Send us a textWhat happens when justice collides with government secrecy? We invite you to join our conversation with attorney Michael Kuzma as we untangle the complex case of Leonard Peltier, a Native American activist imprisoned for nearly five decades. Despite clear evidence of trial irregularities, withheld FBI documents, and a ballistics report proving Peltier's innocence, he was denied a retrial. Kuzma shares his insights into the disparities between Peltier's conviction and the acquittals of his co-defendants, highlighting the self-defense arguments that led to their freedom. As Peltier's release date approaches, we reflect on the long-standing battle for clemency and the challenges that could still hinder justice.Dive into the murky waters of government secrecy as we reveal the shocking discrepancies in FBI records related to Peltier's case. Learn about the arduous journey to uncover over 142,000 pages of government records—a stark contrast to the measly 3,500 pages initially shared. We discuss the broader implications of COINTELPRO activities and the enduring quest for justice that Peltier's case exemplifies. Finally, we celebrate President Biden's commutation decision, a momentous victory for Peltier's advocates, marked by elation and gratitude, yet overshadowed by the wish that justice had not been so long delayed. As we reflect on the systemic injustices faced by Indigenous peoples, Leonard Peltier's story cannot be separated from the broader historical context: the epidemic of violence against Indigenous women represented by the Missing and Murdered Indigenous Women (MMIW) movement, and the tragic killing of Annie Mae Aquash, whose death remains a stark reminder of the lengths to which systems of oppression have gone to silence Indigenous voices. These injustices are not isolated; they are part of a broader tapestry of historical and ongoing colonial violence.his podcast is produced by Global Justice Ecology Project.Breaking Green is made possible by tax deductible donations from people like you. Dr. Marie Helene Peltier is a leadership psychologist, and author of “The Resilience Plan: A Strategic Approach to Optimizing Your Work Performance and Mental Health.” In this episode, she unpacks the science and practical strategies behind resilience, offering insights into how mental health and leadership are deeply interconnected. From creating personalized resilience plans to building resilient teams, the conversation explores how leaders can thrive under stress and navigate challenges effectively. Dr. Peltier emphasizes actionable steps like tailoring stress management techniques to individual needs, integrating resilience into team discussions, and using strategic tools to balance professional demands with personal priorities. She also covers the importance of values-driven planning, the role of proactive resilience, and how leaders can “bounce forward” through adversity. Key Takeaways [02:48] Dr. Peltier begins by discussing the deep connection between mental health and leadership. She explains that our thoughts, emotions, and behaviors influence how we lead, make decisions, and interact with teams. Resilience is critical for leaders to navigate demands effectively and sustain peak performance. [05:08] When addressing behavioral changes, Dr. Peltier advises distinguishing between coaching and psychological support. Coaches should focus on actionable strategies while referring clients to specialists when deeper mental health issues arise. [08:35] She highlights the benefits of regular physical activity (cardio, strength training, meditative practices), nutrition, and time in nature. These actions create a strong foundation for resilience, but leaders often overlook them due to their demanding schedules. [12:51] Dr. Peltier advocates starting with values to prioritize actions and using tools like a SWOT analysis to identify gaps in resilience resources. She encourages leaders to create realistic, context-specific plans that align with their unique challenges and demands. [19:23] Resilience isn't just individual—it's systemic. Leaders should bring resilience into team discussions, proactively preparing for high-demand periods and creating strategies to handle stress collectively. [27:45] Dr. Peltier reframes resilience as both a decision and a plan. While the willingness to be resilient is essential, strategic preparation ensures that leaders have the tools to act when challenges arise. [34:23] Dr. Peltier advises leaders to prepare for increasing demands, including technological changes like AI integration, by strengthening their personal and team resilience. [35:47] And remember, Resilience isn't a single skill. It's a variety of skills and coping mechanisms to bounce back from bumps in the road as well as failures. You should focus on emphasizing the positive. Jean Chatzky Quotable Quotes "Resilience is our ability to go through that adversity here, which could be acute or chronic, and come out even stronger." "A lot of the time, the ways in which we behave today don't emerge randomly out of nowhere." "If resilience was a mathematical equation, these variables would account for