It allows them to save money and work without losing access to crucial government benefits like Supplemental Security Income (SSI) and Medicaid, which have strict asset limits of $2,000 for individuals and $3,000 for couples. The key features of an ABLE account include:Eligibility: Available to those who are blind or disabled before age 26 (rising to 46 in 2026).Savings Opportunity: Allows individuals to work and save without exceeding government asset limits.Tax Benefits: Often provides state tax deductions similar to 529 college savings plans.Contribution Limits: The lifetime maximum contribution limit aligns with 529 plans but should stay under $100,000 to avoid affecting SSI or Medicaid.Qualified Expenses: Can be used for day-to-day needs like food and rent, excluding vices like alcohol or gambling.No Impact on Government Benefits: ABLE account balances won't disqualify the individual from receiving SSI or Medicaid.It's important to note that in most states, there is a Medicaid payback provision, which allows the state to recover funds from the ABLE account to cover medical bills after the account holder's passing. However, some states, including Kansas, have removed this clawback provision, making these accounts even more attractive for families.What is a Special Needs Trust?A special needs trust (SNT) is a more established tool designed to protect individuals' eligibility for government benefits while allowing families to manage significant assets. This trust can hold homes, vehicles, real estate, investments, and various accounts like IRAs or Roth IRAs. Key benefits of a special needs trust include:Asset Management: Can hold a wide variety of assets that would otherwise disqualify someone from receiving government benefits.Estate Planning Certainty: Spells out how the assets will be managed and distributed after the individual's passing.No Medicaid Clawback: Unlike ABLE accounts, SNTs are not subject to Medicaid payback provisions, providing greater long-term financial security.Spending Flexibility: Can cover a wide range of expenses not covered by government programs.However, special needs trusts come with a downside. If the trust is used to pay for food or rent, the SSI benefit will be reduced by $334 per month. The lengths you will go to in order to accomplish your own destruction” - An excerpt from Neuromancer by William Gibson I have had an unswerving devotion to electronic music ever since my heady baptism in the 90s London rave scene which culminated in an intense 5 years of studying music production. Since then I have spent a lifetime delving deeper and deeper into production. My music has been compared to Jon Hopkins, Robert Miles and Orbital. Although these similarities are discernable, I am simply an artist determined to do my own thing. I grew up in a single parent family and my mum has been my greatest role model, she was a Children's Party Entertainer for most of her adult life. As a well-established artist, Rommek has expanded his own sound, carving his way into the current techno and experimental scenes. His extensive interest in sound design is crafted within the dense atmospheres, heavy broken rhythms and electrifying tones found within his productions. The London based producer released his debut record 'Thought Patterns' on Weekend Circuit in 2014. Rommek later joined the seminal Blueprint Records in 2016, gradually releasing five solo EPs, plus remixes from label owner James Ruskin and Broken English Club, O/V/R, Makton. Since then, he's had a steady output of releases on Dutch imprint Leyla Records, Natural Selection as well as Mord, Hex, Loose Lips and collaborative release with the Spanish duo NX1 in 2022. Rommek's latest EP pushes his creative boundaries one-step further, as the UK Producer makes his debut on Tommy Four Seven's - 47 imprint. Exploring futuristic techno fused with 180 BPM IDM/ D&B crossovers. Torn Relics, the experimental project between Rommek + Aimee Mullen was formed during 2018. Their debut EP, The Poisoned Chalice, released on Sacred Court, featured a remix by label owner SNTS. In 2020 the duo's debut album: Abolish The Dogma, was released on Leyla Records, followed by ‘Burning Injustice' in 2021 via Instruments of Discipline. Since releasing over 10 EP's, Rommek has gained a wide range of noteworthy support, from BBC Radio 1, to many features and reviews in Mixmag, The Wire, The Quietus and Fuze magazine. In 2018 he was featured within the top 100 globally charted artists on Resident Advisor. Furthermore, as a touring DJ, he has played in over 20 countries around the globe. Charlie Foley better known as BUCA has been steadily grafting within the Cork techno scene in recent years. Over the past 12 months the young DJ and producer has become a firm fixture in the city's expansive techno circle, and has become the go to man for supplying