunity; he cheats, literally, over his wife's dead body). “I just won the Senior Club Championship at a big golf club, with many very good players. To do so you need strength, accuracy, touch and above all, mental toughness. Ask Bret Baier (Fox) a very good golfer.” Yeah that's who I'm going to, to decide mental and physical competence.“The Wall Street Journal and Fox are damaged goods and their failed DeSanctimonious push and stupid $780 million settlement.” And the final thrust of this intellectual argument that would make Einstein weep – all in caps – “MORONS!!!" Plus, oh, just confirmation that Clarence and Ginni Thomas and Leonard Leo and Harlan Crow and Cleta Mitchell should all be in jail for life. Tanya Chutkan, the District Judge in Donald Trump's election interference case in Washington D.C., has set a date for March 4, 2024, which falls right in the middle of the 2024 Presidential campaign and does not give much time for Trump lawyers to review the evidence and form a defense. Chutkan has been commiserating with the Obama judges in D.C. on how to make this the first case to take down Trump. She purposely set a March trial date to interfere with the Florida documents case in May. Judge Chutkan does not want a fair trial, or a trial based on evidence, and there will not be due process in her courtroom which would make Stalin proud. Judge Cannon needs to file an anti-suit injunction to cease litigation being brought in D.C. so the defendants, particularly Trump, can do one trial at a time and have an actual shot of staying out of prison and having his due process rights recognized. Also, any Republican who votes against an impeachment inquiry of Joe Biden should be removed from office, because the country comes first – not their political futures. The Constitution provides a remedy for corruption in the Executive branch, and there is a mountain of evidence against Biden for his removal from office. Later, it's time to break up the cabal of radical Democrat lawyers who make up the D.C. judiciary. These lifetime Democrat judges are destroying our judiciary, justice system, and republic. They disrespect you, they disrespect the rule of law, and they are interfering in a presidential election. They are simply too powerful and too political. They've demonstrated that they've abused their lifetime appointments and have become abusive and even tyrannical. El jueves pasado Donald Trump se presentó en la prisión del condado de Fulton, en Atlanta, a requerimiento del tribunal que le acusa de haber tratado de perpetrar un fraude electoral en 2020 para revertir los resultados en el Estado de Georgia. Una vez allí se le tomaron las huellas dactilares y le fotografiaron. Esta fotografía era histórica porque se trata de la primera vez en la historia en la que a un expresidente le hacen una ficha policial. Todo fue rápido, en apenas veinte minutos el trámite quedó resuelto. Trump salió por donde había entrado y se marchó a bordo de un automóvil rodeado de una numerosa escolta. Todo estaba calculado al milímetro, incluido el uso que el equipo de Trump quería dar al acontecimiento. En apenas unos minutos la foto fue publicada y se convirtió en tendencia en periódicos y redes sociales, días después hasta se puso merchandising a disposición de los potenciales clientes en varias tiendas online con la fotografía de marras. Para Trump el juicio al que le van a someter en Georgia es una farsa, una parodia de la Justicia. Cree que él no hizo nada malo y que todo esto no es más que una vergonzosa interferencia del departamento de Justicia en la campaña electoral del año próximo. Los candidatos a las primarias del Partido Republicano ya han tenido un debate televisado al que Trump no acudió. En su lugar grabó una entrevista en exclusiva con Tucker Carlson, el antiguo presentador de Fox News, que se publicó en X unos minutos antes de que diese comienzo el debate. Con o sin golpes de efecto como el de la entrevista, el hecho es que a lo largo del año próximo Donald Trump tendrá que sentarse en el banquillo varias veces. Pesan sobre él cuatro imputaciones. La de Georgia es quizá la más grave, pero no la única. En Florida un tribunal federal le va a juzgar por retener documentación clasificada en su residencia de Mar-a-Lago cuando ya había abandonado la Casa Blanca. En Nueva York tiene pendiente el juicio por pagar con dinero de la campaña el silencio de la actriz Stormy Daniels, con quien tuvo relaciones íntimas hace años. En Washington le espera otro juicio emparentado directamente con el de Atlanta: un jurado federal le acusa de conspiración para alterar los resultados electorales de las últimas elecciones presidenciales. Este último juicio tiene ya fecha señalada, tendrá lugar en Washington el próximo 4 de marzo, es decir, dentro de unos seis meses. Para entonces las primarias ya habrán arrancado (lo harán el 15 de enero en Iowa) y sólo un día después de que comience el juicio se celebrará el Súper Martes, fecha clave en esas elecciones ya que un total de 15 Estados convocan primarias, algunos muy importantes como Texas o California que, entre ambas, envían más de 300 delegados a la convención republicana que en 2024 está programada a mediados de julio en Milwaukee. Para el equipo de campaña de Trump que el candidato pase las primarias sentado en el banquillo es una oportunidad, pero también una amenaza. Una oportunidad porque pueden emplearlo como combustible electoral para apelar al voto de los republicanos más descontentos, que ven en esto una persecución organizada contra Trump por parte del sistema. Una amenaza porque el juicio ocupará buena parte del espacio informativo y eso no es necesariamente bueno para su candidatura. De hecho, los abogados de Trump pidieron un aplazamiento. En origen se iba a celebrar el 2 de enero, ellos querían llevárselo hasta mediados de 2026. Así, en el caso de que ganase las elecciones podría autoindultarse. Pero la jueza responsable del caso, Tanya Chutkan, no ha querido demorar algo que está ya instruido. El