most of the variance." "Sometimes we can just learn a new way, experiment with it, it works, and that in itself will actually shift whatever was there internally." "Whatever works for you, assuming it's healthy, do this. Let's just start there." "Resilience isn't just about individuals; there are actions we want to take as leaders, but we also want to focus on the team and organization." "We tend to just receive the demands here and then turn towards our team and do the work. That moment of saying, wait a second, let me ask my leader for help, is often missed." "Keep looking for what that resource could be for you. Don't just say, well, I don't have the finances, so not doing anything." "Resilience is a decision, but it's also a plan. And just a decision to be resilient isn't sufficient—it's a great start, but insufficient." "Leaders must identify their values, look at demands and resources, and prioritize what actions will help them thrive." "As these things come up, we will need to face these demands and embrace them with even more resilience." "Resilience is our ability to grow through adversity and bring our best decisions and best thinking to the table." PELTIER, ELECTION PROTECTION & the ECO-BROADCAST NETWORK Our GREEP Zoom #209 begins with “Time” by our Poet Laureate MIMI GERMAN. We hear the latest about Leonard Peltier from TATANKA BRICCA and LYDIA PONCE in concert with the Indigenous community supporting him: “I would like to be out of prison, but I am a free man.” BARBARA WRIGHT reminds us to thank The Creator for the fact that Leonard is out of prison & with his people. LIndsay Graham, Lisa Murkowsky & Susan Collins are summoned for praise by DANIELA GIOSEFFI. Will Trump's GOP wear itself out with a Rope-a-Dope of illegal acts, asks MYLA RESON. We hear from MIMI S about the need to recognize what should have been with Bernie Sanders. From Columbus, Ohio we hear from SANDY BOLZENIUS about the kinds of election fraud that turned the Buckeye State to Bush in 2004. . From co-convenor MIKE HERSH we bemoan the Democrats' lack of a backbone—except when disenfranchising people of color. “How long can they keep this up?” wonders MELISSA HALL. Massive disenfranchisement demands a class action case against the Democrats for failing to protect the vote, says DAVID SALTMAN. Bring in Ray McClendon and the NAACP, says JOHN STEINER. Our erstwhile engineer STEVE CARUSO evokes some of the carnage now damaging our planetary consciousness. For the inauguration of the ECO-BROADCAST NETWORK we hear from green media activists LIBBE HALEVY, DOUG WOOD, JACK EIDT, ALEX SMITH, STEVEN STARR, URSULA RUEDENBERG about building a major media presence for a post-nuclear green-powered broadcast reality. With this gathering we “made history” says Mike Hersh, & will continue next week with still more.

This week on the Mark Levin Show, Joe Biden issued last-minute pardons right before Trump was sworn in. He pardoned Leonard Peltier who killed FBI agents. He also pardoned Anthony Fauci, Gen Mark Milley, the January 6 committee, and his family members. Joe Biden never met a murderer whose sentence he did not want to commute -- depraved! Apparently, if Leonard Peltier were a Proud Boy, the media would be more upset with his commutation by Biden, even though Peltier was imprisoned for his role in the cold-blooded murder of two wounded FBI agents. Or Biden's commutation of dozens of horrible murderers in our federal prisons. Can any Democrat or media surrogate tell us why Biden commuted sentences for murderers on the way out the door? Later, the hate America Attorney General's in blue states and the hate America press want you to believe that birthright citizenship is in the Constitution. It's not in the Constitution. It's not in any of the legislative history for the 14th Amendment It's not in the 1866 Civil Rights Act. The idea that if you're born in the U.S., you're automatically a citizen is a sham. Why don't we put tariffs on Qatar and Saudi Arabia? Qatar for funding Hamas, which murdered American citizens, and Saudi Arabia for ripping us off on oil prices, helping drive up the cost of gasoline for all Americans. If it's good enough for our allies, it's good enough for these Arab countries. Learn more about your ad choices. Visit podcastchoices.com/adchoices
First up, Ralph welcomes back constitutional law expert Bruce Fein to talk about his reaction to Donald Trump's inaugural address. Then Ralph is joined by Public Citizen Co-President Robert Weissman to discuss Public Citizen's lawsuit against Trump regarding Elon Musk's D.O.G.E task force. Finally, Ralph speaks with Public Citizen's Government Affairs lobbyist Craig Holman about the flood of donations from corporations and billionaires to Trump's inaugural fund.Bruce Fein is a Constitutional scholar and an expert on international law. Mr. Fein was Associate Deputy Attorney General under Ronald Reagan and he is the author of Constitutional Peril: The Life and Death Struggle for Our Constitution and Democracy, and American Empire: Before the Fall.Sitting on that platform at the inauguration was probably trillions of dollars held by individuals—not by companies, just