cavernous rhythms and distorted mayhem. Cork's appetite for techno remains unparalleled within the context of Ireland's dance music scene, and the county seem's to be spitting out some of the countries best techno DJs by the minute, with each DJ honing in on their craft and having a vast knowledge of the culture of their slice of techno. BUCA is one of the latest DJs to arise from the underbelly of pounding rhythms in the rebel county, and his appetite for industrial techno has seen him become a firm favourite for all things gnarly and tough. BUCA has only recently started sharing his music after a long period of producing music behind close doors, and perfecting his trade. His debut track Muerta came on Imminent Records in September and acted as a bold introduction to the rapturous sound of BUCA. Muerta caught the attention of plenty of techno heavyweights including Tommy Four Seven, Cassie Raptor, SNTS and many more. BUCA's latest track Conclusion show's BUCA at his finest as he explores the realms of bone shattering techno, while remaining somewhat poignant and atmospheric. In the world of harsh and slamming techno tracks can seem somewhat lethargic and lacking in dynamics but BUCA has managed to create a hypnotic and vigorous groove which is utterly relentless. PLANNING One parent just asked how to think about planning for the future, here is what I said. Part of the answer is a simple SNT (special needs trust) and Life Insurance payable to the trust, this is more affordable than you think. The desire not to burden your other kids is natural, but not always helpful. I'd leave that up to them, in most of the families that I have had the privilege of getting to know... at least one sibling WANTS to step up, and plans their life accordingly. And even then they will need support, but less. At this point, I would ask yourself two things: - 3a. Are you going to live in this place for good? If so, get all over services in your state. The rules and realities vary considerably by state. - 3b. If you are flexible, is there another place you could live and what are services like there? I've seen a few families take a deep breath, ask these questions and move. A month ago, a podcast listener asked us a series of detailed questions about self-settled SNTs (special needs trusts). We tackle the questions in this episode. Actually, the listener's questions didn't specify whether their questions were about self-settled special needs trusts or third-party trusts. And the answers differ quite a bit depending on which trust type is involved. So in two earlier podcast episodes (here and here), we addressed the questions for third-party SNTs. Those trusts hold a third-party's money -- like an inheritance set up by a parent of grandparent, for instance. When the money was once directly available to the beneficiary, though, the trust has to be different. This comes up with personal injury settlements, direct inheritances (money left outright to a beneficiary with a disability) or accumulated wealth. It is harder to qualify for Supplemental Security Income and Medicaid benefits, and when a trust is created the options tend to be more restrictive. So we back up and tackle the same questions, about self-settled SNTs. We do love to hear/read questions from our listeners. Of course, we can't give individualized legal advice based on those questions. But they often give us an opportunity to explain a key part of the elder law that we practice -- and love.
In our previous podcast episode we answered listener's questions about SNTs -- special needs trusts. This week we finish up with more questions about SNTs. As we explained in that previous podcast, special needs trusts can be "self-settled" or "third-party." The difference: follow the money. If the funding came from outside sources, the SNT is usually a third-party trust. If the assets came from the beneficiary herself (or himself), the trust is usually a self-settled SNT. When the trust's assets came from outside sources the SNT may still be a self-settled trust -- if the beneficiary could have claimed the funds outright. These two podcast episodes concentrate on third-party SNTs. In a later episode, we'll review the same topics and our answers and explain how they differ for self-settled SNTs. We hear a lot of confusion about SNTs from our clients. Colleagues, accountants, investment managers and even eligibility workers often express confusion about the details. An entire industry of public benefits assistance tackles some of the most common problems -- but often not particularly about special needs trusts. We try to clear up some of the confusion, and address the most common questions we hear. One listener graciously submitted a list of questions that included most of those we hear most often. With thanks, we tackle those questions in this two-part series.