juicio podría propulsarle dentro de su partido y que termine alzándose con la nominación republicana, pero cuando se enfrente a Biden el día 5 de noviembre eso jugará en su contra. SEASON 2 EPISODE 23: COUNTDOWN WITH KEITH OLBERMANN A-Block (1:44) SPECIAL COMMENT: Two major developments today warranting a bulletin edition: Judge Tonya Chutkan has set the start of jury selection in the Trump Subversion of the Election trial in Washington for March 4. Trump is, as I predicted this morning, EFFED. He's SO effed he's already insisting he will appeal her decision, proving he doesn't even know there is no legal means FOR him to appeal it. He is SO effed. Meanwhile in Atlanta, his former Chief of Staff Mark Meadows seems hell bent on confessing to everything - including crimes he hasn't been charged with - just to get the trial moved from state to federal court. He actually took the stand this morning and admitted to everything on the Raffensberger call (and I think I called him Ken in here. Ken pitched for the Phillies in 1954). Note: the rest of this edition is repeated from Monday's regular edition. If you've heard it, feel free to hit STOP right about here. Also: the first signs of life are appearing in the attempt to actually DO something about disqualifying Trump from the ballot under the Disqualification Clause of Section 3 of the 14th Amendment. After another mass shooting - one predicated on distinct and undeniable racism - shock and grief and rage can account for almost any reaction. But as Governor Ron DeSantis, who trades in distinct and undeniable racism and who had the gall to insist HBCUs in Florida would not be targeted when one was targeted Saturday, attended a vigil last night for the victims in Jacksonville, the crowd rightly booed and heckled him and his inanely smiling wife. And the local Democratic councilwoman made an unbelievable mistake. She told the crowd to "put parties aside. A bullet don't know a party." She could not be more wrong. A bullet not only knows a party but the bullets are there BECAUSE of a party and we damn well better say so. We have mass shootings and we have nearly unfettered civilian access to weapons of war and we have an orgy of gun worship BECAUSE of Republicans. Period. Our gun crisis may not be 100% Republican but it's 95%. Our awareness that at any moment, anywhere, anyone in this country could be murdered by sentient fecal matter and the only variables are which minority group THIS one murdered because of which Republican THIS one listened to, waxes and wanes. But there are four unswerving constants and they played out in Jacksonville over the weekend: they had the guns because of Republicans; if they didn't have the HATE already they got IT because of Republicans; nearly all of our news media will refuse to say that mass shootings in this country are the unquestioned FAULT of Republicans, and no matter what the circumstances of this particular one were, Republicans will insist it's too soon to – you know – try to STOP them from happening and to propose – you know – SOLUTIONS – is trying to exploit a tragedy for political gain. As opposed to trying to exploit a tragedy for donations from the National Rifle Association and making sure that nothing is ever, ever, done, to stop the next one. Trump's other spawn, Vivek Ramaswamy, spent Sunday morning insisting that Mike Pence he should've refused to certify Biden's election until the Senate agreed to instantly instituted new laws to mandate the most draconian Republican talking points about voting suppression: single-day elections, paper ballots, government-issued ID's, and quote “led through that level reform and then under that condition certified the election” – as if every moment of the political day is a hostage situation and every law is optional because Vivek Ramaswamy sees a loophole to exploit.  Happily that performance on "Meet The Press" earned Ramaswamy the coveted endorsement of one viewer: O.J. Simpson. B-Block (27:52) IN SPORTS: Spain's Soccer Kiss scandal continues to cascade. The Chicago White Sox still don't know how two fans got shot in the bleachers during a game. And the Oakland A's forgot they'll have to find a place to play four lame duck seasons before moving to Las Vegas (32:44) THE WORST PERSONS IN THE WORLD: Zillow mistakenly reports Trump sold Mar-a-Lago to Junior for 10 times its value ("Oops!"), Tucker and Musk are lying about the audience for Carlson's interview with Trump by a factor of at least 300:1, and Jonathan Turley 2023's biggest enemy right now is: Jonathan Turley 2021. Judge Aileen Cannon might have made an error so egregious in a ruling on Monday that the Department of Justice may have clear grounds to call for her recusal from the case. The judge decided to reveal the existence of a second grand jury that was still conducting investigations into the documents scandal, even though the DOJ had filed this information, along with other intelligence, under seal - but Cannon made it all public anyway.Also, MyPillow CEO Mike Lindell doesn't appear to think before he speaks, and that could get his good friend Donald Trump into trouble. Lindell suggested this week that Donald Trump will end up getting more votes in the 2024 election than there are people, which could only be done by way of fraud. But that's what Lindell says will happen if Trump keeps getting indicted because Lindell swears that Trump's popularity is going through the roof. And finally, Donald Trump is reportedly angry at his newest lawyer, John Lauro, because Lauro isn't going along with Trump's plan to get judge Tanya Chutkan removed from his trial. Lauro has been going across the media world making Trump's problems worse by accidentally "admitting" to some crimes and offering a weak defense of others, but that doesn't seem to bother the former President. What bothers Trump is that Lauro will not make a preemptive motion to remove the judge - a move Lauro knows will fail. This showdown could lead to problems for Trump.