individuals—fabulous wealth. And you have to ask, if these are business people, why are you at the political event? Why aren't you building a better mousetrap? Why aren't you like Thomas Edison, looking to find new ways of doing business? It's because all of their profits come from manipulating government in their favor. It's the opposite of so-called capitalism.Bruce FeinRemember that this lust for power transcends all reason, and that we're endowed with that lust.Bruce FeinRobert Weissman is a staunch public interest advocate and activist, as well as an expert on a wide variety of issues ranging from corporate accountability and government transparency, to trade and globalization, to economic and regulatory policy. As the President of Public Citizen, he has spearheaded the effort to loosen the chokehold corporations and the wealthy have over our democracy. The alleged purpose [of D.O.G.E.] is to advance efficiency of the government. But what it's really about is rolling back regulations—the things that give us clean air, clean water, safe food, fair workplace, economic justice, protections against discrimination, and more—to benefit corporate bottom lines, on the one hand, and on the other, to pursue a right-wing libertarian extremist agenda with slashing government spending, especially to protect the most poor and vulnerable.Robert WeissmanMusk said at first he wanted to try to cut $2 trillion from the budget every year. That's an impossibility, since the entire budget of discretionary spending is less than $2 trillion. Apparently, if you're the richest person in the history of the world, you don't actually have to know anything that you're talking about to be taken seriously.Robert WeissmanCraig Holman serves as Public Citizen's Capitol Hill lobbyist on ethics, lobbying, and campaign finance rules. He is also working with European nongovernmental organizations and members of the European Commission and Parliament in developing a lobbyist registration system for the European Union. Previously, he was senior policy analyst at the Brennan Center for Justice at New York University School of Law, and he has assisted in drafting campaign finance reform legislation (including pay-to-play legislation), and has conducted numerous research projects on the initiative process and the impact of money in politics. What's interesting is that some previous inaugural committees…didn't want to make it look like their administration's on the auction block by taking million-dollar donations from special interests and corporations. And so Bush had limited contributions to $100,000, Obama limited to $50,000 as well—they just didn't want it to look like they're putting their whole administration on the auction block. Trump doesn't seem to care about that.Craig HolmanNews 1/22/25* On January 20th, Joe Biden handed over the presidency to Donald Trump. In one of his last acts before leaving office, former President Biden commuted the sentence of Indigenous activist Leonard Peltier, NPR reports. Peltier has been imprisoned for nearly 50 years following his conviction for the murder of two FBI agents at the Pine Ridge reservation; he has never wavered in maintaining his innocence. Despite Peltier being 80 years old and in increasingly poor health, NPR reports FBI Director Christopher Wray urged Biden not to “pardon Leonard Peltier or cut his sentence short.” Biden ultimately did not pardon Peltier, instead merely allowing him to complete his sentence under house arrest. In a statement, Peltier himself said “It's finally over — I'm going home…I want to show the world I'm a good person with a good heart.” Friend of the show Tom Morello, a longtime advocate for Peltier's release, wrote “Leonard has become a friend over the years and I am so glad…he will be able to spend his remaining years with family and friends.” Peltier's daughter Kathy, shocked by Biden's last-minute commutation after decades of being rebuffed by successive presidents of both parties, said “I'm just thankful that he had the balls and the guts to do it.”* Donald Trump was inaugurated on Monday, making him the first president in the modern era to serve non-consecutive terms. Immediately following his formal assumption of power, he issued a flurry of executive orders, including an exhaustive list of “rescissions” of Biden's executive actions. Among these, POLITICO reports that Trump immediately put Cuba back on the list of state sponsors of terrorism, signifying a return to the bad old days of hostility towards our island neighbor. This is only expected to worsen with American foreign policy being directed by Marco Rubio. Cuban President Miguel Díaz-Canel called Trump's reversal “an act of arrogance and disregard for truth,” adding “the legitimate and noble cause of our people will prevail and we will once again succeed.”* Another Trump executive order issued Monday formally created the Department of Government Efficiency, aka DOGE. However, it seems that instead of creating a new agency, this action mainly just renamed the U.S. Digital Service – an existing executive branch office – the U.S. DOGE service. Moreover, this newly redubbed USDS does not appear to have a mandate to cut the federal workforce. Instead, it seems to be primarily concerned with updating federal information technology systems. Reading between the lines, it seems likely that Trump is putting Elon Musk in charge of this federal IT agency as a means to dole out public money to the tech oligarch and his cronies, rather than streamline the functions of the federal government.* In more Big Tech news, CBS reports President Trump is “set to announce billions of dollars in private sector investment to build artificial intelligence infrastructure in the United States.” According to this report, OpenAI, Softbank and Oracle are planning a joint venture called “Stargate,” to begin with a massive data center in Texas. These corporations are planning to pour $500 billion into this project over the next four years. This will almost certainly be augmented by public funds provided by the Trump administration.* Turning to Gaza, Democracy Now! reported Saturday that both Biden and Trump gave Israel the “green light” to resume the assault on Gaza if Netanyahu felt it necessary. This piece quotes Netanyahu, saying that both presidents “gave full backing to Israel's right to return to fighting if Israel reaches the conclusion that negotiations of the second stage is fruitless.” As this piece notes, Israel killed approximately 200 Palestinians after the ceasefire was agreed upon last Wednesday. We can only hope the ceasefire holds and that President Trump sticks to his commitment to enforce the deal.* At the same time, friend of the show Norman Solomon is out with a piece in the Hill on the class action lawsuit filed by 800 Northern California residents, including Solomon himself, against their Democratic representatives in Congress, alleging that they are “illegally helping to provide weapons to Israel for use in committing genocide in Gaza.” As Solomon admits, the suit, directed against Congressmen Jared Huffman and Mike Thompson is unlikely to get far. However, he does believe both that the funding of the genocidal war is illegal under the humanitarian Leahy Laws and that these lawsuits can apply much needed scrutiny to these members and force them to register the opposition of their constituents to their positions – something with which many Democrats have refused to reckon. Solomon hopes to make Gaza a defining issue in the 2026 California Democratic Congressional primaries.* Two weeks ago, we discussed the American Historical Association's vote to condemn the “scholasticide” occurring in Gaza. Since then however, the AHA has tried to backpedal and delegitimize that vote. On January 17th, the AHA Council released a statement in which they write that while they deplore “any intentional destruction of Palestinian educational institutions, libraries, universities, and archives in Gaza,” the council considers the scholasticide resolution “outside the scope of the Association's mission and purpose.” The AHA Council therefore decided to disregard the vote of its membership and unilaterally veto the resolution. This cowardly and disgraceful decision to nullify the voice of America's historians will ironically be a stain on the history of the organization itself.* In more foreign affairs news, the crisis in South Korea continues to deepen. Last week, President Yoon was formally incarcerated pending his trial before the country's Constitutional Court after he attempted to seize power in a coup. Upon his detention, South Korean political newsletter Blue Roof reported that “Pro-Yoon supporters are rioting… storming the courthouse and attacking the marshals.” Security forces however were able to subdue the rioters, per Reuters. The Constitutional Court will now decide whether or not to remove Yoon from the presidency. Yoon could also face a trial on insurrection charges which would carry penalties up to and including life in prison and even capital punishment.* Turning back to domestic news, the Fraternal Order of Police Lodge 5, representing the cops of Philadelphia, is currently engaging in contract negotiations with the city – and making outrageous new demands. The Philadelphia Inquirer reports that beyond pay raises and better vacation policy, “the police union is seeking to roll back transparency and accountability measures that predate the COVID-19 pandemic and civil unrest of 2020.” Indeed, the FOP is seeking to terminate the department's decade-long policy of releasing the names of most officers involved in shootings, prevent the Citizens Police Oversight Commission from investigating police misconduct, and “restrict outside access to currently available records ― such as those detailing how fired officers return to the force through the once-secretive grievance arbitration process.” Beyond these measures to make the police more secretive and less accountable to the public, the FOP is also demanding outrageous new perks for police officers, including interest free home loans and provisions allowing cops to live outside the state. We can only hope the city remains firm in these negotiations and preserves the public's right to know* Finally, CNN is out with a new poll showing the Democratic