A listener sent us several questions about SNTs (that is, special needs trusts). We thought the questions were good, and if we talked about them it would give us a chance to explain a number of things about trusts for people with disabilities. Broadly speaking, there are two different "flavors" of SNTs. Sometimes the beneficiary's assets fund the trust (those are called "self-settled"). Others are "third-party" (that is, the money comes from someone else -- a family member's estate plan, for example). Those "third-party" trusts generally have more generous rules than their "self-settled" cousins. When we get questions about SNTs, our answers usually have to be doubled-up. "If the SNT is a self-settled trust, the answer is ..." we might explain. And then: "but if it is a third-party trust, the answer is different." In order to keep the "Answer A/Answer B" distinction to a minimum, we've decided here to answer all the questions only for third-party SNTs. When we recorded this podcast, it spanned two longer-than-usual sessions. In a third, later, session, we will go back over the same territory but for self-settled SNTs. A word about terminology: we use "self-settled" and "first-party" interchangeably. We do not believe that there is widespread acceptance of a distinction between "special needs" trusts and "supplemental benefits" trusts, but some use the latter term for one (or the other) of the two types of trusts. And there are actually four or five other types of special needs trusts to consider. We haven't talked here about pooled trusts, or "Miller" trusts, or "sole benefit" trusts or "Qualified Disability" trusts because they are less common terms, not because they are unimportant. But we'd love to get your questions about those designations for later episodes.

Oliver Albach’s love for electronic music was initiated by his brother, who would bring back DJ Compilations from the UK in 2007. His passion for electronic soundscapes soon translated into a fascination for tweaking sound. Living in Munich, close to clubs like MMA and Rote Sonne, provided Oliver with the opportunity to further discover electronic music and more specifically focus on Techno. In 2016 he moved to Barcelona for 4 Months. Being able to visit the infamous INSERT events at Razzmatazz enhanced his appreciation for rough yet rhythmic Techno. In 2019 he co-founded a group of music enthusiasts called “ọmọ”, with a concept to organise state of the art music experiences in Munich. Currently “ọmọ” is pursuing a concept for simulcasting DJ Sets on a weekly basis, to provide young artist with exposure. His Live tries to combine deep basses with strong atmospheres, cold and electric with abstract touches and complex percussions, which sometimes touch the sound experimentation with unusual textures without neglecting the dance floor. This work will be reflected in his new work Sounds of the Universe remix by the Alss label. Seeker is always looking for his live or hybrid to be a bit elegant and raw, trying at all times to start a different feeling for the public. As a DJ he has participated in numerous raves and events. His last performance was At Avalon Club with SNTS on Nuit / Noire night. He has had other stage names such as Pablo Cacif and Juciff, where he has gained considerable experience. Inspired by high mountain ecosystems and cultural environments and Indigenous musicals, Zemög composes Ambient, Deep Techno and Downtempo taking as a sound source modular synthesis, textures transmitted by natural surfaces and captures of aboriginal instruments and meditation. He started exploring production in 2011 and as a DJ in 2012 with his old project called Tsynth, with which he released two EPs, "White Sand" for "ALSS" and "Woods" for "Tono Limited ”, in addition to some remixes. In 2016 he began to develop his Zemög project and it was until 2019 when he decided Publish your first works. At only 25 years old, his productions have already gained support from some of the hardest-hitting artists in the industry. Artists such as Dax J, Paula Temple, Rebekah, I Hate Models and SNTS have all had the pleasure of spinning some of WNDRLST's music. His journey into the deep and dark realms of techno begun when he saw Rebekah play at an outdoor music festival in Europe. WNDRLST had never heard of felt music in such a way before. This was it for him. In an instant, he was hooked and hard and rocking techno. Music had always played a part in WNDRLST's life. He starting producing loops and replications of other tracks at 13 years old. Soon after, he starting DJ out of interest and soon found himself playing vinyl DJ sets. Rebekah was really the catalyst that put WNDRLST on course to make a career out of music. Although he has had over 10 years of experience in production, music had never been a career option. @RLVS é João Relvas, dj nascido em Coimbra mas a residir em Lisboa. Ele é o sexto convidado de N’A CABINE, e marca este episódio com sonoridades negras que criam, ao longo de 70 minutos, um ambiente altamente magnético. Em 2011, começa a aventurar-se, "em casa", na mesa de mistura depois de começar a "interagir mais com o meio" quando muda para a capital. Mas o gosto pelo lado eletrónico surge antes disso, não fosse hábito dele ouvir "bandas como Depeche Mode, New Order, Cabaret Voltaire ou Kraftwerk". É designer gráfico de profissão, mas seria impossível ficar afastado da música eletrónica. Tudo dela o atrai: as "constantes mutações que sofre", "a capacidade de surpreender" ou o lado sempiterno. RLVS diz que tudo isto o leva "a uma constante pesquisa e descoberta", e por isso mantém-se atento ao que se passa pelo país "e não só". O coimbrense baseado em Lisboa não gosta de descrever a música que seleciona, até porque, apesar da predominância do techno, há outros fatores que influenciam esse momento, como a intuição e espontaneidade que apresenta na cabine, ou o seu "estado de espírito" e o do público. Além de aliar isso às "experiências de vida", RLVS afirma que adora "todo o tipo de arte", reconhecendo a importância pessoal de "beber um pouco de cada uma". Olha para a cena portuguesa como uma das mais efusivas, para clubes como Gare e Lux Frágil como espaços inigualáveis, e para os nossos artistas como excelentes referências daquilo que pode ser feito em Portugal. A Thousand Details, Lewis Fautzi, Norbak, Temudo ou VIL são alguns dos nomes que refere quando a conversa circunda os portugueses. No ano de 2015, fundou a Music Chemistry na sua terra natal, levando até lá artistas como Adriana Lopez, em parceria com a Cosanostra Coimbra, ou Antigone. Mais recentemente, tem participado em projetos como a NAME, onde já atuaram nomes como Cleric ou SNTS, e a Contakt. Born in Yokohama, Anri’s was surrounded with the booming hiphop scene in her home town. A trip to Tokyo in 1999 gave Anri her first taste of electronic music and there was no looking back. Inspired by many techno dj’s in Tokyo she moved there later that year. Her first gigs in Tokyo in 2003 quickly built her skills and her sound - finding her sonic niche, and gathering bookings all over Japan. In 2010 she moved to Melbourne, after visiting and discovering a flourishing techno scene. There she began a residency on Steve Ward's Kiss FM radio show “Chameleon Recordings Radio”, where she quickly gained a loyal following. Steve’s Ward’s influence also did not end there, with Anri moving into music production as she delved deeper into the world of Sound Design by enrolling at the Electronic Music Academy. As an artist on Chameleon’s roster she headlined parties for their events in Australia and Europe.2014 saw a move to Berlin with a residency at Chalet. Since being based in Berlin she has played shows in Italy, Sweden, Helsinki, Doha, Amsterdam, France, Poland and Switzerland. As well as playing at many of Berlin’s favorite clubs including Ritter Bruzke, Ipse, Golden Gate, Birget & Bier and Salon zur wilder Renate as a resident DJ and organizer of a regular party there called Tokyo Redlight. Anri has also toured Asia several times through Japan, Hong Kong, Shanghai, Kunming and Beijing. 2014 also saw the first release from Anri with her single “Yume” from TEAM Records in Amsterdam, released on Gem Records (Amsterdam). ArchivOne or Cristiano De Luca was born in 1995 in Naples. DJ, producer and remixer. Begins to approach the music at age 8, he started playing drums, guitar and piano. Since then, his life has revolved around its ultimate goal: demonstration of his musical vision in the form of DJ Set as well as his productions. ArchivOne is a musically versatile artist who likes to get lost in the sound worlds, taking all kinds of influences from different genres and incorporates them into his productions. Despite this, his heart beats fast for Techno, is the heartbeat of his city that inspired him so generously. In 2015 he founded together with his friend his first Label : Off the White Records, with its first two releases was a great success. His new music caught the attention of new and old artists of the Techno getting feedback from Bleak, Chris Liebing, DVS1, Luca Agnelli, Sam Paganini, Thomas Hessler, DJ Hyperactive, SLAM, Blind Observatory, Tommy Four Seven, Xhei, Dyad, SNTS, Bas Mooy, Zadig and many more ....