Party registering its worst ratings in decades. According to this poll, “a 58% majority of Democrats and Democratic-leaning independents say that the…Party needs major changes, or to be completely reformed, up from just 34% who said the same after…2022.” This comes on the heels of a January 15th YouGov poll showing that a plurality of Biden 2020 voters who didn't vote for Kamala Harris in 2024 said “ending Israel's violence in Gaza was the top issue affecting their vote choice.” The CNN poll also showed that “Only 49% of Democratic-aligned adults say they expect their party's congressional representatives to be even somewhat effective at resisting GOP policies.” Yet, perhaps the starkest number from this poll is “just 33% of all Americans express a favorable view of the Democratic Party, an all-time low in CNN's polling dating back to 1992.” These abysmal results should be a wakeup call to the moribund leadership of the party as the country drives of a cliff. If history is any indication though, the Democrats will remain asleep at the wheel. This has been Francesco DeSantis, with In Case You Haven't Heard. #POTUS: Releasing Peltier. @AndrewCMcCarthy @NRO @ThadMcCotter @theamgreatness 1910 Alberta Blackfeet
On Tuesday's Mark Levin Show, Joe Biden never met a murderer whose sentence he did not want to commute -- depraved! We have hypocritical Democrats in 2020 against preemptive pardons, then Biden pardons his family. Biden has now set a precedent; Democrats burn down traditions then they complain about it. Later, the 11th-hour effort to stop Pete Hegseth has begun and you better believe the Democrats have colluded behind the scenes to do this. Now, Democrats have an affidavit containing new allegations that Hegseth's ex-wife feared for her safety from abuse, but Hegseth's ex-wife says it never happened. Republicans must rally around Hegseth against this setup. The scandal is not Hegseth, it's the Democrats. Afterward, no, Elon Musk didn't give the Hitler salute. It's the Democrat party with their history of antisemitism. Finally, Trump's foreign policy team needs to make sure they do not in any way help create yet another terrorist regime, this time a Palestinian terror state. They also need to eliminate Iran's nuclear sites. And beware of the terror-supporting Qatar regime, that funded Hamas to the tune of $1.8 billion, protected its leaders for years, and is funding radical, pro-terrorist, antisemitic groups in our own country and in our colleges and universities. Leonard Peltier will spend the remainder of his prison sentence at home after the 11th-hour action by President Joe Biden. Friends, family and supporters expressed surprise and relief as they heard the news Monday. National Congress of American Indians President Mark Macarro said Biden's decision comes after "50 years of unjust imprisonment," and is a powerful act of compassion and an important step toward healing.” In December, Macarro personally asked Biden to take action on Peltier's behalf. Among the many advocates for Peltier's release over the past five decades include South African President Nelson Mandela, Mother Teresa and the United Nations High Commissioner on Human Rights. We'll hear from Peltier's family and others who have followed his case about what this action means for him and how it will be viewed historically.
What else did you expect him to do? And Biden did one more classic Biden move on his way out yesterday, which was a major slap in the face to the FBI. But we talked about a lot more today, including parting gifts from Hamas, snow near the Gulf of America, and a tribute to Walt Peffer.
A livestream conversation hosted by TRN Podcast host Nick Estes and prominent members of the Leonard Peltier movement for clemency! Statement by The Red Nation: "After a half-century of unjust incarceration, Leonard Peltier is finally going home! “It's finally over–I'm going home,” said Peltier in response to the news. “I want to show the world I'm a good person with a good heart. I want to help the people, just like my grandmother taught me.” For decades, the now elder Dakota and Ojibwe member of the American Indian Movement represented a powerful symbol for millions. His imprisonment has been viewed as collective punishment against generations of Indigenous people who fought for liberation, from the Red Power Movement of the 1960s and 1970s to the Water Protector Movement that fought against the construction of the Dakota Access Pipeline in 2016." Sen. Brian Schatz (D-Hawaii) calls for the release of imprisoned American Indian Movement activist Leonard Peltier in a speech on December 4, 2024. Peltier is serving two life sentences for the deaths of two FBI agents on the Pine Ridge Reservation in South Dakota. Now at age 80, he has been behind bars for more than half of his life. "He is in declining health, experiencing vision loss and other illnesses," Schatz said on the floor of the U.S. Senate. "And in spite of all that, earlier this year, federal officials denied his request for compassionate release." Schatz, who serves as chair of the Senate Committee on Indian Affairs, urged President Joe Biden to set Peltier free.
By Amy Goodman & Denis Moynihan Amnesty International has campaigned for Peltier's release for decades. The group recently sent a letter to President Biden, reiterating their demand.

Federal prosecutors have attempted to tie Indigenous political prisoner Leonard Peltier to the murder of fellow AIM activist, Anna Mae Pictou-Aquash. It is a frequent allegation that has relied on weak evidence and the charges of paid federal informants. In this episode, TRN Podcast co-host Nick Estes (@nickwestes) looks at several sources of information from key Indigenous activists who knew Leonard Peltier and Anna Mae Pictou-Aquash to the FBI's own knowledge of her murder at the time it happened and federal prosecutors' initial hesitancy to take up the case. Power our work here: www.patreon.com/redmediapr ------ Below is the text of Hank Adams' 2020 Facebook post, shortly before his passing: Note: Adams is responding to a 2016 APTN article in which Assembly of First Nations Chief Perry Bellegarde apologizes to Anna Mae Aquash's family. December 14, 2020 Intellectually dishonest hate-monger Paul DeMain has reignited his campaign to assure denial of any Executive Clemency to LEONARD PELTIER, 76, at any time before Leonard's next scheduled Parole Hearing in Year 2024 with a continued misuse and abuse of the December 1975 gunshot death of ANNA MAE AQUASH and the unconscionable exploitation of Anna Mae Pictou-Aquash's children. Assembly of First Nations National Chief Perry Bellegarde makes significant points in this 2016 article in which the 1975 Aquash death became the center point in President Barack Obama's decision to deny Clemency to Peltier: “I regret that my statement caused some hurt and pain and I apologize for the pain I caused her [Denise Maloney Pictou] and her family,” said Bellegarde. “That wasn't my intent.” Bellegarde said he still would like to see Peltier freed. He said the case is a separate issue from AIM's execution of Aquash. “I called for that (Peltier's release) because there is an injustice there,” said Bellegarde. “So I will continue to advocate for that.” Bellegarde said two previous AFN national chiefs have made the same call which is also backed by Amnesty International and prominent individuals like the Dalai Lama. Peltier was extradited from Canada to the U.S. in December 1976. Warren Allmand, Canada's solicitor general at the time of Peltier's extradition, has since stated the F.B.I submitted false information to have Peltier extradited." DeMain's posting of Aquash daughter Denise Maloney Pictou's December 12, 2020, renewed accusations against Leonard Peltier and DeMain's hated AIM organization [re-Posted here in Comment 1] are the beginning of a campaign to assure that 2020 President-Elect Joe Biden will not grant Executive Clemency to Leonard Peltier. In death and posthumously, Anna Mae has been made a sainted heroine. But between 1972 and November 14, 1975, Anna Mae's ways were AIM's ways. AIM's ways - good and bad - were without qualification or reservation Anna Mae's ways, by choice. At NCAI in November, American Indian Press Association's (AIPA) Richard LaCourse told me of his meeting with Dennis Banks, Leonard Peltier, Kamook Banks, and Anna Mae just before his coming to Portland for NCAI.. Anna Mae then had indicated no distress nor given any indication that she was being held prisoner or against her will. On November 14, 1975, the four AIM "leaders" only broke apart because of the Ontario, Oregon stopping of their [Marlon Brando] recreational vehicle by armed Oregon police. A couple days later, Leonard Peltier was transported (through Franks Landing) from Portland into British Columbia (by associates of mine, who did not inform me then of their activity). He spent the next month in the locale he was taken to and remained incommunicado with U.S. colleagues until later, at least until he traveled to Small Boy's camp in Alberta, Canada. That is where the RCMP and FBI picked up on Leonard - long after Anna Mae Aquash's death in the second week of December 1975. Memorandum in the FBI's Denver Office dated as early as December 19, 1975 disclosed Anna Mae Aquash had been killed - although the FBI would feign ignorance of the death and the corpse identity for more than the next three months. The December 1975 memos identified the killers as John "Boy" Graham, Arlo Looking Cloud, and Theda Nelson Clarke - although none of the three were indicted through the next 28 years. The Looking Cloud trial was held in December 2004; Graham's in 2010 - lapses of 29 and 35 years. Theda Nelson - a likely FBI Informant in December 1975 - (on mental competency findings) did not go to trial. Clark died at age 87 in 2011. Although a lead prosecutor opened the Leonard Peltier trial in Fargo, North Dakota on March 16, 1977 declaring: "AIM is not on trial."; both AIM and Leonard Peltier were made the main 'defendants' in the 2004 and 2010 trials for the killing of Anna Mae Aquash! If there was ever a case where all parties - prosecution, defense and all witnesses - acted in friendly collusion to 'convict' undefended and absent non-parties [1st Leonard Peltier; 2nd AIM] - the Looking Cloud and Graham trials were such cases. The fodder for the trial's conspiratorial claptrap largely was wrung from the mind and imagination of Paul DeMain in his relentless vendetta against AIM leaders and most creatively against Leonard Peltier. Many of his unsubstantiated claims were rejected by author Steven Hendricks when writing "The Unquiet Grave" (2007). DeMain "Timelines" for Anna Mae Pictou have since focused on the AIM Convention in New Mexico just prior to the Jumping Bull Compound deaths of FBI Agents on Pine Ridge on June 26, 1975 leading to the 1977 life sentence convictions of Peltier. The design is intended to prejudice considerations against any grant of parole or clemency for Peltier. Canada's Assembly of First Nation is correct in declaring the "execution" of Anna Mae Aquash and the pursuit of "freedom" for Leonard Peltier on compassionate and humanitarian grounds are "separate issues." They are correct in continuing their support for Executive Clemency through offices of both the Canadian Prime Minister and any U.S. President. What satisfaction can President Elect Biden derive from side-stepping all humanitarian and compassionate considerations for Leonard Peltier through a first term, deferring any favorable consideration to the scheduled Parole Hearing in 2024? The Pardons Office of a bureaucratic and prejudiced Justice Department housing the FBI has already failed the last four Presidents of the United States in this matter! Will retribution finally end if Leonard Peltier is still alive in 2024 and then 80 years old? Indians of Western Washington who transported Leonard Peltier to Canada on or about November 17, 1975, and Indians of British Columbia who hosted and concealed him for the next month or until beyond when the FBI first was informed of Anna Mae's death and the identity of her killers can attest to Leonard's movements and communications (record) that wholly absolve Leonard Peltier of any direct or indirect role in the December 1975 murder of Anna Mae Pictou-Aquash.
When Fairfax, Virginia criminal and DUI defense lawyer Jonathan Katz faces particularly challenging times in court, he often imagines that his peace teacher Jun Yasuda is to his right, his trial teacher Steve Ranch is to his left, and his martial arts teacher is also right there. This Beat the Prosecution episode interviews Jon Katz's friend and peace mentor Jun Yasuda, who spearheaded making the Grafton, New York, Peace Pagoda a reality.https://www.graftonpeacepagoda.org (This peace pagoda is such an amazing place that Jon's friend's usually constantly overactive dog stood in quietness when first visiting the pagoda.)Lama Surya Das has aptly pointed out that it is not enough to rage against violence if we do not also pursue peace within ourselves. Likewise, an effective criminal defense lawyer needs to find and develop internal peace so that anger, stress, and upset do not eat the lawyer alive; and so that the lawyer may think, see and hear clearly -- and show total compassion, teamwork and listening with their client -- on the road to pursuing the best defense. Jun Yasuda is as tough as nails, having crisscrossed the nation on foot in even harsh climates, having fasted for peace and justice for days on end, and having set her own selfish interests aside for the greater good of humankind. She advocated for sanctuary in New York for American Indian Movement cofounder Dennis Banks when his sanctuary in California was cancelled. She dry fasted for a week for Mumia Abu-Jamal when he was still on death row. Jun-san briefly was in a lockup adjacent to Leonard Peltier's during the pendency of his trial where she went to support him. (Mr. Peltier's prosecutor ended up concluding that his prosecution and continued incarceration were and are unjust. https://www.amnestyusa.org/wp-content/uploads/2023/03/From-US-Attorney-James-Reynolds.pdf . His authoring appellate judge decades ago supported clemency for Peltier. https://www.whoisleonardpeltier.info/download/Heaney.pdf )Jun-san recognizes the importance of restorative justice as an alternative to the overgrown criminal justice system that she points out disproportionately incarcerates minorities and often uses inmates for free and cheap labor.
